{"id":74298,"date":"2024-04-17T09:36:17","date_gmt":"2024-04-17T17:36:17","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/04\/17\/coalition-of-justice-groups-pushes-biden-to-support-marijuana-legalization-instead-of-schedule-iii-move\/"},"modified":"2024-04-17T12:45:41","modified_gmt":"2024-04-17T20:45:41","slug":"coalition-of-justice-groups-pushes-biden-to-support-marijuana-legalization-instead-of-schedule-iii-move","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/04\/17\/coalition-of-justice-groups-pushes-biden-to-support-marijuana-legalization-instead-of-schedule-iii-move\/","title":{"rendered":"Coalition Of Justice Groups Pushes Biden To Support Marijuana Legalization Instead Of Schedule III Move"},"content":{"rendered":"<\/p>\n<p>In a new letter to the White House, a group of 20 justice and drug reform advocacy organizations are calling on President Joe Biden and Vice President Kamala Harris to publicly support the removal of marijuana from the federal Controlled Substances Act (CSA) rather than merely a move to Schedule III, as the <a href=\"https:\/\/www.marijuanamoment.net\/white-house-says-marijuana-rescheduling-is-now-up-to-doj-after-receiving-hhs-recommendation-guided-by-the-evidence\/\" target=\"_blank\" rel=\"noopener\">government is currently considering<\/a>.<\/p>\n<p>Biden has said repeatedly during his campaign and term in office that <a href=\"https:\/\/www.marijuanamoment.net\/god-almighty-no-one-should-be-in-prison-over-marijuana-possession-biden-says-at-congressional-black-caucus-event\/\" target=\"_blank\" rel=\"noopener\">\u201cno one should be in jail merely for the use or possession of marijuana,\u201d<\/a> but advocates in the letter said that \u201conly the descheduling of marijuana will truly decriminalize it at the federal level.\u201d<\/p>\n<p>To fulfill his campaign pledge to decriminalize, the letter from the Marijuana Justice Coalition (MJC)\u2014which includes drug reformers, justice organizations, immigrant rights groups and others\u2014tells the president, \u201cyou must begin to explicitly support the <em>descheduling<\/em> of marijuana from the CSA.\u201d<\/p>\n<p>\u201cIt is incumbent upon you to call on Congress to pass descheduling legislation, such as the Senate-led <em>Cannabis Administration and Opportunity Act (CAOA)<\/em> and the House-led <em>Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act<\/em>,\u201d it says. \u201cNot only do these bills decriminalize marijuana through descheduling, they include your other campaign pledge on marijuana policy reform\u2014automatic expungements\u2014and establish programming for reinvestment in communities disproportionately targeted by marijuana criminalization.\u201d<\/p>\n<p>By contrast, a move to Schedule III \u201cwould maintain the federal criminalization of marijuana and most criminal penalties would remain unchanged.\u201d Mandatory minimums would still apply, noncitizens would continue to face deportation over low-level cannabis crimes and patients, such as veterans, would continue to have to break the law to access state-legal medical marijuana, MJC said.<\/p>\n<p>\u201cYour administration has the opportunity to finally have federal marijuana policy catch up to public opinion and the state legal landscape that is increasingly rejecting marijuana criminalization,\u201d the coalition wrote. \u201cPardons for simple possession cases are a good first step but as Vice President Harris recently said at the March 15, 2024 Roundtable Conversation about Marijuana Reform, \u2018there is still much more to do.&#8217;\u201d<\/p>\n<p>Harris also <a href=\"https:\/\/www.marijuanamoment.net\/kamala-harris-says-we-need-to-legalize-marijuana-for-first-time-since-joining-biden-ticket-signaling-potential-shift-ahead-of-election\/\" target=\"_blank\" rel=\"noopener\">said at the time that \u201cwe need to legalize marijuana\u201d<\/a>\u2014but those remarks were made behind closed doors after the press had already been asked to leave the room.<\/p>\n<p>Biden, meanwhile, both as a presidential candidate and while in office, has vocally supported limited cannabis reforms and taken concrete steps to review marijuana laws and forgive Americans with past convictions for minor cannabis crimes. But he\u2019s also consistently overstated the impact of his actions, for example falsely claiming in this year\u2019s State of the Union Address that his administration\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/fact-check-biden-falsely-claims-his-marijuana-pardons-expunged-thousands-of-convictions-in-state-of-the-union-address\/\" target=\"_blank\" rel=\"noopener\">recent pardons around cannabis expunged \u201cthousands of convictions.