Ana Maria Rodriguez (R) last week, would make Florida the latest in a growing number of states that have worked to establish tax parity for the cannabis industry that continues to face steep financial barriers under federal prohibition.<\/p>\n<p>Rodriguez\u2019s proposal would amend Florida\u2019s tax code by allowing medical cannabis operators to claim state-level tax deductions in \u201can amount equal to an expenditure that is eligible to be claimed as a federal income tax deduction but is disallowed because marijuana is a controlled substance under federal law,\u201d the bill text says.<\/p>\n<p>The measure is being filed as the state Supreme Court considers a case that will decide whether voters will see an adult-use marijuana legalization initiative on next year\u2019s ballot. The case was brought before the court following a challenge from Florida Attorney General Ashley Moody (R).<\/p>\n<p>As the senator\u2019s new tax <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2024\/974\/\" target=\"_blank\" rel=\"noopener\">bill<\/a> is currently drafted, however, it would only extend the state-level relief to medical cannabis businesses.<\/p>\n<p>Several states have recently taken similar steps as congressional efforts to enact marijuana policy reform continue to stall.<\/p>\n<p>For example, New York\u2019s governor signed legislation last month to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-signs-marijuana-tax-cut-bills-providing-local-280e-relief-for-nyc-businesses\/\" target=\"_blank\" rel=\"noopener\">provide tax relief to New York City marijuana businesses<\/a> that are similarly blocked from making federal deductions the IRS 280E ban. A budget bill enacted last year already included provisions to broadly <a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-send-budget-with-marijuana-business-tax-breaks-to-governor-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">allow state-level cannabis business tax deductions<\/a>, but the latest reform addresses the city\u2019s separate tax policy.<\/p>\n<p>In October, the Pennsylvania House approved a large-scale tax reform bill that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-house-approves-280e-tax-cut-for-marijuana-businesses-over-gop-objections\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">contains language to provide state-level relief to medical marijuana businesses<\/a>. The reform has drawn the ire of Republican members\u2014who normally champion tax cuts\u2014as a Democratic giveaway to the cannabis industry.<\/p>\n<p>In August, the governor of Maine signed legislation to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maine-governor-signs-bill-allowing-state-level-marijuana-business-tax-deductions-that-are-prohibited-under-federal-irs-280e-code\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">decouple the state tax from the federal policy for cannabis businesses<\/a>.<\/p>\n<p>The governor of Illinois also signed a budget bill\u00a0in June that includes provisions that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/illinois-governor-signs-bill-allowing-marijuana-businesses-to-claim-state-tax-deductions-as-partial-irs-280e-fix\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">will allow licensed marijuana businesses to take state tax deductions<\/a>\u00a0that they\u2019re currently prohibited from utilizing under the IRS code.<\/p>\n<p>That same month, the governor of Connecticut also signed budget legislation that includes\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-marijuana-industry-tax-breaks-signed-into-law-by-governor\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">provisions to\u00a0provide state-level tax relief<\/a>\u00a0to licensed marijuana businesses as a federal 280E workaround for the industry.<\/p>\n<p>Also,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-governor-signs-bill-to-let-marijuana-businesses-claim-state-tax-deductions-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the governor of New Jersey signed legislation<\/a>\u00a0in May to allow licensed marijuana businesses to deduct certain expenses on their state tax returns as a partial IRS 280E fix. Lawmakers in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/iowa-regulators-push-to-exempt-medical-marijuana-from-sales-tax-and-to-decouple-state-from-federal-280e-penalty-on-businesses\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">Iowa<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-house-gop-lawmakers-kill-senate-passed-marijuana-280e-tax-relief-bill-that-governor-opposed\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">Virginia<\/a>\u00a0have similarly pursued tax relief for each of their state\u2019s marijuana markets.<\/p>\n<p>At the congressional level, Rep. Earl Blumenauer (D-OR) reintroduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-congressional-bill-would-provide-federal-tax-relief-for-marijuana-businesses-by-amending-irss-280e-code\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">a bill in May that would amend the IRS code<\/a>\u00a0to allow state-legal marijuana businesses to finally take federal tax deductions that are available to companies in other industries.<\/p>\n<p>He told Marijuana Moment that he\u2019s \u201cabsolutely convinced when we are able to fully deduct their business expenses that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressman-says-letting-marijuana-businesses-claim-federal-tax-deductions-with-280e-repeal-will-actually-generate-more-revenue\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">there actually will be more revenue collected<\/a>\u00a0because people will comply fully with the law.\u201d<\/p>\n<p>For the time being, the marijuana industry continues to face tax policy challenges under the umbrella of prohibition. And as\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-researchers-analyze-280e-marijuana-tax-penalty-and-legislative-solutions\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the Congressional Research Service (CRS) noted<\/a>\u00a0in a 2021 report, IRS \u201chas offered little tax guidance about the application of Section 280E.