Nancy Mace (R-SC) secured a committee markup of the <a href=\"https:\/\/www.marijuanamoment.net\/republican-lawmakers-file-bill-to-tax-and-regulate-marijuana-as-alternative-to-democratic-proposals\/\" target=\"_blank\" rel=\"noopener\">States Reform Act (SRA) that she filed last session<\/a>, her office told Marijuana Moment on Thursday.<\/p>\n<p>That bill, which has not yet been refiled for the new Congress, would end federal marijuana prohibition while taking specific steps to ensure that businesses in existing state markets can continue to operate unencumbered by changing federal rules.<\/p>\n<p>Mace\u2019s legislation was one of several cannabis reform proposals that were considered <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-congressional-committee-holds-marijuana-legalization-hearing\/\" target=\"_blank\" rel=\"noopener\">during a House Oversight subcommittee hearing<\/a> last year, but it did not ultimately receive a vote.<\/p>\n<p>With Republicans now in control of the House, the prospects of legalization advancing this Congress have dimmed significantly\u2014but the congresswoman says she has now secured a commitment to action from Speaker Kevin McCarthy (R-CA), who has struggled to convince his caucus to support the debt ceiling proposal that Mace initially opposed before the two reached a compromise on cannabis and several of her other legislative priorities.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The States Reform Act will receive a markup in the House thanks to powerful advocacy by <a href=\"https:\/\/twitter.com\/RepNancyMace?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@RepNancyMace<\/a>. This is incredibly encouraging news and further illustrates the potential for meaningful cannabis reform to advance in this Congress. <a href=\"https:\/\/t.co\/3Xj3163I19\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/3Xj3163I19<\/a><\/p>\n<p>\u2014 US Cannabis Council (@USCannabisCncl) <a href=\"https:\/\/twitter.com\/USCannabisCncl\/status\/1651340422382272513?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 26, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>William Hampson, press secretary for the congresswoman, told Marijuana Moment that the deal is a \u201cbig win for Rep. Mace and supporters of the SRA and we\u2019re excited to have the Speaker working with us on this.\u201d<\/p>\n<p>As introduced last session, the bill contained provisions meant to appeal to both sides of the aisle.<\/p>\n<p>It incorporated certain equity provisions such as expungements for people with non-violent cannabis convictions and called for an excise tax on marijuana, revenue from which would support community reinvestment, law enforcement and Small Business Administration (SBA) activities.<\/p>\n<p>The legislation was primarily aimed at having the federal government treat cannabis in a similar manner to alcohol, while removing the marijuana from the Controlled Substances Act and providing retroactive effects for people previously punished over the plant.<\/p>\n<p>It called for expungements of prior federal cannabis convictions within one year of enactment.<\/p>\n<p>Again, Mace\u2019s SRA hasn\u2019t been refiled for the 118th Congress yet, so it\u2019s possible that the language and provisions may be revised. Mace\u2019s spokesperson said that \u201cfirm details\u201d on the filing and prospective committee markup are \u201cstill being hammered out.\u201d<\/p>\n<p>The New York Times earlier noted the cannabis deal between Mace and McCarthy, quoting the congresswoman touting her apparently successful efforts to secure commitments on \u201cweed, women and guns\u201d and <a href=\"https:\/\/www.nytimes.com\/live\/2023\/04\/26\/us\/debt-ceiling-vote-news?smid=url-share#with-gop-votes-at-a-premium-mace-leverages-hers-to-get-unrelated-concessions\" target=\"_blank\" rel=\"noopener\">saying<\/a> the two had a \u201cvery productive\u201d conversation. Mace said she felt \u201cheard by the speaker.\u201d<\/p>\n<p>She also <a href=\"https:\/\/twitter.com\/juliegraceb\/status\/1651312679745667074\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> secured agreements to advance separate legislation on access to reproductive health and childcare services and to hold a floor vote on a bill concerning active shooter alerts.<\/p>\n<p>Marijuana Moment reached out to the speaker\u2019s office to confirm Mace\u2019s description of their agreement, but no response was received by time of publication. Even if McCarthy does follow through on the idea of holding a committee vote on Mace\u2019s marijuana bill, it\u2019s not clear if it would then advance to floor consideration, which is apparently not part of the deal.<\/p>\n<p>While McCarthy has <a href=\"https:\/\/www.marijuanamoment.net\/where-the-new-republican-and-democratic-congressional-leaders-stand-on-marijuana\/\" target=\"_blank\" rel=\"noopener\">backed modest reforms such as cannabis banking legislation<\/a>, he has voted against legalization bills and amendments to protect businesses abiding by state laws from federal prosecution.