Tim Walz (D) released his budget request for the 2024-2025 biennium, just hours before a <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-lawmakers-approve-marijuana-legalization-bill-in-another-house-committee-with-first-senate-hearing-set-this-week\/\" target=\"_blank\" rel=\"noopener\">House committee voted to approve a legalization bill<\/a> that\u2019s moved through several panels in recent weeks.<\/p>\n<p>During a press briefing, Lt. Gov. Peggy Flanagan (D) said that \u201cit is past time to safely legalize adult cannabis use\u201d and that \u201cprohibition doesn\u2019t work.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cLegalizing adult-use cannabis is about our economic future. It\u2019s about expanding our economy and creating jobs across the state. It\u2019s about health, allowing us to regulate the industry and to ensure that products are safe and educating the public about the facts of cannabis use. It\u2019s about public safety, allowing law enforcement to focus on violent crime and expunging the records of people who are convicted of non-violent offenses involving cannabis to give them a second chance. It\u2019s about recognizing the way that we have been doing things isn\u2019t working, and we can change.\u201d<\/p>\n<p>Within the first year of implementation, the governor\u2019s office is projecting that the state would generate $6 million in revenue from a new 15 percent gross receipts tax on marijuana sales. That increases to $26.5 million in 2025, $62 million in 2026 and $100 million by 2027.<\/p>\n<p>The state\u2019s existing sales tax is estimated to additionally bring in an additional $30.8 million from cannabis sales in 2027.<\/p>\n<p>A separate new 15 percent gross receipts tax would also be imposed on THC edibles <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-signs-bill-to-clarify-legality-of-cbd-infused-hemp-foods-and-drinks\/\" target=\"_blank\" rel=\"noopener\">that were legalized under a bill that Walz signed<\/a> last year.<\/p>\n<p>The <a href=\"https:\/\/mn.gov\/mmb\/budget\/current-budget\/governors-budget-recommendations\/\" target=\"_blank\" rel=\"noopener\">budget<\/a> proposal calls for the establishment of a Cannabis Management Office (CMO) to oversee an eventual regulated marijuana market.<\/p>\n<p>\u201cThe Governor recommends funding for the safe and responsible legalization of cannabis for adults in Minnesota,\u201d the budget document says. \u201cThis recommendation also includes funding for grants to assist individuals entering the legal cannabis market, provides for expungement of non-violent offenses involving cannabis, and implements taxes on adult-use cannabis.\u201d<\/p>\n<p>\u201cProhibiting the use of cannabis in Minnesota has not worked. Despite the current prohibition, marijuana is widely consumed across Minnesota,\u201d it continues. \u201cRegulating cannabis for use by adults will replace the abundant illicit market with a tightly regulated system with controls similar to those currently accepted for the sale of alcohol.\u201d<\/p>\n<p>The <a href=\"https:\/\/mn.gov\/mmb-stat\/documents\/budget\/2024-25-biennial-budget-books\/governors-recommendations-january\/cannabis-management-office.pdf\" target=\"_blank\" rel=\"noopener\">budget<\/a> <a href=\"https:\/\/mn.gov\/mmb-stat\/documents\/budget\/2024-25-biennial-budget-books\/governors-recommendations-january\/cannabis-expungement-board.pdf\" target=\"_blank\" rel=\"noopener\">proposes<\/a> to allocate millions of dollars to a variety of state agencies that would have a hand in implementing legalization. For example, it says $822,000 should go to the Department of Agriculture for Fiscal Years 2024-2025 for \u201cfood safety and pesticide enforcement lab testing and rulemaking related to changes in cannabis laws.\u201d<\/p>\n<p>In addition to CMO, the governor is seeking funding to create a Cannabis Expungement Board\u2014$921,000 for the next fiscal year and $844,000 in 2025.<\/p>\n<p>The broader legalization proposal that Walz is pushing \u201cprovides for automatic sealing of dismissals, exonerations, convictions, or stayed sentences of petty misdemeanor and misdemeanor marijuana offenses by the Bureau of Criminal Apprehension, which will provide notice of the expungement to local law enforcement agencies as well as the Judicial Branch for compliance purposes.\u201d<\/p>\n<p>Both the OCM and expungement board are also proposed as part of the legalization legislation that lawmakers have been considering.<\/p>\n<p>The expungement board would support that effort by reviewing \u201cother cannabis convictions to consider eligibility for expungement or resentencing,\u201d Walz\u2019s budget says.<\/p>\n<p>\u201cThis proposal seeks to begin to address the inequities the current system of marijuana prohibition has created, beginning with the expungement of nonviolent marijuana offenses,\u201d it says. \u201cA Division of Social Equity at the Office of Cannabis Management will work to further promote the consideration of equity and inclusion in the development and implementation of cannabis regulatory systems.