Fairness should be a central tenet of the reform, and while advocates have helped secure \u201cminor but meaningful changes\u201d to the legislation this session as compared to the version filed last Congress, she argues that more can be done.<\/p>\n<p>\u201cDespite ongoing debate over the implications of passing protections for financial institutions before adopting more comprehensive and impactful cannabis reforms, a growing number of advocates and policymakers are taking the position that if lawmakers are prioritizing cannabis banking, the reform\u2014like every other cannabis policy issue\u2014can and should be equity-centered,\u201d she wrote.<\/p>\n<p>\u201cWhile many in the broader cannabis industry are working simply to get the SAFE Banking Act passed, others are working to improve the bill,\u201d the paper says. \u201cThe goal is to ensure that banking is consistent, systematic, fair, just, and impartial and that SAFE accomplishes more than merely protecting financial institutions from federal enforcement if they choose to provide services to certain marijuana businesses.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">A new paper from DEPC <a href=\"https:\/\/twitter.com\/OSU_Law?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@OSU_Law<\/a> Practitioner in Residence <a href=\"https:\/\/twitter.com\/cat_packer?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@cat_packer<\/a> details how efforts to promote fairness in <a href=\"https:\/\/twitter.com\/hashtag\/marijuanabanking?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#marijuanabanking<\/a> have led to minor but meaningful amendments to the SAFE Banking Act of 2023, and how to ensure banking is fair for all.<\/p>\n<p><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/09\/27a1.png\" alt=\"&#x27A1;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/> <a href=\"https:\/\/t.co\/dLhJ6gw1YP\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/dLhJ6gw1YP<\/a> <a href=\"https:\/\/t.co\/OQVG67UNzQ\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/OQVG67UNzQ<\/a><\/p>\n<p>\u2014 Drug Enforcement and Policy Center (@OSULawDEPC) <a href=\"https:\/\/twitter.com\/OSULawDEPC\/status\/1702028646259585505?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">September 13, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Some of the changes lawmakers have already incorporated into the legislation include extending banking protections to Community Development Financial Institutions (CDFIs) or Minority Depository Institutions (MDIs), providing access to federally backed mortgage loans to cannabis industry workers and mandating reporting requirements on market diversity and inclusiveness.<\/p>\n<p>Packer, whose <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4569810\" target=\"_blank\" rel=\"noopener\">paper<\/a> was published by the Ohio State University (OSU) Drug Enforcement and Policy Center where she is a cannabis policy practitioner in residence, highlights five additional recommended changes that she says could further bolster the equity impact of the SAFE Banking Act.<\/p>\n<ol>\n<li>Revise guidance to regulators to prevent banks from marking people with a \u201cred flag\u201d because of prior cannabis convictions if those records have been expunged or if the conviction was for an activity that\u2019s been made legal. Such circumstances \u201cshould not be considered an automatic indication that a business may be engaged in illegal activity.\u201d<\/li>\n<li>While the SAFE Banking Act requires regulators to develop best practices for financial institutions serving the hemp industry, the paper says that should also be extended to the marijuana market.<\/li>\n<li>The bill requires regulators and the Government Accountability Office (GAO) to study and and make recommendations concerning small business diversity and inclusion reports, but the language should be amended to define what constitutes a small businesses. The definition should be \u201cin line with state-level definitions of cannabis microbusinesses.\u201d<\/li>\n<li>GAO\u2019s mandate to study barriers to entry in the marijuana industry should be updated to include a \u201ccomprehensive review\u201d of \u201cexisting strategies in legal jurisdiction.\u201d<\/li>\n<li>Finally, the SAFE Banking Act should be revised to \u201crequire that financial institutions demonstrate compliance with existing anti-discrimination in lending laws in order to receive the benefit of safe harbor.\u201d<\/li>\n<\/ol>\n<p>\u201cUltimately, Congress will decide what\u2019s politically feasible. My goal is to ensure that Congress passes the best version of the SAFE Banking Act that it can,\u201d Packer told Marijuana Moment on Wednesday.<\/p>\n<p>\u201cAs someone who advocates on behalf of underserved communities and federal cannabis policies that are fair, my priority is ensuring that Congress understands the limitations of this bill, its potential impacts if there aren\u2019t amendments focused on fairness and that minor and technical changes to this bill could improve it in significant ways,\u201d she said. \u201cIf we\u2019re only focused on what\u2019s politically feasible\u2014and willing to allow the politics of policymaking to be a hurdle to common sense policies that would promote fairness in cannabis banking\u2014I worry about what that means for federal cannabis policy reform broadly.\u201d<\/p>\n<p>Several of the recommendations in this latest paper also appeared in a <a href=\"https:\/\/www.marijuanamoment.net\/former-marijuana-regulators-call-for-10-equity-amendments-to-bipartisan-cannabis-banking-bill\/\" target=\"_blank\" rel=\"noopener\">2022 paper from CRCC that Packer helped author<\/a>.