{"id":69619,"date":"2023-10-24T11:52:25","date_gmt":"2023-10-24T19:52:25","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/10\/24\/pennsylvania-house-committee-schedules-marijuana-legalization-hearing-for-next-week-with-chair-considering-state-run-stores\/"},"modified":"2023-10-25T19:46:55","modified_gmt":"2023-10-26T03:46:55","slug":"pennsylvania-house-committee-schedules-marijuana-legalization-hearing-for-next-week-with-chair-considering-state-run-stores","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/10\/24\/pennsylvania-house-committee-schedules-marijuana-legalization-hearing-for-next-week-with-chair-considering-state-run-stores\/","title":{"rendered":"Pennsylvania House Committee Schedules Marijuana Legalization Hearing For Next Week, With Chair Considering State-Run Stores"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/10\/MM_Bill_Tracker_V5_blank-15.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A Pennsylvania House committee will convene for an informational meeting next week to hear from experts about adult-use marijuana legalization as legislators chart a path for the reform, with the panel\u2019s chairman considering the possibility of incorporating a state-run cannabis sales model.<\/p>\n<p>While the House Health Subcommittee on Health Care will not take up any specific legislation at its November 1 hearing, members will have the chance to listen to testimony from professors, advocates and addiction specialists about the health considerations of moving forward with legalization in the Keystone State.<\/p>\n<p>The subcommittee is chaired by Rep. Dan Frankel (D), who has <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-lawmakers-unveil-marijuana-legalization-bill-with-focus-on-social-equity\/\" target=\"_blank\" rel=\"noopener\">previously sponsored cannabis legalization legislation<\/a> and circulated a cosponsorship memo earlier this year <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-team-up-on-new-marijuana-legalization-bill-2\/\" target=\"_blank\" rel=\"noopener\">previewing plans to file another reform bill this session<\/a>.<\/p>\n<p>Frankel told Marijuana Moment in a phone interview on Tuesday that the measure he\u2019s planning to introduce early next year will likely be \u201cquite different\u201d from the version he previously sponsored, and it will be partly informed by the meetings members hold in his panel. The lawmaker expects there will be two or three meetings to discuss the reform before a final bill is brought to the full committee.<\/p>\n<p>\u201cMy framework for addressing this overall, which is what we\u2019ll try to fit into this hearing, is as we move forward with an adult-use bill, focusing on for safety, equity\u2014particularly with respect to restorative justice\u2014and also revenue for the state and access for folks,\u201d Frankel said.<\/p>\n<p>\u201cMy goal would be to find something that that our entire conference can support\u2014and I would expect that there would be some bipartisan support for this legislation,\u201d he said. \u201cI think it\u2019s very important that we have bipartisan support if we\u2019re going to send something over to the Senate, which is controlled by my Republican colleagues.\u201d<\/p>\n<p>The chairman said that lawmakers will be looking at a variety of state regulatory models and \u201cwhat we could do better\u201d in Pennsylvania, noting that certain states have \u201ccome forward with some pretty interesting ideas as well that we want to hear about, so we\u2019ll be looking at those as well as we craft something.\u201d<\/p>\n<p>One of those interesting ideas that the chairman said is \u201ccertainly an option\u201d is the model of state-run cannabis stores, similar to what\u2019s been proposed and is being <a href=\"https:\/\/www.marijuanamoment.net\/uniqueness-of-new-hampshires-proposed-state-run-marijuana-stores-could-create-federal-liability-ags-office-says\/\" target=\"_blank\" rel=\"noopener\">actively considered in the New Hampshire legislature as a commission there explores legalization options<\/a>.<\/p>\n<p>\u201cIt has some political challenges to go that way, but in some ways, it makes sense if you want to roll out adult-use quickly and safely,\u201d he said. \u201cThat could be part of the retail dispensary operation\u2014having that administered as well, since there\u2019s already that infrastructure there with respect to alcohol,\u201d the sale of which the state currently controls in Pennsylvania.<\/p>\n<p>\u201cSo there\u2019s some interest in looking at the state store system as part of it\u2014not necessarily entirely\u2014but as part of the distribution system or dispensary system,\u201d Frankel said. However, he recognized that beside political challenges, with certain conservatives already critical of the state\u2019s alcohol system, there\u2019s also the fact that Pennsylvania purchases much of the alcohol that is sold at retailers from out-of-state companies, which is \u201cnot an option with respect to cannabis\u201d under federal prohibition.