{"id":67105,"date":"2023-07-26T14:08:52","date_gmt":"2023-07-26T22:08:52","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/26\/seattle-marijuana-industry-workers-get-union-like-job-retention-protections-under-new-local-law\/"},"modified":"2023-07-26T19:46:02","modified_gmt":"2023-07-27T03:46:02","slug":"seattle-marijuana-industry-workers-get-union-like-job-retention-protections-under-new-local-law","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/26\/seattle-marijuana-industry-workers-get-union-like-job-retention-protections-under-new-local-law\/","title":{"rendered":"Seattle Marijuana Industry Workers Get Union-Like Job Retention Protections Under New Local Law"},"content":{"rendered":"<\/p>\n<p><em>\u201cThe Cannabis Employee Job Retention Ordinance provides protections for workers in this industry that will help provide a stable workplace, stronger workforce, and contribute to a better overall economy for Seattle.\u201d<\/em><\/p>\n<p><strong>By Timothy Schuman, The Center Square<\/strong><\/p>\n<p>Nearly a year after being proposed by Seattle Mayor Bruce Harnell, Seattle\u2019s newest cannabis-related law went into effect last week.<\/p>\n<p>Brought into existence by Mayor Harrell and Councilmember Teresa Mosqueda (D), who sponsored the bill in Council, the new law was pitched to the public as part of a <a href=\"http:\/\/seattle.legistar.com\/LegislationDetail.aspx?ID=5751072&amp;GUID=456570A1-D942-451D-AA7C-370C8427990C&amp;Options=ID|Text|&amp;Search=cannabis\" target=\"_blank\" rel=\"noopener\">suite<\/a> of \u201clegislation to improve equity in the cannabis industry.\u201d<\/p>\n<p>\u201cThe Cannabis Employee Job Retention Ordinance provides protections for workers in this industry that will help provide a stable workplace, stronger workforce, and contribute to a better overall economy for Seattle,\u201d said Office of Labor Standards Director Steven Marchese in a <a href=\"https:\/\/news.seattle.gov\/2023\/07\/19\/office-of-labor-standards-announces-seattles-cannabis-employee-job-retention-ordinance-effective-july-19-2023\/\" target=\"_blank\" rel=\"noopener\">news release<\/a> accompanying the announcement.<\/p>\n<p>The final rules and time periods for the legislation were decided earlier this month.<\/p>\n<p>The legislation added Chapter 8.38 to the Seattle Municipal Code titled \u201cCannabis Employee Job Retention.\u201d The law is meant to protect employees in the cannabis industry if their employer sells the business or the license changes hands.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/OLS_SEA?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@OLS_SEA<\/a> announces the City of Seattle\u2019s Cannabis Employee Job Retention (CEJR) Ordinance is effective Wednesday, July 19, 2023. Requirements include covered outgoing cannabis business employers to post written notice of a change in control.<a href=\"https:\/\/t.co\/uznhmm54Ea\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/uznhmm54Ea<\/a> <a href=\"https:\/\/t.co\/h7r2ZBUGQZ\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/h7r2ZBUGQZ<\/a><\/p>\n<p>\u2014 Seattle Office of Labor Standards (@OLS_SEA) <a href=\"https:\/\/twitter.com\/OLS_SEA\/status\/1681690654588674050?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 19, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>According to the <a href=\"https:\/\/www.seattle.gov\/documents\/Departments\/LaborStandards\/SMC%208.38.pdf\" target=\"_blank\" rel=\"noopener\">text<\/a> of the legislation, it establishes a \u201cpreferential hiring list\u201d based on the concept of \u201cseniority,\u201d which aims to provide a backstop for rank-and-file employees in the event of a management shake-up.<\/p>\n<p>The law states that employers \u201cmust hire by seniority within each job classification to the extent that comparable job classifications exist,\u201d and this prohibition on hiring outside of this preferential industry list lasts a full 180 days after any management change.<\/p>\n<p>This means anyone who works for any licensed dispensary in any capacity is extended these protections.<\/p>\n<p>The concept of seniority is more nebulous.<\/p>\n<p>According to the law, seniority is \u201cdetermined by the employee\u2019s seniority within their most recent job classification.\u201d<\/p>\n<p>It does not, however, lay out any guidance for what that job classification is based on.<\/p>\n<p>The fallback is a union-like determination \u201cby the employee\u2019s date of hire,\u201d which is required to be provided by the outgoing employer prior to any management or ownership change.<\/p>\n<p>Industry employees also gain another backstop from this new code.<\/p>\n<p>If they accept an offer, an offer that will likely be extended as employers are prohibited from hiring anywhere outside the preferential list, the employer \u201cmust retain the employee for no less than 90 days.\u201d<\/p>\n<p>The law does list an exception for \u2018just cause\u2019 firings.<\/p>\n<p>\u201cThe Cannabis Employee Job Retention Ordinance is a monumental step toward protecting the rights of cannabis industry employees,\u201d said Cody Funderburk in a statement.
