But it was reported on Tuesday that appropriators have reached an agreement on a \u201cframework\u201d for the legislation. What\u2019s troubling for supporters, however, is a brief <a href=\"https:\/\/twitter.com\/bresreports\/status\/1602831272518336512\" target=\"_blank\" rel=\"noopener\">post<\/a> from a Punchbowl News reporter saying that the Secure and Fair Enforcement (SAFE) Banking \u201cwill not be included\u201d in the package.<\/p>\n<p>This comes on the heels of comments from the GOP Senate whip who said he\u2019s not expecting the cannabis proposal to be attached to the spending bill, either. And Senate Minority Leader Mitch McConnell (R-KY), who applauded the <a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-decline-to-put-marijuana-reform-in-defense-bill-as-new-details-surface-on-safe-plus-package\/\" target=\"_blank\" rel=\"noopener\">exclusion of SAFE Banking from a must-pass defense bill<\/a> last week, has repeatedly signaled that he\u2019d <a href=\"https:\/\/www.marijuanamoment.net\/mcconnell-brags-about-marijuana-banking-defeat-in-defense-bill-signaling-hell-fight-to-stop-it-in-omnibus-spending-too\/\" target=\"_blank\" rel=\"noopener\">fight against attempts to advance it through appropriations<\/a> as well.<\/p>\n<p>In his latest comments on the spending package on Wednesday, McConnell said that \u201cpoison pills\u2026will need to stay away from the process.\u201d<\/p>\n<p>\u201cEven then, the calendar will still make this a challenging sprint,\u201d the minority leader said. \u201cIf a truly bipartisan full-year bill without poison pills is ready for Senate passage by late next week, then I\u2019ll support it\u2026 Otherwise, we\u2019ll be passing a short-term continuing resolution into the new year.\u201d<\/p>\n<p \/>\n<p>A continuing resolution that\u2019s currently advancing in the House would keep the government funded through December 23. The deadline under current law is this Friday.<\/p>\n<p>McConnell has previously referred to marijuana banking as a \u201cpoison pill\u201d in the context of other large-scale legislation, but he didn\u2019t explicitly reference the reform in these latest remarks. Still, it\u2019s not an especially encouraging position for advocates who view appropriations as one of the last remaining vehicles for SAFE Banking or a broader SAFE Plus package that could include expungements and other cannabis provisions, short of moving it as a standalone before Congress adjourns for the session.<\/p>\n<p>All of that is to say that there\u2019s a fair amount of pessimism as the clock ticks down. But not everyone shares that sentiment, including SAFE Banking sponsor Rep. Ed Perlmutter (D-CO), who has made abundantly clear that he\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-sponsor-lays-out-plan-to-advance-reform-after-exclusion-from-defense-bill-sharply-rebuking-senate-blockade\/\" target=\"_blank\" rel=\"noopener\">unwilling to give up the push<\/a> and will continue to seek the bill\u2019s passage before his retirement at the end of the 117th Congress.<\/p>\n<p>A staffer in Perlmutter\u2019s office told Marijuana Moment on Wednesday that while there\u2019s uncertainty about advancing cannabis banking reform through the omnibus spending bill, the congressman \u201cis still pushing as hard as he can and talking to leadership.\u201d<\/p>\n<p>Perlmutter said at a House Rules Committee meeting on Tuesday that SAFE Banking is <a href=\"https:\/\/www.marijuanamoment.net\/house-marijuana-banking-sponsor-and-key-senator-keep-up-fight-while-gop-whip-tempers-expectations-and-clock-ticks-down\/\" target=\"_blank\" rel=\"noopener\">one of two \u201coutstanding matters that I\u2019m still working on.\u201d<\/a> After the reform was left out of the National Defense Authorization Act (NDAA) last week, he said he was looking at appropriations as an alternative vehicle, but at this point he said he\u2019s just intent on adding it to \u201csomething.\u201d<\/p>\n<p>With each day that passes in the lame duck, there\u2019s growing frustration and anxiety among advocates and stakeholders, some of whom feel that this may be the last chance in the short-term to get marijuana banking enacted before Republicans reclaim the majority in the House starting on January 3.<\/p>\n<p>For his part, Sen. Cory Booker (D-NJ) has pinned blame on McConnell, <a href=\"https:\/\/www.nj.com\/marijuana\/2022\/12\/mitch-mcconnell-is-blocking-all-marijuana-legislation-in-congress-njs-booker-says.html\" target=\"_blank\" rel=\"noopener\">telling<\/a> NJ.com that his vocal opposition to cannabis reform has had a chilling effect of GOP members who might otherwise be amenable to passing legislation that contains SAFE Banking language.<\/p>\n<p>\u201cThey\u2019re dead set on anything in marijuana,\u201d he said, referring to Republican leadership. \u201cThat to me is the obstacle.\u201d<\/p>\n<p>\u201cThe caucus is clearly divided but the people in power in their caucus are clearly against doing anything on marijuana,\u201d he added.