{"id":58860,"date":"2022-12-02T13:50:22","date_gmt":"2022-12-02T21:50:22","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/12\/02\/new-jersey-marijuana-regulators-approve-rules-for-public-cannabis-consumption-areas\/"},"modified":"2022-12-02T17:45:41","modified_gmt":"2022-12-03T01:45:41","slug":"new-jersey-marijuana-regulators-approve-rules-for-public-cannabis-consumption-areas","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/12\/02\/new-jersey-marijuana-regulators-approve-rules-for-public-cannabis-consumption-areas\/","title":{"rendered":"New Jersey Marijuana Regulators Approve Rules For Public Cannabis Consumption Areas"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/12\/MM_Bill_Tracker_V5_blank-9.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>New Jersey marijuana regulators approved rules for \u201cpublic cannabis consumption areas\u201d on Friday, bringing the state one step closer to providing the social use option to adults and patients.<\/p>\n<p>Adult-use cannabis shops opened in April, but advocates have emphasized the need to implement regulations that give people additional spaces for where they can lawfully consume.<\/p>\n<p>On Friday, the New Jersey Cannabis Regulatory Commission (CRC) moved closer to achieving that goal by approving requirements for the consumption sites and fees for businesses that operate them.<\/p>\n<p>\u201cEquitable access to cannabis means everyone who wishes to consume has some place they can do that\u2014legally, safely, and responsibly,\u201d CRC Chair Dianna Houenou said in a press release. \u201cWhen regulated properly, cannabis consumption areas can strengthen the industry, while giving people more choices on where they consume.\u201d<\/p>\n<p \/>\n<p>Food items could not be sold on-site under the draft rules, though people would be able to bring their own food or have it delivered. Alcohol and tobacco could not be sold or consumed at the cannabis consumption sites.<\/p>\n<p>The proposed application fee and microbusiness and standard license fees for the facilities would be $1,000. They could operate indoors or outdoors, but the latter would need to be enclosed.<\/p>\n<p>\u201cI\u2019m very excited that we\u2019re pushing this forward because it is a safe space for consumers and patients,\u201d one commissioner said ahead of the vote to approve the draft rules. \u201cIt\u2019s definitely another stride for the commission, so I\u2019m really excited that we were able to put this together on a timely manner.\u201d<\/p>\n<p>Before the rules are finalized, they will be posted in the New Jersey Register, after which point they will be subject to a 60-day public comment period.<\/p>\n<p>CRC further approved 113 conditional cannabis licenses, eight annual licenses and six conversations from conditional to annual at their meeting on Friday.<\/p>\n<p>The public consumption development in New Jersey comes just days after Nevada regulators announced the winners of the state\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/nevada-regulators-award-states-first-marijuana-consumption-lounge-licenses-in-lottery-drawings\/\" target=\"_blank\" rel=\"noopener\">first cannabis lounge licensees<\/a>.<\/p>\n<p>In 2019, Alaska became the first state to enact regulations that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/alaska-is-officially-the-first-state-to-legalize-on-site-marijuana-consumption\/\" target=\"_blank\" rel=\"noopener\">provide for the on-site use option at dispensaries<\/a>.<\/p>\n<p>Colorado followed suit with legislation approved that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bills-allowing-marijuana-deliveries-and-tasting-rooms-head-toward-colorado-governors-desk\/\" target=\"_blank\" rel=\"noopener\">legalized cannabis \u201ctasting rooms\u201d and \u201cmarijuana hospitality establishments\u201d<\/a>\u00a0where adults could freely use cannabis.<\/p>\n<p>Social consumption sites are also provided for in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-signs-marijuana-legalization-bill-hours-after-lawmakers-put-it-on-his-desk\/\" target=\"_blank\" rel=\"noopener\">New York\u2019s recently enacted marijuana legalization law<\/a>, though it\u2019s not clear how long after the first retailers open that such activity will be authorized.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana governor also recently said that <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-governor-says-state-should-revisit-marijuana-home-grow-ban-after-market-matures\/\" target=\"_blank\" rel=\"noopener\">the state should \u201crevisit\u201d its current criminalization<\/a> of homegrown marijuana for personal use\u2014but he thinks that conversation should happen at a later point after the commercial market has matured.<\/p>\n<p>In October, the New Jersey Assembly separately approved a bill that would allow licensed marijuana businesses <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-lawmakers-approve-bill-to-let-marijuana-businesses-claim-state-tax-deductions-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\">to deduct certain expenses on their state tax returns<\/a>, a partial remedy as the industry continues to be blocked from making federal deductions under Internal Revenue Service (IRS) code known as 280E.<\/p>\n<p>While the adult-use market is still developing, it\u2019s already proven profitable, with\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-recreational-marijuana-sales-hit-80-million-since-post-4-20-launch\/\" target=\"_blank\" rel=\"noopener\">the state reporting about $80 million in marijuana sales<\/a>\u00a0in the first ten weeks after retailers opened shop in April.<\/p>\n<p>A bill filed by Senate President Nicholas Scutari (D) over the summer would also authorize the governor to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-senate-president-files-bill-to-allow-interstate-marijuana-commerce\/\" target=\"_blank\" rel=\"noopener\">enter into agreements for interstate marijuana commerce<\/a>\u00a0with other states that have legalized cannabis.
