{"id":66942,"date":"2023-07-18T09:40:08","date_gmt":"2023-07-18T17:40:08","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/18\/justice-department-extends-public-comments-period-on-marijuana-pardon-certificate-application\/"},"modified":"2023-07-19T19:47:23","modified_gmt":"2023-07-20T03:47:23","slug":"justice-department-extends-public-comments-period-on-marijuana-pardon-certificate-application","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/18\/justice-department-extends-public-comments-period-on-marijuana-pardon-certificate-application\/","title":{"rendered":"Justice Department Extends Public Comments Period On Marijuana Pardon Certificate Application"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/MM_Bill_Tracker_V5_blank-35.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>The Justice Department extending a public comment period concerning its marijuana pardon certification process that was established under a directive from the president last year.<\/p>\n<p>In a notice published in the Federal Register on Tuesday, DOJ\u2019s Office of the Pardon Attorney said the comment window will now be open until August 15 as it requests authorization from the White House Office of Management and Budget (OMB) to process applications for cannabis pardon certificates for an additional three years, rather than continue to request approval on a month-to-month basis.<\/p>\n<p>The department <a href=\"https:\/\/www.marijuanamoment.net\/justice-department-launches-marijuana-pardon-certificate-application\/\" target=\"_blank\" rel=\"noopener\">launched an online portal for people to submit their request<\/a> for the formal acknowledgment of their presidential pardon in March. People who\u2019ve committed federal cannabis possession offenses, or violated the law in Washington, D.C., are eligible for the relief.<\/p>\n<p>President Joe Biden issued the pardon directive, while also initiating an administrative review into the federal scheduling of marijuana, late last year. The pardons were processed automatically, but DOJ is also providing certifications for those who want tangible proof of the forgiveness.<\/p>\n<p>\u201cWritten comments and suggestions from the public and affected agencies concerning the proposed collection of information are encouraged,\u201d the new notice says.<\/p>\n<p>The department is specifically interested in feedback that addresses whether collecting the additional information under the extended timeline \u201cis necessary for the proper performance of the functions of the agency, including whether the information will have practical utility.\u201d<\/p>\n<p>It\u2019s also interested in receiving comments on \u201cthe accuracy of the agency\u2019s estimate of the burden of the proposed collection of information, including the validity of the methodology and assumptions used.\u201d<\/p>\n<p>\u201cDOJ seeks [Paperwork Reduction Act] authorization for this information collection for three (3) years,\u201d it says. \u201cOMB authorization for an [information collection request] cannot be for more than three (3) years without renewal. The DOJ notes that information collection requirements submitted to the OMB for existing ICRs receive a month-to-month extension while they undergo review.\u201d<\/p>\n<p>The department said that the purpose of the information collection \u201cis to gather information necessary to enable the Office of the Pardon Attorney, U.S. Department of Justice to expeditiously administer the provisions of the Executive Order 10467, a proclamation granting pardons to individuals charged or convicted of simple possession of marijuana.\u201d<\/p>\n<p>\u201cThe collection will enable individuals to apply for certificates of pardon, restoring political, civil, and other rights by implementing a process to provide certificates of pardon as provided by the order,\u201d DOJ said.<\/p>\n<p>Overall, it <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/07\/18\/2023-15111\/agency-information-collection-activities-proposed-ecollection-ecomments-requested-application-for\" target=\"_blank\" rel=\"noopener\">estimates<\/a> that approximately 20,000 people will complete the required forms to apply for the pardon certificates.<\/p>\n<p>Comments can be submitted to Deputy Pardon Attorney Kira Gillespie at kira.gillespie@usdoj.gov.<\/p>\n<p>Pardon Attorney Elizabeth Oyer said in December that the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/doj-official-details-plans-to-provide-presidential-marijuana-pardon-certificates-through-10-minute-application-process\/\" target=\"_blank\" rel=\"noopener\">online application would be posted \u201cvery soon,\u201d<\/a> but activists have expressed frustration about the delay in the pardon certification rollout, which was ultimately launched in March.<\/p>\n<p>Biden\u2019s pardon proclamation was fairly limited in scope, as it did not free anyone who is currently incarcerated and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/who-is-left-behind-by-bidens-marijuana-pardon-immigrants-military-members-and-more\/\" target=\"_blank\" rel=\"noopener\">excludes people who were convicted of selling cannabis<\/a>, among other groups that advocates would like to see get relief.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/MM_Bill_Tracker_V5_blank-34.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Meanwhile, DOJ and the U.S. Department of Health and Human Services (HHS) are in the process of fulfilling the other part of the president\u2019s cannabis directive, reviewing the scheduling status of marijuana under the Controlled Substances Act (CSA). The president <a href=\"https:\/\/www.marijuanamoment.net\/biden-promotes-marijuana-pardons-and-scheduling-review-in-juneteenth-proclamation\/\" target=\"_blank\" rel=\"noopener\">has routinely touted both moves<\/a> as consistent with the administration\u2019s efforts to promote social equity.<\/p>\n<p>HHS Secretary Xavier Becerra told Marijuana Moment last month that <a href=\"https:\/\/www.marijuanamoment.net\/feds-aim-to-finish-cannabis-scheduling-review-this-year-top-biden-official-tells-marijuana-moment\/\" target=\"_blank\" rel=\"noopener\">he\u2019s hoping to deliver on the president\u2019s scheduling directive<\/a> by the year\u2019s end. And congressional marijuana reform leaders <a href=\"https:\/\/www.marijuanamoment.net\/congressional-cannabis-caucus-leaders-react-to-marijuana-scheduling-update-from-top-biden-official\/\" target=\"_blank\" rel=\"noopener\">said that they are encouraged by that timetable<\/a>.<\/p>\n<p>\u201cI will be disappointed if we cannot make significant progress within the year,\u201d Rep. Earl Blumenauer (D-OR), co-chair of the Congressional Cannabis Caucus, told Marijuana Moment. \u201cThere should be a greater sense of urgency for this long overdue action.\u201d<\/p>\n<p>Blumenauer also led a letter to Becerra and Attorney General Merrick Garland in March, alongside 15 other bipartisan members of Congress,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/more-than-a-dozen-congressional-lawmakers-demand-transparency-in-marijuana-scheduling-review-by-biden-administration\/\" target=\"_blank\" rel=\"noopener\">demanding transparency in the cannabis scheduling review<\/a>.<\/p>\n<p>Rep. Barbara Lee, another co-chair of the caucus, said last month that the Biden administration needs to <a href=\"https:\/\/www.marijuanamoment.net\/congresswoman-urges-biden-to-act-on-marijuana-now-as-negotiations-continue-on-banking-bill\/\" target=\"_blank\" rel=\"noopener\">take action on federal cannabis scheduling \u201cnow,\u201d<\/a>\u00a0before the upcoming election.<\/p>\n<p>Once HHS finalizes its review, it will send a scheduling recommendation to the Drug Enforcement Administration (DEA),\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-federal-health-official-tells-lawmakers-marijuana-scheduling-review-is-ongoing-but-dea-makes-final-call\/\" target=\"_blank\" rel=\"noopener\">which makes the final call<\/a>.
