An initial court appearance is set for next week on January 2.<\/p>\n<p>The news of the law enforcement action against the 69-year-old man, Greg Bretz, ignited a strong response from the cannabis reform community. He told The Wichita Eagle that he was using cannabis to relief symptoms of his condition while spending weeks \u201cflat on my back\u201d since being hospitalized three weeks ago.<\/p>\n<p>A doctor, Bretz said, told him to use whatever means necessary to ameliorate the pain. But hospital staff contacted law enforcement after he allegedly vaped in his hospital room, and three officers then paid him a visit. They seized his vape device as well as edible paste containing THC.<\/p>\n<p>Staff at the Hays Medical Center <a href=\"https:\/\/www.kansas.com\/opinion\/opn-columns-blogs\/dion-lefler\/article270381287.html\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> said they were worried that the vaping device could be a potential fire hazard\u2014though Bretz said he was not on oxygen, raising questions about the concern.<\/p>\n<p>The end result, however, is a terminally ill man facing possible prosecution over the possessing cannabis that he says us used medically.<\/p>\n<p>And Kansas House Democrats were quick to amplify the story to demonstrate the need to enact a policy change in the state.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">House Dems are committed to legalizing access to medical marijuana. <a href=\"https:\/\/twitter.com\/hashtag\/MMJ?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#MMJ<\/a> is available to ill patients in dozens of states across the country.<\/p>\n<p>Kansans shouldn\u2019t be forced to choose between quality, safe health care and abiding by the law. <a href=\"https:\/\/twitter.com\/hashtag\/ksleg?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#ksleg<\/a><a href=\"https:\/\/t.co\/RhVDMJY5mz\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/RhVDMJY5mz<\/a><\/p>\n<p>\u2014 Kansas House Democrats (@KSHouseDems) <a href=\"https:\/\/twitter.com\/KSHouseDems\/status\/1607437772205494273?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">December 26, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cHouse Dems are committed to legalizing access to medical marijuana. [Medical marijuana] is available to ill patients in dozens of states across the country,\u201d the party wrote on Monday. \u201cKansans shouldn\u2019t be forced to choose between quality, safe health care and abiding by the law.\u201d<\/p>\n<p>Bretz\u2019s story is reminiscent of a 2019 controversy that <a href=\"https:\/\/www.marijuanamoment.net\/video-missouri-police-search-cancer-patients-bags-for-marijuana-in-hospital-room\/\" target=\"_blank\" rel=\"noopener\">saw three Missouri police officers visit a hospital<\/a> and search through the belongings of a man with stage-four pancreatic cancer in a fruitless attempt to find marijuana.<\/p>\n<p>Missouri, which is right next door to Kansas, has since legalized cannabis for adult use following last month\u2019s ballot initiative vote on the reform.<\/p>\n<p>Kansas, meanwhile, remains one of a declining number few states that have kept prohibition on the books even for medical use of cannabis.<\/p>\n<p>The Kansas House of Representatives approved a medical marijuana bill in the last session, but it later stalled in the Senate.<\/p>\n<p>Supportive lawmakers are hoping to see a policy change in the upcoming session. Members of a special committee <a href=\"https:\/\/www.marijuanamoment.net\/kansas-lawmakers-hold-final-medical-marijuana-meeting-after-touring-grow-facility-with-chairman-previewing-2023-bill-plans\/\" target=\"_blank\" rel=\"noopener\">held a final meeting on medical marijuana issues<\/a> this month that will be used to inform reform legislation that will be introduced in the 2023 session.<\/p>\n<p>The Special Committee on Medical Marijuana, members of which\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-lawmakers-to-tour-marijuana-grow-facility-in-missouri-as-they-finalize-medical-cannabis-bill-for-2023\/\" target=\"_blank\" rel=\"noopener\">toured a Missouri cannabis cultivation facility<\/a> this month as part of their work, went over the wide range of issues that they\u2019ve been discussing with officials and experts in recent months. The plan is to finalize a report with recommendations for the legislature heading into the new year.<\/p>\n<p>At\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-lawmakers-take-another-step-toward-legalizing-marijuana-at-second-of-three-committee-hearings\/\" target=\"_blank\" rel=\"noopener\">an earlier hearing in October<\/a>, members focused on the \u201cpublic policy implications\u201d of the reform, receiving testimony from stakeholders and advocates about\u00a0how to effectively regulate the market, touching on issues like track-and-trace, the pros and cons of licensing caps and the role that physicians should play.