{"id":66510,"date":"2023-07-04T12:02:19","date_gmt":"2023-07-04T20:02:19","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/04\/california-courts-have-sealed-90-percent-of-eligible-marijuana-cases-state-attorney-generals-report-shows\/"},"modified":"2023-07-05T19:47:50","modified_gmt":"2023-07-06T03:47:50","slug":"california-courts-have-sealed-90-percent-of-eligible-marijuana-cases-state-attorney-generals-report-shows","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/07\/04\/california-courts-have-sealed-90-percent-of-eligible-marijuana-cases-state-attorney-generals-report-shows\/","title":{"rendered":"California Courts Have Sealed 90 Percent Of Eligible Marijuana Cases, State Attorney General\u2019s Report Shows"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/07\/MM_Bill_Tracker_V5_blank-10.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>California courts have sealed, resentenced or dismissed about 90 percent of eligible marijuana convictions for activity that was legalized under a 2016 voter-approved initiative, a new report from the state attorney general\u2019s office shows.<\/p>\n<p>As of April 6, the state\u2019s judicial system has processed relief for 206,052 of out an estimated 227,650 cannabis cases that were identified as eligible following the passage of records reform legislation that the governor signed in 2018.<\/p>\n<p>The new report, released last month by Attorney General Rob Bonta\u2019s (D) office, shows that most counties across the state have made significant progress since being given the directive.<\/p>\n<p>When voters approved Proposition 64 in 2016, it legalized marijuana possession, cultivation and sales, while providing an option for people with prior cannabis convictions to petition the courts for relief. Two years later, Gov. Gavin Newsom (D) signed AB 1793, which created a process to automate clemency.<\/p>\n<p>Then, <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-10-marijuana-bills-including-interstate-commerce-employment-protections-and-record-sealing\/\" target=\"_blank\" rel=\"noopener\">the governor signed separate legislation, AB 1706, last year<\/a> that built upon the state\u2019s record sealing law by giving courts\u00a0 until March 1, 2023 to seal records for qualifying marijuana cases that weren\u2019t challenged by July 1, 2020. The bill, which was sponsored by the attorney general\u2019s wife, who serves in the state Assembly, also required the California Department of Justice to work with the Judicial Council of California to produce quarterly joint progress reports to the legislature.<\/p>\n<p>This is the second <a href=\"https:\/\/oag.ca.gov\/system\/files\/media\/ab1706-legreport-06012023.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a> to that end. The first <a href=\"https:\/\/oag.ca.gov\/system\/files\/media\/AB-1706-Legislative-Report.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a> showed that, as of January 2023, courts had either resentenced or dismissed 197,205 marijuana cases.<\/p>\n<p>\u201cSome counties aren\u2019t making much progress, notably Alameda, Amador, Marin and Trinity,\u201d California NORML <a href=\"https:\/\/www.canorml.org\/clearing-of-past-marijuana-crimes-moves-forward-across-california\/\" target=\"_blank\" rel=\"noopener\">said<\/a> in a blog post on Wednesday. \u201cMarked progress was seen in El Dorado, Humboldt, Kern, Madera, Napa, Riverside, Sacramento and Sutter counties, with small gains in other counties.
