Scott Wiener (D) was approved on the floor in a vote of 21-16 on Wednesday and now heads to the Assembly for consideration.<\/p>\n<p>The measure, which is a more narrowly tailored version of a bill that Wiener led last session that <a href=\"https:\/\/www.marijuanamoment.net\/california-senators-last-minute-deal-to-remove-lsd-couldnt-save-psychedelics-bill-but-he-sees-a-path-forward\/\" target=\"_blank\" rel=\"noopener\">passed the Senate but was later abandoned in the Assembly<\/a> after members watered it down significantly,\u00a0has advanced under an accelerated process that <a href=\"https:\/\/www.marijuanamoment.net\/california-bill-to-legalize-psychedelics-possession-and-facilitated-use-advances-to-senate-floor-after-skipping-committees\/\" target=\"_blank\" rel=\"noopener\">allowed it to skip some committee consideration<\/a> this year. It cleared the Appropriations Committee without a hearing earlier this month and was <a href=\"https:\/\/www.marijuanamoment.net\/california-senators-approve-psychedelics-legalization-bill-in-committee\/\" target=\"_blank\" rel=\"noopener\">previously approved by the Public Safety Committee<\/a> in March.<\/p>\n<p>SB 58 would legalize the \u201cpossession, preparation, obtaining, transfer, as specified, or transportation of\u201d specific amounts of psilocybin, psilocyn, DMT, ibogaine and mescaline for personal or facilitated use. Notably, \u201csynthetic\u201d psychedelics like LSD and MDMA would not be legalized, unlike the provisions of the previous version of Wiener\u2019s legislation.<\/p>\n<p>Beside personal possession being legalized, the bill would also specifically provide for \u201cgroup counseling and community-based healing\u201d involving the entheogenic substances.<\/p>\n<p>\u201cThis is a tremendously hopeful step for veterans and all those who wish to benefit from psychedelics to heal from PTSD, anxiety, and depression, or simply to improve their well-being,\u201d Wiener said in a press release on Wednesday. \u201cWe came extremely close to decriminalizing these promising treatments in the last legislative session, and after deep engagement with stakeholders, we made changes to limit our proposal to naturally occurring substances and retain quantity limits to ensure these five naturally-occurring substances are for personal use only.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The Senate just passed our bill (SB 58) to decriminalize possession &amp; use of 5 naturally occurring psychedelics \u2014 psilocybin, psilocin, DMT, ibogaine, mescaline.<\/p>\n<p>These substances aren\u2019t addictive &amp; show promise in treating mental health \/addiction. I look forward to working with my colleagues in the Assembly to provide relief for the suffering of so many,\u201d he said.<\/p>\n<p>The bill would also repeal state law prohibiting \u201cany spores or mycelium capable of producing mushrooms or other material which contain psilocybin or psilocyn.\u201d The state ban on drug paraphernalia for the covered substances would also be eliminated under the legislation.<\/p>\n<p>In addition to having to formally clear the Appropriations Committee last session, the prior version of Wiener\u2019s bill also needed to go before two policy committees\u2014Public Safety and Health\u2014whereas this year\u2019s measure only needed to be heard in the former panel, further highlighting its expedited path to the floor this time.<\/p>\n<p>The bill contains at least two key changes from the measure that advanced last session.<\/p>\n<p>First, is excludes synthetic psychedelics like LSD and MDMA from the list of substances that would be legalized and focuses only on those that are derived from plants or fungi.<\/p>\n<p>When the prior version of the legislation was in jeopardy near the end of the 2022 session, Wiener sought to make a deal to save it by removing synthetics\u00a0in an attempt to shift law enforcement organizations\u00a0from being opposed to neutral on the bill. That move was opposed by advocates and ultimately did not produce a passable proposal.<\/p>\n<p>Peyote is also excluded from the bill\u2019s legalized substances list, which is responsive to concerns raised by some advocates and indigenous groups about the risks of over-harvesting the vulnerable cacti that\u2019s been ceremonially used.<\/p>\n<p>Under the second major change to the bill from last year\u2019s version, it no longer includes a provision mandating a study to explore future reforms. Wiener responded by shelving the legislation and holding it for 2023.<\/p>\n<p>Meanwhile, a separate\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB941\" target=\"_blank\" rel=\"noopener\">bill<\/a> from Assemblymember Marie Waldron (R) was introduced in February to legalize psychedelics-assisted therapy for military veterans.<\/p>\n<p>Specifically, it would allow licensed clinical counselors to administer controlled substances\u2014including but not limited to psilocybin, MDMA, LSD, ketamine and ibogaine\u2014to veterans for the treatment of post-traumatic stress disorder (PTSD), traumatic brain injury or addiction.<\/p>\n<p>People who receive the treatment would need to go through a minimum of 30 sessions each lasting at least 12 hours, with at least two two counselors present for each session.