<\/p>\n<p>While McConnell\u2019s influence on the issue during the lame duck seems apparent, however, many industry stakeholders feel that Senate Majority Leader Chuck Schumer (D-NY) shares at least some of the blame, arguing that it\u2019s incumbent on him to leverage the Democratic majority and force floor consideration of the incremental reform.<\/p>\n<p>It\u2019s the least he could do, they say, given his earlier promises to bring comprehensive legalization to the floor.<\/p>\n<p style=\"padding-left: 40px\"><strong><a href=\"https:\/\/www.leafly.com\/news\/politics\/vote-democrat-to-legalize-it-sen-chuck-schumer-tells-leafly\" target=\"_blank\" rel=\"noopener\">September 2020:<\/a><\/strong> \u201cMy commitment is that, if I am leader, I am going to do everything I can to put the Marijuana Freedom and Opportunity Act [his earlier legalization bill] on the floor of the Senate,\u201d Schumer, as then-minority leader, said. \u201cThe odds are very high it will pass.\u201d<\/p>\n<p style=\"padding-left: 40px\"><strong><a href=\"https:\/\/www.marijuanamoment.net\/chuck-schumer-says-marijuana-legalization-will-be-prioritized-if-democrats-retake-senate\/\" target=\"_blank\" rel=\"noopener\">October 2020<\/a>:<\/strong> \u201cIf I become majority leader, I put this on the floor and it\u2019s likely to pass.\u201d<\/p>\n<p style=\"padding-left: 40px\"><strong><a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-could-advance-even-under-mcconnell-top-senate-democrat-says\/\" target=\"_blank\" rel=\"noopener\">December 2020:<\/a><\/strong> \u201cIf I become majority leader, I put it on the floor, and my guess\u2026it\u2019ll pass. It\u2019ll get Democratic and Republican votes.\u201d<\/p>\n<p style=\"padding-left: 40px\"><strong><a href=\"https:\/\/www.marijuanamoment.net\/schumer-says-federal-marijuana-legalization-bill-will-hit-senate-floor-soon\/\" target=\"_blank\" rel=\"noopener\">April 2021:<\/a><\/strong> \u201cI am going to put this bill on the floor soon,\u201d Schumer said, at the time referring to his yet-to-be-filed CAOA.<\/p>\n<p>But even before he, Booker and Senate Finance Committee Chairman Ron Wyden (D-OR) filed their much-anticipated legalization bill\u2014the Cannabis Administration and Opportunity Act (CAOA)\u2014in July, it became clear that they did not have the 60 votes needed to clear the Senate and hopes of ending prohibition this Congress were dashed.<\/p>\n<p>Whether it was wishful thinking, strategy or something in-between, those promises did not ultimately materialize.<\/p>\n<p>Of course, political dynamics shift\u2014and the steep 60-vote threshold for Senate passage was likely a key part of the calculus in <em>not<\/em> following through on that commitment\u2014but now many advocates are left wondering why he doesn\u2019t at least take this lame duck opportunity to use his power to bring SAFE Banking or SAFE Plus to the floor, where it\u2019d presumably enjoy modest bipartisan support, before entering into a divided Congress next year.<\/p>\n<p>It\u2019s not as if everyone has accepted the idea that a Democratic Senate and GOP House means that incremental reform is dead on arrival in the 118th Congress. There are some who even believe that House Republicans may take the chance to seize the issue from Democrats with their new majority\u2014which is certainly the hope of pro-legalization Rep. Nancy Mace (R-SC).<\/p>\n<p>The congresswoman said in a since-deleted tweet on Wednesday that \u201cSAFE Banking is a good bill and it\u2019s a shame all the misinformation about how its passage was imminent. He added that lawmakers are \u201cthis close to a deal,\u201d placing his thumb and index fingers about an inch apart.<\/p>\n<p>Last week, SAFE Banking sponsor Sen. Jeff Merkley (D-OR) said that he will \u201ckeep fighting\u201d to get the reform \u201cpassed this year,\u201d adding that \u201cthis is not the end of the road.\u201d<\/p>\n<p>\u201cWe need to make sure that legal cannabis businesses have access to the financial services they need\u2014operating in cash is an open door to robbery and money laundering,\u201d he said. That\u2019s also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/as-congress-stalls-on-marijuana-banking-new-report-details-public-safety-risk-of-cash-intensive-dispensaries\/\" target=\"_blank\" rel=\"noopener\">a point highlighted in a recent analysis<\/a>\u00a0that looked at the trends and motivations for crimes targeting cannabis businesses in Washington State.<\/p>\n<p>One senator who could make or break the final SAFE deal in appropriations is Sen. Patty Murray (D-WA), who will serve as Senate president pro tempore for the 118th Congress, is also pushing for passage of the cannabis banking reform during the lame duck, which she discussed at a leadership briefing with Schumer last week.<\/p>\n<p>Murray said that Democrats have made significant progress on a number of issues, even with the slimmest possible majority in the Senate. She said that \u201cwe are not done yet,\u201d and there are areas of bipartisan consensus that can still advance before the end of the session, which includes \u201cmaking sure our legal cannabis businesses can access credit.\u201d<\/p>\n<p>Whether SAFE or SAFE Plus makes it into the forthcoming appropriations deal is yet to be seen.
