Scott Wiener (D) in a 3-2 vote on Tuesday. It next heads to the Appropriations Committee.<\/p>\n<p>The \u201cRegulated Therapeutic Access to Psychedelics Act\u201d has been drafted in a way that\u2019s meant to be responsive to concerns voiced by Gov. Gavin Newsom (D) last year when he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-newsom-vetoes-psychedelics-legalization-bill-despite-leading-on-marijuana-reform\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">vetoed a broader proposal that included provisions to legalize low-level possession of substances<\/a>\u00a0such as psilocybin.<\/p>\n<p>Instead, the new bill that\u2019s now being unveiled would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-plans-to-file-therapeutic-psychedelics-bill-with-republican-support-following-governors-veto-of-broader-legalization\/\" target=\"_blank\" rel=\"noopener\">provide regulated access to psychedelics in a facilitated setting<\/a>, without removing criminal penalties for possession outside of that context. It does not lay out any specific qualifying medical conditions that a person must have in order to access the services.<\/p>\n<p>The measure had\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-bill-to-legalize-psychedelic-services-get-amendments-ahead-of-expected-committee-vote-next-month\/\" target=\"_blank\" rel=\"noopener\">already undergone a series of mostly technical amendments<\/a> before reaching committee. Wiener also agreed to revise the legislation at last week\u2019s hearing to make it so psychedelics facilitators would need to have an existing professional health license, such as those for psychiatrists, social workers, drug and alcohol counselors and nurse practitioners.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Our legislation legalizing supervised use of psychedelics, with licensed facilitators, just passed its second committee, the Senate Public Safety Committee.<\/p>\n<p>SB 1012 will help people access psychedelics while increasing safety &amp; education.<\/p>\n<p>Thank you, colleagues!<\/p>\n<p>\u2014 Senator Scott Wiener (@Scott_Wiener) <a href=\"https:\/\/twitter.com\/Scott_Wiener\/status\/1782834830088237426?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 23, 2024<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>SB 1012 is an \u201coverdue approach,\u201d Wiener told committee members on Tuesday. \u201cPeople are using psychedelics today. There is incredible potential in terms of treating mental health and substance use disorders. And we should bring it into the sunlight so people can use safely in a supervised, structured setting.\u201d<\/p>\n<p>Advocates were disappointed to see the governor, who championed marijuana legalization while serving as the state\u2019s lieutenant governor, reject the earlier psychedelics measure from Wiener last year. But the senator has said he was encouraged that Newsom \u201cconstructively\u201d recommended a dialed-back pathway to reform.<\/p>\n<p>SB 1012 is a \u201cdirect response to the governor\u2019s request,\u201d Wiener\u2019s office said last week.<\/p>\n<p>Retired Lt. Diane Goldstein, executive director of the Law Enforcement Action Partnership (LEAP), testified in favor of the legislation during Tuesday\u2019s hearing, stating that it would \u201ccraft an actionable plan for the regulated use of psychedelics as an issue of public health.\u201d<\/p>\n<p>\u201cThis bill is a first step towards saving lives by helping to destigmatize cutting edge treatments for the underlying mental health challenges that drive addiction and other behavioral health issues while providing needed guardrails and safety to access treatment,\u201d she said.<\/p>\n<p>Several law enforcement associations, including the California State Sheriffs\u2019 Association, expressed opposition to the reform.<\/p>\n<p>Sen. Kelly Seyarto (R), vice chair of the Public Safety Committee, also criticized the proposal. He voiced \u201cgrave concerns about expanding the ability for people to alter their minds and then go out into the public\u201d and said he would not be supporting it unless it is \u201cnarrowed way down.\u201d<\/p>\n<p><strong>Here\u2019s what the bill,\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB1012\" target=\"_blank\" rel=\"noopener\">SB 1012<\/a>, would accomplish:\u00a0<\/strong><\/p>\n<ul>\n<li>Adults 21 and older could access psilocybin, psilocyn, DMT, mescaline (excluding peyote) and MDMA at licensed facilities with trained facilitators.<\/li>\n<li>Facilitators would need to undergo training and obtain a license under a professional board that\u2019d be established under the California Department of Consumer Affairs (DCA).