{"id":62035,"date":"2023-02-22T10:25:27","date_gmt":"2023-02-22T18:25:27","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/02\/22\/north-carolina-medical-marijuana-bill-clears-second-senate-committee\/"},"modified":"2023-02-22T19:46:16","modified_gmt":"2023-02-23T03:46:17","slug":"north-carolina-medical-marijuana-bill-clears-second-senate-committee","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/02\/22\/north-carolina-medical-marijuana-bill-clears-second-senate-committee\/","title":{"rendered":"North Carolina Medical Marijuana Bill Clears Second Senate Committee"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/02\/MM_Bill_Tracker_V5_blank-40.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A second North Carolina Senate committee approved <a href=\"https:\/\/www.marijuanamoment.net\/north-carolina-gop-senator-refiles-medical-marijuana-legalization-bill-with-key-leader-calling-it-the-right-thing-to-do\/\" target=\"_blank\" rel=\"noopener\">a bill to legalize medical marijuana<\/a> on Wednesday\u2014one day after it cleared an initial panel and shortly after\u00a0a top House lawmaker said his chamber is positioned to enact the reform this session despite blocking similar legislation last year.<\/p>\n<p>The Senate Finance Committee advanced the proposal from Sen. Bill Rabon (R) in a voice vote. It has already received approval in the Judiciary Committee and will next head to the Rules Committee, which Rabon chairs, before potentially going to the floor.<\/p>\n<p>The measure would allow patients with qualifying conditions such as cancer, epilepsy, post-traumatic stress disorder (PTSD) and multiple sclerosis to possess and purchase cannabis from licensed dispensaries.<\/p>\n<p>\u201cThe intent of this bill is to make only changes to existing state law that are necessary to protect patients and their doctors from criminal and civil penalties, and would not intend to change current civil and criminal laws governing the use of non-medical marijuana,\u201d Rabon said before the latest committee vote. \u201cThat\u2019s it.\u201d<\/p>\n<p>The panel also adopted an amendment making technical changes to fix outdated cross-references in the bill.<strong><br \/>\n<\/strong><\/p>\n<p>Advocates are confident that the legislation will make it through the Senate, as the prior version did during the past session. What\u2019s been less certain is how the GOP-controlled House will approach the issue.<\/p>\n<p>But in a recent podcast interview, House Speaker Tim Moore (R) indicated that he feels the chamber\u2019s new political makeup may give the legislation a pathway for passage.<\/p>\n<p>\u201cI think there\u2019s been a change. We have a lot of new members,\u201d he said, adding that he believes more than 50 percent of lawmakers now back medical cannabis reform. \u201cI would not be surprised at all if that bill moved. I think the odds are more likely than not that something will happen on that.\u201d<\/p>\n<p>That\u2019s a significant change in tone for the speaker, who previously remarked that there were \u201ca lot of concerns\u201d with Rabon\u2019s bill.<\/p>\n<p>Senate President Pro Tempore Phil Berger (R) said in an interview with the same podcast that the legislation his chamber advanced last session was \u201cwell-constructed\u201d and \u201caddressed a lot of the concerns that people have\u201d while providing a needed treatment option for patients with serious illnesses.<\/p>\n<p><strong>Here are the key provisions of the medical cannabis <a href=\"https:\/\/www.ncleg.gov\/BillLookUp\/2023\/S3\" target=\"_blank\" rel=\"noopener\">legislation<\/a>, SB 3:\u00a0<\/strong><\/p>\n<p style=\"padding-left: 40px\">Patients would be allowed to access cannabis if they have a \u201cdebilitating medical condition\u201d such as cancer, epilepsy, HIV\/AIDS, Parkinson\u2019s disease, multiple sclerosis and post-traumatic stress disorder.<\/p>\n<p style=\"padding-left: 40px\">Smoking and vaping would also be allowed, but doctors would need to prescribe a specific method of delivery and dosages for patients under the revised legislation. And they would need to reevaluate patients\u2019 eligibility for the program at least once a year.