{"id":67108,"date":"2023-07-26T12:35:47","date_gmt":"2023-07-26T20:35:47","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/26\/house-approves-veterans-medical-marijuana-access-and-psychedelics-research-amendments-as-part-of-spending-bill\/"},"modified":"2023-07-26T19:46:09","modified_gmt":"2023-07-27T03:46:09","slug":"house-approves-veterans-medical-marijuana-access-and-psychedelics-research-amendments-as-part-of-spending-bill","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/26\/house-approves-veterans-medical-marijuana-access-and-psychedelics-research-amendments-as-part-of-spending-bill\/","title":{"rendered":"House Approves Veterans Medical Marijuana Access And Psychedelics Research Amendments As Part Of Spending Bill"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/MM_Bill_Tracker_V5_blank-37.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>The U.S. House of Representatives has approved amendments to a large-scale spending bill that would allow U.S. Department of Veterans Affairs (VA) doctors to recommend medical cannabis to military veterans and promote research into substances like psilocybin and MDMA.<\/p>\n<p>Just one day after the House Rules Committee <a href=\"https:\/\/www.marijuanamoment.net\/key-house-committee-clears-marijuana-and-psychedelics-amendments-for-floor-votes-while-blocking-others\/\" target=\"_blank\" rel=\"noopener\">made the measures in order for floor consideration<\/a>, they passed on the floor on Wednesday and are advancing as part of appropriations legislation covering Military Construction, Veterans Affairs and Related Agencies (MilCon\/VA).<\/p>\n<p>The medical cannabis measure, which was filed by the co-chairs of the Congressional Cannabis Caucus\u2014Reps. Brian Mast (R-FL), Earl Blumenauer (D-OR), Dave Joyce (R-OH) and Barbara Lee (D-CA)\u2014passed in a voice vote.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Medical marijuana is legal in Florida, but veterans in Florida \u2013 or other states where it\u2019s legal \u2013 are not afforded the same access in the VA.<\/p>\n<p>Today, I offered an amendment to allow VA physicians to discuss cannabis as an option in states where it is legal. <a href=\"https:\/\/t.co\/hJQv945vem\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/hJQv945vem<\/a><\/p>\n<p>\u2014 Rep. Brian Mast (@RepBrianMast) <a href=\"https:\/\/twitter.com\/RepBrianMast\/status\/1684337549341253632?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 26, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Their amendment, which was later cosponsored by Reps. Jim McGovern (D-MA) and Matt Gaetz (R-FL), would specifically prohibit the use of VA funds to enforce provisions of an existing directive that bars doctors from making medical cannabis recommendations to veterans.<\/p>\n<p>Veterans face a \u201cDepartment of Veterans Affairs that does not allow their primary care physicians, their post-deployment clinics, to discuss the medical treatment options,and work with them through the paperwork for those medical treatment options that are actually available in their states,\u201d Mast said. \u201cIf they\u2019re not working with their doctors to do that, then you have to ask yourself who is it that they would be working with to do that for medical treatment.\u201d<b><br \/>\n<\/b><\/p>\n<p>Blumenauer said that \u201cveterans in Oregon and across the country have shared powerful stories with me about how medical cannabis has saved their lives and given relief from wounds of war seen and unseen.\u201d<\/p>\n<div style=\"max-width: 1024px\">\n<div style=\"width: 100%;height: 0;padding-bottom: 56.25%;padding-top: 60px\" \/>\n<\/div>\n<p>\u201cThese veterans have also shared their fear about what happened if they work with the VA doctors to incorporate their cannabis use into their treatment plans. The VA denies veterans access to this care option by preventing providers from completing forms in compliance with state medical marijuana programs,\u201d he said. \u201cThis is a shameful disservice to the men and women who put their lives on the line. The VA is forcing veterans to seek care outside the VA or self medicate. Our veterans are paying the price for Congress\u2019s failure to act.\u201d<\/p>\n<p>Joyce also spoke in favor of the amendment, saying he\u2019s \u201cproud to join my colleagues in leading this common sense effort to help our country\u2019s veterans access medical treatment.\u201d<\/p>\n<p>\u201cI\u2019ve seen firsthand the many challenges our nation\u2019s heroes face when they return home,\u201d he said. \u201cWe should all be resolved to help expand access to treatments for the medical challenges, both mental and physical, our nation\u2019s veterans experience.\u201d<\/p>\n<p>The measure passed despite Rep. Debbie Wasserman Schultz (D-FL), a former chair of the Democratic National Committee, joining Rep. John Carter (R-TX) in voicing opposition to it on practical grounds, arguing that it could put VA doctors in legal jeopardy if they actually fill out forms to recommend medical cannabis to veterans.<\/p>\n<p>Despite their opposition, no one requested that a recorded vote be taken to challenge the measure\u2019s passage via voice vote.