Kate Brown\u2019s (D) cannabis clemency action\u2014which also involves forgiveness for more than $14 million in fines and fees\u2014comes about a month after President Joe Biden issued thousands of pardons for federal marijuana possession cases and called on governors to follow suit.<\/p>\n<p>\u201cNo one deserves to be forever saddled with the impacts of a conviction for simple possession of marijuana\u2014a crime that is no longer on the books in Oregon,\u201d Brown said in a press release. \u201cOregonians should never face housing insecurity, employment barriers, and educational obstacles as a result of doing something that is now completely legal, and has been for years.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">No one deserves to be saddled with the impacts of a simple possession of marijuana conviction\u2014a crime that is no longer on the books in Oregon. I am pardoning these prior Oregon offenses, an act that will impact an estimated 45,000 individuals. <a href=\"https:\/\/t.co\/mT9bcYzCcV\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/mT9bcYzCcV<\/a><\/p>\n<p>\u2014 Governor Kate Brown (@OregonGovBrown) <a href=\"https:\/\/twitter.com\/OregonGovBrown\/status\/1594771812441026560?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">November 21, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cMy pardon will remove these hardships,\u201d she said, adding that \u201cwhile Oregonians use marijuana at similar rates, Black and Latina\/o\/x people have been arrested, prosecuted, and convicted at disproportionate rates.\u201d<\/p>\n<p>Pardons typically provide more limited relief than expungements, but the governor said the the Oregon Judicial Department will additionally be working with courts to formally seal all applicable possession records.<\/p>\n<p>Brown\u2019s office says that they\u2019ve identified 47,144 convictions for possession of up to one ounce of marijuana that took place before 2016 that will be cleared from the records of an estimated 45,000 people.<\/p>\n<p>\u201cWe are a state, and a nation, of second chances. Today, I am taking steps to right the wrongs of a flawed, inequitable, and outdated criminal justice system in Oregon when it comes to personal marijuana possession,\u201d the governor <a href=\"https:\/\/mailchi.mp\/oregon\/news-releasegovernor-kate-brown-grants-pardon-for-oregon-marijuana-offenses\" target=\"_blank\" rel=\"noopener\">said<\/a> on Monday. \u201cFor the estimated 45,000 individuals who are receiving a pardon for prior state convictions of marijuana possession, this action will help relieve the collateral consequences arising from these convictions.\u201d<\/p>\n<p>The fact that the estimated relief for possession cases alone in one state is in the tens of thousands underscores what advocates have been pointing out in the weeks since Biden\u2019s clemency announcement: the vast majority of marijuana convictions take place at the state level, which the president has no power to remedy.<\/p>\n<p>Governors from states across the U.S. <a href=\"https:\/\/www.marijuanamoment.net\/will-governors-issue-marijuana-pardons-following-bidens-call-to-action-dozens-are-already-weighing-in\/\" target=\"_blank\" rel=\"noopener\">have given mixed responses about their plans<\/a> for marijuana clemency in light of the president\u2019s directive, with some pledging to analyze their options and others noting that their authority is limited.<\/p>\n<p>Congressional researchers released a report last week <a href=\"https:\/\/www.marijuanamoment.net\/congressional-researchers-lay-out-six-key-limitations-of-bidens-marijuana-pardons\/\" target=\"_blank\" rel=\"noopener\">that provides a point-by-point overview<\/a> of the limitations of the president\u2019s mass marijuana pardon, including that state restriction.<\/p>\n<p>Following Biden\u2019s pardon proclamation, the federal U.S. Sentencing Commission (USCC) released a detailed analysis showing the geographic and demographic breakdown of those who are eligible for relief.<\/p>\n<p>Consistent with the estimates highlighted by the White House last month, USSC found that <a href=\"https:\/\/www.marijuanamoment.net\/federal-report-details-whos-impacted-by-bidens-marijuana-pardon-action-state-by-state\/\" target=\"_blank\" rel=\"noopener\">6,577 U.S. citizens have committed the covered offense<\/a>. The independent federal organization further identified 1,122 cases involving what it described as \u201cresident\/legal alien offenders.\u201d<\/p>\n<p>Activists with Students for Sensible Drug Policy (SSDP), Last Prisoner Project (LPP) and DCMJ\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/activists-stage-white-house-protest-to-push-biden-to-release-marijuana-prisoners\/\" target=\"_blank\" rel=\"noopener\">staged protests outside of the White House last month<\/a> to demand that Biden also release the estimated 2,800 people currently in federal prison for marijuana convictions that aren\u2019t limited to simple possession.<\/p>\n<p>The presidential clemency is also limited by the fact that non-citizens with cannabis possession records were specifically excluded from pardons\u2014an issue that\u2019s been identified by numerous advocacy groups and lawmakers.<\/p>\n<p>For example, nine congressional lawmakers sent a letter to Biden last week, imploring him to <a href=\"https:\/\/www.marijuanamoment.net\/aoc-leads-lawmakers-in-pushing-biden-to-extend-marijuana-pardons-to-immigrants\/\" target=\"_blank\" rel=\"noopener\">extend his pardons include immigrants<\/a>\u00a0who have citizenship status issues. They are also urged him to \u201cprioritize\u201d decriminalization or descheduling.<\/p>\n<p>Rep. Alexandria Ocasio-Cortez (D-NY) previously\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/aoc-criticizes-bidens-exempting-undocumented-immigrants-from-marijuana-pardon-saying-democrats-must-step-up-to-win-latino-votes\/\" target=\"_blank\" rel=\"noopener\">called for an expansion of the president\u2019s pardons<\/a>, stressing the importance of having a Democratic Party that proactively stands up for Latino communities, including the immigrant population.