<\/p>\n<p>Advocates are optimistic about the prospect of Wiener\u2019s psychedelics legalization bill this round. Not only have California lawmakers had more time to consider the proposal since its original introduction, but there\u2019s significantly more momentum behind psychedelics reform this session as lawmakers in states across the country across the country work to tackle the issue.<\/p>\n<p>For example, the Colorado Gov. Jared Polis signed a bill this week to <a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-signs-psychedelics-regulation-bill-into-law\/\" target=\"_blank\" rel=\"noopener\">create a regulatory framework for legal psychedelics<\/a>\u00a0under a voter-approved initiative.<\/p>\n<p>Minnesota lawmakers recently passed an omnibus health bill that contains <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-is-forming-a-psychedelics-task-force-under-bill-lawmakers-sent-to-governors-desk\/\" target=\"_blank\" rel=\"noopener\">provisions to create a psychedelics task force<\/a>\u00a0meant to prepare the state for possible legalization.<\/p>\n<p>This month, a North Carolina House committee approved a bill to create a $5 million grant program to support research into <a href=\"https:\/\/www.marijuanamoment.net\/north-carolina-lawmakers-approve-bill-to-create-5-million-psychedelic-research-grant-fund-in-committee\/\" target=\"_blank\" rel=\"noopener\">the therapeutic potential of psilocybin and MDMA<\/a>\u00a0and to create a Breakthrough Therapies Research Advisory Board to oversee the effort.<\/p>\n<p>A Washington State bill to <a href=\"https:\/\/www.marijuanamoment.net\/washington-governor-signs-bill-to-create-psilocybin-therapy-pilot-program-along-with-partial-veto\/\" target=\"_blank\" rel=\"noopener\">promote research into psilocybin and create a pilot program<\/a> to provide therapeutic access to the psychedelic for mental health treatment was signed by the governor.<\/p>\n<p>A Nevada Senate committee approved a revised bill last month that would <a href=\"https:\/\/www.marijuanamoment.net\/nevada-senators-approve-bill-to-create-psychedelics-working-group-to-plan-for-safe-accessible-and-affordable-access\/\" target=\"_blank\" rel=\"noopener\">create a new working group to study psychedelics<\/a>\u00a0and develop a plan to allow regulated access for therapeutic purposes.<\/p>\n<p>The Hawaii Senate approved a bill last month to create an advisory council to look into possible regulations to <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-approves-bill-to-create-psychedelics-advisory-council-to-prepare-for-federal-approval\/\" target=\"_blank\" rel=\"noopener\">provide access to federal \u201cbreakthrough therapies\u201d<\/a>\u00a0like psilocybin and MDMA.<\/p>\n<p>An analysis published in an American Medical Association journal last year concluded that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/most-states-will-legalize-psychedelics-by-2037-analysis-published-by-american-medical-association-predicts\/\" target=\"_blank\" rel=\"noopener\">a majority of states will legalize psychedelics<\/a>\u00a0by 2037, based on statistical modeling of policy trends.<\/p>\n<p>A national poll published in March found that a <a href=\"https:\/\/www.marijuanamoment.net\/majority-of-americans-back-legalizing-psychedelics-therapy-and-federally-decriminalizing-substances-like-psilocybin-poll-finds\/\" target=\"_blank\" rel=\"noopener\">majority of U.S. voters support legal access to psychedelics therapy<\/a>\u00a0and back federally decriminalizing substances like psilocybin and MDMA.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"KoMea838Ep\">\n<p><a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-ohio-lawmakers-file-new-marijuana-legalization-bill-as-activists-collect-signatures-to-put-issue-on-november-ballot\/\" target=\"_blank\" rel=\"nofollow noopener\">Bipartisan Ohio Lawmakers File New Marijuana Legalization Bill As Activists Collect Signatures To Put Issue On November Ballot<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p><em>Photo elements courtesy of <a href=\"https:\/\/pixabay.com\/photos\/peyote-cactus-wild-thorns-flowers-2828665\/\" target=\"_blank\" rel=\"noopener\">carlosemmaskype<\/a> and <a href=\"https:\/\/www.flickr.com\/photos\/brindle95\/17616870559\" target=\"_blank\" rel=\"noopener\">Apollo<\/a>.<\/em><\/p>\n<p>The post <a rel=\"nofollow noopener\" href=\"https:\/\/www.marijuanamoment.net\/california-senate-passes-bill-to-legalize-psychedelics-possession-and-facilitated-use\/\" target=\"_blank\">California Senate Passes Bill To Legalize Psychedelics Possession And Facilitated Use<\/a> appeared first on <a rel=\"nofollow noopener\" href=\"https:\/\/www.marijuanamoment.net\" target=\"_blank\">Marijuana Moment<\/a>.<\/p>\n<p>&#013;<br \/>\n&#013;<br \/>\nRead More: <a href=\"https:\/\/www.marijuanamoment.net\/california-senate-passes-bill-to-legalize-psychedelics-possession-and-facilitated-use\/\" target=\"_blank\" rel=\"nofollow noopener\">California Senate Passes Bill To Legalize Psychedelics Possession And Facilitated Use<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A California bill to legalize the possession of certain psychedelics and facilitated use of the substances has passed the Senate.
