{"id":71084,"date":"2023-12-19T09:58:41","date_gmt":"2023-12-19T17:58:41","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/12\/19\/top-federal-health-official-and-former-white-house-drug-czar-brief-congress-on-kratom-as-advocates-push-for-bipartisan-reform-bill\/"},"modified":"2023-12-19T13:35:15","modified_gmt":"2023-12-19T21:35:15","slug":"top-federal-health-official-and-former-white-house-drug-czar-brief-congress-on-kratom-as-advocates-push-for-bipartisan-reform-bill","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/12\/19\/top-federal-health-official-and-former-white-house-drug-czar-brief-congress-on-kratom-as-advocates-push-for-bipartisan-reform-bill\/","title":{"rendered":"Top Federal Health Official And Former White House Drug Czar Brief Congress On Kratom As Advocates Push For Bipartisan Reform Bill"},"content":{"rendered":"<p><html><body><\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/12\/MM_Bill_Tracker_V5_blank-18.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A top federal health official and a former White House drug czar were among the featured speakers at a recent kratom-focused congressional briefing, laying out research priorities for the plant and broadly promoting alternative approaches to drug criminalization.<\/p>\n<p>Last week\u2019s event, organized by the American Kratom Association (AKA), was meant to give a science-based overview of kratom issues for congressional staff and stakeholders as bipartisan lawmakers work to advance a bill to federally regulate the substance, which is currently unscheduled and anecdotally used for pain relief, curbing withdrawal symptoms and other purposes.<\/p>\n<p>National Institute on Drug Abuse (NIDA) Director Nora Volkow started by saying that while she always wants policy to be grounded in science, she\u2019s come to understand that data is \u201cnot necessarily sufficient or enough.\u201d<\/p>\n<p>In the case of kratom, she said, \u201cunfortunately, we don\u2019t know much,\u201d which is why NIDA is committed to expanding research into its potential risks and benefits. For example, she said health agencies have \u201cinvested significant resources\u201d to synthesize the main compound of kratom so that researchers can conduct clinical trials investigating how it can be used for pain management and also \u201cfor the treatment of drug addiction.\u201d<\/p>\n<p\/>\n<p>\u201cWe actually are very much open\u201d to identifying those possible benefits, she said at the event. Volkow added, however, that the current lack of empirical data means there\u2019s \u201cno way of quantifying how to properly see the value.\u201d<\/p>\n<p>The National Institutes of Health (NIH) hosted a meeting last year to explore the therapeutic potential of the \u201ccontroversial tree,\u201d with an expert similarly <a href=\"https:\/\/www.marijuanamoment.net\/federal-agency-explores-benefits-of-the-controversial-tree-kratom\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">providing an overview of the science of kratom<\/a>\u00a0and what role it could play in mitigating the overdose crisis.<\/p>\n<p>Former Rep. Matt Salmon (R-AZ), who now serves as chairman of AKA, said at Wednesday\u2019s briefing that he first learned about kratom during his last term in Congress, and he recalled how he eventually led a bipartisan letter to the Food and Drug Administration (FDA) to \u201cget them to rethink their position\u201d on scheduling kratom.<\/p>\n<p>\u201cI\u2019m really thankful that, once they actually relied on science rather than emotion, that they\u2019ve never tried to schedule it again,\u201d he said. \u201cBut the fact is that there\u2019s a lot of information out there\u2014and I will say this point blank, most of it is misinformation.\u201d<\/p>\n<p>He talked about his own personal experience using kratom as an opioid alternative after he had knee replacement surgery, saying he used the plant-based medicine for about a month post-operation and he \u201cdidn\u2019t have a lick of trouble not using it anymore\u201d after that point.<\/p>\n<p>Jim Carroll, who served as director of the Office of National Drug Control Policy (ONDCP) under President Donald Trump from 2018 to 2021, also participated in the briefing. Like Salmon, he said he became aware of FDA\u2019s intent to schedule kratom and questioned what he described as a \u201cone-sided\u201d rationale, ultimately prompting him and other federal health officials to intervene.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Powerful presentations at the <a href=\"https:\/\/twitter.com\/hashtag\/CongressionalBriefing?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#CongressionalBriefing<\/a> <br \/>Thank you to everyone who attended! <a href=\"https:\/\/t.co\/XUCCnAQ39J\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/XUCCnAQ39J<\/a><\/p>\n<p>\u2014 American Kratom Association (@TheKratomAssn) <a href=\"https:\/\/twitter.com\/TheKratomAssn\/status\/1735330897723814391?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">December 14, 2023<\/a><\/p>\n<\/blockquote>\n<p\/>\n<p>He said that <a href=\"https:\/\/www.marijuanamoment.net\/former-trump-drug-czar-says-top-federal-officials-stopped-fda-from-scheduling-kratom-amid-concern-about-agencys-bias\/\" target=\"_blank\" rel=\"noopener\">FDA was trying to get the Drug Enforcement Administration (DEA) to \u201ccriminalize kratom\u201d<\/a> based on its argument that the plant was linked to overdose deaths, without providing an alternative perspective.<\/p>\n<p>\u201cSo we did not have [the order] signed. We made sure that it was withdrawn,\u201d Carroll said. \u201cWhat we did really, as far as I am concerned, is took away the criminalization of research and the criminalization of treatment.\u201d<\/p>\n<p>The former drug czar made clear he isn\u2019t personally advocating for the kratom cause; rather, he wants to contribute to the conversation about the harms of policies criminalizing drugs and substance misuse more broadly.<\/p>\n<p>\u201cIf we\u2019ve learned and we\u2019ve all grown and realized that addiction is not a criminal event\u2014that we\u2019ve stopped criminalizing addiction\u2014why are we going to criminalize research? Why are we going to criminalize treatment when it shows great potential?