Jacky Rosen (D-NV) introduced the legislation on Thursday, amid a week of significant congressional activity on cannabis reform issues.<\/p>\n<p>The senator\u2019s proposal would prevent SBA from denying a series of loans and other services\u2014including disaster relief, microloans and technical assistance\u2014to businesses solely because they are involved in state-legal cannabis markets.<\/p>\n<p>\u201cThe unfair barriers to basic federal support and resources have hurt our state\u2019s legally-operating cannabis small businesses,\u201d\u00a0 Rosen told Marijuana Moment. \u201cThis legislation will level the playing field so that cannabis small businesses\u2014including those owned by people of color, women, and veterans\u2014have access to the same federal resources and loans that other legal businesses are entitled to.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Legally-operating cannabis small businesses in NV &amp; across the country deserve full access to <a href=\"https:\/\/twitter.com\/SBAgov?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@SBAgov<\/a> loans &amp; resources.<\/p>\n<p>That\u2019s why I&#8217;m introducing a bill to level the playing field &amp; lift the current restrictions that bar cannabis small businesses from accessing SBA loans.<\/p>\n<p>\u2014 Senator Jacky Rosen (@SenJackyRosen) <a href=\"https:\/\/twitter.com\/SenJackyRosen\/status\/1593731121706958850?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">November 18, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The \u201cFair Access for Cannabis Small Businesses Act\u201d contains <a href=\"https:\/\/www.marijuanamoment.net\/new-house-bills-would-make-cannabis-businesses-eligible-for-federal-small-business-aid\/\" target=\"_blank\" rel=\"noopener\">similar provisions to a House bill filed last year<\/a> by Rep. Nydia Vel\u00e1zquez (D-NY), though that legislation also contained broader language to remove marijuana from the Controlled Substances Act (CSA).<\/p>\n<p>The new <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/5131\" target=\"_blank\" rel=\"noopener\">bill<\/a> does\u2019t have those federal legalization provisions, but it would amend the Small Business Act to add language to various sections stipulating that loans and services can\u2019t be denied \u201csolely because the borrower is a cannabis-related legitimate business or service provider.\u201d<\/p>\n<p>Rosen\u2019s legislation also includes a couple additional amendments to the Small Business Act that were not included in Vel\u00e1zquez\u2019s bill, such as ensuring that cannabis businesses can access \u201cassistance from resource partners\u201d and service providers like small business development centers, women\u2019s business centers and veteran business outreach centers.<\/p>\n<p>.A section on SBA technical assistance would also be uniquely amended under Rosen\u2019s bill to support the cannabis industry.<\/p>\n<p>\u201cFor Black and brown communities that have been ravaged by the war on drugs for decades, there is a light at the end of the tunnel as the end of cannabis prohibition comes near,\u201d U.S. Cannabis Council (USCC) CEO Khadijah Tribble said in a press release on Friday. \u201cBut without access to capital through financing tools like SBA loans, most Black and brown cannabis entrepreneurs won\u2019t get the chance to profit from an industry that was once used to stigmatize them\u2014even in states where the plant has been legalized.\u201d<\/p>\n<p>Rosen, who serves on the Senate Small Business Committee, has been a longstanding advocate pushing for reform at the SBA to treat the cannabis industry no differently than other traditional markets.<\/p>\n<p>Over the summer, Rosen asked colleagues on the powerful Appropriations Committee to include provisions in a spending bill to <a href=\"https:\/\/www.marijuanamoment.net\/senator-urges-colleagues-to-give-marijuana-businesses-access-to-federal-sba-loans-and-services\/\" target=\"_blank\" rel=\"noopener\">give small marijuana businesses fair access<\/a> to SBA loan programs and entrepreneurial development resources, for example.<\/p>\n<p>The senator also addressed the issue during a Senate Small Business Committee hearing last year, <a href=\"https:\/\/www.marijuanamoment.net\/senator-gets-marijuana-commitment-from-bidens-small-business-administration-nominee\/\" target=\"_blank\" rel=\"noopener\">receiving a commitment from then-nominee<\/a>\u00a0and current SBA Administrator Isabel Guzman that she would look into expanding access to companies in the state-legal marijuana market.<\/p>\n<p>Criticism over the lack of SBA access for cannabis firms came to the fore amid the coronavirus pandemic. Rosen\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/10-senators-demand-that-marijuana-businesses-be-allowed-to-access-federal-sba-loans\/\" target=\"_blank\" rel=\"noopener\">led a separate letter addressing the problem<\/a> alongside nine other senators last year.<\/p>\n<p>SBA did confirm in 2020 that cannabis companies <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-businesses-are-ineligible-for-coronavirus-disaster-relief-federal-agency-confirms\/\" target=\"_blank\" rel=\"noopener noreferrer\">do not qualify for disaster relief loans amid the coronavirus pandemic<\/a>.<\/p>\n<p>There\u2019s been talk about the possibility of facilitating marijuana industry SBA access through a package of incremental cannabis reforms that\u2019s actively being finalized by Senate Majority Leader Chuck Schumer (D-NY), but others have signaled that the final bill will be more narrowly tailored, centering on bipartisan expungement and banking proposals.<\/p>\n<p>\u201cSenator Rosen\u2019s landmark legislation would help advance equity and innovation in the cannabis industry by leveling the playing field for independent cannabis operators,\u201d USCC\u2019s Tribble said. \u201cIf paired with the SAFE Banking Act, The Fair Access for Cannabis Small Businesses Act would create a regulatory framework that would ensure a vibrant startup scene and a diversity of players.\u201d<\/p>\n<p>A comprehensive legalization bill that Schumer, Sen.
