{"id":73369,"date":"2024-03-20T09:25:34","date_gmt":"2024-03-20T17:25:34","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/03\/20\/top-federal-health-official-clarifies-rescheduling-marijuana-wouldnt-decriminalize-it-which-biden-campaigned-on\/"},"modified":"2024-03-20T19:46:07","modified_gmt":"2024-03-21T03:46:07","slug":"top-federal-health-official-clarifies-rescheduling-marijuana-wouldnt-decriminalize-it-which-biden-campaigned-on","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/03\/20\/top-federal-health-official-clarifies-rescheduling-marijuana-wouldnt-decriminalize-it-which-biden-campaigned-on\/","title":{"rendered":"Top Federal Health Official Clarifies Rescheduling Marijuana Wouldn\u2019t Decriminalize It\u2014Which Biden Campaigned On"},"content":{"rendered":"<\/p>\n<p>The Biden administration\u2019t top health official has again defended his department\u2019s recommendation to reschedule marijuana against Republican criticism, while pointing out that the incremental move would not decriminalize cannabis despite the president\u2019s campaign pledges to do so.<\/p>\n<p>During a hearing before the House Appropriations Subcommittee on Labor, Health And Human Services, Education, And Related Agencies on Wednesday, several members addressed the cannabis scheduling review, including two GOP members who oppose the reform and a Democrat who helped advance a legalization bill in 2020.<\/p>\n<p>Rep. Chuck Edwards (R-NC) pressed\u00a0Health and Human Services (HHS) Secretary Xavier Becerra on the impact of a possible rescheduling action, questioning whether moving marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA) would increase youth access and voicing concern about mental health implications of cannabis use.<\/p>\n<p>Becerra corrected the lawmaker on the idea that rescheduling would decriminalize marijuana, clarifying that \u201cit can still be a criminal violation depending on its use\u201d under Schedule III. In effect, the secretary\u2019s comments underscore that the modest reform would not accomplish the president\u2019s campaign promise to decriminalize cannabis, though it would have other effects such as removing research barriers and freeing up state-licensed marijuana businesses to take federal tax deductions.<\/p>\n<p>\u201cI don\u2019t know about your state, but in my state of California, and probably more than half of the states of the nation, marijuana is already somewhat available, whether for medical purposes or even for recreational purposes,\u201d the secretary said. \u201cWhat we\u2019re talking about here is, though, the federal treatment of marijuana, of cannabis, because federal law treats cannabis differently than most states, and what the president asked us to do is examine where we are with cannabis.\u201d<\/p>\n<p>He then said he was unsure whether marijuana is currently classified as a Schedule I or Schedule V controlled substance, and prohibitionist Rep. Andy Harris (R-MD) clarified that it is Schedule I. Becerra went on to say that meant cannabis is considered among \u201cthe most potent and dangerous type of narcotic.\u201d<\/p>\n<p \/>\n<p>Edwards\u2014who introduced legislation last year to <a href=\"https:\/\/www.marijuanamoment.net\/gop-congressmans-bill-would-cut-federal-funding-for-states-and-tribes-that-legalize-marijuana\/\" target=\"_blank\" rel=\"noopener\">slash federal funding from individual states and Indians tribes that legalize marijuana<\/a>\u2014cited research suggesting a link between cannabis use and certain mental health conditions and asked Becerra if he was aware of such studies.<\/p>\n<p>\u201cI\u2019m aware of a number of reports and studies,\u201d Becerra replied. \u201cWhen I was the attorney general in California, we dealt with the issue of marijuana. And as the secretary, I\u2019ve worked closely with the Food and Drug Administration, which is the agency charged with making a determination about the scheduling.\u201d<\/p>\n<p>\u201cThe various studies you\u2019re probably referring to are the types of studies and reports that the Food and Drug Administration would have taken into consideration as it did as its assessment of cannabis,\u201d he said.<\/p>\n<p>The secretary <a href=\"https:\/\/www.marijuanamoment.net\/top-biden-health-official-defends-marijuana-rescheduling-recommendation-against-criticism-from-gop-senator\/\" target=\"_blank\" rel=\"noopener\">similarly deferred to FDA on the science justifying its rescheduling recommendation<\/a> to the Drug Enforcement Administration (DEA) during a Senate Finance Committee hearing last week.<\/p>\n<p>Edwards also said later in the House <a href=\"https:\/\/appropriations.house.gov\/legislation\/hearings\/fiscal-year-2025-budget-request-department-health-and-human-services\" target=\"_blank\" rel=\"noopener\">hearing<\/a> that he doesn\u2019t want to \u201cget into the debate about marijuana and cigarettes right now, although I believe we need to be having some more conversation up here on this Hill about the harmful effects of marijuana and the states\u2019 rights to circumvent federal law.\u201d<\/p>\n<p>Don Murphy, a cannabis lobbyist and former GOP Maryland legislator, told Marijuana Moment that the congressman\u2019s remarks are \u201chypocritical.\u201d<\/p>\n<p>\u201cNorth Carolina is the tobacco capital of the world,\u201d he said. \u201cAs a representative of the state of North Carolina, Edwards is the epitome of hypocrisy.\u201d<\/p>\n<p>Following Edwards, Harris also commented on his concerns about cannabis rescheduling, saying HHS essentially with \u201cboth arms hugs this idea of reducing the scheduling\u201d and reiterating that he worries such a move could <a href=\"https:\/\/www.marijuanamoment.net\/moving-marijuana-to-schedule-iii-would-not-violate-international-treaties-legal-opinion-says\/\" target=\"_blank\" rel=\"noopener\">put the U.S. in violation of international drug treaties\u2014a point disputed by experts<\/a>.<\/p>\n<p>\u201cSome people think we will be violating our international treaty agreements,\u201d Harris said. \u201cNow, given that this administration is all-in for a treaty agreement with the World Health Organization on pandemic things that would, you know, give up our rights as states in a free nation, I\u2019m a little surprised that they, you know, want to have this beef with the World Health Organization on the Single Conventions. But I\u2019ll leave it at that.\u201d<\/p>\n<p \/>\n<p>In a recent letter to DEA Administrator Anne Milgram, Harris separately said <a href=\"https:\/\/www.marijuanamoment.net\/fda-reached-flawed-and-misguided-conclusion-to-reschedule-marijuana-gop-congressman-tells-dea-administrator\/\" target=\"_blank\" rel=\"noopener\">the agency should \u201cabide by our nation\u2019s international treaty obligations\u201d<\/a> and keep marijuana in Schedule I, while challenging the scientific review from FDA.<\/p>\n<p>Rep.