<\/p>\n<p>The provisions of the amendment were revised ahead of the Rules Committee meeting on Tuesday. It previously shared the same language as <a href=\"https:\/\/www.marijuanamoment.net\/va-doctors-could-recommend-medical-marijuana-to-veterans-in-legal-states-under-bill-approved-by-senate-committee\/\" target=\"_blank\" rel=\"noopener\">an amendment that was approved by the Senate Appropriations Committee<\/a> last month for that chamber\u2019s version of the spending legislation. If the House proposal hadn\u2019t been changed, that likely would have increased its chances of being adopted into law as part of the final conference report\u2014but now there will have to be bipartisan and bicameral discussion about which, if any, version will be enacted.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">If medical cannabis is legal in your state, why wouldn\u2019t you be able to talk to your doctor about it? In 2016, the House and Senate both adopted different versions of the reform in their spending bills\u2014but <a href=\"https:\/\/web.archive.org\/web\/20160811220436\/http:\/\/www.marijuana.com\/blog\/news\/2016\/06\/congress-blocks-medical-marijuana-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">neither<\/a> made it into the final conference report following negotiations.<\/p>\n<p>Meanwhile, the House also adopted, by a voice vote, an amendment from Reps. Lou Correa (D-CA) and Jack Bergman (R-MI) that would encourage research into the therapeutic potential of certain psychedelics.<\/p>\n<p>\u201cIf psychedelic-assisted therapy can treat a veterans PTSD or prevent them from taking their own life, then we owe it to them to take an active role in researching these potentially life saving therapies,\u201d Bergman said on the floor. \u201cThis amendment will unlock potential treatments that have been shown to actually cure PTSD\u2014something current medicine and modern psychology have been unable to do\u2014and give our veterans a chance to live a long, happy life that we all take for granted.\u201d<\/p>\n<div style=\"max-width: 1024px\">\n<div style=\"width: 100%;height: 0;padding-bottom: 56.25%;padding-top: 60px\" \/>\n<\/div>\n<p>No members rose to speak against the measure; instead, Correa used the allotted \u201copposition\u201d time to speak in support of the proposal.<\/p>\n<p>\u201cLet\u2019s take care of business. Let\u2019s make sure the VA takes these studies, bring back data so that we can create a program that takes care of our veterans,\u201d the congressman said. \u201cVeterans have fought for our freedom. It\u2019s time that we continue and step up to fulfill our moral obligation to take care of them as well.\u201d<\/p>\n<p>The lawmakers, who are also the founding co-chairs of a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-relaunch-psychedelics-caucus-to-promote-studies-on-therapeutic-use\/\" target=\"_blank\" rel=\"noopener\">congressional psychedelics caucus that promotes research into entheogenic substances,<\/a> also <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-congressional-lawmakers-promote-psychedelics-research-amendment-to-spending-bill-ahead-of-key-committee-meeting\/\" target=\"_blank\" rel=\"noopener\">promoted the measure on Monday<\/a> ahead of the Rules Committee meeting.<\/p>\n<p>The text of the Bergman-Correa legislation does not specifically mention psychedelics and simply simultaneously increases and decreases funding in an unrelated part of the bill, a common tactic in appropriations legislation by members who want to send a message to federal agencies about key priorities without actually altering legislative text.<\/p>\n<p>The\u00a0<a href=\"https:\/\/rules.house.gov\/bill\/118\/hr-4366\" target=\"_blank\" rel=\"noopener\">summary<\/a>\u00a0of the proposal posted by the Rules Committee says it \u201cincreases and decreases the Medical and Prosthetic Research account at the Department of Veterans Affairs to ensure the VA conducts large-scale studies into the efficacy of drugs that have FDA-designated Breakthrough Therapy status to treat post-traumatic stress disorder through VA-administered drug assisted therapy trials.\u201d<\/p>\n<p>Meanwhile, a <a href=\"https:\/\/www.marijuanamoment.net\/congressional-committee-calls-for-increased-enforcement-against-non-compliant-cbd-products\/\" target=\"_blank\" rel=\"noopener\">report attached to the spending legislation<\/a> by the House Appropriations Committee also includes a section noting that \u201cVA has clarified that nothing in VA statutes or regulations specifically prohibits a veteran whose income is derived from state-legalized cannabis activities from obtaining a certificate of eligibility for VA home loan benefits.\u201d<\/p>\n<p>Wednesday\u2019s vote to approve the amendments represents one of the first examples of progress on cannabis and psychedelics reform in the GOP-controlled House. Brian Schatz (D-HI), would allow veterans to use medical cannabis in states and territories where its legal, mirroring\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-file-congressional-bill-to-legalize-medical-marijuana-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">a standalone bill that the senator introduced<\/a>\u00a0in April.<\/p>\n<p>It would additionally protect doctors who discuss and fill out paperwork to recommend medical marijuana for veterans.
