James Comer (R-KY) said that he would leverage his authority as the new chairman of the House Oversight and Accountability Committee to put the head of FDA on the spot about the ongoing regulatory lapse.<\/p>\n<p>\u201cI want to bring the FDA commissioner in front of the committee, and this is one of the things that we want to talk about,\u201d Comer, who helped champion federal hemp legalization through the 2018 Farm Bill, said. \u201cIt\u2019s not just their lack of action with respect to CBD and other types of hemp\u2014it\u2019s their inaction regarding a lot of areas of their jurisdiction.\u201d<\/p>\n<p \/>\n<p>\u201cWe\u2019ve got an agency here that has a big budget, they have a lot of employees, but it doesn\u2019t seem like they\u2019re getting a lot of their work done, and they have a huge backlog,\u201d the congressman said. \u201cSo I want to bring them in and ask them what the problem is.\u201d<\/p>\n<p>Comer, who previously served as Kentucky\u2019s agriculture commissioner, said he\u2019s been clear with FDA that lawmakers \u201cwant hemp to be regulated like a nutraceutical or whatever to where we can have credible hemp companies and where consumers, when they purchase hemp, they know exactly what\u2019s in that hemp and it\u2019s not the wild west out there.\u201d<\/p>\n<p>Consumers should have to \u201cworry about going to a gas station and seeing a product labeled hemp and then learning that it really isn\u2019t hemp,\u201d he said. \u201cSo this is something that the FDA has failed to do\u2014and we\u2019re going to bring them in that committee early on and try to get them on the right track and figure out a way to get them caught up with things like CBD regulation.\u201d<\/p>\n<p>As U.S. Hemp Roundtable\u2019s Jonathan Miller said in the interview, FDA has received numerous letters from bipartisan lawmakers about the need to create a regulatory framework that allows for the marketing of hemp-based products in the food supply or as dietary supplements.<\/p>\n<p>Late last year, top officials at the agency said they are <a href=\"https:\/\/www.marijuanamoment.net\/fda-officials-say-hemp-and-cbd-regulatory-plan-is-months-away-as-it-carries-out-marijuana-scheduling-review\/\" target=\"_blank\" rel=\"noopener\">months away from releasing a regulatory assessment<\/a> on the issue, though FDA has maintained that it may take additional legislative work before it\u2019s able to finalize such rules.<\/p>\n<p>The market for hemp, CBD and more novel intoxicating cannabinoids like delta-8 THC is already widespread across the country. As such, FDA officials seem to increasingly recognize the urgency of rulemaking.<\/p>\n<p>\u201cThe hemp industry is deeply grateful to Chairman Comer for his leadership on this issue,\u201d Miller said in an email blast on Thursday. \u201cThere might not be a U.S. hemp industry had it not been for the chairman\u2019s actions as Kentucky\u2019s agriculture commissioner, and he is continuing his strong advocacy for the nation\u2019s farmers in his current role.\u201d<\/p>\n<p>FDA officials have said that a couple of points that they are assessing concern whether CBD can be used safely in the long-term, and what impacts consumption might have during pregnancy. The rise in popularity of delta-8 THC products, which the Drug Enforcement Administration (DEA) says are not controlled substances, has further complicated rulemaking.<\/p>\n<p>FDA recently touted its role helping a state agency\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fda-looks-to-collect-more-cannabis-data-as-it-touts-federal-state-partnership-in-enforcement-action-against-delta-8-thc-business\/\" target=\"_blank\" rel=\"noopener\">crack down on a company selling delta-8 THC gummies<\/a>\u00a0that they said are linked to \u201cserious adverse events.\u201d<\/p>\n<p>In November, the agency <a href=\"https:\/\/www.marijuanamoment.net\/fda-sends-warning-letters-to-companies-selling-cbd-infused-foods-and-beverages-as-hemp-industry-awaits-regulations\/\" target=\"_blank\" rel=\"noopener\">sent warning letters to five companies<\/a>\u00a0that sell foods and beverages containing CBD.<\/p>\n<p>The agency didn\u2019t specify why it targeted those particular five companies out of the many more that market similar cannabidiol-infused consumables, but it said that they sell products \u201cthat people may confuse for traditional foods or beverages which may result in unintentional consumption or overconsumption of CBD.