And we should be lowering taxes at least temporarily.\u201d<\/p>\n<p>For operators trying to comply with state law, he continued, \u201cWe should make the regulatory burden less than what it is while we target the illicit market that is undercutting them.\u201d<\/p>\n<p>Bonta\u2019s comments came as he announced a new program to aid cities and counties in addressing illegal marijuana activity through administrative enforcement and nuisance abatement. For too long, he said, fly-by-night operators in the state have gotten away with it.<\/p>\n<p><span style=\"font-weight: 400\">\u201cSome folks believe they can avoid the tax burden or regulatory burden and just operate and make a profit without being legal,\u201d Bonta said at the event. \u201cAnd they\u2019ve been doing it. They haven\u2019t been shut down. They haven\u2019t had an administrative action taken against them. And that\u2019s what is necessary, and that\u2019s why this will be an important tool.\u201d<\/span><\/p>\n<p \/>\n<p>Fresno is the first California city to participate in the California Department of Justice\u2019s (CADOJ) Cannabis Administrative Prosecutor Program (CAPP), which <a href=\"https:\/\/oag.ca.gov\/Capp\" target=\"_blank\" rel=\"noopener\">provides<\/a> local jurisdictions with CADOJ legal support to pursue the administrative actions.<\/p>\n<p>\u201cThis innovative new program allows my office to better support local governments in our collective efforts to tackle illegal cannabis activities,\u201d Bonta said in a <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-announces-new-state-local-program-tackle-illegal\" target=\"_blank\" rel=\"noopener\">press release<\/a> about CAPP, \u201cand we are confident that this new cost-effective program will have dramatic and measurable effects.\u201d<\/p>\n<p>If cited, the release continues, \u201cillegal operators will have an opportunity to voluntarily shut down their operation, or face the eradication of unlicensed commercial cannabis cultivation or the cessation of unlicensed retail or manufacturing activity, as well as an order authorizing the recovery of enforcement costs.\u201d<\/p>\n<p>The program will provide attorneys to pursue administrative sanctions before local authorities \u201cand, where necessary, assist with the development of procedures for expedited administrative enforcement,\u201d his office said. In a further incentive to Fresno, it notes that any funding received through the program \u201cthat exceeds the cost of services provided as part of this MOU will be held by the city of Fresno.\u201d<\/p>\n<p>In comments first <a href=\"https:\/\/www.canorml.org\/ag-bonta-announces-capp-program-to-target-illicit-cannabis-operations-administratively-with-local-cooperation\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> by California NORML, Bonta also explained why administrative actions were more appealing than seeking criminal penalties against unlicensed operators.<\/p>\n<p>\u201cWhen public safety is at risk, we take appropriately aggressive action,\u201d he said. \u201cBut low-level offenders that don\u2019t need to be treated as criminals, when we can shut down their operations through the administrative process, we will. The practice was popular in the late aughts and early 2010s, as cities and towns across the state attempted to shut down an exploding number of storefront dispensaries and unregulated delivery services. While many businesses were penalized, some continued operating, treating fines as a cost of doing business.<\/p>\n<p>The cost of becoming a licensed cannabis business in the state is one factor explaining the presence of illegal grow sites, but another issue that California regulators have identified is the fact that much of the state\u2019s jurisdictions\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-officials-launch-new-marijuana-map-revealing-which-areas-are-still-blocking-businesses\/\" target=\"_blank\" rel=\"noopener\">prohibit marijuana businesses from operating in their areas<\/a>, fueling demand for illicit products since regulated items are costly and out of reach for many consumers.<\/p>\n<p>To expand retail access, California cannabis regulators, are currently spending millions in <a href=\"https:\/\/www.marijuanamoment.net\/california-announces-20-million-grant-program-to-expand-marijuana-retail-licensing-in-underserved-areas\/\" target=\"_blank\" rel=\"noopener\">grants to parts of the state with limited access to legal retailers<\/a>, a program launched earlier this year. In June, the Department of Cannabis Control issued about $4 million to local jurisdictions in an incentive to <a href=\"https:\/\/www.marijuanamoment.net\/california-regulators-award-4-million-to-localities-working-to-license-marijuana-businesses-and-curb-illicit-market\/\" target=\"_blank\" rel=\"noopener\">speed licensing of marijuana businesses<\/a>, part of $20 million in total grants set to go out under the Local Jurisdictional Retail Access Grant program.<\/p>\n<p>Localities that have opted out of allowing marijuana retailers, with no plans to license them in the future, don\u2019t qualify for the grants. Likewise, jurisdictions that already have licensing programs or where retailers have already been approved also don\u2019t qualify.<\/p>\n<p>Among potential health and safety hazards more common in unlicensed products, illegal cannabis operations typically don\u2019t abide by environmental laws. Earlier this year, the U.S. Fish and Wildlife Service said that the <a href=\"https:\/\/www.marijuanamoment.net\/federal-conservation-agency-says-californias-high-marijuana-licensing-costs-fuel-illicit-grows-that-are-harming-endangered-owls\/\" target=\"_blank\" rel=\"noopener\">use of prohibited pesticides in illicit California marijuana grows<\/a> were significant contributors to its request to list two species of spotted owl under the federal Endangered Species Act. The agency said the practice would likely increase with demand for marijuana \u201cif the costs of buying land and acquiring\/maintaining permits to legalize a grow operation are too high.\u201d<\/p>\n<p>Last year, a pair of GOP congressmen asked key cabinet officials in the Biden administration to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/anti-legalization-gop-congressmen-push-biden-admin-to-study-marijuana-cultivations-environmental-impacts\/\" target=\"_blank\" rel=\"noopener\">study the environmental impacts of marijuana cultivation<\/a>\u2014acknowledging both the intensive electrical demand that growing cannabis can involve as well as the role that legalization can play in setting regulations for the plant.<\/p>\n<p>California\u2019s own Department of Fish and Wildlife\u2019s in 2021 opened applications for proposals <a href=\"https:\/\/www.marijuanamoment.net\/applications-are-open-for-marijuana-funded-california-cultivator-environmental-clean-up-grants-state-announces\/\" target=\"_blank\" rel=\"noopener\">for a Cannabis Restoration Grant Program<\/a>\u00a0aimed at helping small marijuana cultivators with environmental clean-up and restoration efforts.<\/p>\n<div>\n<p>In further efforts to shrink the illicit market, last year the state adopted a law <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-marijuana-tax-relief-bill-aimed-at-combating-illicit-market\/\" target=\"_blank\" rel=\"noopener\">eliminating the state\u2019s cannabis cultivation tax<\/a>.<\/p>\n<p>Meanwhile, California is making moves to <a href=\"https:\/\/www.marijuanamoment.net\/california-officials-take-key-step-toward-interstate-marijuana-commerce-requesting-legal-opinion-on-federal-risk\/\" target=\"_blank\" rel=\"noopener\">expand its marijuana market beyond the state\u2019s borders<\/a>, with regulators recently seeking a formal opinion from the state attorney general\u2019s office on whether allowing interstate marijuana commerce would put the state at \u201csignificant risk\u201d of federal enforcement action.<\/p>\n<p>The request for guidance from DCC is a key step that could eventually\u00a0trigger a law that the governor signed\u00a0last year, empowering him to <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-10-marijuana-bills-including-interstate-commerce-employment-protections-and-record-sealing\/\" target=\"_blank\" rel=\"noopener\">enter into agreements with other legal states to import and export marijuana<\/a> products.<\/p>\n<p>Gov.
