It needed 60 votes in support to pass.<\/p>\n<p>Schumer ultimately switched his own vote to a \u201cno\u201d in order to be able to enter a motion to reconsider under Senate rules. He said it was \u201cregrettable that this bill, which so much helps our veterans, went down.\u201d<\/p>\n<p>\u201cOur veterans need it. It was supported by all of our veterans groups. It had bipartisan, unanimous support in committee,\u201d he said. \u201cI hope that some of our members on the other side of the aisle who didn\u2019t vote for it will reconsider.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">R&#8217;s voting Yea: Cassidy, Collins, Hawley, Moran, Murkowski, Rounds, Schmitt, Sullivan.<\/p>\n<p>Schumer voted no to enter a motion to reconsider.<\/p>\n<p>Feinstein did not vote. <a href=\"https:\/\/t.co\/gNq3iBGKC1\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/gNq3iBGKC1<\/a><\/p>\n<p>\u2014 Senate Periodicals (@SenatePPG) <a href=\"https:\/\/twitter.com\/SenatePPG\/status\/1651322341396303872?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 26, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Though the bill isn\u2019t technically dead, the vote raises practical questions not just about the prospects of the veterans legislation but also other bipartisan marijuana measures that lawmakers are working to advance, like cannabis banking reform.<\/p>\n<p>The bill <a href=\"https:\/\/www.marijuanamoment.net\/u-s-senate-committee-approves-bipartisan-marijuana-research-bill-focused-on-military-veterans-with-ptsd-and-pain\/\" target=\"_blank\" rel=\"noopener\">cleared the Senate Veterans\u2019 Affairs Committee<\/a> in February, becoming the first piece of standalone marijuana legislation to advance through a panel in the chamber. The chairman of the committee, Sen. Jon Tester (D-MT) is sponsoring the measure, alongside Sen. Dan Sullivan (R-AK).<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Not only are they blocking VA from *researching* medicinal cannabis as an alternative treatment for veterans dealing with chronic pain or PTSD\u2014they&#8217;re blocking improvements to veterans homeownership efforts, community-based support, outreach, and more.<\/p>\n<p>It&#8217;s totally unacceptable.<\/p>\n<p>\u2014 Senator Jon Tester (@SenatorTester) <a href=\"https:\/\/twitter.com\/SenatorTester\/status\/1651342977640407040?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 26, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The proposal is intended to mandate studies by the U.S. Department of Veterans Affairs (VA) to explore the therapeutic potential of cannabis for veterans with post-traumatic stress disorder (PTSD) and chronic pain.<\/p>\n<p>Tester said on the floor ahead of Wednesday\u2019s vote that he understood that the cannabis proposal was \u201ccontroversial\u201d among GOP members, but he argued it was an important step to ensure that veterans have \u201ca better understanding of the role that medicinal cannabis plays in treating the wounds of war.\u201d<\/p>\n<div style=\"max-width: 1024px\">\n<div style=\"width: 100%;height: 0;padding-bottom: 56.25%;padding-top: 60px\" \/>\n<\/div>\n<p>\u201cToday it\u2019s time to put political differences aside and do what\u2019s right for our veterans,\u201d he said, adding that the VA studies required under the bill could find that marijuana serves as an opioid alternative for veterans with chronic pain.<\/p>\n<p>Sen. Jerry Moran (R-KS), ranking member of the Veterans\u2019 Affairs Committee, spoke in favor of the measure, stating that \u201cthis is a effort to make certain that veterans are not doing something that is harmful to them and to make an informed decision.\u201d<\/p>\n<p>It may be possible that GOP senators who rejected the cloture proposal took issue with an <a href=\"https:\/\/www.congress.gov\/congressional-record\/volume-169\/issue-66\/senate-section\/article\/S1307-3\" target=\"_blank\" rel=\"noopener\">amendment<\/a> that Tester sought to attach to the bill that would add a number of non-cannabis items dealing with issues such as housing and senior care. But others, like Sen. James Lankford (R-OK), made clear their opposition to the specific marijuana language.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">When the conversation about how to serve our veterans after all they sacrificed is to give them marijuana\u2014we have failed our veterans.<\/p>\n<p>\u2014 Sen. Bill Cassidy (R-LA), Susan Collins (R-ME), Josh Hawley (R-MO), Lisa Murkowski (R-AK), Mike Rounds (R-SD), Eric Schmitt (R-MO)\u2014were the only Republicans who joined Democrats in <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1181\/vote_118_1_00097.htm\" target=\"_blank\" rel=\"noopener\">voting<\/a> to allow the measure to advance.