Ghazala Hashmi (D) passed in the Senate Education and Health Subcommittee on Health Professions in a 6-1 vote on Friday morning.<\/p>\n<p>This comes about a week after a separate Virginia House of Delegates panel <a href=\"https:\/\/www.marijuanamoment.net\/virginia-lawmakers-reject-bill-to-allow-psilocybin-access-for-medical-use\/\" target=\"_blank\" rel=\"noopener\">rejected a measure to legalize psilocybin for therapeutic use<\/a> for people with serious conditions who obtain a doctor\u2019s recommendation.<\/p>\n<p>Hashmi\u2019s <a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?231+sum+SB932\" target=\"_blank\" rel=\"noopener\">legislation<\/a>, which now heads to the full committee for consideration, is more narrowly tailored than a proposal she filed last session to decriminalize psilocybin altogether.<\/p>\n<p>Instead, it would reclassify psilocybin from Schedule I to Schedule III under state law and establish a Virginia Psilocybin Advisory Board.<\/p>\n<p>Hashmi said in opening <a href=\"https:\/\/virginia-senate.granicus.com\/MediaPlayer.php?view_id=3&amp;clip_id=5618\" target=\"_blank\" rel=\"noopener\">remarks<\/a> on Friday that this reform would help inform future steps to provide alternative treatment options for people whose \u201cmedications are not really assisting them,\u201d while \u201chelping them to take care of their critical needs\u201d with psilocybin.<\/p>\n<p><strong>\u2014<br \/>\nMarijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/01\/MM_Bill_Tracker_V5_blank-135.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\nLearn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/p>\n<p>She added that there\u2019s \u201cincreasingly compelling research\u201d that\u2019s being conducted in major universities across the country that is speaking to the significant medical value of psychedelics for certain conditions.<\/p>\n<p>The board that\u2019s being proposed would be required to \u201cdevelop a long-term strategic plan for establishing therapeutic access to psilocybin services and monitor and study federal laws, regulations, and policies regarding psilocybin,\u201d the bill text states.<\/p>\n<p>The governor would be responsible for appointing 12 members to the board, including public health and safety officials, an addiction medicine specialist, a psychologist, a physicians specializing in post-traumatic stress disorder (PTSD), a clinical researcher, a mycologist and more.<\/p>\n<p>While it wouldn\u2019t allow legal therapeutic use of psilocybin, the bill states that the advisory board would be tasked with analyzing \u201cscientific studies and research on the safety and efficacy of psilocybin in treating mental health conditions and on the requirements, specifications, and guidelines for providing psilocybin services in Virginia.\u201d<\/p>\n<p>Members would need to submit a report on its findings to the governor and legislature by December 1 of each year.<\/p>\n<p>If enacted, the measure would amend state statute to place psilocybin in Schedule III. Possession of substances in that schedule is considered a Class 1 misdemeanor punishable by a maximum one year in prison and a fine of up to $2,500.<\/p>\n<p>Possession a Schedule I drug, where psilocybin is currently listed, is a Class 5 felony that carries up to 10 years in prison and up to a $2,500 fine.<\/p>\n<p>Del. Dawn Adams (D), who sponsored the separate committee-defeated therapeutic psilocybin bill this session, told Marijuana Moment earlier this month that she felt the Senate advisory board legislation stood a stronger chance of passing. However, she worried that it would give legislators an excuse to delay action on more comprehensive reform for the psychedelic.<\/p>\n<p>Virginia is just one of numerous states where\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/lawmakers-are-already-pursuing-psychedelics-legislation-in-nearly-a-dozen-states-for-2023\/\" target=\"_blank\" rel=\"noopener\">psychedelics reform is being pursued in the 2023 session<\/a>\u00a0so far.<\/p>\n<p>More than a dozen state legislatures\u00a0have seen psychedelics proposals introduced\u00a0in the first weeks of 2023 as the local decriminalization movement expands, bringing in legislators from diverse political backgrounds.<\/p>\n<p>Most recently, reform measures surfaced in <a href=\"https:\/\/www.marijuanamoment.net\/lawmakers-in-three-more-states-file-psychedelics-reform-bills-for-2023\/\" target=\"_blank\" rel=\"noopener\">Connecticut, Massachusetts and Oklahoma<\/a>.<\/p>\n<p>A Republican Missouri lawmaker filed a bill last week that would <a href=\"https:\/\/www.marijuanamoment.net\/gop-missouri-lawmaker-revises-therapeutic-psilocybin-legalization-bill-for-2023-session\/\" target=\"_blank\" rel=\"noopener\">provide therapeutic access to psilocybin<\/a>\u00a0for people with serious mental health conditions.<\/p>\n<p>A Republican New Hampshire lawmaker also recently filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-new-hampshire-lawmaker-files-bill-to-legalize-psychedelics-like-lsd-and-psilocybin\/\" target=\"_blank\" rel=\"noopener\">legalize the possession and use of psychedelics<\/a>\u00a0like psilocybin and LSD by adults 21 and older.<\/p>\n<p>New York Assemblymember Linda Rosenthal (D) pre-filed legislation late last month\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-file-psychedelics-legalization-bill-for-2023\/\" target=\"_blank\" rel=\"noopener\">to legalize certain psychedelics<\/a>\u00a0like psilocybin and ibogaine for adults 21 and older. Gov.