\u201d he asked. \u201cAnd I think that\u2019s how we need to approach this issue, not only as Congress but also as families and as individuals and stop the stigma. I\u2019m convinced that\u2019s part of what\u2019s going on here: It\u2019s a continuation of this stigma.\u201d<\/p>\n<p>Mac Haddow, senior fellow on public policy at AKA, told Marijuana Moment that one of the challenges of informing lawmakers and congressional staff about kratom-related issues is lingering \u201cchatter\u201d from FDA officials who \u201cpersistently say that kratom is dangerous.\u201d<\/p>\n<p>\u201cWe thought it was important for those staffers and members to have an opportunity to hear from scientists and policymakers who have firsthand knowledge and understanding of kratom and how it can help,\u201d he said. \u201cIt was a great step forward.\u201d<\/p>\n<p>Haddow said that the hope is this briefing will be instructive to lawmakers as advocates push to advance a bipartisan bill\u2014<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-in-congress-introduce-new-bill-to-regulate-kratom-nationwide\/\" target=\"_blank\" rel=\"noopener\">the Kratom Consumer Protection Act<\/a>, which was filed by Sens. Cory Booker (D-NJ) and Mike Lee (R-UT), as well as Reps. Mark Pocan (D-WI) and Jack Bergman (R-MI), in October.<\/p>\n<p>If the bill becomes law, it would require FDA to take further steps to evaluate the health and safety of kratom and would also prohibit the agency from regulating kratom products in a way that\u2019s more restrictive than regulations for food or dietary supplements.<\/p>\n<p>Soren Shade, founder of the Colorado-based kratom company Top Tree Herbs who attended the congressional briefing, told Marijuana Moment that \u201cthis is an important bill to pass in order to help disseminate good information and help protect the supply of kratom for consumers, many of whom count on it, and getting rid of it would be a disaster and cause a lot of suffering.\u201d<\/p>\n<p>\u201cIn regards to the bare minimum goal of ensuring that a safe, clean and reliable supply of this wonderful leaf is available for the long-term, I think this bill is a good first step for that. I think there\u2019s a lot of work to be done,\u201d Shade, who was among many kratom stakeholders visiting D.C. to set meetings with congressional offices to advocate for reform, said.<\/p>\n<p>There\u2019s an open question as to why FDA has evidently targeted kratom, but stakeholders say it could also explain why it placed an import alert for products coming from countries like Indonesia.\u00a0In a meeting with President Joe Biden last month, <a href=\"https:\/\/www.marijuanamoment.net\/indonesias-president-urges-biden-to-lift-fdas-kratom-import-restrictions-advocacy-groups-say\/\" target=\"_blank\" rel=\"noopener\">the president of Indonesia reportedly urged the administration to lift the alert<\/a>. A top Indonesian administrative official separately made the request to FDA earlier this year, pledging to see to it that exported products meet safety requirements.<\/p>\n<p>Meanwhile, after failing to secure the scheduling of kratom, FDA solicited public input in 2021 as it prepared to <a href=\"https:\/\/www.marijuanamoment.net\/fda-seeks-public-input-on-possible-global-kratom-ban-after-domestic-scheduling-effort-stalled\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">submit the U.S. perspective on a potential international kratom ban<\/a> that never materialized. The United Nations World Health Organization (WHO) decided in 2021 <a href=\"https:\/\/www.marijuanamoment.net\/united-nations-panel-rejects-international-kratom-ban\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">not to recommend that kratom be globally prohibited<\/a>.<\/p>\n<p>While the decision was based on a scientific review of the risk of dependence, abuse potential and therapeutic applications of kratom, advocates touted the fact that about 80,000 people submitted comments to the panel,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fda-seeks-public-input-on-possible-global-kratom-ban-after-domestic-scheduling-effort-stalled\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">sharing their perspectives and experiences<\/a>\u00a0with the plant-derived substance.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a American Medical Association, in <a href=\"https:\/\/www.marijuanamoment.net\/american-medical-association-promotes-psychedelics-research-opposes-kratom-criminalization-and-affirms-support-for-marijuana-drug-testing\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">adopting a new slate of drug policy positions<\/a>, said that people \u201cwho are using kratom only for personal use should not face criminal consequences.\u201d The group added, however, that the substance should be evaluated by authorities \u201cfor its appropriateness for sale and potential oversight via the Controlled Substances Act, before it can be marketed, purchased, or prescribed.\u201d<\/p>\n<p>In 2020, the federal Agency for Healthcare Research and Quality (AHRQ) asked the public to help identify research that specifically\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/feds-want-help-finding-evidence-on-marijuana-and-kratoms-role-in-treating-pain\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">looks at the risks and benefits of cannabinoids and kratom<\/a>.<\/p>\n<p>The Centers for Disease Control and Prevention (CDC) in 2020 separately\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cdc-flooded-with-comments-on-marijuana-and-kratom-as-alternative-painkillers-ahead-of-deadline\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">received more than one thousand comments concerning kratom<\/a>\u00a0as part of another public solicitation.<\/p>\n<p>Critics have said FDA misstated the facts on kratom to overstate its health risks, for example by failing to distinguish between health hazards associated with kratom itself and those caused by adulterants found in unregulated kratom
