A North Carolina Senate committee discussed a bill to legalize medical marijuana<\/a> on Wednesday\u2014and a top House lawmaker is giving new signs that his chamber is positioned to enact the reform after blocking similar legislation last year.<\/p>\n The Senate Judiciary Committee held a hearing on the bill from Sen. Bill Rabon (R), with some discussion on proposed amendments. If the proposal clears the panel at a subsequent meeting, it will have two more committee stops before potentially heading to the floor.<\/p>\n The measure would allow patients with qualifying conditions such as cancer, epilepsy, post-traumatic stress disorder (PTSD) and multiple sclerosis to possess and purchase cannabis from licensed dispensaries.<\/p>\n During the committee hearing, Rabon emphasized the simplicity of the legislation, and he said he\u2019s hopeful that this will be the last time he\u2019ll have to push for the reform.<\/p>\n The sponsor stressed that the legislation was drafted to ensure that the medical cannabis program would be \u201ctightly controlled\u201d while maintaining penalties for non-medical use of marijuana.<\/p>\n \u201cYou have to start somewhere,\u201d he said, adding that lawmakers can \u201clearn as we go and grow as we learn\u201d if the law needs additional revisions down the line.<\/p>\n Advocates are confident that the bill will make it through the Senate, as the prior version did during the past session. What\u2019s been less certain is how the GOP-controlled House will approach the issue.<\/p>\n But in an interview<\/a> with Spectrum News 1\u2019s \u201cTying It Together\u201d podcast that was released on Wednesday, House Speaker Tim Moore (R) indicated that he feels the chamber\u2019s new political makeup may give the legislation a pathway for passage.<\/p>\n \u201cI think there\u2019s been a change. We have a lot of new members,\u201d he said, adding that he believes more than 50 percent of lawmakers now back medical cannabis reform. \u201cI would not be surprised at all if that bill moved. I think the odds are more likely than not that something will happen on that.\u201d<\/p>\n \u201cBut the devil is in the details. This can\u2019t just be wide open recreational use,\u201d he added. \u201cThere needs to be a true medical reason for it. There has to be prescription, supervision, all that kind of stuff. It can\u2019t just be a reckless way to expand recreational drug use. So I think something will happen along those lines.\u201d<\/p>\n Listen to the speaker\u2019s comments on medical cannabis below, starting around 27:15 into the audio below:<\/strong><\/p>\n\n That\u2019s a significant change in tone for the speaker, who previously remarked that there were \u201ca lot of concerns\u201d with Rabon\u2019s bill.<\/p>\n Senate President Pro Tempore Phil Berger (R) said in an interview with the same podcast last month that the legislation his chamber advanced last session was \u201cwell-constructed\u201d and \u201caddressed a lot of the concerns that people have\u201d while providing a needed treatment option for patients with serious illnesses.<\/p>\n Here are the key provisions of the medical cannabis legislation<\/a>, SB 3:\u00a0<\/strong><\/p>\n Patients would be allowed to access cannabis if they have a \u201cdebilitating medical condition\u201d such as cancer, epilepsy, HIV\/AIDS, Parkinson\u2019s disease, multiple sclerosis and post-traumatic stress disorder.<\/p>\n Smoking and vaping would also be allowed, but doctors would need to prescribe a specific method of delivery and dosages for patients under the revised legislation. And they would need to reevaluate patients\u2019 eligibility for the program at least once a year.<\/p>\n The bill provides for up to 10 medical marijuana suppliers who control the cultivation and sale of cannabis. Each supplier can operate up to eight dispensaries. That\u2019s double the dispensary cap laid out in the earlier version.<\/p>\n Under the bill, a Compassionate Use Advisory Board would be established, and it could add new qualifying medical conditions.<\/p>\n Separately, a Medical Cannabis Production Commission would be created to ensure that there\u2019s an adequate supply of cannabis for patients, oversee licensing and generate enough revenue to regulate the program.<\/p>\n The\u00a0measure\u00a0would further create a North Carolina Cannabis Research Program to \u201cundertake objective, scientific research regarding the administration of cannabis or cannabis-infused products as part of medical treatment.\u201d<\/p>\n There don\u2019t appear to be specific equity provisions that many advocates push for as part of legalization legislation.<\/p>\n The Judiciary Committee chairman indicated that the panel would take the bill back up for action on Tuesday.<\/p>\n \u2014 \u201cWe are excited to see SB 3 getting an early committee hearing. For too long, the suffering patients of North Carolina have not had access to safe, lab-tested medical cannabis,\u201d Kevin Caldwell, a legislative manager at the Marijuana Policy Project, told Marijuana Moment.<\/p>\n \u201cNorth Carolinians deserve the same access that citizens in 37 other states currently have for debilitating conditions. Too many have had to resort to the illicit market for relief, with the legal and health consequences that accompany using that market,\u201d he added. \u201cIt is refreshing to see bipartisan sponsorship to create a medical cannabis program that would positively affect the lives of thousands of suffering North Carolinians.\u201d<\/p>\n A findings section in the bill states that it\u2019s the intent of the legislature \u201cprioritize the protection of public health and safety in the creation of a system for the cultivation, processing, and selling of medical cannabis.\u201d<\/p>\n Further, \u201cthe General Assembly that the regulatory system created by this Article be nimble and able to respond quickly to changes in the rapidly-evolving cannabis industry.\u201d<\/p>\n A poll released this week found that North Carolinians are also ready for the reform<\/a>, with about three in four voters saying they back medical cannabis legalization.<\/p>\n \u201cWe hope the General Assembly responds to the wishes of its electorate and moves this legislation through the legislative process and brings this bill to Gov. Cooper\u2019s desk,\u201d Caldwell said.<\/p>\n For his part, Gov. Roy Cooper (D) said in December that he thinks a medical marijuana legalization bill\u00a0\u201chas an opportunity to pass\u201d this session<\/a>, and he also reiterated his support for broader decriminalization of cannabis possession, noting racial disparities in enforcement.<\/p>\n Cooper\u2019s public support for decriminalization is a relatively recent development. He first\u00a0openly backed the policy change in October<\/a>, saying that it\u2019s time to \u201cend the stigma,\u201d while separately announcing steps he\u2019s taken to explore his options for independently granting relief to people with existing convictions.<\/p>\n Following President Joe Biden\u2019s mass pardon announcement in October, which also involved a call to action for governors to provide state-level relief, Cooper said that he\u2019s directed state attorneys to review pardon authority for marijuana offenses<\/a>.<\/p>\n The governor separately convened a North Carolina Task Force for Racial Equity in Criminal Justice that\u00a0previously recommended decriminalizing marijuana<\/a>. The report from the panel, which is chaired by state Attorney General Josh Stein (D), also included a recommendation for the state to initiate a study on whether to more broadly legalize cannabis sales.<\/p>\n Under current law, possessing more than half an ounce up to 1.5 ounces of cannabis is a class 1 misdemeanor, subject to up to 45 days imprisonment and a $200 fine.
