So far only about two dozen retailers have opened statewide since adult-use sales began last December.<\/p>\n<p>Applications will be open until December 4, and regulators are expected to begin awarding the new licenses early next year.<\/p>\n<p>Gov. Kathy Hochul (D) announced the launch of the new application period on Wednesday, at the same time emphasizing her administration is \u201cramping up\u201d law enforcement efforts to go after unlicensed marijuana businesses, which have proliferated amid delays to the state\u2019s legal rollout.<\/p>\n<p>Both expanding business licensing and targeting illegal actors are meant to help speed New York\u2019s transition from the underground marijuana market to licensed retailers.<\/p>\n<p>\u201cToday\u2019s an important milestone in our efforts to stand up a brand new industry,\u201d Hochul said in an <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/news\/2023\/10\/04\/new-york-opens-up-applications-for-more-cannabis-licenses?fbclid=IwAR1cd1V5y2H835abFdUhSg1m26puHUm4Ot4mYY51a8nYW4DbVE6Ys-s5GGk#\" target=\"_blank\" rel=\"noopener\">interview<\/a> with Spectrum News NY1 about the announcement. She said she expects \u201ctens of thousands\u201d of license applicants, who will be selected through a lottery process. \u201cWe expect, over the next year, to have over 1,000 legal cannabis shops,\u201d she said.<\/p>\n<p>The same day as the announcement, New York City\u2019s Department of Small Business Services announced an educational program for entrepreneurs that the office said \u201cconnects cannabis business owners with free, high-quality training and advice proctored by leading players in the legal cannabis industry.\u201d Applications for the so-called <a href=\"https:\/\/nyc-business.nyc.gov\/nycbusiness\/article\/fasttrac\" target=\"_blank\" rel=\"noopener\">FastTrac<\/a> program are due by October 18.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Applications to legally grow, process, distribute, &amp; sell cannabis are now open\u2014 the largest expansion of our market to date!<\/p>\n<p>We\u2019re growing a cannabis industry that will generate millions in revenue annually, create or sustain thousands of jobs, and prioritize equity and safety. <a href=\"https:\/\/t.co\/Ue0qLBmi5k\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/Ue0qLBmi5k<\/a><\/p>\n<p>\u2014 Governor Kathy Hochul (@GovKathyHochul) <a href=\"https:\/\/twitter.com\/GovKathyHochul\/status\/1709550136911692014?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">October 4, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Hochul estimated that there are more than 2,000 illegal marijuana stores currently operating in the state, many of which operate with impunity in New York City.<\/p>\n<p>\u201cWe had talked about our enforcement against the illegal cannabis shops, and how by the end of the summer, we\u2019d have many more\u2014dozens more\u2014legal places open,\u201d the governor said, \u201cand then the lawsuits started.\u201d<\/p>\n<p>Frustrations over New York\u2019s cannabis program have compounded over recent months, as regulators have worked to stand up a market that prioritizes social equity, awarding conditional licenses to people who\u2019ve been most impacted by prohibition. The process has been slow, however\u2014and illicit cannabis businesses have proliferated in the interim. Meanwhile, <a href=\"https:\/\/www.marijuanamoment.net\/new-york-judge-halts-marijuana-business-license-approvals-following-military-veteran-led-lawsuit\/\" target=\"_blank\" rel=\"noopener\">lawsuits have temporarily halted cannabis licensing<\/a>, further complicating the issue.<\/p>\n<p>Hochul described the legal challenges as coming from \u201cbig companies from out of state, you know, greedy corporations that wanted their piece of it before we can make it available to veterans and [minority- and women-owned business enterprises] and focus on a social equity component, which was the intent of the law.\u201d<\/p>\n<p>\u201cBut today\u2019s a breakthrough,\u201d the governor continued. \u201cWe\u2019re going to keep going, and by the end of the year we should be seeing a process that is much smoother than it has been today.\u201d<\/p>\n<p>In a press release about the license application, Hochul\u2019s office simultaneously touted the results of \u201ccontinued aggressive enforcement against the illegal sale of cannabis across the state,\u201d which has so far seized more than four tons of illicit products. We will continue working to build the most equitable adult-use cannabis industry in the nation that invests in communities and rights the wrongs of the past.\u201d<\/p>\n<p>Speaking to NY1, Hochul said her office is \u201cgoing to continue to empower every entity from the attorney general\u2019s office to the sheriff\u2019s office and really encourage local police departments to step up and do what they have to do. Let\u2019s shut them down. Let\u2019s padlock them. We\u2019re intent on making this be successful. Ultimately we will.