Mary Schneider (D) cleared the House in an 86-6 vote last month and the Senate unanimously in a 45-0 vote last week. It now heads to the desk of Gov. Doug Burgum (R).<\/p>\n<p>Under the proposal, terminally ill patients could use proof of their admittance in hospice care in lieu of a doctor\u2019s written recommendation to register as a medical cannabis patient. As introduced, the measure would have given the self-certification option to any person age 65 and older, but that was amended out by the House Human Services Committee last month.<\/p>\n<p>The legislation states that regulators would have to issue a cannabis patient card within 14 days of receiving the documentation, and application fees would be waived.<\/p>\n<p>In the interest of expediency, the <a href=\"https:\/\/www.ndlegis.gov\/assembly\/68-2023\/regular\/bill-overview\/bo1478.html\" target=\"_blank\" rel=\"noopener\">bill<\/a> also makes it so designated caregivers would be able to pick up marijuana products for patients in hospice without going through a background check process, just as they\u2019re currently allowed to do for terminally ill patients.<\/p>\n<p>\u201cWhen someone is in hospice, they often don\u2019t have the time to go through the entire process,\u201d Senate Majority Caucus Leader Kristin Roers (R) said on the floor last week. \u201cAnd so I wanted to allow there to be a little bit easier of a path if somebody was admitted into a hospice program to be able to obtain medical marijuana while they\u2019re in that.\u201d<\/p>\n<p>Roers added that cannabis can be used as a substitute for opioids, and so access to marijuana could help them be \u201cmore alert in those final days and final hours of their lives that they spend with their families.\u201d<\/p>\n<p>Given the widespread bipartisan support that the bill enjoyed, it seems likely that Gov. The proposal from Rep. Jason Dockter (R) <a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">passed the House<\/a>, but it was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-senate-rejects-house-passed-marijuana-legalization-bill-ceding-issue-to-activists-for-ballot-measure\/\" target=\"_blank\" rel=\"noopener\">defeated in the full Senate<\/a>\u00a0after advancing out of committee there.<\/p>\n<p>Meanwhile, a bill to significantly <a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-marijuana-decriminalization-bill-advances-as-activists-and-lawmakers-push-legalization-measures\/\" target=\"_blank\" rel=\"noopener\">expand North Dakota\u2019s current marijuana decriminalization policy<\/a>\u00a0cleared the House last year but was later defeated in the Senate.<\/p>\n<p>Under the current statute, possession of half an ounce or less of cannabis is an infraction punishable by a fine of up to $1,000, with no jail time. The defeated proposal would\u2019ve made possession of up to an ounce a non-criminal offense that carried a $50 fine.<\/p>\n<p>North Dakota voters approved a medical cannabis ballot measure in 2016.<\/p>\n<p>The legislature also recently passed a resolution that encourages residents to <a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-house-approves-resolution-encouraging-people-to-buy-american-flags-made-of-hemp\/\" target=\"_blank\" rel=\"noopener\">buy U.S. flags that are made out of hemp<\/a> and manufactured in the state.<\/p>\n<p>House Majority Leader Chet Pollert (R) previously said that he\u2019s not \u201ca marijuana person,\u201d but he\u2019s acknowledged that cannabis legalization is coming.
