Lawmakers are now prepared to introduce reform legislation after officials finalized recommendations for legalization as part of a task force.<\/p>\n<p>Representatives of major advocacy organization\u2014including the Marijuana Policy Project (MPP), ACLU of Hawaii and Drug Policy Forum of Hawaii\u2014said at Wednesday\u2019s briefing that they\u2019re gearing up for an active session, with hopes to also pass legislation to facilitate automatic record clearing and resentencing.<\/p>\n<p>They were joined by Rep. Jeanne\u0301 Kapela (D), who plans to file legalization legislation and said that \u201cthis year, we stand on the precipice of history.\u201d<\/p>\n<p>\u201cWe now have a roadmap for legalizing recreational cannabis in our islands,\u201d she said. \u201cLegalizing cannabis is not just a matter of money, it is a matter of moralities.\u201d<\/p>\n<p>\u201cOur society\u2019s most marginalized people would be first in line to participate in the cannabis industry that we are seeking to grow,\u201d Kapela added. \u201cAgricultural and business practices would be based on sustainable and indigenous cultivation methods, ensuring that cannabis operations uplift the needs of U.S. residents, the needs of Hawaii\u2019s people, not the profits of multi-state <a href=\"https:\/\/health.hawaii.gov\/medicalcannabis\/dual-use\/\" target=\"_blank\" rel=\"noopener\">task force<\/a> that submitted a <a href=\"https:\/\/health.hawaii.gov\/opppd\/files\/2022\/12\/Act-169-SLH-2022-Dual-Use-of-Cannabis-Task-Force-FINAL-REPORT.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a> on legalization policy considerations to the legislature ahead of the new session.<\/p>\n<p>\u201cPeople of color and economically disadvantaged residents are disproportionately harmed by our state\u2019s unwarranted commitment to incarceration,\u201d Kapela said in a press release. \u201cBy legalizing cannabis, we can build an industry that diversifies our economy, strengthens our agricultural heritage, and delivers justice to those who have been unjustly criminalized.\u201d<\/p>\n<p>Legislators have worked to enact legalization in the Aloha State over several sessions, but while <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-approves-marijuana-legalization-bill-and-separate-decriminalization-expansion-proposal\/\" target=\"_blank\" rel=\"noopener\">the reform was approved in the Senate in 2021<\/a>, it stalled after failing to proceed past a House committee by a key deadline.<\/p>\n<p>\u201cMarijuana prohibition has caused immeasurable harm to our communities, particularly communities of color,\u201d DeVaughn Ward, senior legislative counsel at MPP, said. \u201cCannabis legalization is an opportunity to stop the harm to our residents and the waste of limited public safety resources.\u201d<\/p>\n<p>Nikos Leverenz of the Drug Policy Forum of Hawaii said that the legislation that\u2019s set to be introduced represents \u201ca critical opportunity for the legislature to repair the substantial harms that decades of cannabis prohibition have wrought upon those from Native Hawaiian and under-resourced communities.\u201d<\/p>\n<p>\u201cHawaii\u2019s cannabis policy should center the needs of those damaged by the continued criminalization of cannabis and draconian drug law enforcement,\u201d he said. \u201cAt the same time, a properly regulated adult-use market will create many quality jobs and business opportunities across the state, including those related to cannabis tourism, craft cannabis, and cannabis science.\u201d<\/p>\n<p>Advocates didn\u2019t get much help from the former Democratic governor, Dave Ige, who has resisted legalization, in part because he said he was reluctant to pass something that conflicts with federal law. That\u2019s despite the fact that Hawaii has a medical marijuana system that allows people to grow and sell cannabis in contravention of broad federal prohibition.<\/p>\n<p>But now that Gov. Josh Green (D) has been sworn in, activists are feeling emboldened. He said in November that he\u2019d sign a bill to legalize cannabis for adults and already has ideas about how tax revenue from marijuana sales could be utilized.<\/p>\n<p>\u201cI think that people already have moved past that culturally as a concern,\u201d Green said in a debate ahead of the election.<\/p>\n<p>That\u2019s a welcome development for advocates, who have spent years working with lawmakers to develop a bill to tax and regulate cannabis in the state only to consistently have the governor airing skepticism about the reform.<\/p>\n<p>In 2020, Ige allowed a bill to become law without his signature that <a href=\"https:\/\/www.marijuanamoment.net\/hawaiis-marijuana-decriminalization-law-is-officially-in-effect\/\" target=\"_blank\" rel=\"noopener\">decriminalized possession of up to three grams of cannabis<\/a>, making the offense punishable by a $130 fine, without the possibility of incarceration. But even then he was reluctant, <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-governor-vetos-two-cannabis-bills-while-letting-decriminalization-become-law\/\" target=\"_blank\" rel=\"noopener\">describing it as \u201ca very tough call\u201d<\/a> and saying he went \u201cback and forth\u201d on the issue.<\/p>\n<p>Meanwhile, a <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-committee-approves-bill-to-legalize-marijuana-for-senior-citizens-65-and-older\/\" target=\"_blank\" rel=\"noopener\">Hawaii Senate committee approved a bill last year<\/a> to make it so people 65 and older could automatically qualify for medical marijuana, regardless of whether they had a diagnosed condition that would otherwise make them eligible. But that legislation was not ultimately enacted last session.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/hawaii-legislature-seeks-marijuana-exemption-from-dea-while-senate-requests-legal-psilocybin-plan\/\" target=\"_blank\" rel=\"noopener\">The state legislature adopted a resolution<\/a> in 2021 that asks the state to seek an exemption from the Drug Enforcement Administration (DEA) stipulating that it is permitted to run its medical cannabis program without federal interference. The House <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-lawmakers-seek-marijuana-exemption-from-dea-while-also-requesting-legal-psilocybin-plan\/\" target=\"_blank\" rel=\"noopener\">approved an identical measure in March 2021<\/a>, but it only applied to that chamber.<\/p>\n<p>Lawmakers in the state have separately worked to <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-lawmakers-approve-senate-passed-psilocybin-workgroup-resolution-in-committee\/\" target=\"_blank\" rel=\"noopener\">advance modest psychedelics reform legislation<\/a>.