<\/p>\n<p>With a new, narrow Democratic majority in the House this session and support from Gov. Josh Shapiro (D), <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-marijuana-legalization-prospects-increase-as-democrats-claim-majority-in-house-with-incoming-pro-reform-governor\/\" target=\"_blank\" rel=\"noopener\">the prospects of legalization in Pennsylvania picked up<\/a>\u2014but there\u2019s still an open question about how the GOP-controlled Senate might approach reform if the opposite chamber delivered it a bill.<\/p>\n<p>That said, more Republican senators have come on board with the policy change, with <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-unveil-new-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">a bipartisan legalization measure already having been filed in the body<\/a> this session by Sens. Dan Laughlin (R) and Sharif Street (D), for example.<\/p>\n<p>Last year, the Senate Law and Justice Committee <a href=\"https:\/\/www.marijuanamoment.net\/key-pennsylvania-senate-committee-completes-final-marijuana-legalization-hearing-to-inform-reform-legislation\/\" target=\"_blank\" rel=\"noopener\">held a series of hearings on marijuana legalization that were meant to inform legislation<\/a> that the panel\u2019s Republican chairman, Sen. Mike Regan (R), was drafting.<\/p>\n<p>At next week\u2019s <a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/cteeInfo\/Index.cfm?Code=55&amp;CteeBody=H\" target=\"_blank\" rel=\"noopener\">meeting<\/a>, the House panel will hear from Carnegie Mellon University professor Jonathan Caulkins, Penn State College of Medicine professor Kent Vrana, New Frontier Data Chief Knowledge Officer Amanda Reiman and a representative of the addiction prevention community.<\/p>\n<p>A staffer for Frankel told Marijuana Moment on Tuesday that issues covered will include the impact of legalization on the illicit market, the health implications of marijuana use and the economic and industry potentials of the policy change.<\/p>\n<p>Reiman told Marijuana Moment that she will be providing \u201can overview of who cannabis consumers are, their sourcing patterns and preferred methods of ingestion\u201d based on a survey that New Frontier Data conducted this year. She will alsobrief lawmakers on \u201cmarket projections through 2030 based on two scenarios\u2014one where the states expected to open markets do (OH, FL, etc), and one where no other markets open between now and then,\u201d she said.<\/p>\n<p>\u201cFor consumers, I will be covering consumer demographics, use patterns, motivations for use, preferred product forms, sourcing and spending,\u201d Reiman said. \u201cFinally, I will be reviewing reasons why people do not participate in the regulated market.\u201d<\/p>\n<p>Cannabis industry stakeholders were intentionally excluded for this initial meeting in order to allow members to hear from those who don\u2019t have a direct investment in the potential market and learn more about \u201cthe contours and the landscape that they\u2019re going to be looking at as they consider legalization,\u201d a committee staffer said.<\/p>\n<p>In addition to the more conventional legalization proposal that\u2019s being sponsored by bipartisan senators this session, House lawmakers have also filed separate bills to <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-lawmakers-file-bill-to-legalize-marijuana-sales-through-state-run-stores\/\" target=\"_blank\" rel=\"noopener\">legalize marijuana sales through state-run stores<\/a>\u00a0and to provide permits for farmers and small agriculture businesses to cultivate cannabis once adult-use sales are allowed.<\/p>\n<p>Also, earlier this month, the House approved a large-scale tax reform bill that <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-house-approves-280e-tax-cut-for-marijuana-businesses-over-gop-objections\/\" target=\"_blank\" rel=\"noopener\">contains language to provide state-level relief to medical marijuana businesses<\/a> as they continue to struggle under federal financial barriers. The reform drew the ire of Republican members\u2014who normally champion tax cuts\u2014as a Democratic giveaway to the cannabis industry.<\/p>\n<p>Another measure to allow all licensed medical marijuana grower-processors in the state to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senate-passes-bill-letting-medical-marijuana-growers-sell-directly-to-patients-with-house-considering-home-cultivation-amendment\/\" target=\"_blank\" rel=\"noopener\">sell their cannabis products directly to patients<\/a>\u00a0cleared the Senate in September, and it\u2019s now pending House committee action.<\/p>\n<p>Former Gov.