<\/p>\n<p>Sen. John Cornyn (R-TX) told CNN that the decision by most senators from his party to vote against allowing the bill to move forward came after a \u201cspirited debate\u201d in the caucus lunch earlier in the day.<\/p>\n<p>He said some members had concerns about the structure of the proposed cannabis research at VA, arguing that it \u201cwould be done strictly through volunteers who would come forward and talk about their experience with marijuana and PTSD,\u201d and \u201cit depends on people to self-select and we don\u2019t know how that would skew the results.\u201d<\/p>\n<p><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif\">He <a href=\"https:\/\/www.cnn.com\/2023\/04\/26\/politics\/republicans-reject-veterans-cannabis-study\/index.html\" target=\"_blank\" rel=\"noopener\">said<\/a> negotiations on the legislation would continue and that the vote amounts to \u201chitting the pause button\u201d for now.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">4 years ago, I went to every county in PA to talk about marijuana.  <\/p>\n<p>Veterans were unanimously for having cannabis as a medical option for their PTSD.  <\/p>\n<p>This is common sense. <a href=\"https:\/\/t.co\/Fe7RkfNG79\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/Fe7RkfNG79<\/a><\/p>\n<p>\u2014 Senator John Fetterman (@SenFettermanPA) <a href=\"https:\/\/twitter.com\/SenFettermanPA\/status\/1651330327158063111?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 26, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Tester, for his part, criticized GOP lawmakers after the vote.<\/p>\n<p>\u201cIn Montana, we respect and fight for the men and women who have defended our country and freedoms,\u201d he <a href=\"https:\/\/www.tester.senate.gov\/newsroom\/press-releases\/tester-statement-on-republicans-blocking-veterans-health-and-benefits-legislation\/\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cToday\u2019s failed vote tells them that their government doesn\u2019t value their sacrifices. By blocking consideration of a bill that passed unanimously out of committee two months ago, a group of Republicans today prioritized partisan politics over providing our nation\u2019s veterans their hard-earned benefits and care.\u201d<\/p>\n<p>A <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-house-members-file-veterans-medical-marijuana-research-bill-with-senate-companion-up-for-vote-this-week\/\" target=\"_blank\" rel=\"noopener\">House companion version of the standalone legislation was filed<\/a> by Reps. Lou Correa (D-CA) and Jack Bergman (R-MI) days before the Senate committee approval.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/326\" target=\"_blank\" rel=\"noopener\">bill<\/a>\u00a0has been revised in this latest version to give VA latitude in determining for itself whether it\u2019s capable of overseeing clinical trials into marijuana for chronic pain and PTSD.<\/p>\n<p>The significant change appears to be responsive to concerns expressed by VA officials who testified against the earlier proposals.<\/p>\n<p>A previous version of the legislation\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-approve-marijuana-research-bill-for-veterans-in-committee-vote\/\" target=\"_blank\" rel=\"noopener\">cleared a House committee in 2021<\/a>, despite the protests of VA officials. Earlier iterations of the measure also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-file-another-marijuana-research-bill-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">moved through committee in 2020 and 2018<\/a>\u00a0as well, but none were enacted into law.<\/p>\n<p>The legislation has been revised this Congress to include a requirement for a retroactive observation study to look into the experiences of veterans who\u2019ve used marijuana for such treatment in the past outside of the clinical trail context.<\/p>\n<p>But there\u2019s another change that observers have picked up on as potentially giving VA the ability to avoid fulfilling a key objective on clinical trials.<\/p>\n<div class=\"google-auto-placed ap_container\">\n<p>Within 90 days of completion of an\u00a0<em>observational<\/em>\u00a0study on the effects of cannabis on PTSD and chronic pain, VA would be required to submit a report to Congress on whether it\u2019s capable of carrying out the more robust\u00a0<em>clinical<\/em>\u00a0trials that were at the center of earlier forms of the legislation.