\u201d<\/p>\n<p>Reps. Morgan Griffith (R-VA) and Brett Guthrie (R-KY) sent a letter to FDA Commissioner Robert Califf in September, demanding answers over the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-blast-fda-over-lack-of-cbd-regulations-and-demand-status-update\/\" target=\"_blank\" rel=\"noopener\">continued lack of regulations for CBD<\/a>\u00a0for those purposes.<\/p>\n<p>Griffith and other bipartisan lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-slam-completely-insufficient-fda-response-to-hemp-bill-request-and-lack-of-cbd-regulations\/\" target=\"_blank\" rel=\"noopener\">sent a separate, related letter to the FDA commissioner<\/a>\u00a0in August. They expressed frustration over the \u201ccompletely insufficient response\u201d the agency provided in response to their bill calling for hemp-derived CBD to be permitted and regulated as a food additive.<\/p>\n<p>After the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-bill-to-regulate-hemp-derived-cbd-in-food-and-beverages-filed-in-congress\/\" target=\"_blank\" rel=\"noopener\">CBD Product Safety and Standardization Act<\/a>\u00a0was filed in December 2021, the sponsors sought technical assistance from FDA to advise on key provisions. But four months after they sent the inquiry, FDA returned a \u201cone-page\u201d response that was \u201csimply a reformatting of a document provided to Congress over two years ago,\u201d the lawmakers said<\/p>\n<p>At a House Appropriations subcommittee hearing in May, FDA\u2019s Califf recognized that the agency\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fda-head-admits-agency-has-been-slow-to-regulate-cbd-but-suggests-congress-needs-to-do-more\/\" target=\"_blank\" rel=\"noopener\">had moved slowly with rulemaking for CBD<\/a>\u00a0in the food supply, stating that the situation \u201clooks pretty much the same in terms of where we are now\u201d as compared to when he first worked on the issue in 2016.<\/p>\n<p>He said the FDA has taken steps to research the safety profile of cannabinoids to inform future rules, but he also punted the criticism about inaction to Congress, saying he doesn\u2019t feel that \u201cthe current authorities we have on the food side or the drug side necessarily give us what we need to have to get the right pathways forward.\u201d<\/p>\n<p>\u201cWe\u2019re going to have to come up with something new,\u201d Califf said. \u201cI\u2019m very committed to doing that.\u201d<\/p>\n<p>Stakeholders have strongly encouraged FDA to live up to its authority and provide guidelines and clarity for the industry. But the agency has largely limited its regulatory enforcement authority to sending warning letters to certain CBD businesses and denying cannabinoid marketing applications.<\/p>\n<p>Last year, for example, the agency simply <a href=\"https:\/\/www.marijuanamoment.net\/fda-warns-companies-about-cbd-products-for-food-producing-animals\/\" target=\"_blank\" rel=\"noopener\">sent warning letters to four cannabis companies<\/a>\u00a0for allegedly making unsanctioned claims about the medical benefits of CBD products they\u2019ve marketed for animals.<\/p>\n<p>FDA also warned consumers about\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fda-warns-about-marijuana-infused-copycat-foods-leading-to-accidental-thc-consumption\/\" target=\"_blank\" rel=\"noopener\">marijuana-infused copycat food products<\/a>\u00a0that resemble popular brands and the risks of accidentally ingesting THC, particularly for children.<\/p>\n<p>The agency separately\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fda-issues-first-warning-letters-targeting-delta-8-thc-products-it-says-are-being-illegally-marketed\/\" target=\"_blank\" rel=\"noopener\">issued its first set of warnings<\/a>\u00a0to companies over the allegedly illegal sale of products containing the increasingly popular cannabinoid delta-8 THC.<\/p>\n<p>It sent five warning letters to companies that are marketing products with the intoxicating compound and making what the agency says are unsanctioned claims about their therapeutic potential.<\/p>\n<p>Last year, Comer also called on leadership to <a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-requests-hearing-on-fdas-failure-to-set-cbd-and-delta-8-thc-regulations\/\" target=\"_blank\" rel=\"noopener\">schedule a hearing to hold FDA accountable<\/a>\u00a0for its lack of action to set regulations for CBD and delta-8 THC products.<\/p>\n<p>All of this comes in the background of a major task for FDA: Conducting a scientific review into marijuana, at the direction of President Joe Biden, to aid in an assessment of its federal scheduling.
