{"id":59376,"date":"2022-12-14T09:00:03","date_gmt":"2022-12-14T17:00:03","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/12\/14\/nearly-2-million-marijuana-convictions-have-been-pardoned-or-expunged-in-the-u-s-in-the-past-five-years-new-report-shows\/"},"modified":"2022-12-14T17:45:41","modified_gmt":"2022-12-15T01:45:41","slug":"nearly-2-million-marijuana-convictions-have-been-pardoned-or-expunged-in-the-u-s-in-the-past-five-years-new-report-shows","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/12\/14\/nearly-2-million-marijuana-convictions-have-been-pardoned-or-expunged-in-the-u-s-in-the-past-five-years-new-report-shows\/","title":{"rendered":"Nearly 2 Million Marijuana Convictions Have Been Pardoned Or Expunged In The U.S. In The Past Five Years, New Report Shows"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/12\/MM_Bill_Tracker_V5_blank-56.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>State government officials have provided nearly 2 million pardons and expungements to people with low-level marijuana convictions over recent years, according to a new analysis from NORML.<\/p>\n<p>There\u2019s been renewed national interest in cannabis clemency since <a href=\"https:\/\/www.marijuanamoment.net\/biden-announces-mass-marijuana-pardons-and-calls-for-cannabis-scheduling-review\/\" target=\"_blank\" rel=\"noopener\">President Joe Biden issued a mass marijuana pardon<\/a> in October, forgiving several thousands Americans who\u2019ve committed federal possession offenses and <a href=\"https:\/\/www.marijuanamoment.net\/will-governors-issue-marijuana-pardons-following-bidens-call-to-action-dozens-are-already-weighing-in\/\" target=\"_blank\" rel=\"noopener\">encouraging governors to follow the administration\u2019s lead<\/a>.<\/p>\n<p>But while the presidential action has been viewed by advocates as a welcome step in the right direction, it\u2019s severely limited in scope, due in large part to the fact that vast majority of marijuana cases take place at the state level, falling outside of the president\u2019s jurisdiction.<\/p>\n<p>Some governors have taken clemency action in the weeks since Biden\u2019s mass pardon, but many other state and local officials had moved to provide similar relief even before the president stepped up.<\/p>\n<p>A new report published by NORML on Wednesday examines publicly available data from across the country, showing how officials have provided about 100,000 pardons and 1.7 million expungements since 2018.<\/p>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/norml\/posts\/pfbid025wrJu9v9vmA88L9djzfMbGRTBwbihTg3CdVP4r3vVXoQbihxjowP48pY2UwSN8JAl\" data-width=\"552\" \/>\n<p>\u201cHundreds of thousands of Americans unduly carry the burden and stigma of a past conviction for behavior that most Americans, and a growing number of states, no longer consider to be a crime,\u201d NORML Deputy Director Paul Armentano <a href=\"https:\/\/norml.org\/blog\/2022\/12\/14\/norml-report-highlights-state-efforts-to-provide-expungement-relief-to-millions-with-low-level-cannabis-convictions\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cOur sense of justice and our principles of fairness demand that public officials and the courts move swiftly to right the past wrongs of cannabis prohibition and criminalization.\u201d<\/p>\n<p><strong>Here\u2019s are <a href=\"https:\/\/norml.org\/marijuana\/fact-sheets\/marijuana-pardons-and-expungements-by-the-numbers\/\" target=\"_blank\" rel=\"noopener\">key examples<\/a> of cannabis clemency that state and local officials have facilitated over the past four years:\u00a0<\/strong><\/p>\n<h3>Pardons<\/h3>\n<p>Nevada Gov. Steve Sisolak (D) has made a consistent effort to right the wrongs of criminalization. In 2020, for example, he <a href=\"https:\/\/www.marijuanamoment.net\/nevada-pardons-more-than-15000-people-with-marijuana-convictions-under-governors-resolution\/\" target=\"_blank\" rel=\"noopener\">pardoned more than 15,000 people<\/a>\u00a0who were convicted for low-level cannabis possession. That action was made possible under\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nevada-governor-introduces-measure-to-pardon-tens-of-thousands-with-marijuana-convictions\/\" target=\"_blank\" rel=\"noopener\">a resolution the governor introduced<\/a>\u00a0that was unanimously approved by the state\u2019s Board of Pardons Commissioners.<\/p>\n<p>In 2019, Washington State Gov. Jay Inslee (D) announced that people with misdemeanor marijuana possession convictions on their records <a href=\"https:\/\/www.marijuanamoment.net\/washington-governor-will-pardon-people-with-marijuana-possession-convictions-he-announces\/\" target=\"_blank\" rel=\"noopener\">were eligible to receive an expedited pardon<\/a>. He estimated that 3,500 Washington residents would qualify for the relief.<\/p>\n<p>One day before legal recreational marijuana sales launched in Illinois in 2019, Gov. J.B. Pritzker (D) announced that his office was pardoning more than 11,000 people <a href=\"https:\/\/www.marijuanamoment.net\/illinois-governor-pardons-over-11000-people-for-marijuana-one-day-before-legal-sales-begin\/\" target=\"_blank\" rel=\"noopener\">who had previously been convicted of simple cannabis possession<\/a>.