{"id":61441,"date":"2023-02-01T11:46:05","date_gmt":"2023-02-01T19:46:05","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/02\/01\/psychedelics-bills-filed-in-four-more-states-as-2023-reform-efforts-heat-up\/"},"modified":"2023-02-01T19:46:35","modified_gmt":"2023-02-02T03:46:35","slug":"psychedelics-bills-filed-in-four-more-states-as-2023-reform-efforts-heat-up","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2023\/02\/01\/psychedelics-bills-filed-in-four-more-states-as-2023-reform-efforts-heat-up\/","title":{"rendered":"Psychedelics Bills Filed In Four More States As 2023 Reform Efforts Heat Up"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/02\/MM_Bill_Tracker_V5_blank-3.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Another series of psychedelics reform bills have been introduced in states from New Hampshire to Hawaii, building on the movement that\u2019s seen exceptional activity in the 2023 session.<\/p>\n<p>The proposed legislation ranges in scope, but legislators across the aisle are making their interest in the issue clear this year.<\/p>\n<p>More than a dozen psychedelics bills <a href=\"https:\/\/www.marijuanamoment.net\/lawmakers-in-three-more-states-file-psychedelics-reform-bills-for-2023\/\" target=\"_blank\" rel=\"noopener\">have been filed in legislatures throughout the U.S.<\/a> in recent weeks\u2014from modest proposals to establish advisory boards that would study the issue to broader ones that would legalize substances like psilocybin for therapeutic use.<\/p>\n<p><strong>Here\u2019s a rundown of the latest proposals since Marijuana Moment\u2019s last roundup of psychedelics legislation:\u00a0<\/strong><\/p>\n<h3>Hawaii<\/h3>\n<p>Numerous psychedelics bills have been introduced in the Aloha State.<\/p>\n<p>Sen. Ron Kouchi (D) filed a <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=1454&amp;year=2023\" target=\"_blank\" rel=\"noopener\">bill<\/a> to create a \u201ctherapeutic psilocybin working group\u201d that would be tasked with studying the \u201cmedicinal and therapeutic effects of psilocybin or psilocybin-based products\u201d for conditions such as anxiety, depression and post-traumatic stress disorder (PTSD).<\/p>\n<p>The body would also need to look into the efficacy of therapeutic psilocybin programs that are being implemented in Colorado and Oregon.<\/p>\n<p>Members would have to \u201cdetermine and develop a long-term strategic plan to ensure the safe availability and accessibility of affordable, therapeutic psilocybin or psilocybin-based products for adults twenty-one years of age or older.\u201d<\/p>\n<p>Rep. Amy Perruso (D) is sponsoring companion <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1337&amp;year=2023\" target=\"_blank\" rel=\"noopener\">legislation<\/a> in the House.<\/p>\n<p>A Senate concurrent <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SCR&amp;billnumber=5&amp;year=2023\" target=\"_blank\" rel=\"noopener\">resolution<\/a> from Sen. Stanley Chang (D) would similarly request a \u201cMedicinal Psilocybin and Psilocin Working Group\u201d to study local, state and federal laws on the entheogens, existing scientific literature on the therapeutic value of the fungi and possible the medical protocol for administering psilocybin.<\/p>\n<p>The whereas section of the resolution says that \u201cstudies conducted by nationally and internationally recognized medical institutions indicate that psilocybin and psilocin have shown efficacy, tolerability, and safety in the treatment of a variety of mental health conditions, including addiction, depression, anxiety disorders, and end-of-life psychological distress.\u201d<\/p>\n<p>It adds that \u201cHawaii has a shortage of mental health professionals and should actively consider novel, innovative, and safe solutions to treat its citizens.\u201d<\/p>\n<p>There\u2019s also an identical Senate <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SR&amp;billnumber=3&amp;year=2023\" target=\"_blank\" rel=\"noopener\">resolution<\/a> from the same sponsor.<\/p>\n<p>Rep. Adrian Tam (D) introduced <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1340&amp;year=2023\" target=\"_blank\" rel=\"noopener\">legislation<\/a> that would establish a \u201cbeneficial treatments advisory council\u201d that would be required to \u201creview, evaluate, and recommend new medicinal treatments for mental health\u201d such as psilocybin and MDMA.<\/p>\n<p>This measure nearly mirrors the Senate bill from Kouchi, except that the advisory council would need to explore the laws, science and possible therapeutic of MDMA in addition to psilocybin. There\u2019s also a Senate <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=1531&amp;year=2023\" target=\"_blank\" rel=\"noopener\">version<\/a> of this legislation from Sen. Matthew Santonastaso (R) would simply remove the psychedelic DMT from the list of controlled substances under state statute.<\/p>\n<p>The <a href=\"https:\/\/gencourt.state.nh.us\/bill_status\/legacy\/bs2016\/bill_status.aspx?lsr=0430&amp;sy=2023&amp;sortoption=&amp;txtsessionyear=2023&amp;txtbillnumber=HB216\" target=\"_blank\" rel=\"noopener\">proposal<\/a>\u00a0states that \u201cindividuals in possession of the drug would no longer be subject to the criminal penalties imposed by that statute.