{"id":71258,"date":"2023-12-26T08:45:20","date_gmt":"2023-12-26T16:45:20","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/12\/26\/florida-officials-arrest-two-people-accused-of-falsifying-signatures-for-marijuana-legalization-ballot-initiative\/"},"modified":"2023-12-27T19:46:37","modified_gmt":"2023-12-28T03:46:37","slug":"florida-officials-arrest-two-people-accused-of-falsifying-signatures-for-marijuana-legalization-ballot-initiative","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/12\/26\/florida-officials-arrest-two-people-accused-of-falsifying-signatures-for-marijuana-legalization-ballot-initiative\/","title":{"rendered":"Florida Officials Arrest Two People Accused Of Falsifying Signatures For Marijuana Legalization Ballot Initiative"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/12\/MM_Bill_Tracker_V5_blank-37.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Florida officials say they\u2019ve arrested two paid canvassers charged with allegedly falsifying signatures on petitions to put a marijuana legalization initiative on the state\u2019s 2024 ballot.<\/p>\n<p>As the state Supreme Court weighs a legal challenge to the ballot measure that was brought by Florida Attorney General Ashley Moody (R), the Florida Department of Law Enforcement (FDLE) said in a news release last week that two individuals are facing multiple felony counts of submitting falsified petitions.<\/p>\n<p>FDLE said that three canvassers are being prosecuted on fraud charges, including one person who was involved in petitioning for an unrelated gambling-related initiative. The department said that \u201ccirculators submitted dozens of falsified marijuana and gambling initiatives petitions,\u201d without specifying how many signatures may have been impacted.<\/p>\n<p>\u201cThe Florida Constitution is a sacred document by which Florida\u2019s government, voters and citizens are adjudicated,\u201d Florida Secretary of State Cord Byrd said. \u201cFlorida Law lays out a detailed process by which issues can be submitted to Florida\u2019s voters for consideration before they are added to Florida\u2019s Constitution.\u201d<\/p>\n<p>\u201cTo fraudulently misappropriate this process for personal gain is not only illegal but also violates the trust of law-abiding Floridians across the state,\u201d he said.<\/p>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/FDLEpage\/posts\/pfbid02n5sndYito2bXAiXM9MnmcNo6agJzBF7bwbVtWvqTJtsuarw3BGmXmhbGjzcAKed5l\" data-width=\"552\" \/>\n<p>FDLE Commissioner Mark Glass <a href=\"https:\/\/www.fdle.state.fl.us\/News\/2023\/December\/FDLE-arrests-paid-petition-circulators-for-petitio\" target=\"_blank\" rel=\"noopener\">said<\/a> that the election process \u201cmust remain free from those who would commit voter fraud to champion an initiative or candidate,\u201d and in this case, \u201cpaid petition circulators were trying to game the voting system.\u201d<\/p>\n<p>Many campaign petition circulators are paid based in part by the number of signatures they collect, so it\u2019s possible the alleged crimes were carried out for personal financial gain.<\/p>\n<p>A spokesperson for the cannabis campaign, Smart &amp; Safe Florida, told Marijuana Moment that it is \u201cfully supportive of FDLE\u2019s investigation and we pledge to cooperate in any way we can.\u201d<\/p>\n<p>If the allegations are substantiated, they said \u201cwe hope the individuals involved are prosecuted to the fullest extent of the law.\u201d<\/p>\n<p>The state\u2019s prosecution of the paid circulators is happening more than six months after the Florida Division of Elections announced that activists had submitted enough signatures to qualify for the 2024 ballot.<\/p>\n<p>They <a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-legalization-initiative-has-enough-signatures-for-2024-ballot-state-officials-say\/\" target=\"_blank\" rel=\"noopener\">turned in nearly one million signatures for ballot placement<\/a>, well beyond the 891,523 needed, suggesting that the reportedly falsified petitions that are now in question would not meaningfully impact the campaign\u2019s current qualification status.<\/p>\n<p>In order to get on the ballot, an initiative needed valid signatures from registered voters totaling at least eight percent of the district-wide vote in the most recent presidential election in at least 14 of the state\u2019s 28 congressional districts\u2014in addition to the statewide number needed. The marijuana campaign has met the threshold in exactly 14 districts.<\/p>\n<p>That said, even with enough signatures, the question remains how the state Supreme Court will come down on the overall legalization measure, which the attorney general\u2019s office wants to see invalidated ahead of next year\u2019s election.<\/p>\n<p>The court held oral arguments in that case last month. The state\u2019s main argument is that the ballot initiative is affirmatively misleading, in part because she says\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-attorney-general-says-voters-are-too-stupid-to-see-through-marijuana-companys-monopolistic-legalization-push\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">voters would not be able to understand from the summary<\/a>\u00a0that marijuana would remain federally illegal even if Florida moved to legalize.<\/p>\n<p>Moody made the same argument about misleading ballot language against a 2022 legalization measure, and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-supreme-court-kills-another-marijuana-legalization-ballot-measure-for-2022\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the Supreme Court subsequently invalidated it<\/a>.<\/p>\n<p>The campaign and supporters, meanwhile, have maintained that the court must respect the intent of the citizen initiative process and allow voters the opportunity to decide on the issue.<\/p>\n<p>Nearly seven out of ten registered Florida voters <a href=\"https:\/\/www.marijuanamoment.net\/nearly-70-percent-of-florida-voters-support-marijuana-legalization-ballot-initiative-with-majorities-of-every-demographic-in-favor\/\" target=\"_blank\" rel=\"noopener\">say they support the marijuana legalization initiative<\/a>, with majorities of every demographic surveyed in favor of the reform, according to a poll that was released last month.<\/p>\n<p>The multi-state marijuana company Trulieve has <a href=\"https:\/\/dos.elections.myflorida.com\/committees\/ComDetail.asp?account=83475\" target=\"_blank\" rel=\"noopener\">contributed<\/a>\u00a0more than $39 million to the Smart &amp; Safe Florida campaign to date. As discussed in oral arguments, Moody has accused the company of supporting the measure in order to have a \u201cmonopolistic stranglehold\u201d on the state\u2019s cannabis market.<\/p>\n<p>If approved, the measure would change the state Constitution to allow existing medical cannabis companies in the state like Trulieve to begin selling marijuana to all adults over 21. It contains a provision that would allow\u2014but not require\u2014lawmakers to take steps toward the approval of additional businesses. Home cultivation by consumers would not be allowed under the proposal as drafted.<\/p>\n<p>Adults 21 and older would be able to purchase and possess up to one ounce of cannabis, only five grams of which could be marijuana concentrate products. The three-page measure also omits equity provisions favored by advocates such as expungements or other relief for people with prior cannabis convictions.<\/p>\n<p>Separately, economic analysts from the Florida legislature and the office of Gov. Ron DeSantis (R) estimate that the marijuana legalization initiative would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-ballot-measure-would-net-up-to-431-million-in-annual-tax-revenue-analysts-for-desantis-and-lawmakers-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">generate between $195.6 million and $431.3 million<\/a>\u00a0in new sales tax revenue annually if voters enact it.