<\/p>\n<p>Kansas City Mayor Quinton Lucas (D) facilitated pardons for 8,000 residents with marijuana records in 2020, and he followed up later that year by introducing an ordinance to <a href=\"https:\/\/www.marijuanamoment.net\/kansas-city-mayor-files-measure-to-remove-all-local-penalties-for-marijuana-possession\/\" target=\"_blank\" rel=\"noopener\">end all penalties for marijuana possession<\/a> under the municipality\u2019s local laws.<\/p>\n<p>Colorado Gov. Jared Polis (D) <a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-says-new-marijuana-clemency-plan-will-be-announced-within-days\/\" target=\"_blank\" rel=\"noopener\">announced last year that he granted 1,351 pardons<\/a> for convictions of possession of two ounces or less of marijuana. Previously, he signed an executive order <a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-grants-thousands-of-marijuana-pardons-with-new-clemency-powers\/\" target=\"_blank\" rel=\"noopener\">granting nearly 3,000 pardons<\/a> for people convicted of possession one ounce of less of cannabis.<\/p>\n<p>Birmingham, Alabama Mayor Randall Woodfin (D) <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-congressional-committee-holds-marijuana-legalization-hearing\/\" target=\"_blank\" rel=\"noopener\">said at a congressional hearing last month<\/a> that he\u2019s processed about 23,000 pardons for residents with cannabis records.<\/p>\n<p>Gov. Tom Wolf (D) launched the statewide pardon initiative in October, touting it as an opportunity to let citizens have minor cannabis possession convictions cleared from their records. And while officials touted the fact that it received about 3,500 clemency applications, it was recently reported that <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-marijuana-pardon-initiative-disappoints-as-thousands-of-applicants-are-rejected\/\" target=\"_blank\" rel=\"noopener\">only a couple hundred have been conditionally approved<\/a>.<\/p>\n<p>The governor of Oregon recently granted a mass pardon for state-level marijuana possession offenses that will <a href=\"https:\/\/www.marijuanamoment.net\/oregon-governor-issues-marijuana-pardons-for-45000-people\/\" target=\"_blank\" rel=\"noopener\">provide relief to an estimated 45,000 people<\/a>\u2014a move that she <a href=\"https:\/\/www.marijuanamoment.net\/oregon-governor-says-her-mass-marijuana-pardons-are-truly-an-act-of-mercy\/\" target=\"_blank\" rel=\"noopener\">described as \u201ctruly an act of mercy\u201d<\/a> and that <a href=\"https:\/\/www.marijuanamoment.net\/biden-cheers-oregon-for-following-his-lead-with-marijuana-pardons\/\" target=\"_blank\" rel=\"noopener\">received praise from Biden<\/a>.<\/p>\n<p>Wisconsin Gov. Tony Evers (D) has <a href=\"https:\/\/www.marijuanamoment.net\/wisconsin-governor-grants-marijuana-and-drug-related-pardons-setting-state-clemency-record\/\" target=\"_blank\" rel=\"noopener\">granted hundreds of pardons during his tenure<\/a>, primarily for people convicted of non-violent marijuana or other drug offenses.<\/p>\n<p>\u201cWhile pardons provide a level of forgiveness for past crimes, these are not the same as expungements\u2014which seal past convictions from public view,\u201d the NORML report says. \u201cTo facilitate the latter, lawmakers in many states in recent years have enacted laws providing explicit pathways to expunge the records of those with low-level marijuana convictions.\u201d<\/p>\n<p>\u201cIn some cases, those eligible for expungement relief are not required to take any action,\u201d it continued. \u201cInstead, state officials automatically review past records and notify those who meet the state\u2019s criteria for expungement. And legislation <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-10-marijuana-bills-including-interstate-commerce-employment-protections-and-record-sealing\/\" target=\"_blank\" rel=\"noopener\">Gov. Gavin Newsom (D) signed in September<\/a> to build upon the relief provisions of the cannabis law is expect to facilitate about 34,000 more expungements.<\/p>\n<p>The governor of Illinois has touted that <a href=\"https:\/\/www.marijuanamoment.net\/illinois-governor-announces-half-a-million-marijuana-expungements-and-pardons\/\" target=\"_blank\" rel=\"noopener\">more than 500,000 expungements and pardons<\/a> had been processed for people with low-level marijuana offenses on their records in late 2020. He also signed a bill in June to make it so courts <a href=\"https:\/\/www.marijuanamoment.net\/illinois-governor-signs-bill-to-close-marijuana-expungement-loophole\/\" target=\"_blank\" rel=\"noopener\">cannot deny petitions to expunge or seal records<\/a> based on a positive drug test for marijuana.<\/p>\n<p>The New Jersey Judiciary announced last year that the state had <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-has-expunged-a-third-of-a-million-marijuana-convictions-since-july\/\" target=\"_blank\" rel=\"noopener\">expunged more than 362,000 marijuana cases<\/a>, when a decriminalization law took effect that mandated the relief for people who have been caught up in prohibition enforcement.<\/p>\n<p>More than 150,000 marijuana possession convictions in New York <a href=\"https:\/\/www.marijuanamoment.net\/new-york-launches-process-for-destroying-marijuana-conviction-records\/\" target=\"_blank\" rel=\"noopener\">were automatically expunged in 2019<\/a>, and that number has grown to 200,000 as of 2021, NORML said.
