{"id":66912,"date":"2023-07-19T09:17:00","date_gmt":"2023-07-19T17:17:00","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/19\/new-york-regulators-vote-to-allow-marijuana-farmers-markets-while-nearly-doubling-the-number-of-provisional-retailer-licenses\/"},"modified":"2023-07-19T19:46:35","modified_gmt":"2023-07-20T03:46:35","slug":"new-york-regulators-vote-to-allow-marijuana-farmers-markets-while-nearly-doubling-the-number-of-provisional-retailer-licenses","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/19\/new-york-regulators-vote-to-allow-marijuana-farmers-markets-while-nearly-doubling-the-number-of-provisional-retailer-licenses\/","title":{"rendered":"New York Regulators Vote To Allow Marijuana Farmers Markets, While Nearly Doubling The Number Of Provisional Retailer Licenses"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/2705-1.png\" width=\"72\" height=\"72\"> <\/p>\n<p>New York marijuana regulators have approved a resolution to authorize cannabis farmers markets where growers could sell their supplies while helping to meet consumer demand as the state works to open additional retail dispensaries.<\/p>\n<p>The state Cannabis Control Board (CCB) passed the measure on Wednesday, along with separate resolutions focused on nearly doubling the number of approved conditional retailer licenses, enacting regulations for marijuana research, banning the sale of synthetic cannabinoids like delta-8 THC and other issues.<\/p>\n<p>The authorization of the cannabis farmers markets\u2014which regulators are calling the \u201cCannabis Grower\u2019s Showcase\u201d\u2014comes about two months after an Office of Cannabis Management (OCM) official first disclosed <a href=\"https:\/\/www.marijuanamoment.net\/new-york-regulators-plan-to-launch-marijuana-farmers-markets-within-a-month-to-help-meet-demand\/\" target=\"_blank\" rel=\"noopener\">plans to provide the alternative sales model<\/a>.<\/p>\n<p>Under the resolution, the board is says it wants adult-use cannabis cultivator and processor licensees to \u201cbring their product to market and allow [conditional retail] licensees to sell such products simultaneously.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: <a href=\"https:\/\/twitter.com\/hashtag\/NYCCB?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYCCB<\/a> approved the Cannabis Growers Showcase allowing licensees to partner on events to showcase &amp; sell AU <a href=\"https:\/\/twitter.com\/hashtag\/NYcannabis?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYcannabis<\/a> products.<\/p>\n<p>The CGS will:<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/2705.png\" alt=\"&#x2705;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/> Expand access to safer products<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/1faf1-1f3fd-200d-1faf2-1f3ff.png\" alt=\"&#x1FAF1;&#x1F3FD;&#x200D;&#x1FAF2;&#x1F3FF;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/> Enable consumers to connect w. licensees<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/2699.png\" alt=\"&#x2699;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/> Protect the two-tier market<\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1681686537858166790?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 19, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The plan for the showcases is to have \u201ca minimum of three growers\u201d and at least one licensed retailer hosting farmers market-style events in municipalities that authorize them.<\/p>\n<p>At least initially, on-site consumption will be prohibited because permitting people to use marijuana at the markets would require additional permitting from the state Department of Public Health. Also, organizers will have to ensure that alcohol isn\u2019t also sold at the events.<\/p>\n<p>Theoretically, farmers could seek municipal approval and hold the farmers markets on their own property. Or they could seek to join other events like concerts, fairs and festivals that are being separately organized.<\/p>\n<p>The rules for the farmers market program aren\u2019t available yet, however. The <a href=\"https:\/\/cannabis.ny.gov\/system\/files\/documents\/2023\/07\/ccb-resolution-cgs-approval-7-19-23.pdf\" target=\"_blank\" rel=\"noopener\">resolution<\/a> simply authorizes OCM to issue an application for licensees to complete if they want to participate.<\/p>\n<p>\u201cThe showcases will offer several benefits, including providing our consumers access to legal regulated cannabis in places which have limited or don\u2019t yet currently have access to storefront sales,\u201d OCM Director of Policy John Kagia said. \u201cThey\u2019ll drive new revenue opportunities for our cultivators who are the anchors of our supply chain\u2014and we\u2019ve certainly heard from our cultivators [about] the urgency of a program like this to expand the retail sales.\u201d<\/p>\n<p>Meanwhile, the board also <a href=\"https:\/\/cannabis.ny.gov\/ccb-resolution-resolution-issuing-certain-conditional-adult-use-retail-dispensary-licenses-7-19\" target=\"_blank\" rel=\"noopener\">approved<\/a> an additional 212 provisional retailer licenses\u2014the largest single batch of approvals to date. This brings the states total to 463 licensees that are gearing up to serve the adult market. It\u2019s expected to take six months to a year for the shops to open.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: The CAURD program is expanding. An additional 212 provisional licensees have been approved by the <a href=\"https:\/\/twitter.com\/hashtag\/NYCCB?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYCCB<\/a>, making this the biggest cohort to date.<\/p>\n<p>The program now expands to 463 licenses as the State continues to work to build an equitable framework for <a href=\"https:\/\/twitter.com\/hashtag\/NYcannabis?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYcannabis<\/a>.<\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1681677633023516672?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 19, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The <a href=\"https:\/\/cannabis.ny.gov\/cannabis-control-board-meetings\" target=\"_blank\" rel=\"noopener\">actions<\/a> taken by the board on Wednesday \u201cwill help to close a number of gaps and to improve the operations of our cannabis supply chain,\u201d CCB Chair Tremaine Wright said. \u201cWe continue to revise, edit, develop and refine in an effort to make the current program as robust as possible.\u201d<\/p>\n<p>There are currently only 20 adult-use retailers operating in the state amid what many observers see as a troubled rollout that has seen delays in financing and opening storefronts that are supposed to be provided to equity retailers by the state.