<\/p>\n<p>The bicameral committee,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-lawmakers-create-special-medical-marijuana-committee-to-prepare-issue-this-summer-for-2023-action\/\" target=\"_blank\" rel=\"noopener\">which was formed in June<\/a>,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-lawmakers-hold-first-of-three-medical-marijuana-hearings-with-plans-to-draft-new-reform-bill-in-coming-weeks\/\" target=\"_blank\" rel=\"noopener\">convened for an initial meeting<\/a>\u00a0in October that involved state officials, law enforcement and an Oklahoma medical cannabis regulator giving their perspective on the issue.<\/p>\n<p>In the midst of these discussions, a spokesperson for the top Kansas GOP senator recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-gop-kansas-senator-says-medical-marijuana-is-not-a-priority-as-committee-crafts-bill-prompting-democratic-pushback\/\" target=\"_blank\" rel=\"noopener\">said the issue is \u201cnot a priority\u201d<\/a>\u2014prompting pushback from House Democratic leadership.<\/p>\n<p>The spokesperson said that Senate President Ty Masterson (R) recognizes that the reform issue is \u201cmaturing,\u201d adding that any federal action \u201cwould be more evidence of that.\u201d However, \u201cit is not a priority\u201d for the senator, who wields significant influence over what legislation advances.<\/p>\n<p>While advocates were disappointed that lawmakers were unable to pass a medical cannabis bill by the end of the 2022 session in May\u2014despite considerable momentum and the support of Gov. Laura Kelly (D)\u2014the hope is that the committee\u2019s work will lay the groundwork for meaningful action when the legislature convenes again.<\/p>\n<p>The special\u00a0panel\u00a0is comprised of members appointed by the House speaker and Senate president.<\/p>\n<p>House Minority Leader Tom Sawyer (D) said in June that he\u2019s \u201cbeen pretty frustrated that we have yet to get a bill passed,\u201d while acknowledging that the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-medical-marijuana-hearings-cancelled-after-senate-gop-leader-reroutes-house-passed-bill\/\" target=\"_blank\" rel=\"noopener\">House voted to legalize medical marijuana<\/a>\u00a0last year only to see a relative lack of action in the Senate.<\/p>\n<p>The Senate did hold several hearings on cannabis reform this year, but members never got around to scheduling a vote. Late in the session, legislative leaders formed a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-house-lawmakers-unveil-proposed-medical-marijuana-compromise-with-senate-in-bicameral-conference-committee\/\" target=\"_blank\" rel=\"noopener\">bicameral conference committee that was tasked with arriving at a deal<\/a>\u00a0that could pass both chambers, although that didn\u2019t pan out by the time lawmakers adjourned.<\/p>\n<p>Democratic lawmakers made a final push to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-democrats-push-for-medical-marijuana-ahead-of-legislative-deadline\/\" target=\"_blank\" rel=\"noopener\">enact medical cannabis legalization before the legislative deadline<\/a>, but Olson said in May that the \u201cheavy load\u201d his committee had to carry on other issues meant that lawmakers would not be \u201cgetting this measure across the finish line this session.\u201d<\/p>\n<p>Members of the House and Senate Federal and State Affairs Committees held two public conference meetings in April to discuss a way to merge the House-passed medical marijuana bill with a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-senators-hold-first-of-three-medical-marijuana-legalization-hearings-in-committee\/\" target=\"_blank\" rel=\"noopener\">separate one that Senate lawmakers began considering<\/a>\u00a0this year. At the last official meeting, lawmakers from the House side went through areas where they were willing to concede to differences in the other chamber\u2019s bill, as well as provisions they wanted to keep from their own measure.<\/p>\n<p>Sawyer and Assistant Minority Leader Jason Probst (D) said in January that they wanted to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-kansas-democrats-unveil-plan-to-put-medical-and-adult-use-marijuana-legalization-on-the-2022-ballot\/\" target=\"_blank\" rel=\"noopener\">let voters decide on legalizing medical and adult-use marijuana<\/a>\u00a0in the state.<\/p>\n<p>The governor, for her part, wants to see medical cannabis legalization enacted, and she said earlier this year that she \u201cabsolutely\u201d thinks the bill could pass if \u201ceverything else doesn\u2019t take up all the oxygen.\u201d<\/p>\n<p>She previously pushed a separate proposal that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-governor-proposes-legalizing-medical-marijuana-to-fund-healthcare-expansion\/\" target=\"_blank\" rel=\"noopener\">legalize medical cannabis and use the resulting revenue<\/a>\u00a0to support Medicaid expansion, with Rep.
