administration\u2014including marijuana pardons, drug sentencing reform, harm reduction and enhanced drug war enforcement for fentanyl\u2014ahead of the president\u2019s State of the Union address on Tuesday.<\/p>\n<p>President Joe Biden did not end up explicitly discussing cannabis when he appeared before the joint session of Congress, but the statements were meant to expand on the basic parameters of the annual speech.<\/p>\n<p>The White House said in a <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/02\/07\/fact-sheet-the-biden-harris-administrations-work-to-make-our-communities-safer-and-advance-effective-accountable-policing\/\" target=\"_blank\" rel=\"noopener\">factsheet<\/a> that the president would \u201chighlight progress\u201d on criminal justice issues during the speech and included a section that directly discussed tackling the \u201cfailed approach to marijuana and crack cocaine.\u201d<\/p>\n<p>\u201cThe criminalization of marijuana possession has upended too many lives\u2014for conduct that is now legal in many states,\u201d the fact sheet on the administration\u2019s Safer America Plan says. \u201cWhile white, Black and brown people use marijuana at similar rates, Black and brown people are disproportionately in jail for it.\u201d<\/p>\n<p>Biden\u2019s pardon proclamation, which affected several thousands of people who\u2019ve committed federal cannabis possession offenses, \u201clifts barriers to housing, employment, and educational opportunities,\u201d it continues.<\/p>\n<p>The pardons that he provided don\u2019t technically expunge the possession records, as that falls beyond his executive authority\u2014but as the factsheet notes, he also encouraged governors to follow his lead by granting relief at the state level where their authority may be different and where the bulk of cannabis cases have been prosecuted.<\/p>\n<p>The president further directed a review into marijuana scheduling, another component of his cannabis actions that the White House is highlighting ahead of the address, saying it is part of how the administration is \u201cguided by science and evidence.\u201d<\/p>\n<p>Biden\u2019s plan additionally \u201ccalls on Congress to end once and for all the racially discriminatory sentencing disparity between crack cocaine and powder cocaine offenses,\u201d a policy that he had a hand in enacting during his time as a U.S. senator\u2014when he earned a reputation as a key drug warrior on Capitol Hill.<\/p>\n<p>A separate <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/02\/07\/fact-sheet-in-state-of-the-union-president-biden-to-outline-vision-to-advance-progress-on-unity-agenda-in-year-ahead\/\" target=\"_blank\" rel=\"noopener\">factsheet<\/a> from the administration on Tuesday pointed to the administration\u2019s work to expand access to the opioid overdose reversal drug naloxone and remove the so-called X-waiver that has limited healthcare provider access to prescription medications meant to combat opioid use disorder.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" href=\"https:\/\/twitter.com\/ONDCP\/status\/1623045370736418821?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">February 7, 2023<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Advocates welcome the harm reduction approach, but on the other side of the coin, the White House is also touting increased enforcement and scheduling action as it relates to fentanyl.<\/p>\n<p>It detailed record-high seizures of the opioid by Border Patrol agents, for example.<\/p>\n<p>Biden followed suit during the speech itself, calling on the country to \u201claunch a major surge to stop fentanyl production, sale, and trafficking, with more drug detection machines to inspect cargo and stop pills and powder at the border.\u201d<\/p>\n<p>\u201cWorking with couriers like Fed Ex to inspect more packages for drugs,\u201d he <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2023\/02\/07\/remarks-of-president-joe-biden-state-of-the-union-address-as-prepared-for-delivery\/\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cStrong penalties to crack down on fentanyl trafficking.\u201d<\/p>\n<p>In a call with reporters on Tuesday, White House Office of National Drug Control Policy (ONDCP) Director Rahul Gupta <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/02\/07\/on-the-record-press-call-on-president-bidens-unity-agenda-ahead-of-the-state-of-the-union\/\" target=\"_blank\" rel=\"noopener\">talked<\/a> about the push to keep fentanyl and its analogous in Schedule I of the Controlled Substances Act (CSA).<\/p>\n<p>He said that the temporary classification of the opioid is set to expire on December 31, 2024, and Biden \u201cis going to be calling on Congress to look at that to make this permanent\u2014and it\u2019s going to be important in order to protect Americans from the threat of lethal drugs, such as fentanyl and fentanyl-related substances.\u201d<\/p>\n<p>With respect to marijuana actions, Biden and members of his administration have routinely cheered the pardon action in recent months, including on Martin Luther King Jr. Day when the president described the action as <a href=\"https:\/\/www.marijuanamoment.net\/biden-touts-fulfilled-promise-on-marijuana-and-calls-for-expungements-at-mlk-day-event\/\" target=\"_blank\" rel=\"noopener\">a reflection of his commitment to \u201cequal justice.\u201d<\/a><\/p>\n<p>At the end of last year, <a href=\"https:\/\/www.marijuanamoment.net\/as-biden-issues-a-handful-of-new-marijuana-and-drug-pardons-advocates-demand-he-release-current-prisoners\/\" target=\"_blank\" rel=\"noopener\">the president granted a half dozen additional pardons<\/a>, including for a handful of people with marijuana or other drug convictions on their records.<\/p>\n<p>Domestic Policy Council Director Susan Rice said in December that the president\u2019s broader cannabis clemency and directive for an administrative review into cannabis scheduling <a href=\"https:\/\/www.marijuanamoment.net\/top-white-house-official-lists-bidens-marijuana-pardons-and-scheduling-review-among-top-2022-administration-achievements\/\" target=\"_blank\" rel=\"noopener\">have helped address the country\u2019s \u201cfailed approach to marijuana\u201d<\/a>\u00a0and represent key parts of the administration\u2019s \u201cremarkably productive year.\u201d<\/p>\n<p>Meanwhile, a bipartisan group of 29 congressional lawmakers from both the House and Senate\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-group-of-29-congressional-lawmakers-push-biden-to-back-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">sent a letter to the president in December<\/a>, asking that he formally back federal marijuana legalization as the administration carries out the cannabis scheduling review.<\/p>\n<p>While the lawmakers didn\u2019t request that Biden take administrative action to unilaterally facilitate legalization, it does underscore an eagerness among supporters for the White House to play a more proactive role in advancing reform.<\/p>\n<p>U.S. Health and Human Services (HHS) Secretary Xavier Becerra, who was CCed on the letter,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bidens-health-secretary-shares-marijuana-scheduling-news-at-420-again\/\" target=\"_blank\" rel=\"noopener\">tweeted a link to a Marijuana Moment article<\/a>\u00a0that discusses the president\u2019s administrative cannabis scheduling directive.<\/p>\n<p>\u201cWe\u2019re going to take a look at what science tells us and what the evidence tells us,\u201d Becerra, who has a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bidens-health-secretary-pick-could-help-reclassify-marijuana\/\" target=\"_blank\" rel=\"noopener\">considerable record supporting cannabis reform<\/a>\u00a0as a congressman and as California\u2019s attorney general, said at the recent overdose prevention event. \u201cThat will guide what we do\u2014and we hope that will guide what the federal government does.\u201d<\/p>\n<p>Following the president\u2019s October announcement, the secretary said that the department\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/doj-to-expeditiously-act-on-bidens-marijuana-pardon-directive-while-hhs-looking-forward-to-scheduling-review\/\" target=\"_blank\" rel=\"noopener\">would \u201cwork as quickly as we can\u201d<\/a>\u00a0to carry out the scientific review.