<\/li>\n<li>The board would be overseen by an expert oversight committee under the Business, Consumer Services, and Housing Agency (BCSHA)\u2014with members appointed by the governor.<\/li>\n<li>The bill would establish a \u201cDivision of Regulated Psychedelic-Assisted Therapy\u201d under the BCSHA that would be tasked with regulating the psychedelics program.<\/li>\n<li>Regulators would need to develop rules to allow for the licensing of producers and laboratory testing facilities for psychedelics.<\/li>\n<li>The bill would not restrict psychedelic services to people with a specific set of qualifying medical conditions.<\/li>\n<li>Individuals interested in participating in the psychedelic services would need to submit to a health and safety screening.<\/li>\n<li>Facilitators would be required to conduct follow-up appointments with participants, report any adverse effects and provide integration services.<\/li>\n<li>The legislation would create a public-private fund that\u2019d be tasked with promoting public education around the safe use of psychedelic substances.<\/li>\n<li>Psychedelics would remain prohibited outside of the licensed service centers, and there would be no commercial sales component of the law.<\/li>\n<li>Regulators would also need to ensure that psychedelic services are affordable and accessible to low-income populations.<\/li>\n<li>A \u201cPublic Education and Harm Reduction Fund\u201d would also be created to support efforts to educate the public about the potential benefits and risks of psychedelics.<\/li>\n<\/ul>\n<p>Meanwhile, Assemblymember Marie Waldron (R), the lead on the Assembly side, is sponsoring a separate psychedelics bill focused on promoting research and creating a framework for the possibility of regulated therapeutic access that has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-assembly-unanimously-approves-bill-to-create-psychedelics-workgroup-and-prepare-for-legal-therapeutic-access\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">already moved through the Assembly this year with unanimous support<\/a>.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a campaign to put psilocybin legalization on the state\u2019s November ballot recently announced that it\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-psilocybin-initiative-wont-be-on-2024-ballot-after-activists-fall-short-in-signatures-for-third-cycle-in-a-row\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">did not secure enough signature to qualify in time for a deadline<\/a>.<\/p>\n<p>Another campaign filed and then abruptly withdrew an initiative to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-campaign-withdraws-2024-ballot-measure-to-create-state-psychedelics-research-agency\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">create a $5 billion state agency tasked with funding and promoting psychedelics research<\/a>\u00a0last year.<\/p>\n<p>A third campaign also entered the mix late last year,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/californians-have-until-monday-to-comment-on-revised-psychedelics-ballot-proposal-with-final-update-expected-december-1\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">proposing to legalize the possession and cultivation of substances<\/a>\u00a0like psilocybin, LSD, MDMA, DMT, ibogaine and mescaline. People could buy them for therapeutic use with a doctor\u2019s recommendation. Advocates for that measure still have time to gather and turn in signatures.<\/p>\n<p>The California Legislative Analyst\u2019s Office (LAO) has since released its review of that proposal, outlining not only the plan\u2019s policy implications but\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-psychedelics-ballot-measure-could-undermine-marijuana-taxes-state-officials-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">also its potential fiscal impacts on the state<\/a>\u2014which the report calls \u201cvarious\u201d and \u201cuncertain.\u201d<\/p>\n<p>Some California municipalities, meanwhile, are pushing forward with reform on the local level. The city of Eureka, for example, adopted a resolution in October to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/after-california-governors-psychedelics-bill-veto-another-city-council-approves-decriminalization-resolution\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">decriminalize psychedelic plants and fungi and make enforcement of laws against personal use, cultivation and possession a low priority for police<\/a>. It\u2019s at least the fifth local jurisdiction in the state to embrace the policy change.
