Kathy Hochul (D) announced on Wednesday that her new program bill would amend the state\u2019s cannabis law by giving regulators at the Office of Cannabis Management (OCM), Department of Taxation and Finance (DTF) and law enforcement enhanced authority to stamp out the hundreds of illegal businesses operating in New York.<\/p>\n<p>Illicit retailers could face fines exceeding $10,000 per day for violating the law by selling cannabis products without a license. As it stands, those illegal operators far outnumber businesses in the regulated industry.<\/p>\n<p>\u201cOver the past several weeks I have been working with the legislature on new legislation to improve New York\u2019s regulatory structure for cannabis products,\u201d Hochul <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-hochul-proposes-new-legislation-improve-new-yorks-nation-leading-adult-use-cannabis\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cThe continued existence of illegal dispensaries is unacceptable, and we need additional enforcement tools to protect New Yorkers from dangerous products and support our equity initiatives.\u201d<\/p>\n<p>Illicit operators that are growing marijuana plants or manufacturing products could face fines of up to $200,000 under the proposal, which has been transmitted to the Senate and Assembly.<\/p>\n<p>Assembly Republicans are also putting the administration on notice about the \u201cproliferation of illegal shops,\u201d which lawmakers said in a letter on Wednesday \u201cwas entirely predictable.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Assembly Republicans wrote to Gov. Hochul and Comptroller Tom DiNapoli today, calling for an audit of the state\u2019s cannabis program and enforcement plan to address the growing number of illegal stores. <a href=\"https:\/\/t.co\/00M5ZDbfRm\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/00M5ZDbfRm<\/a><\/p>\n<p>\u2014 NY Assembly GOP (@NYS_AM) <a href=\"https:\/\/twitter.com\/NYS_AM\/status\/1638606718262190095?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">March 22, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cPrior to the passage of the [legalization law], concerns were raised bout the legalization of cannabis opening up a lack market,\u201d they said. \u201cBecause the state is responsible for creating the current market conditions, we would like to know how state officials intend to respond.\u201d<\/p>\n<p>Separately, the Coalition for Access to Regulated and Safe Cannabis (CARSC), which represents several well-known multi-state marijuana companies that currently operate medical cannabis businesses in New York, recently filed a lawsuit against OCM in the state Superior Court. The coalition is alleging that regulators have violated the state\u2019s marijuana law by precluding vertically integrated \u201cregistered organizations\u201d from the initial licensing rollout and instead prioritizing people from communities harmed by the drug war.<\/p>\n<p>The businesses are <a href=\"https:\/\/www.syracuse.com\/marijuana\/2023\/03\/exclusive-nys-cannabis-regulators-sued-again-this-time-by-the-big-players.html\" target=\"_blank\" rel=\"noopener\">asking<\/a> the court to mandate that regulators start more broadly approving retail licenses.<\/p>\n<p>As it stands, relatively few New Yorkers have access to nearby legal adult-use dispensaries, as <a href=\"https:\/\/www.marijuanamoment.net\/new-yorks-first-recreational-marijuana-store-owned-by-a-person-harmed-by-drug-war-will-open-next-week-governor-announces\/\" target=\"_blank\" rel=\"noopener\">only five shops have opened their doors<\/a>\u00a0as regulators seek to prioritize social equity licensing applicants who have been most impacted by the drug href=\"https:\/\/www.marijuanamoment.net\/new-york-and-new-jersey-marijuana-regulators-spar-on-twitter-over-which-states-legalization-plan-is-better\/\" target=\"_blank\" rel=\"noopener\">from out-of-state officials<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-governor-touts-opening-day-of-adult-use-marijuana-sales-and-calls-new-york-crazy-for-starting-with-just-one-shop\/\" target=\"_blank\" rel=\"noopener\">like the governor of Connecticut<\/a>, for opening so few retailers in recent months despite significant demand in the populous state.<\/p>\n<p>Regulators did\u00a0<a href=\"https:\/\/cannabis.ny.gov\/cannabis-control-board-meetings\" target=\"_blank\" rel=\"noopener\">announce<\/a> this month that they are doubling the number of <a href=\"https:\/\/www.marijuanamoment.net\/new-york-officials-award-first-marijuana-dispensary-licenses-to-people-harmed-by-drug-war\/\" target=\"_blank\" rel=\"noopener\">conditional adult-use marijuana licenses that can be approved<\/a>, from 150 to 300, after receiving feedback from certain applicants that they would be able to more expeditiously open storefronts without additional support through a state program designed to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-approves-firms-to-build-first-social-equity-marijuana-dispensary-storefronts-days-before-key-regulators-meeting\/\" target=\"_blank\" rel=\"noopener\">help eligible entities create physical locations<\/a>.<\/p>\n<p>Hochul <a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-visits-states-first-legal-marijuana-retailer-outside-manhattan-but-doesnt-buy-anything\/\" target=\"_blank\" rel=\"noopener\">visited one of the handful of currently operating cannabis retailers<\/a>\u00a0late last month, though she didn\u2019t buy anything, even as she signaled openness to trying marijuana in the future.<\/p>\n<p>In December, Hochul separately unveiled a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-unveils-marijuana-store-qr-code-verification-tool-and-universal-label-for-cannabis-products\/\" target=\"_blank\" rel=\"noopener\">marijuana business and product verification tool<\/a>, with plans to post a QR code on licensed cannabis retailers and a universal symbol label for authorized cannabis products.<\/p>\n<p>The governor also signed a bill in late November\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-signs-bill-encouraging-businesses-to-use-hemp-for-construction-packaging-and-other-purposes\/\" target=\"_blank\" rel=\"noopener\">aimed at expanding the state\u2019s hemp market<\/a>\u00a0by promoting collaborative partnerships to identify more opportunities to utilize the crop and its derivatives for packaging, construction and other purposes.<\/p>\n<p>Meanwhile, <a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-to-require-health-insurance-coverage-of-medical-marijuana-clears-assembly-committee\/\" target=\"_blank\" rel=\"noopener\">New York lawmakers approved a bill on Tuesday<\/a> that would require public health insurance providers in the state to include medical marijuana as a covered prescription drug and authorize private insurers to do the same.<\/p>\n<p>Also, New York lawmakers recently <a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-file-psychedelics-legalization-bill-for-2023\/\" target=\"_blank\" rel=\"noopener\">filed legislation for this year\u2019s session to legalize certain psychedelics<\/a>\u00a0like psilocybin and ibogaine for adults 21 and older.