\u201d<\/p>\n<p>\u201cThere is no method to determine how many fewer charges will be brought as a result of the bill,\u201d an analysis says.<\/p>\n<p>The House Criminal Justice and Public Safety Committee recently held a <a href=\"https:\/\/indepthnh.org\/2023\/01\/20\/house-criminal-justice-panel-hears-bill-to-legalize-halucinogenic-drug-dmt\/\" target=\"_blank\" rel=\"noopener\">hearing<\/a> on the legislation but did not vote on advancement.<\/p>\n<p>A Republican New Hampshire lawmaker also recently filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-new-hampshire-lawmaker-files-bill-to-legalize-psychedelics-like-lsd-and-psilocybin\/\" target=\"_blank\" rel=\"noopener\">legalize the possession and use of psychedelics<\/a>\u00a0like psilocybin and LSD by adults 21 and older.<\/p>\n<h3>New York<\/h3>\n<p>Sen. Nathalia Fernandez (D) has filed a bill to legalize psilocybin therapy for patients with qualifying conditions.<\/p>\n<p>Under the <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2023\/S3520\" target=\"_blank\" rel=\"noopener\">proposal<\/a>, people could receive psilocybin treatment from a certified facilitator in a clinical setting, or at their home if they\u2019re unable to travel. Patients and facilitators would receive protections against state-level prosecution.<\/p>\n<p>A Psilocybin Assisted Therapy (PAT) grant program would be established to \u201cprovide veterans, first responders, retired first responders, and low income individuals with the funding necessary to receive psilocybin and\/or MDMA assisted therapy.\u201d<\/p>\n<p>The bills calls for $5 million in funding, \u201cor so much thereof as may be necessary,\u201d to support the grant program.<\/p>\n<p>The state Department of Agriculture and Markets would launch and oversee a pilot program to cultivate psilocybin mushrooms that facilitators could access, with the intent of lowering costs.<\/p>\n<p>\u201cStruggles with mental health ailments like PTSD, depression, anxiety, and substance abuse disorder are often a major disruptor to a person\u2019s livelihood,\u201d a sponsor memo attached to the bill says. \u201cPsilocybin assisted therapies have been called a \u2018breakthrough therapy\u2019 by the FDA for providing people facing these mental ailments unbelievable response rates and even high remission rates.\u201d<\/p>\n<p>\u201cThis treatment gives a promising alternative to a crisis that is only being exacerbated in today\u2019s society,\u201d it continues. \u201cAs a State, it is our duty to use every tool at our disposal to alleviate that suffering for New Yorkers.\u201d<\/p>\n<h3>Utah<\/h3>\n<p>In Utah, Senate Minority Leader Luz Escamilla (D) has announced plans to soon file legislation to legalize psilocybin for people with serious mental health conditions.<\/p>\n<p>The legislation is expected to allow people with PTSD, anxiety or depression to receive the psychedelic treatment in clinical settings with a professional\u2019s recommendation.<\/p>\n<p>\u201cThere\u2019s enough evidence it can help in very specific mental health conditions,\u201d Escamilla <a href=\"https:\/\/www.fox13now.com\/news\/local-news\/bill-would-legalize-psilocybin-in-utah-under-strict-controls\" target=\"_blank\" rel=\"noopener\">told<\/a> FOX 13 News. \u201cWe want to bring it in a controlled manner.\u201d<\/p>\n<h3>West Virginia<\/h3>\n<p>In West Virginia, Rep. Kayla Young (D) filed a <a href=\"http:\/\/www.wvlegislature.gov\/Bill_Status\/Bills_history.cfm?input=2951&amp;year=2023&amp;sessiontype=RS&amp;btype=bill\" target=\"_blank\" rel=\"noopener\">bill<\/a> that would simply remove psilocybin, marijuana and THC from the state\u2019s list of controlled substances.<\/p>\n<p>These are some of the latest examples of psychedelics reform legislation that lawmakers across the country are pursuing this year.<\/p>\n<p>Legislators in <a href=\"https:\/\/www.marijuanamoment.net\/lawmakers-in-three-more-states-file-psychedelics-reform-bills-for-2023\/\" target=\"_blank\" rel=\"noopener\">Connecticut, Massachusetts and Oklahoma<\/a> also recently filed bills to revise laws governing entheogenic plants and fungi.<\/p>\n<p>In a setback,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-lawmakers-reject-bill-to-allow-psilocybin-access-for-medical-use\/\" target=\"_blank\" rel=\"noopener\">Virginia lawmakers rejected a bill this month<\/a>\u00a0that would have allow people with serious mental health conditions to possess and use psilocybin mushrooms with a doctor\u2019s recommendation.<\/p>\n<p>Meanwhile, a Republican Missouri lawmaker has filed a bill <a href=\"https:\/\/www.marijuanamoment.net\/gop-missouri-lawmaker-files-psilocybin-therapy-bill-for-2023-session\/\" target=\"_blank\" rel=\"noopener\">that would provide therapeutic access to psilocybin<\/a>\u00a0for people with serious mental health conditions.<\/p>\n<p>New York Assemblymember Linda Rosenthal (D) pre-filed legislation late last month\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-file-psychedelics-legalization-bill-for-2023\/\" target=\"_blank\" rel=\"noopener\">to legalize certain psychedelics<\/a>\u00a0like psilocybin and ibogaine for adults 21 and older. Gov.
