{"id":63767,"date":"2023-04-12T10:41:45","date_gmt":"2023-04-12T18:41:45","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/04\/12\/washington-lawmakers-set-to-enact-interstate-marijuana-sales-bill\/"},"modified":"2023-04-12T17:45:44","modified_gmt":"2023-04-13T01:45:44","slug":"washington-lawmakers-set-to-enact-interstate-marijuana-sales-bill","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/04\/12\/washington-lawmakers-set-to-enact-interstate-marijuana-sales-bill\/","title":{"rendered":"Washington Lawmakers Set To Enact Interstate Marijuana Sales Bill"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/04\/MM_Bill_Tracker_V5_blank-72.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Lawmakers in Washington State are on the cusp of passing legislation that would set the stage for licensed marijuana businesses to be able to engage in cross-border commerce with cannabis companies in other legal states.<\/p>\n<p>The state\u2019s House of Representatives approved the bill, SB 5069, in a 71\u201326 vote on Wednesday. Members approved a minor amendment on the House floor to correct what was described as \u201ca scrivener\u2019s error\u201d in a version <a href=\"https:\/\/www.marijuanamoment.net\/washington-senate-votes-to-legalize-interstate-marijuana-commerce\/\" target=\"_blank\" rel=\"noopener\">passed by the Senate<\/a> last mont\u03a9h. The fix means the legislation still needs one more final Senate nod before it can proceed to Gov. Jay Inslee (D) for his signature.<\/p>\n<p>The measure would not immediately allow interstate cannabis commerce. Rather, it would give the governor the authority to enter into agreements with other legal states only if there\u2019s a federal law change \u201cto allow for the interstate transfer of cannabis\u201d or if the U.S. Department of Justice (DOJ) issues an opinion \u201callowing or tolerating\u201d marijuana commerce across state lines.<\/p>\n<p>\u201cSometimes government falls behind events. This is a small way of being proactive,\u201d Rep. Sharon Wylie (D) said on the floor on Wednesday. \u201cShould the federal government act when we are not in session, we don\u2019t know how they would act. We don\u2019t know when they will act, but this sends a message and sets us up so that we can respond responsibly.\u201d<\/p>\n<p>Both other West Coast states, Oregon and California, have already adopted similar laws. California\u2019s, however, would also allow the state\u2019s attorney general to trigger the policy change through a legal opinion absent any new federal moves. In January, state regulators <a href=\"https:\/\/www.marijuanamoment.net\/california-officials-take-key-step-toward-interstate-marijuana-commerce-requesting-legal-opinion-on-federal-risk\/\" target=\"_blank\" rel=\"noopener\">requested that Attorney General Rob Bonta\u2019s (D) office prepare that guidance<\/a>.<\/p>\n<p>\u201cThis puts us on the same playing field as those other states, and it also makes sure that our vendors and our licensees are informed of what is going on in their world,\u201d Wylie said on the Washington House floor on Wednesday.<\/p>\n<p>Under the bill, if either of the two federal conditions are met, state regulators would be required to provide written notice of the federal policy change, as well as any state-level \u201cstatutory changes necessary to authorize the sale, delivery, and receipt of cannabis\u201d from out-of-state companies. Ann Rivers (R), the bill\u2019s prime sponsor, called Washington\u2014which legalized cannabis for adults through a ballot initiative in 2012\u2014\u201ca leader in the cannabis industry.\u201d But she warned that the state \u201ccould be left in the dust if we\u2019re out of town and unable to take action\u201d when federal law changes.<\/p>\n<p>\u201cWe know that legalization on the federal level is coming. We\u2019ve seen bills introduced and it feels like it\u2019s getting closer,\u201d she said. <a href=\"https:\/\/app.leg.wa.gov\/billsummary?BillNumber=5069&amp;Year=2023&amp;Initiative=false\" target=\"_blank\" rel=\"noopener\">SB 5069<\/a>, she said, entrusts the governor \u201cto look out for this industry and make sure that business can flow from our state to other states and back to us in a legal way, in a safe way and in a way that can be enforced.