\u201d<\/p>\n<p>State Attorney General Letitia James (D) said in a statement that \u201cexpanding the number of cannabis licenses while simultaneously taking action against unlicensed sellers is a common sense way to support small businesses and incentivize entrepreneurs to legally enter the marketplace\u201d under the state\u2019s legalization law, the Marihuana Regulation and Taxation Act (MRTA).<\/p>\n<p>\u201cBy holding unlicensed cannabis sellers accountable,\u201d James continued, \u201cmy office is helping ensure New York can realize the intended purpose of MRTA, namely to remediate some of the societal harm caused by the so-called war on drugs.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Want to learn more about the application process? New York\u2019s market is centered around equity, with the nation\u2019s strongest anti-trust protections in place that ensures small operators will forever have a place in our cannabis industry.\u201d<\/p>\n<p>Currently the state has issued 270 conditional licenses, 40 conditional processor licenses and 23 conditional adult-use licenses across the state, <a href=\"https:\/\/cannabis.ny.gov\/licensing\" target=\"_blank\" rel=\"noopener\">according<\/a> to OCM.<\/p>\n<p>Added Wright: \u201cNew York State remains steadfast in its efforts to build an equitable, competitive and diverse cannabis industry. Today, the day our general application window opens, marks a huge step forward in making our vision of an equitable and accessible New York cannabis market a reality.\u201d<\/p>\n<p>Separately, lawmakers are seeking broad input on challenges facing the legal cannabis industry. Earlier this week, Sen. Jeremy Cooney (D), who chairs the legislature\u2019s first-ever cannabis committee, <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senate-cannabis-committee-invites-people-to-apply-to-testify-at-hearing-on-legalization-challenges-this-month\/\" target=\"_blank\" rel=\"noopener\">invited members of the public to apply to testify<\/a> at an upcoming hearing on the matter.<\/p>\n<p>Cooney <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senate-marijuana-committee-schedules-hearing-to-address-challenges-for-legalization-rollout\/\" target=\"_blank\" rel=\"noopener\">first announced the marijuana hearing in early September<\/a>, saying its purpose is to \u201cfinally address the many challenges that we have seen with the rollout of adult-use cannabis here in New York.\u201d<\/p>\n<p>Regulators are already making moves\u2014some of them controversial\u2014to broaden access to the legal market. Last month the state Cannabis Control Board (CCB) <a href=\"https:\/\/www.marijuanamoment.net\/new-york-to-open-adult-use-marijuana-market-to-all-businesses-including-large-multistate-operators-and-medical-cannabis-companies\/\" target=\"_blank\" rel=\"noopener\">adopted a change to open retail licensing to all applicants<\/a>, including big businesses from outside the state and existing medical marijuana companies. The change sparked an outcry from social equity applicants, who said it will undercut the state\u2019s ambitious plan to prioritize small businesses and companies owned by people most directly impacted by prohibition.<\/p>\n<p>As part of the state\u2019s effort to speed consumer access to legal marijuana, regulators also launched a program, known as the Cannabis Growers Showcase (CGS), an initiative of New York\u2019s Office of Cannabis Management (OCM) that allows licensed growers and processors to sell directly to consumers.<\/p>\n<p>Regulators\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-regulators-vote-to-allow-marijuana-farmers-markets-while-nearly-doubling-the-number-of-provisional-retailer-licenses\/\" target=\"_blank\" rel=\"noopener\">voted to approve that program<\/a> in July\u00a0and quickly\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-is-now-accepting-applications-for-marijuana-farmers-markets\/\" target=\"_blank\" rel=\"noopener\">began accepting applications<\/a>. The\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-yorks-first-marijuana-farmers-market-will-open-this-week-regulators-announce\/\" target=\"_blank\" rel=\"noopener\">first pop-up event kicked off in the Hudson Valley<\/a> in August, and another was held <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-farmers-market-opens-alongside-new-york-state-fair\/\" target=\"_blank\" rel=\"noopener\">down the road from this year\u2019s state fair<\/a>.<\/p>\n<p>Late last month, 66 state lawmakers\u2014about a third of the entire state legislature\u2014also wrote to Hochul urging her to <a href=\"https:\/\/www.marijuanamoment.net\/66-new-york-lawmakers-urge-governor-to-sign-bill-allowing-bulk-marijuana-sales-to-tribal-retailers\/\" target=\"_blank\" rel=\"noopener\">sign a bill that would allow licensed marijuana producers to sell products to tribal retailers<\/a>.