\u201d<\/p>\n<p>IRS did\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/irs-releases-tax-guidance-for-marijuana-industry\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">provide some guidance in an update in 2020<\/a>, explaining that while cannabis businesses can\u2019t take standard deductions, 280E does not \u201cprohibit a participant in the marijuana industry from reducing its gross receipts by its properly calculated cost of goods sold to determine its gross income.\u201d<\/p>\n<p>The IRS update seemed to be\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/irs-rejects-watchdog-recommendation-to-provide-marijuana-business-tax-guidance\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-google-interstitial=\"false\">responsive to a Treasury Department internal watchdog report<\/a>\u00a0that was released in 2020. The department\u2019s inspector general for tax administration had criticized IRS for failing to adequately advise taxpayers in the marijuana industry about compliance with federal tax laws. And it directed the agency to \u201cdevelop and publicize guidance specific to the marijuana industry.\u201d<\/p>\n<p>The industry\u2019s 280E problem could also be resolved if the Drug Enforcement Administration (DEA) accepts the recommendation of the U.S. Department of Health and Human Services (HHS) and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-federal-health-agency-says-marijuana-should-be-moved-to-schedule-iii-in-historic-recommendation-to-dea\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">moves marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA)<\/a>.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/12\/MM_Bill_Tracker_V5_blank-27.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Back in Florida, a recent survey found that <a href=\"https:\/\/www.marijuanamoment.net\/nearly-70-percent-of-florida-voters-support-marijuana-legalization-ballot-initiative-with-majorities-of-every-demographic-in-favor\/\" target=\"_blank\" rel=\"noopener\">nearly seven out of ten registered voters say they support the marijuana legalization initiative<\/a> that may appear on next year\u2019s ballot <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-florida-supreme-court-hears-arguments-in-case-to-decide-if-marijuana-legalization-will-appear-on-2024-ballot\/\" target=\"_blank\" rel=\"noopener\">depending on the outcome of the case before the state Supreme Court<\/a>, which heard oral arguments from Moody\u2019s office and the Smart &amp; Safe Florida campaign last month.<\/p>\n<p>The state official\u2019s main argument is that the ballot measure is affirmatively misleading, in part because she says\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-attorney-general-says-voters-are-too-stupid-to-see-through-marijuana-companys-monopolistic-legalization-push\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">voters would not be able to understand from the summary<\/a>\u00a0that marijuana would remain federally illegal even if Florida moved to legalize.<\/p>\n<p>The campaign and supporters have maintained that the court must respect the intent of the citizen initiative process and allow voters the opportunity to decide on the issue after\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-legalization-initiative-has-enough-signatures-for-2024-ballot-state-officials-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">they turned in nearly one million signatures<\/a>\u00a0for ballot placement that have been certified by the state.<\/p>\n<p>Moody made the same argument about misleading ballot language against a 2022 legalization measure, and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-supreme-court-kills-another-marijuana-legalization-ballot-measure-for-2022\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the Supreme Court subsequently invalidated it<\/a>.<\/p>\n<p>An economic analysts from the Florida legislature and the office of Gov. Ron DeSantis (R) estimate that the 2024 marijuana legalization initiative would <a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-ballot-measure-would-net-up-to-431-million-in-annual-tax-revenue-analysts-for-desantis-and-lawmakers-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">generate between $195.6 million and $431.3 million<\/a>\u00a0in new sales tax revenue annually if voters enact it.<\/p>\n<p>The legalization campaign shouldn\u2019t expect to receive support from DeSantis, a GOP 2024 presidential candidate, who said at a recent event that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ron-desantis-says-he-would-not-decriminalize-marijuana-if-elected-president\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">he would not move to federally decriminalize cannabis<\/a>\u00a0if elected.<\/p>\n<p>DeSantis signed a bill that took effect over the summer that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/desantis-approved-florida-law-bans-recreational-marijuana-ads-while-instituting-more-industry-worker-restrictions\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">added restrictions to medical marijuana advertising and manufacturing<\/a>, prohibiting any products or messages that promote \u201crecreational\u201d cannabis use, while adding more stringent eligibility requirements for workers in the industry.<\/p>\n<p>He also signed legislation in July\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/desantis-signs-bill-banning-hemp-chewing-gum-and-other-cannabis-products-for-people-under-21-in-florida\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">banning sales of any consumable hemp products<\/a>\u2014including cannabis \u201cchewing gum\u201d\u2014to people under 21, an expansion of an existing prohibition on young people being able to purchase smokable hemp.<\/p>\n<p>Additionally, the governor approved a bill in June\u00a0that expressly\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/desantis-signs-bill-prohibiting-medical-marijuana-at-florida-recovery-residences-even-if-recommended-by-doctor\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">prohibits sober living facilities from allowing residents to possess or use medical marijuana<\/a>, even if the patient is certified by a doctor to legally use cannabis therapeutically in accordance with state law.