\u201d<\/p>\n<p>\u201cThe proposal additionally requires the prioritization of social equity applicants in cannabis license selection along with the cannabis grower and industry training and navigation grant programs,\u201d it continues.<\/p>\n<p>A substance misuse treatment advisory board would receive five percent of marijuana tax revenue to support public health programs.<\/p>\n<p>The governor\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-puts-marijuana-legalization-funding-in-budget-request\/\" target=\"_blank\" rel=\"noopener\">included funding for implementing legalization<\/a>\u00a0in his last executive budget request, but lawmakers were unable to enact the policy change.<\/p>\n<p>This budget development comes amid committee action on <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-lawmakers-unveil-revised-marijuana-legalization-bill-with-committee-hearing-scheduled-next-week\/\" target=\"_blank\" rel=\"noopener\">a legalization bill that was introduced in both chambers<\/a> earlier this month.<\/p>\n<p>On the House side, <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-marijuana-legalization-bill-clears-second-house-committee-2\/\" target=\"_blank\" rel=\"noopener\">the legislation has moved through several committees so far<\/a>, and Senate committee is scheduled to consider its companion version on Wednesday.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2023\/01\/MM_Bill_Tracker_V5_blank-113.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>With majorities in both the House and Senate and control over the governorship this session, Democratic-Farmer-Labor party officials are confident that legalization will be enacted sooner than later.<\/p>\n<p>The legislation is an iteration of the 2021 House-passed bill from former Majority Leader Ryan Winkler (D), who now serves as campaign chairman of the advocacy coalition MN is Ready. That group\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesotas-outgoing-house-majority-leader-will-lead-push-to-legalize-marijuana-in-2023-with-revised-bill\/\" target=\"_blank\" rel=\"noopener\">announced last month that it would be lobbying for the measure<\/a>\u00a0while leading a grassroots effort to build support for reform.<\/p>\n<p>Walz, for his part, has\u00a0called on supporters to join lawmakers and the administration in their push legalize marijuana this session, and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesotas-governor-wants-people-to-sign-a-marijuana-petition-asking-lawmakers-to-put-legalization-on-his-desk\/\" target=\"_blank\" rel=\"noopener\">he circulated an email blast this month<\/a>\u00a0that encourages people to sign a petition backing the reform.<\/p>\n<p>Following their election win in November,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-senators-signal-plans-to-advance-marijuana-legalization-in-2023-with-new-democratic-majority\/\" target=\"_blank\" rel=\"noopener\">Democrats internally agreed to discuss the issue<\/a>\u00a0in short order.<\/p>\n<p>House Speaker Melissa Hortman (D) said recently that she expected cannabis reform to be included in the governor\u2019s budget request, though she reiterated that the reform \u201cwill take a long time\u201d to move through the legislature.<\/p>\n<p>Walz and Hortman have differing opinions about how quickly the issue can advance this session, however, with Walz\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-predicts-state-will-legalize-marijuana-by-may\/\" target=\"_blank\" rel=\"noopener\">recently saying it would be done \u201cby May\u201d<\/a>\u00a0and the speaker indicating it could take until next year.<\/p>\n<p>Winkler told Marijuana Moment earlier this month that he agrees with the governor, saying \u201cit is likely that [passing legalization] will be done by May.\u201d<\/p>\n<p>\u201cThe reason is that the legislature adjourns until next year at the end of May, and so if they don\u2019t do it in that timeline, it\u2019ll take another full year\u2014and I don\u2019t think anything will be improved or bettered by waiting,\u201d he said. \u201cSo it\u2019s in everyone\u2019s interest to get this bill passed.\u201d<\/p>\n<p>Two polls released in September found that the majority of Minnesota residents\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/two-new-minnesota-polls-show-support-for-legalizing-marijuana\/\" target=\"_blank\" rel=\"noopener\">support adult-use marijuana legalization<\/a>\u2014and one survey showed that even more Minnesotans approve of the state\u2019s move to legalize THC-infused edibles that was enacted earlier this year.<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/growing-majority-of-minnesotans-support-marijuana-legalization-state-fair-poll-conducted-by-lawmakers-finds\/\" target=\"_blank\" rel=\"noopener\">survey conducted by officials with the House<\/a>\u00a0at the annual State Fair that was released in September also found majority support for legalization. That legislature-run poll found that 61 percent of Minnesotans back legalizing cannabis for adult use.<\/p>\n<p>Support was up this year from 58 percent when the House Public Information Services\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-lawmakers-poll-shows-growing-support-for-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">polled fair goers on the issue in 2021<\/a>.