<\/p>\n<p>\u201cThe Secretary may terminate the clinical trials\u2026if the Secretary determines that the Department of Veterans Affairs is unable to meet clinical guideline requirements necessary to conduct such trials or the clinical trials would create excessive risk to participant,\u201d the bill text says.<\/p>\n<p>The reason that\u2019s important, in part, is because VA has repeatedly come out against past versions of the reform proposal, with the department suggesting that the research mandate goes too far with too many requirements. Under the new language, VA could finish the qualitative observational study and then independently decide against carrying out the clinical trial portion involving human subjects.<\/p>\n<p>Other revisions in the new version include removing language that required studies to involve at least seven cannabis varieties and instead leaving that open-ended. That may help further address some of VA\u2019s prior concerns about the measure being unduly prescriptive.<\/p>\n<\/div>\n<p>Correa had\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/watch-live-key-house-committee-to-vote-on-federal-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">a conversation with VA Secretary Denis McDonough<\/a>\u00a0about the issue of marijuana and veterans last year, and so there were some heightened expectations that the department might reverse course on the legislation\u2014but that hasn\u2019t happened to date.<\/p>\n<p>A coalition of more than 20 veterans service organizations (VSOs)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/veterans-groups-demand-congress-pass-bill-on-va-medical-marijuana-research-before-session-ends\/\" target=\"_blank\" rel=\"noopener\">sent a letter to congressional leaders late last year<\/a>\u00a0to urge the passage of a marijuana and veterans research bill before the end of the last Congress. But that did not pan out.<\/p>\n<p>Also,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congress-pushes-military-to-consider-psychedelics-and-marijuana-therapy-while-other-cannabis-provisions-left-out-of-defense-bill\/\" target=\"_blank\" rel=\"noopener\">a large-scale defense spending bill\u00a0that was enacted<\/a>\u00a0at the end of the last session\u00a0excluded separate language from a previously House-passed version that would have authorized VA doctors to recommend medical cannabis to veterans living in legal states.<\/p>\n<p>Meanwhile, bipartisan House and Senate lawmakers recently refiled bills to <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-file-congressional-bill-to-legalize-medical-marijuana-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">legalize medical marijuana for military veterans<\/a>.<\/p>\n<p>The bill would temporarily allow veterans to legally possess and use cannabis under federal law, as recommended by doctors in accordance with state law. Cory Booker (D-NJ) said recently that lawmakers are <a href=\"https:\/\/www.marijuanamoment.net\/booker-says-lawmakers-will-resurrect-marijuana-banking-bill-so-hundreds-of-businesses-dont-shut-down\/\" target=\"_blank\" rel=\"noopener\">working to \u201cresurrect\u201d the so-called SAFE Plus package<\/a> from last session, acknowledging that failure to advance a banking fix for the industry \u201cliterally means that hundreds of businesses go out of business.\u201d<\/p>\n<p>Meanwhile, a number of cannabis bills were filed last week leading up to 4\/20, though lawmakers didn\u2019t explicitly say that the timing was related to the unofficial marijuana holiday.<\/p>\n<p>For example, Rep. Brian Mast (R-FL) introduced legislation last week to <a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-files-bill-to-allow-marijuana-consumers-to-buy-guns\/\" target=\"_blank\" rel=\"noopener\">protect the Second Amendment rights of people who use marijuana<\/a>\u00a0in legal states, allowing them to purchase and possess firearms that they\u2019re currently prohibited from having under federal law.<\/p>\n<p>Reps. Dave Joyce (R-OH) and Alexandria Ocasio-Cortez (D-NY) have filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-and-aoc-refile-bill-to-incentivize-state-level-marijuana-expungements\/\" target=\"_blank\" rel=\"noopener\">incentive state and local marijuana expungements<\/a>\u00a0with a federal grant program.<\/p>\n<p>Congressional Cannabis Caucus co-chair Rep. Earl Blumenauer (D-OR) filed a measure last week that would <a href=\"https:\/\/www.marijuanamoment.net\/new-congressional-bill-would-provide-federal-tax-relief-for-marijuana-businesses-by-amending-irss-280e-code\/\" target=\"_blank\" rel=\"noopener\">allow state-legal cannabis businesses to claim federal tax deductions<\/a> that are available to other industries.
