David Delloso (D) formally introduced the legislation on Tuesday.<\/p>\n<p>The bill, which is <a href=\"https:\/\/www.marijuanamoment.net\/bill-to-legalize-marijuana-through-state-run-model-introduced-in-pennsylvania\/\" target=\"_blank\" rel=\"noopener\">similar to a measure Delloso filed last session<\/a>, would allow adults 21 and older to possess, consume, cultivate and purchase cannabis through a state stores system run by the Liquor Control Board.<\/p>\n<p>\u201cIn the interest of the efficient use of law enforcement resources, enhancing revenue for public purposes and individual freedom, the people of this Commonwealth find and declare that the use of cannabis should be legal for individuals who are at least 21 years of age and should be taxed,\u201d the text states.<\/p>\n<p>Retail cannabis sales would be taxed at 19 percent, and all of that revenue would go toward the state general fund. The bill would also create a distinct regulatory scheme for industrial hemp.<\/p>\n<p>Notably, the <a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/billinfo\/BillInfo.cfm?syear=2023&amp;sind=0&amp;body=H&amp;type=B&amp;bn=1080\" target=\"_blank\" rel=\"noopener\">legislation<\/a>, which has 20 initial cosponsors, also contemplates the possibility of allowing cannabis imports from other states or countries where marijuana is legal. It would also prohibit regulators from importing marijuana that is produced somewhere that doesn\u2019t accept exports from Pennsylvania.<\/p>\n<p>Lawmakers in several states have pursued interstate marijuana commerce legislation in anticipation of a federal policy change. <a href=\"https:\/\/www.marijuanamoment.net\/oregon-governor-signs-bill-to-allow-interstate-marijuana-imports-and-exports\/\" target=\"_blank\" rel=\"noopener\">Oregon<\/a> and <a href=\"https:\/\/www.marijuanamoment.net\/california-officials-take-key-step-toward-interstate-marijuana-commerce-requesting-legal-opinion-on-federal-risk\/\" target=\"_blank\" rel=\"noopener\">California<\/a> have already enacted bills to that end, and similar legislation is <a href=\"https:\/\/www.marijuanamoment.net\/washington-state-bill-to-allow-interstate-marijuana-commerce-is-officially-heading-to-governors-desk\/\" target=\"_blank\" rel=\"noopener\">on the desk of Washington State\u2019s governor<\/a>.<\/p>\n<p>In a cosponsorship memo for the Pennsylvania bill that was first circulated in February, Delloso emphasized the harms of marijuana criminalization for individuals caught up in the drug war as well as the economic toll of enforcing prohibition. Meanwhile, implementing a legal cannabis market stands to generate hundreds of millions in tax revenue and thousands of jobs, he said.<\/p>\n<p>\u201cHowever, permitting private companies to sell cannabis in Pennsylvania could allow large corporations to take over the cannabis industry, putting profits before the well-being of our communities,\u201d he\u00a0<a href=\"https:\/\/www.legis.state.pa.us\/\/cfdocs\/Legis\/CSM\/showMemoPublic.cfm?chamber=H&amp;SPick=20230&amp;cosponId=39958\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cFor these reasons, my legislation will legalize adult use cannabis through the current state store system in order to ensure the safety and integrity of cannabis sales in Pennsylvania.\u201d<\/p>\n<p>Sen. Marty Flynn (D) released a cosponsorship memo this year that also called on lawmakers to join him in support of forthcoming legislation to legalize marijuana through a state-run program, but his bill hasn\u2019t been filed yet.<\/p>\n<p>Gov. Josh Shapiro (D) <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-calls-for-marijuana-legalization-in-budget-request-as-lawmakers-prepare-reform-bills\/\" target=\"_blank\" rel=\"noopener\">proposed to legalize and tax adult-use marijuana<\/a> with a private commercial market as part of his 2023-2024 budget request in March. It\u2019s not clear if he\u2019s open to the state-run system, <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-calls-for-state-run-marijuana-sales-to-boost-economy-amid-coronavirus\/\" target=\"_blank\" rel=\"noopener\">which his predecessor signaled he backed<\/a> as \u201can ideal way to distribute\u201d cannabis.<\/p>\n<p>Meanwhile, Rep. Republicans have maintained control of the Senate, however, but there are certain GOP members like Sens. Dan Laughlin (R) and Mike Regan (R) who\u2019ve backed reform.<\/p>\n<p>In February, Laughlin also sent a letter to state law enforcement, urging officials to take steps to <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-gop-senator-pushes-state-police-to-reconsider-gun-restrictions-for-marijuana-consumers\/\" target=\"_blank\" rel=\"noopener\">protect gun rights for cannabis consumers<\/a>, particularly medical marijuana patients, in light of a federal court\u2019s recent ruling on the issue.<\/p>\n<p>Meanwhile, Reps. Dan Frankel (D) and Donna Bullock (D) circulated a cosponsorship\u00a0<a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/Legis\/CSM\/showMemoPublic.cfm?chamber=H&amp;SPick=20230&amp;cosponId=39066\" target=\"_blank\" rel=\"noopener\">memo<\/a>\u00a0in January about forthcoming cannabis legalization legislation that doesn\u2019t mention utilizing a state-run model.<\/p>\n<p>Laughlin and Sen. Sharif Street (D)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-unveil-marijuana-legalization-bill-amid-whirlwind-of-reform-efforts-in-the-state\/\" target=\"_blank\" rel=\"noopener\">filed a legalization bill in 2021<\/a>,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-lawmakers-unveil-marijuana-legalization-bill-with-focus-on-social-equity\/\" target=\"_blank\" rel=\"noopener\">as did Reps. Jake Wheatley (D) and Frankel<\/a>.
