But thanks to his signature (or pledge thereof), the cannabis community is on the cusp of three major breakthroughs.<\/p>\n<h4 id=\"h-expungement-and-financial-access\"><strong>Expungement and Financial Access<\/strong><\/h4>\n<p>After a\u00a0long career of ambiguity\u00a0on the cannabis question, in October Biden encouraged advocates by\u00a0<a href=\"https:\/\/cannabisnow.com\/president-biden-sets-federal-cannabis-legalization-in-motion\/\">announcing pardons<\/a>\u00a0for all federal offenses of simple cannabis possession\u2014and calling on governors to follow suit on the state level (where it would have far more practical effect, since the big majority of such cases are under state law).<\/p>\n<p>Representatives Alexandria Ocasio-Cortez (D-NY) and Dave Joyce (R-OH) followed through on this move with a bill to incentivize state and local governments to expunge the criminal records of small-scale cannabis offenders. The Harnessing Opportunities by Pursuing Expungement (HOPE) Act\u00a0<a href=\"https:\/\/norml.org\/act\/federal-the-harnessing-opportunities-by-pursuing-expungement-hope-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">would appropriate<\/a>\u00a0$20 million dollars to the Justice Department for assisting states and localities in reviewing and expunging cannabis convictions.\u00a0<\/p>\n<p>This would appear to face slim odds in the lame-duck Congress, where the Democrats will maintain their razor-thin majority in the Senate but cede the House to similarly narrow GOP control pursuant to last month\u2019s mid-term elections. Senate Republicans have six times\u00a0<a href=\"https:\/\/globalganjareport.com\/node\/1894\">killed<\/a>\u00a0the\u00a0Secure &amp; Fair Enforcement (SAFE) Banking Act, which would allow cannabis businesses operating in conformity with state law to access financial services, including the federal banking system.\u00a0<\/p>\n<p>But now there is an initiative afoot to combine the two measures as a \u201cSAFE Plus\u201d bill. The idea has the support of Senate Majority Leader Chuck Schumer. On Oct. 31, Schumer told\u00a0<a href=\"https:\/\/finance.yahoo.com\/video\/cannabis-stocks-rise-amid-senator-194548780.html\" target=\"_blank\" rel=\"noreferrer noopener\">Yahoo! Finance<\/a>\u00a0that Congress is \u201cvery close to passing cannabis banking and expungement legislation,\u201d after he\u2019d made progress in swaying \u201ca bunch of Republican senators.\u201d<\/p>\n<p>And there have indeed been signs of GOP intransigence starting to bend on these questions\u2014the current version of the SAFE Banking Act was introduced in March by Sen. Steve Daines, a Montana Republican. In\u00a0<a href=\"https:\/\/www.daines.senate.gov\/2021\/03\/23\/daines-introduces-bipartisan-bill-to-increase-public-safety-support-montana-small-businesses\/\" target=\"_blank\" rel=\"noreferrer noopener\">announcing<\/a>\u00a0the bill, Daines said: \u201cMy bipartisan bill will provide needed certainty for legal Montana cannabis businesses and give them the ability to freely use banks, credit unions and other financial institutions without the fear of punishment. This, in turn, will help increase public safety, reduce crime, support Montana small businesses, create jobs and boost local economies. A win-win for all.\u201d<\/p>\n<p><a href=\"https:\/\/subscriber.politicopro.com\/article\/2022\/12\/doj-meets-with-offices-of-toomey-grassley-inhofe-to-discuss-cannabis-banking-00072199\">Politico<\/a>\u00a0now reports that in the countdown to the new Congress, which takes over in January, the Department of Justice has been meeting with staffers from the offices of Republican senators Pat Toomey of Pennsylvania, Jim Inhofe of Oklahoma and Chuck Grassley of Iowa to discuss concerns about the SAFE Banking Act. A DoJ\u00a0<a href=\"https:\/\/punchbowl.news\/wp-content\/uploads\/HR-1996-SAFE-Bank-Act-DOJ-TA-5.31.22.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">memo<\/a>\u00a0on the matter, requested by Senate Republicans and released last week by\u00a0<a href=\"https:\/\/punchbowl.news\/archive\/12222-punchbowl-news-am\/card\/16\/#group-16\" target=\"_blank\" rel=\"noreferrer noopener\">Punchbowl News<\/a>, states that some of the bill\u2019s\u00a0language \u201ccould significantly complicate law enforcement investigations and prosecutions.\u201d<\/p>\n<p>There is hope that if accommodations with the DoJ can be worked out and Republican fears allayed, SAFE Plus can be on Biden\u2019s desk by year\u2019s end\u2014with his signature practically a foregone conclusion. A spokesperson for Sen. Daines told\u00a0<em>Cannabis Now:<\/em>\u00a0\u201cDiscussions are ongoing and we\u2019re trying hard to get SAFE passed into law this year.\u201d<\/p>\n<h4><strong>Widening Medical Research<\/strong><\/h4>\n<p>On Dec. 2\u00a0President Biden\u00a0<a href=\"https:\/\/www.nj.com\/marijuana\/2022\/12\/biden-signs-law-to-boost-cannabis-research.html\" target=\"_blank\" rel=\"noreferrer noopener\">signed legislation<\/a>\u00a0getting the federal government out of the way of medical research into cannabis, and encouraging the development of new commercial drugs derived from the plant. \u00a0The bipartisan Medical Marijuana &amp; Cannabidiol Research Expansion Act was jointly\u00a0<a href=\"https:\/\/www.feinstein.senate.gov\/public\/index.cfm\/press-releases?id=F72220B0-7431-4762-9ED9-0DFF7A8EB66A\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a>\u00a0in the Senate by Grassley, Dianne Feinstein (D-CA) and Brian Schatz (D-HI), and won\u00a0<a href=\"https:\/\/www.senate.gov\/about\/glossary.htm#U\" target=\"_blank\" rel=\"noreferrer noopener\">unanimous consent<\/a>\u00a0in the upper chamber.<\/p>\n<p>A breakdown by legal analysis\u00a0<a href=\"https:\/\/www.bdlaw.com\/publications\/president-biden-signs-law-expanding-research-on-cannabis\/\" target=\"_blank\" rel=\"noreferrer noopener\">Beveridge &amp; Diamond<\/a>\u00a0notes that the new law has three major measures. It provides a mechanism for the scientific study of cannabis and cannabidiol (CBD) for medical purposes; it opens a pathway for the FDA to approve commercial production of drugs containing or derived from cannabis; and it protects doctors, who may now discuss with their patients the potential benefits or harms of using cannabis and cannabis derivatives.\u00a0\u00a0<\/p>\n<p>Passage of the law is raising high hopes for prompt Congressional action on SAFE Plus.\u00a0<\/p>\n<h4><strong>Last-Minute Setback<\/strong><\/h4>\n<p>Chuck Schumer was mustering support to get SAFE Plus included as a rider in the must-pass National Defense Authorization Act. He won support for this plan from Senate Republicans including Dan Sullivan of Alaska and Rand Paul of Kentucky.
