The employment bill sponsor, Sen. For example, it wouldn\u2019t preclude an employer from using drug tests that can detect active impairment from marijuana.<\/p>\n<p>It also says that the reform wouldn\u2019t affect \u201cthe rights or obligations of an employer to maintain a drug and alcohol free workplace, or any other rights or obligations of an employer required by federal law or regulation.\u201d<\/p>\n<p>Further, people working in building or construction trades, as well as those whose jobs would require federal background check or security clearance, wouldn\u2019t be covered under the legislation.<\/p>\n<p>The bill also says it does not \u201cpreempt state or federal laws requiring an applicant to be tested for controlled substances,\u201d including those \u201crequiring applicants to be tested, or the way they are tested, as a condition of employment, receiving federal funding or federal licensing-related benefits, or as required by a federal contract.\u201d<\/p>\n<p>The <a href=\"https:\/\/app.leg.wa.gov\/billsummary?BillNumber=5123&amp;Year=2023&amp;Initiative=false\" target=\"_blank\" rel=\"noopener\">bill<\/a> is one of three related to cannabis that will be considered in committee next week. The other two deal with marijuana industry equity issues and <a href=\"https:\/\/www.marijuanamoment.net\/new-washington-bill-would-allow-interstate-marijuana-commerce\/\" target=\"_blank\" rel=\"noopener\">creating the framework for cannabis interstate commerce<\/a>, pending a federal policy change.<\/p>\n<p>Workplace drug testing policy is a topic that received considerable attention in state legislatures last year, including in California, where Gov. Gavin Newsom (D) signed legislation that <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-10-marijuana-bills-including-interstate-commerce-employment-protections-and-record-sealing\/\" target=\"_blank\" rel=\"noopener\">prohibits most employers from discriminating against workers<\/a> based on drug tests that show the presence of THC metabolites.<\/p>\n<p>Back in July, Washington, D.C. <a href=\"https:\/\/www.marijuanamoment.net\/d-c-mayor-signs-bill-providing-workplace-protections-for-marijuana-consumers\/\" target=\"_blank\" rel=\"noopener\">Mayor Muriel Bowser (D) signed a bill<\/a>\u00a0that bans most workplaces from firing or otherwise punishing employees for marijuana use. The reform was designed to expand on a previous measure lawmakers approved to protect local government employees against\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/workplace-protections-for-dc-medical-marijuana-patients-extended-under-emergency-bill\/\" target=\"_blank\" rel=\"noopener\">workplace discrimination due to their use of medical cannabis<\/a>.<\/p>\n<p>Utah and Louisiana <a href=\"https:\/\/www.marijuanamoment.net\/here-are-the-biggest-marijuana-reform-victories-of-2022-from-legalization-to-workplace-protections\/\" target=\"_blank\" rel=\"noopener\">also enacted laws last year that provide employment protections<\/a> for medical cannabis patients.<\/p>\n<p>In September, New Jersey <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-employers-cant-punish-workers-based-on-a-marijuana-test-alone-state-officials-say\/\" target=\"_blank\" rel=\"noopener\">marijuana regulators approved guidance for employers<\/a> that makes clear they cannot penalize workers based solely on positive drug tests for cannabis metabolites.<\/p>\n<p>After New York enacted recreational legalization, the state Department of Labor also instituted new rules stipulating that employers can\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">no longer drug test most workers for marijuana<\/a>.<\/p>\n<p>Despite prohibitionist arguments that marijuana legalization harms the workforce, a recent study published by the National Bureau of Economic Research (NBER) found that, if anything, <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-boosts-job-opportunities-in-the-agricultural-sector-study-finds\/\" target=\"_blank\" rel=\"noopener\">the reform actually increases job opportunities<\/a>.<\/p>\n<p>Back in Washington State, lawmakers are again <a href=\"https:\/\/www.marijuanamoment.net\/washington-lawmakers-consider-drug-possession-penalties-in-new-session\/\" target=\"_blank\" rel=\"noopener\">considering drug possession penalties and related issues<\/a> this session.<\/p>\n<p>Following a state Supreme Court decision in February 2021 that <a href=\"https:\/\/www.marijuanamoment.net\/washington-supreme-court-strikes-down-criminalization-of-drug-possession\/\" target=\"_blank\" rel=\"noopener\">invalidated the state\u2019s felony law against drug possession<\/a>, lawmakers enacted a temporary criminalization policy that is <a href=\"https:\/\/www.marijuanamoment.net\/drug-possession-to-be-a-misdemeanor-for-now-under-washington-state-bill-headed-to-governors-desk\/\" target=\"_blank\" rel=\"noopener\">set to expire on July 1<\/a>.