\u201d<\/a><\/p>\n<p>During the speech last month, a social media post from Biden\u2019s office repeating that \u201cno one should be jailed just for using or possessing marijuana\u201d was by far his most popular of the night.<\/p>\n<p>Biden has continued to tout the marijuana scheduling directive and cannabis pardons he\u2019s issued, including in a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-touts-marijuana-scheduling-review-and-pardons-in-new-proclamation-for-second-chance-month\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">presidential proclamation declaring April \u201cSecond Chance Month.\u201d<\/a><\/p>\n<p>As for the ongoing review process that could eventually move marijuana into Schedule III, the White House said this month it\u2019s now <a href=\"https:\/\/www.marijuanamoment.net\/white-house-says-marijuana-rescheduling-is-now-up-to-doj-after-receiving-hhs-recommendation-guided-by-the-evidence\/\" target=\"_blank\" rel=\"noopener\">up to the Justice Department to make a final decision<\/a> on scheduling, adding that the Department of Health and Human Services (HHS) recommendation to reclassify cannabis was \u201cguided by the evidence.\u201d<\/p>\n<p>The full list of signatories on the MJC letter include Better Opportunity to Win Legalization (BOWL), Center for American Progress, Clergy for a New Drug Policy, Doctors for Drug Policy Reform, Drug Policy Alliance, Immigrant Defense Project, Immigrant Legal Resource Center (ILRC), JustLeadershipUSA, Minorities for Medical Marijuana, National Association of Criminal Defense Lawyers, National Association of Social Workers, National Immigration Project, National Organization for the Reform of Marijuana Laws (NORML), Southern Poverty Law Center, Students for Sensible Drug Policy (SSDP), Sunita Jain Anti-Trafficking Initiative, Supernova Women, The Hood Incubator, Vera Institute of Justice and Veterans Cannabis Coalition.<\/p>\n<p>While the Drug Enforcement Administration (DEA) has not given a clear sense of timing for when it will complete and submit its cannabis review, there are heightened expectations that it will come before November\u2019s national elections\u2014both because of past precedent in scheduling matters and because the Biden administration has become increasingly vocal about its role in facilitating the review.<\/p>\n<p>The head of the Food and Drug Administration (FDA) under HHS told congressional lawmakers last week that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/watch-live-fda-commissioner-testifies-on-hemp-regulatory-issues-at-congressional-hearing\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">there\u2019s \u201cno reason\u201d for DEA to \u201cdelay\u201d making a marijuana scheduling decision<\/a>.<\/p>\n<p>A DEA official noted recently that it sometimes takes up to six months for <a href=\"https:\/\/www.marijuanamoment.net\/dea-officials-discuss-marijuana-scheduling-timeline-seeking-to-correct-misperceptions-that-decisions-are-made-in-a-shroud-of-secrecy\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">DEA to complete its analysis of health officials\u2019 scheduling recommendations<\/a>\u2014which is about how long it\u2019s now been since the agency began its current cannabis assessment.<\/p>\n<p>Meanwhile, HHS Secretary Xavier Becerra last month defended his agency\u2019s rescheduling recommendation during a Senate committee hearing and also told cannabis lobbyist Don Murphy that he should <a href=\"https:\/\/www.marijuanamoment.net\/top-biden-health-official-defends-marijuana-rescheduling-recommendation-against-criticism-from-gop-senator\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">pay DEA a visit and \u201cknock on their door\u201d for answers about the timing<\/a>\u00a0of their decision.<\/p>\n<p>Certain DEA officials are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dea-officials-reportedly-at-odds-with-biden-admin-over-marijuana-rescheduling-push\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">reportedly resisting the Biden administration\u2019s rescheduling push<\/a>, disputing the HHS findings on marijuana\u2019s safety profile and medical potential, according to unnamed sources who spoke with The Wall Street Journal.<\/p>\n<p><strong>Read the full MJC <a
