{"id":59647,"date":"2022-12-20T11:31:37","date_gmt":"2022-12-20T19:31:37","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/12\/20\/va-updating-medical-marijuana-directive-for-veterans-thats-expiring-this-month-as-congress-pushes-it-to-not-interfere\/"},"modified":"2022-12-20T17:45:54","modified_gmt":"2022-12-21T01:45:54","slug":"va-updating-medical-marijuana-directive-for-veterans-thats-expiring-this-month-as-congress-pushes-it-to-not-interfere","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/12\/20\/va-updating-medical-marijuana-directive-for-veterans-thats-expiring-this-month-as-congress-pushes-it-to-not-interfere\/","title":{"rendered":"VA Updating Medical Marijuana Directive For Veterans That\u2019s Expiring This Month, As Congress Pushes It To \u2018Not Interfere\u2019"},"content":{"rendered":"<\/p>\n<p>The U.S. Department of Veterans Affairs (VA) is working on updating a directive that\u2019s set to expire this month concerning military veteran participation in state-legal medical marijuana programs\u2014and congressional lawmakers are telling the department to \u201cnot interfere\u201d in such activity.<\/p>\n<p>Lawmakers declined to put cannabis banking and a number of other drug policy reforms <a href=\"https:\/\/www.marijuanamoment.net\/congress-keeps-ban-on-d-c-marijuana-sales-while-failing-to-act-on-cannabis-banking-and-expungements\/\" target=\"_blank\" rel=\"noopener\">in a spending bill package released on Tuesday<\/a>\u2014but the relevant appropriations report attached to the legislation notes that VA is \u201cin the process of updating\u201d a Veterans Health Administration (VHA) directive that stipulates the agency\u2019s doctors can discuss marijuana use with veteran patients and that benefits can\u2019t be denied based solely on a patient\u2019s participation in a medical marijuana program.<\/p>\n<p>While advocates have welcomed to adoption of the existing directive, they\u2019ve taken issue with another key component that precludes VA doctors from issuing medical cannabis recommendations for veterans in states with legal programs. As a result, veterans have to go to outside doctors who may not be as closely familiar with their medical histories, or who may charge expensive fees, to fill out such forms.<\/p>\n<p>The congressional spending bill <a href=\"https:\/\/www.appropriations.senate.gov\/imo\/media\/doc\/Division%20J%20-%20Mil%20Con%20Statement%20FY23.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a> \u201cencourages the Department to not interfere with a veteran\u2019s decision to participate in such programs and document it appropriately, to the extent allowable under Federal law.\u201d<\/p>\n<p>It\u2019s unclear whether lawmakers are suggesting that VA maintain the current policy or expand that non-interference position in a way that would allow VA doctors to make cannabis recommendations, for example. That stipulation that the department avoid interfering \u201cto the extent allowable under Federal law\u201d seems to speak to a long-standing debate about whether recommending medical cannabis would put VA doctors at risk of prosecution for aiding and abetting federal crimes.<\/p>\n<p>Federal courts have already determined that doctors who simply recommend medical cannabis to their patients are protected under the First Amendment, but VA\u2019s concerns have caused uncertainty among lawmakers as to whether that protection extends to federally employed physicians.<\/p>\n<p>While the existing 2017 <a href=\"https:\/\/www.publichealth.va.gov\/marijuana.asp\" target=\"_blank\" rel=\"noopener\">directive<\/a> technically expires at the end of this month, it will stay in place even after that expiration until it\u2019s replaced or updated. An earlier version of the directive, which was enacted in 2011, expired in 2016 and <a href=\"https:\/\/www.marijuanamoment.net\/v-issues-new-medical-marijuana-policy-veterans\/\" target=\"_blank\" rel=\"noopener\">wasn\u2019t updated until the next year<\/a>.<\/p>\n<p>Veterans organizations have long criticized VA for opposing cannabis reform legislation, including proposals to mandate certain clinical trials into the medical efficacy of marijuana for certain conditions that commonly afflict veterans and allow VA doctors to issue medical cannabis recommendations in legal states.<\/p>\n<p>\u201cThe VA has been hostile to dismissive in dealing with cannabis and the VHA directive did little to protect veterans,\u201d Eric Goepel, founder and CEO of the Veterans Cannabis Coalition, told Marijuana Moment on Tuesday. \u201cLanguage encouraging the VA to modify how it interprets its own directive\u2014without any statutory oversight, enforcement, or even basic data collection\u2014does nothing.\u201d<\/p>\n<p>\u201cCongress continues to shirk its duties to actually legislate and the staggering rates of veteran suicide and overdose continue unabated,\u201d Goepel, who <a href=\"https:\/\/www.marijuanamoment.net\/as-canada-reimburses-medical-marijuana-for-military-veterans-the-u-s-keeps-failing-those-who-served-op-ed\/\" target=\"_blank\" rel=\"noopener\">separately discussed these issues in an op-ed for Marijuana Moment<\/a> in October, said. \u201cWithout descheduling and robust federal cannabis treatment research and development, the whole nation will continue to suffer.