<\/p>\n<p style=\"padding-left: 40px\">The bill provides for up to 10 medical marijuana suppliers who control the cultivation and sale of cannabis. Each supplier can operate up to eight dispensaries. That\u2019s double the dispensary cap laid out in the earlier version.<\/p>\n<p style=\"padding-left: 40px\">Under the bill, a Compassionate Use Advisory Board would be established, and it could add new qualifying medical conditions.<\/p>\n<p style=\"padding-left: 40px\">Separately, a Medical Cannabis Production Commission would be created to ensure that there\u2019s an adequate supply of cannabis for patients, oversee licensing and generate enough revenue to regulate the program.<\/p>\n<p style=\"padding-left: 40px\">The\u00a0measure\u00a0would further create a North Carolina Cannabis Research Program to \u201cundertake objective, scientific research regarding the administration of cannabis or cannabis-infused products as part of medical treatment.\u201d<\/p>\n<p style=\"padding-left: 40px\">There don\u2019t appear to be specific equity provisions that many advocates push for as part of legalization legislation.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/02\/MM_Bill_Tracker_V5_blank-39.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>A findings section in the bill states that it\u2019s the intent of the legislature \u201cprioritize the protection of public health and safety in the creation of a system for the cultivation, processing, and selling of medical cannabis.\u201d<\/p>\n<p>Further, \u201cthe General Assembly that the regulatory system created by this Article be nimble and able to respond quickly to changes in the rapidly-evolving cannabis industry.\u201d<\/p>\n<p>A poll released this month found that <a href=\"https:\/\/www.marijuanamoment.net\/three-in-four-north-carolina-voters-back-medical-marijuana-legalization-as-lawmakers-work-to-advance-reform-poll-finds\/\" target=\"_blank\" rel=\"noopener\">North Carolinians are also ready for the reform<\/a>, with about three in four voters saying they back medical cannabis legalization.<\/p>\n<p>For his part, Gov. Roy Cooper (D) said in December that he thinks a medical marijuana legalization bill\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-carolina-governor-says-theres-opportunity-to-legalize-medical-marijuana-in-2023-also-reiterating-support-for-broader-decriminalization\/\" target=\"_blank\" rel=\"noopener\">\u201chas an opportunity to pass\u201d this session<\/a>, and he also reiterated his support for broader decriminalization of cannabis possession, noting racial disparities in enforcement.<\/p>\n<p>Cooper\u2019s public support for decriminalization is a relatively recent development. He first\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-carolina-governor-backs-marijuana-decriminalization-and-directs-lawyers-to-review-pardon-options\/\" target=\"_blank\" rel=\"noopener\">openly backed the policy change in October<\/a>, saying that it\u2019s time to \u201cend the stigma,\u201d while separately announcing steps he\u2019s taken to explore his options for independently granting relief to people with existing convictions.<\/p>\n<p>Following President Joe Biden\u2019s mass pardon announcement in October, which also involved a call to action for governors to provide state-level relief, Cooper said that he\u2019s directed state attorneys to <a href=\"https:\/\/www.marijuanamoment.net\/will-governors-issue-marijuana-pardons-following-bidens-call-to-action-dozens-are-already-weighing-in\/\" target=\"_blank\" rel=\"noopener\">review pardon authority for marijuana offenses<\/a>.<\/p>\n<p>The governor separately convened a North Carolina Task Force for Racial Equity in Criminal Justice that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/decriminalize-marijuana-and-study-legalization-north-carolina-governors-racial-equity-task-force-says\/\" target=\"_blank\" rel=\"noopener\">previously recommended decriminalizing marijuana<\/a>. The report from the panel, which is chaired by state Attorney General Josh Stein (D), also included a recommendation for the state to initiate a study on whether to more broadly legalize cannabis sales.<\/p>\n<p>Under current law, possessing more than half an ounce up to 1.5 ounces of cannabis is a class 1 misdemeanor, subject to up to 45 days imprisonment and a $200 fine.