<\/p>\n<p>\u201cAdvocates and policy makers have already helped nudge the business-focused SAFE Banking Act in a direction that better promotes equity,\u201d the new paper concludes. \u201cTheir ongoing efforts to promote fairness in cannabis banking have allowed for minor but meaningful changes. Yet for a bill that contains the word \u2018fair\u2019 in its title, more must be done to ensure the SAFE Banking Act lives up to its name.\u201d<\/p>\n<p>For now, supporters of the cannabis banking legislation are eagerly awaiting a Senate Banking Committee markup, which the chairman is aiming to hold during the current work session ending October 6. This comes about four months after <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-u-s-senate-committee-holds-marijuana-banking-hearing\/\" target=\"_blank\" rel=\"noopener\">the panel held an initial hearing on the legislation<\/a>, where Packer was among those who testified.<\/p>\n<p>Leadership initially planned to advance the bill during the July session, but action was delayed due to disagreements over a key section of the measure that concerns broader banking regulations.<\/p>\n<p>Since returning from the August recess, however, key players on both sides of the aisle have indicated that <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-bill-talks-were-very-productive-over-recess-gop-senate-sponsors-office-says-as-key-chairman-predicts-imminent-agreement\/\" target=\"_blank\" rel=\"noopener\">they\u2019ve had \u201cproductive\u201d conversations and are close to a deal<\/a> to get the bill to the floor. The <a href=\"https:\/\/www.marijuanamoment.net\/senate-committee-vote-on-marijuana-banking-bill-wont-be-next-week-despite-insiders-predictions-chairmans-office-says\/\" target=\"_blank\" rel=\"noopener\">markup will not be held next week, however,<\/a> despite the predictions of industry insiders.<\/p>\n<p>In any case, Senate Banking Committee Chairman Sherrod Brown (D-OH) said on Monday that he hopes to <a href=\"https:\/\/www.marijuanamoment.net\/senate-committee-chair-plans-marijuana-banking-vote-announcement-in-next-few-days-but-outlying-issues-remain\/\" target=\"_blank\" rel=\"noopener\">announce the scheduling of a SAFE Banking Act vote<\/a> in his panel \u201cin the next few days.\u201d<\/p>\n<p>For his part, Senate Majority Leader Chuck Schumer (D-NY) said in a Dear Colleague letter this month that <a href=\"https:\/\/www.marijuanamoment.net\/schumer-renews-push-for-safeguarding-marijuana-banking-but-stresses-need-for-bipartisan-support\/\" target=\"_blank\" rel=\"noopener\">\u201csafeguarding cannabis banking\u201d is one of his top legislative priorities<\/a>, though he stressed the need for bipartisan buy-in. He also said in a floor speech last week that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/schumer-says-senate-will-be-making-progress-on-marijuana-banking-in-floor-speech-on-legislative-priorities\/\" target=\"_blank\" rel=\"noopener\">he\u2019s committed to \u201cmaking progress on cannabis\u201d<\/a>\u00a0during the fall session.<\/p>\n<p>At this point, the SAFE Banking Act has 42 cosponsors\u2014nearly half of the Senate\u2014and that includes eight Republicans and three independents. As a standalone in its current form, insiders say the measure has enough Republican buy-in to reach the 60-vote threshold needed for passage in the Senate.<\/p>\n<p>Sen. Jacky Rosen (D-NV) has also said that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/senator-pushes-marijuana-banking-bill-amendment-to-provide-industry-access-to-small-business-administration-services\/\" target=\"_blank\" rel=\"noopener\">she wanted the SAFE Banking Act to pass with an amendment<\/a>\u00a0allowing cannabis businesses to access federal Small Business Administration (SBA) services.<\/p>\n<p>Rep. Earl Blumenauer (D-OR), who is a lead Democratic sponsor of the House version of the SAFE Banking Act, said at a press briefing in April that thinks it\u2019s important that advocates and lawmakers align on any incremental proposals to end the drug war,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressman-says-letting-marijuana-businesses-claim-federal-tax-deductions-with-280e-repeal-will-actually-generate-more-revenue\/\" target=\"_blank\" rel=\"noopener\">warning against an \u201call-or-nothing\u201d mentality<\/a>.<\/p>\n<p>The American Bankers Association (ABA) also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/american-bankers-association-calls-for-swift-passage-of-marijuana-banking-bill-ahead-of-senate-committee-hearing\/\" target=\"_blank\" rel=\"noopener\">recently renewed its call for the passage<\/a>\u00a0of the legislation. And all 50 of its state chapters did the same, as did insurance and union organizations,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/50-state-bankers-associations-insurance-groups-and-top-union-urge-passage-of-marijuana-banking-bill\/\" target=\"_blank\" rel=\"noopener\">in recent letters to congressional leadership<\/a>.<\/p>\n<p>July also marked the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/its-been-10-years-since-the-first-congressional-marijuana-banking-bill-was-filed-marking-a-milestone-as-lawmakers-make-what-they-hope-is-a-final-push\/\" target=\"_blank\" rel=\"noopener\">10-year anniversary since the introduction<\/a>\u00a0of the first version of what is now known as the SAFE Banking Act.<\/p>\n<p>Colorado Gov.