<\/p>\n<p>As such, a commitment from McCarthy to hold a markup of the bill is especially notable given his opposition to broader reform\u2014a position that advocates and stakeholders have generally interpreted to mean that proposals to end federal cannabis prohibition wouldn\u2019t advance under the GOP House.<\/p>\n<p>Instead, lawmakers in both chambers have put their focus on more incremental marijuana proposals, including a bill to protect banks that work with cannabis businesses from being penalized by federal regulators that was <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-u-s-house-and-senate-lawmakers-reintroduce-marijuana-banking-bill\/\" target=\"_blank\" rel=\"noopener\">filed by bipartisan members of both chambers<\/a> on Wednesday.<\/p>\n<p>Senate Majority Leader Chuck Schumer (D-NY) did say that he would be refiling a legalization bill in his chamber, but the general expectation is that it will meet the same fate that it did last year and fail to advance given the steep 60-vote threshold needed to clear the body.<\/p>\n<p>Schumer also said that he was \u201cdisappointed\u201d that a so-called SAFE Plus package of marijuana banking and expungements legislation he worked on last year wasn\u2019t enacted, saying \u201cwe came close,\u201d but \u201cwe ran into opposition in the last minute.\u201d He said <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-schumer-talks-marijuana-reform-plans-at-4-20-event-inside-the-u-s-capitol\/\" target=\"_blank\" rel=\"noopener\">lawmakers will continue to \u201cwork in a bipartisan way\u201d<\/a>\u00a0to get the job done.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/04\/MM_Bill_Tracker_V5_blank-141.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>The majority leader has been\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/schumer-booker-and-other-senators-to-meet-and-discuss-marijuana-legislation-senate-sources-say\/\" target=\"_blank\" rel=\"noopener\">holding meetings with Democratic<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/schumer-meets-with-gop-senators-to-discuss-marijuana-legislation-for-new-congress\/\" target=\"_blank\" rel=\"noopener\">and Republican members<\/a>\u00a0in the early months of the new Congress to discuss cannabis reform proposals that might have bipartisan buy-in this year.<\/p>\n<p>But the idea of passing modest, bipartisan marijuana legalization came into serious question on Wednesday after <a href=\"https:\/\/www.marijuanamoment.net\/senate-republicans-block-marijuana-research-bill-for-veterans-in-procedural-vote\/\" target=\"_blank\" rel=\"noopener\">Senate Republicans blocked a procedural vote<\/a> to bring a bill to the floor that would have simply promoted research into the medical potential of cannabis for military veterans with post-traumatic stress disorder (PTSD) and chronic pain.<\/p>\n<p>For his part, Sen. Cory Booker (D-NJ) said recently that lawmakers are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/booker-says-lawmakers-will-resurrect-marijuana-banking-bill-so-hundreds-of-businesses-dont-shut-down\/\" target=\"_blank\" rel=\"noopener\">working to \u201cresurrect\u201d the cannabis reform package<\/a>, acknowledging that failure to advance a banking fix for the industry \u201cliterally means that hundreds of businesses go out of business.<\/p>\n<p>Blumenauer, who filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-congressional-bill-would-provide-federal-tax-relief-for-marijuana-businesses-by-amending-irss-280e-code\/\" target=\"_blank\" rel=\"noopener\">allow marijuana businesses to take federal tax deductions<\/a>\u00a0last week, said at a recent press briefing that thinks it\u2019s important that advocates and lawmakers align on any incremental proposals to end the drug war,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressman-says-letting-marijuana-businesses-claim-federal-tax-deductions-with-280e-repeal-will-actually-generate-more-revenue\/\" target=\"_blank\" rel=\"noopener\">warning against an \u201call-or-nothing\u201d mentality<\/a>.<\/p>\n<p>Also on the House side, bipartisan lawmakers filed a bill on Thursday that would <a href=\"https:\/\/www.marijuanamoment.net\/insurance-companies-that-work-with-marijuana-businesses-would-be-protected-under-bipartisan-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">provide a safe harbor to insurance companies<\/a> that work with state-legal cannabis businesses.<\/p>\n<p>Rep. Brian Mast (R-FL) introduced legislation last week to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-files-bill-to-allow-marijuana-consumers-to-buy-guns\/\" target=\"_blank\" rel=\"noopener\">protect the Second Amendment rights of people who use marijuana<\/a>\u00a0in legal states, allowing them to purchase and possess firearms that they\u2019re currently prohibited from having under federal law.<\/p>\n<p>Reps.