\u201d<\/p>\n<p>Earlier this month, a coalition of more than 20 veterans service organizations (VSOs) sent a letter to congressional leaders to urge the passage of the bipartisan VA Medicinal Cannabis Research Act <a href=\"https:\/\/www.marijuanamoment.net\/veterans-groups-demand-congress-pass-bill-on-va-medical-marijuana-research-before-session-ends\/\" target=\"_blank\" rel=\"noopener\">before the end of the current Congress<\/a>. With just a few weeks left during the lame duck session, however, the prospects of that happening are doubtful.<\/p>\n<p>The legislation <a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-approve-marijuana-research-bill-for-veterans-in-committee-vote\/\" target=\"_blank\" rel=\"noopener\">cleared a House committee last year<\/a>, despite the protests of VA officials who\u2019ve argued that it\u2019s unduly prescriptive. Earlier versions of the measure\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-file-another-marijuana-research-bill-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">moved through committee in 2020 and 2018<\/a>\u00a0as well, but they\u2019ve yet to become enacted into law.<\/p>\n<p>VA\u2019s more recent opposition to the proposal has come as a disappointment to advocates who had hoped the department under President Joe Biden would ultimately embrace the modest reform.<\/p>\n<p>Hopes were raised even higher after the bill sponsor, Rep. Lou Correa (D-CA), <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-key-house-committee-to-vote-on-federal-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">informed a separate House panel<\/a>\u00a0last year that he\u2019d had a conversation with VA Secretary Denis McDonough about the issue of marijuana and veterans.<\/p>\n<p>McDonough did say last year that\u00a0while current federal marijuana laws have prevented the department\u2019s physicians from recommending medical cannabis to military veterans, officials are <a href=\"https:\/\/www.marijuanamoment.net\/va-secretary-looking-at-medical-marijuana-policy-change-following-profound-discussion-with-veteran\/\" target=\"_blank\" rel=\"noopener\">\u201clooking at\u201d the possibility of an internal policy change<\/a> and have discussed it with the White House.<\/p>\n<p>More recently, a large-scale defense spending bill\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congress-pushes-military-to-consider-psychedelics-and-marijuana-therapy-while-other-cannabis-provisions-left-out-of-defense-bill\/\" target=\"_blank\" rel=\"noopener\">that was released following bicameral negotiations<\/a> this month excludes separate language from a previously House-passed version that would have authorized VA doctors to recommend medical cannabis to veterans living in states where it is legal.<\/p>\n<p>A joint explanatory statement for the National Defense Authorization Act (NDAA) did direct the Department of Defense to examine the potential of \u201cplant-based therapies\u201d like cannabis and certain psychedelics for service members, however.<\/p>\n<p>A VA official said in September that the department is monitoring research into the therapeutic potential of psychedelics \u201cvery, very closely,\u201d but that treatment involving the substances\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/va-says-psychedelic-therapy-not-part-of-standard-of-care-for-veterans-but-is-closely-following-research\/\" target=\"_blank\" rel=\"noopener\">is not yet part of the \u201cstandard of care\u201d<\/a>\u00a0for military veterans.<\/p>\n<p>Meanwhile, veteran advocates have also been pushing congressional leaders to take into account the population\u2019s needs as part of their work to craft a package of incremental marijuana reforms known as SAFE Plus.<\/p>\n<p>\u201cThere\u2019s no excuse for lawmakers to omit from a cannabis bill provisions that would have a material impact on thousands if not millions of veterans\u2019 lives,\u201d Nick Etten, founder and chairman of the Veterans Cannabis Project, <a href=\"https:\/\/www.marijuanamoment.net\/as-congress-considers-cannabis-reform-veterans-are-being-left-behind-op-ed\/\" target=\"_blank\" rel=\"noopener\">wrote in a recent op-ed for Marijuana Moment<\/a>. \u201cThere is a wide array of bills before Congress\u2013bills with overwhelming, bipartisan support\u2013that would implement simple, commonsense reforms on behalf of vets.\u201d<\/p>\n<p>But with SAFE Banking excluded from both NDAA and the new appropriations package\u2014and time running short in the lame duck session\u2014it seems likely that any additional cannabis reforms will be left to the 118th Congress to decide.<\/p>\n<p><strong>Here\u2019s the full text of the appropriations report section on VA\u2019s medical cannabis directive