<\/p>\n<p>Regulators also approved resolutions affecting the state\u2019s medical cannabis and hemp programs. That includes the adoption of an emergency <a href=\"https:\/\/cannabis.ny.gov\/ccb-resolution-resolution-directing-office-cannabis-management-file-notice-emergency-adoption-and\" target=\"_blank\" rel=\"noopener\">measure<\/a> to prohibit the sale of synthetically produced hemp cannabinoid products like delta-8 THC and establish a minimum 15:1 CBD:THC limit for hemp items.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/NYCCB?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYCCB<\/a> approves several regulations for hemp products to further protect the health and safety of New Yorkers, including establishing a minimum allowable CBD:THC ratio of 15:1, THC limitations, packaging &amp; sale prohibitions to minors, and updating lab testing requirements.<\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1681685095424376837?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 19, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>CCB also passed a <a href=\"https:\/\/cannabis.ny.gov\/ccb-resolution-resolution-directing-office-cannabis-management-file-certain-revised-medical\" target=\"_blank\" rel=\"noopener\">measure<\/a> to revise medical cannabis regulations to require that the terpene content of marijuana products are included on labels. And it separately approved a <a href=\"https:\/\/cannabis.ny.gov\/ccb-resolution-resolution-issuing-certain-cannabis-laboratory-permit\" target=\"_blank\" rel=\"noopener\">resolution<\/a> to authorize Coral Reef Labs to be one of the state\u2019s independent cannabis testing lab.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/NYCCB?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYCCB<\/a> approves several medical cannabis regulatory amendments which include, but are not limited to  requiring terpene content to be reported on lab testing.<\/p>\n<p>Terpenes may play a therapeutic role, therefore disclosing this info is important to many medical <a href=\"https:\/\/twitter.com\/hashtag\/NYcannabis?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#NYcannabis<\/a> patients.<\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1681682604460834817?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 19, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Meanwhile, New York City officials announced on Tuesday that they\u2019re <a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-seeks-private-lenders-for-new-marijuana-fund-to-promote-industry-equity\/\" target=\"_blank\" rel=\"noopener\">seeking lenders to support a marijuana equity fund<\/a> that will promote participation in the industry by people who\u2019ve been disproportionately impacted by criminalization.<\/p>\n<p>Gov. Kathy Hochul\u2019s (D) administration is also stepping up its push to transition people to the legal market, despite the bottlenecking of getting approved retailer licensees launched so far.<\/p>\n<p>That included\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-launches-marijuana-campaign-urging-people-to-buy-legal-at-states-few-licensed-retailers-ahead-of-4-20\/\" target=\"_blank\" rel=\"noopener\">launching a public education campaign in April<\/a>\u00a0encouraging adults to buy their marijuana from licensed shops to ensure that products are safe and that revenue is used to advance equity and reinvestment goals.<\/p>\n<p>The New York Senate has also formed a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senate-unveils-new-marijuana-committee-on-4-20\/\" target=\"_blank\" rel=\"noopener\">committee focused exclusively on marijuana<\/a>\u00a0that will be collaborating with regulators as the state\u2019s cannabis market evolves.<\/p>\n<p>Officials did announce in March that they are doubling the number of\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-officials-award-first-marijuana-dispensary-licenses-to-people-harmed-by-drug-war\/\" target=\"_blank\" rel=\"noopener\">conditional adult-use marijuana licenses that can be approved<\/a>, from 150 to 300, after receiving feedback from certain applicants that they would be able to more expeditiously open storefronts without additional support through a state program designed to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-approves-firms-to-build-first-social-equity-marijuana-dispensary-storefronts-days-before-key-regulators-meeting\/\" target=\"_blank\" rel=\"noopener\">help eligible entities create physical locations<\/a>.<\/p>\n<p>The governor also recently introduced legislation to increase enforcement authority to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-proposes-bill-to-increase-enforcement-against-illicit-marijuana-operators-as-state-works-license-retailers\/\" target=\"_blank\" rel=\"noopener\">crack down on illicit marijuana retailers<\/a>\u00a0as the state struggles to stand up the regulated adult-use market.<\/p>\n<p>In December, Hochul separately unveiled a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-unveils-marijuana-store-qr-code-verification-tool-and-universal-label-for-cannabis-products\/\" target=\"_blank\" rel=\"noopener\">marijuana business and product verification tool<\/a>, with plans to post a QR code on licensed cannabis retailers and a universal symbol label for authorized cannabis products.<\/p>\n<p>She also signed a bill in late November\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-signs-bill-encouraging-businesses-to-use-hemp-for-construction-packaging-and-other-purposes\/\" target=\"_blank\" rel=\"noopener\">aimed at expanding the state\u2019s hemp market<\/a>\u00a0by promoting collaborative partnerships to identify more opportunities to utilize the crop and its derivatives for packaging, construction and other purposes.<\/p>\n<p>The New York Senate also approved a bill last month that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senate-passes-bill-to-let-marijuana-businesses-in-new-york-city-take-local-tax-deductions-prohibited-under-federal-law\/\" target=\"_blank\" rel=\"noopener\">provide tax relief to New York City marijuana businesses<\/a>\u00a0that are currently blocked from making federal deductions under an Internal Revenue Service (IRS) code known as 280E.<\/p>\n<p>While Hochul signed a budget bill last year that included provisions\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-send-budget-with-marijuana-business-tax-breaks-to-governor-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\">allow state-level cannabis business tax deductions<\/a>\u2014a partial remedy to the ongoing federal issue\u2014New York City has its own tax laws that weren\u2019t affected by that