\u201d<\/p>\n<p>The Washington State legislation represents the latest state-level attempt to prepare for eventual interstate cannabis commerce, even as marijuana remains federally prohibited. California\u2019s governor <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-10-marijuana-bills-including-interstate-commerce-employment-protections-and-record-sealing\/\" target=\"_blank\" rel=\"noopener\">signed a similar measure last year<\/a>, while Oregon Gov. Kate Brown (D) <a href=\"https:\/\/www.marijuanamoment.net\/oregon-governor-signs-bill-to-allow-interstate-marijuana-imports-and-exports\/\" target=\"_blank\" rel=\"noopener\">signed interstate marijuana commerce legislation<\/a>\u00a0into law in 2019.<\/p>\n<p>\u201cThis will give us all three West Coast states with interstate commerce laws,\u201d said Adam Smith, founder of the nonprofit <a href=\"https:\/\/www.sensiblemarkets.org\" target=\"_blank\" rel=\"noopener\">Alliance for Sensible Markets<\/a>, which advocates for interstate cannabis trade. \u201cThat is not an accident. We\u2019ve been working on that since 2019, when we passed the original bill in Oregon.\u201d<\/p>\n<p>Smith told Marijuana Moment he doesn\u2019t expect states to wait for federal legalization to begin pursuing cross-border deals. He thinks the laws passed by West Coast states will nudge the Biden Administration into issuing agency guidance allowing interstate commerce to take place.<\/p>\n<p>\u201cWe are sitting on the cusp,\u201d Smith said. \u201cNow we want states to say, \u2018Hey, we have gone through this political process. We are ready to engage in conversation with other states. We just need to know that when you say you will not prosecute folks acting under state regulation, that you actually mean that.\u2019\u201d<\/p>\n<p>\u201cIf the DOJ is going to tolerate state regulation of a federally illegal industry,\u201d he added, \u201cthere\u2019s absolutely no legal reason\u2014and there\u2019s no practical reason\u2014for them to say, \u2018Oh no, but we will draw the line at moving cannabis from California to New Jersey.\u2019\u201d<\/p>\n<p>Ultimately bills like Washington\u2019s, Smith said, would allow states to opt-in to a national marijuana market. That could provide a opportunities for longtime producer states, including those on the West Coast, to sell products to other markets for higher prices. Meanwhile states with conditions less conducive to growing cannabis, or those just setting up a legal market, could import products from elsewhere rather than each state creating its own legal industry.<\/p>\n<p>\u201cNone of this is about opening up commerce between Oregon, California and Washington. Sending underpriced cannabis back and forth between those borders, it\u2019s not going to help anyone,\u201d he said. \u201cWhat this is about is opening up the possibility of deals and conversations with medical and adult-use states where growing cannabis is more difficult, more expensive [and] where it doesn\u2019t make sense to incentivize a lot of investment in production.\u2019\u201d<\/p>\n<p>Smith predicted some of the first cross-border agreements between states could be inked by the end of the year. \u201cI think it\u2019s the most important shift that will happen since the first states legalized,\u201d he said, \u201cand I think most people don\u2019t see it coming.\u201d<\/p>\n<p>Lawmakers were working through dozens of bills ahead of the end of the legislative session this month, including a handful of drug-related proposals. One Senate measure, which was approved by the House on Tuesday, would commit the state to <a href=\"https:\/\/www.marijuanamoment.net\/washington-psilocybin-research-bill-heads-to-house-floor-after-panel-rejects-gop-push-to-restore-legal-use\/\" target=\"_blank\" rel=\"noopener\">further studying psilocybin for therapeutic use<\/a>. A House amendment to that bill would establish a pilot program at the University of Washington aimed at treating veterans and first responders. Because the pilot program was not contained in the version of the bill that passed the Senate, it needs the Senate\u2019s sign-off before going to the governor.<\/p>\n<p>Both chambers have also passed legislation that would prohibit employers in the state from discriminating against job applicants who use <a href=\"https:\/\/www.marijuanamoment.net\/washington-poised-to-prohibit-pre-employment-discrimination-for-marijuana-use-following-house-approval-of-senate-bill\/\" target=\"_blank\" rel=\"noopener\">test positive for marijuana use during the hiring process<\/a>.
