{"id":58232,"date":"2022-11-18T11:03:06","date_gmt":"2022-11-18T19:03:06","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/11\/18\/new-york-approves-firms-to-build-first-social-equity-marijuana-dispensary-storefronts-days-before-key-regulators-meeting\/"},"modified":"2022-11-18T17:45:32","modified_gmt":"2022-11-19T01:45:32","slug":"new-york-approves-firms-to-build-first-social-equity-marijuana-dispensary-storefronts-days-before-key-regulators-meeting","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/11\/18\/new-york-approves-firms-to-build-first-social-equity-marijuana-dispensary-storefronts-days-before-key-regulators-meeting\/","title":{"rendered":"New York Approves Firms To Build First Social Equity Marijuana Dispensary Storefronts Days Before Key Regulators Meeting"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/11\/1f3d7-1.png\" width=\"72\" height=\"72\"> <\/p>\n<p>New York officials announced on Friday that they\u2019ve selected 10 teams of firms to build out about 150 turn-key storefront facilities for social equity marijuana retailers to operate out of once the market officially launches, which is <a href=\"https:\/\/www.marijuanamoment.net\/new-yorks-first-recreational-marijuana-dispensaries-could-be-approved-within-weeks-top-regulator-says\/\" target=\"_blank\" rel=\"noopener\">expected before the end of the year<\/a>.<\/p>\n<p>This news comes days ahead of a scheduled meeting of the Cannabis Control Board (CCB), which is expected to approve initial social equity retailer licenses while separately advancing new regulations for the market on Monday.<\/p>\n<p>But there\u2019s already a hitch in the retailer rollout, with a federal judge issuing an injunction last week in response to a lawsuit that temporarily <a href=\"https:\/\/www.syracuse.com\/marijuana\/2022\/11\/nys-legal-marijuana-industry-shaken-by-court-injunction.html\" target=\"_blank\" rel=\"noopener\">blocks<\/a> regulators from approving Conditional Adult-Use Retail Dispensary (CAURD) licenses in certain regions of the state, like Central New York and Brooklyn.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The key to achieving New York&#8217;s equity goals is creating a sustainable, consumer-driven cannabis market.<\/p>\n<p>Monday, 11\/21 the CCB will consider regulations to:<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/11\/1f3d7.png\" alt=\"&#x1F3D7;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/>Clarify market architecture<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/11\/1faaa.png\" alt=\"&#x1FAAA;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/>Authorize license activity<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/11\/2705.png\" alt=\"&#x2705;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/>Establish enforcement rules &amp; more<br \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/11\/1f517.png\" alt=\"&#x1F517;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/><a href=\"https:\/\/t.co\/lCvBTIljJu\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/lCvBTIljJu<\/a><\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1593359722379345922?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">November 17, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Regardless of how the legal case plays out, steps are being taken to get the state\u2019s marijuana market online within weeks, and Friday\u2019s announcement about the turn-key storefront development project is critical to making that happen.<\/p>\n<p>The Dormitory Authority of the State of New York (DASNY) said in a <a href=\"https:\/\/www.dasny.org\/news\/2022\/firms-selected-design-and-build-new-york-adult-use-retail-cannabis-dispensaries\" target=\"_blank\" rel=\"noopener\">notice<\/a> that agencies have collaborated to approve 10 teams of firms that will \u201cdesign and construct the first adult-use retail cannabis dispensaries to be opened in New York.\u201d<\/p>\n<p>\u201cThe firms were selected to develop approximately 150 turn-key sites across New York State for entrepreneurs who have received a Conditional Adult Use Retail Dispensary License (CAURD) through the New York State Office of Cannabis Management,\u201d it says.<\/p>\n<p>New York\u2019s Social Equity Servicing Corporation (SESC) is \u201ccurrently working\u201d on finding sites where the the initial dispensaries will be located, with funding from the $200 million Social Equity Cannabis Fund that Gov. Kathy Hochul (D) authorized.<\/p>\n<p>Meanwhile, CCB will meet on November 21 and <a href=\"https:\/\/www.marijuanamoment.net\/new-yorks-first-recreational-marijuana-dispensaries-could-be-approved-within-weeks-top-regulator-says\/\" target=\"_blank\" rel=\"noopener\">potentially approve the first set of CAURD licenses<\/a>, Axel Bernabe of the Office of Cannabis Management (OCM) said earlier this month.<\/p>\n<p>On Thursday, OCM separately <a href=\"https:\/\/cannabis.ny.gov\/system\/files\/documents\/2022\/11\/office-of-cannabis-management-previews-new-adult-use-cannabis-regulations.pdf\" target=\"_blank\" rel=\"noopener\">previewed<\/a> regulations that they\u2019ve developed for the broader adult-use marijuana market and which will also be voted on at the upcoming meeting.<\/p>\n<p>The rules rules cover various license types, including cultivation, nursery, processing, distribution, retail dispensary, microbusinesses, and cannabis collectives\/co-ops. OCM said that delivery licenses will be handled in a future round of regulations.<\/p>\n<p>\u201cThe regulations will fully launch the adult-use program in New York by clarifying adult-use market architecture, defining activity allowed under each license type, setting out application criteria, establishing rules for enforcement of the regulations, and more,\u201d the office said in a press release.<\/p>\n<p>\u201cIf the regulations are approved by the Cannabis Control Board (Board), they will be shared for a 60-day public comment period,\u201d it says.<\/p>\n<p>Regulators have said on several occasions in recent months that they\u2019re on track to have adult-use marijuana storefronts open by the end of the year, but the recent comments from Bernabe are more specific about the timeline. He said the state is in a \u201cposition\u201d to meet that goal.<\/p>\n<p>State regulators closed a one-month window for accepting applications\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-officials-are-now-accepting-applications-for-the-first-recreational-dispensary-licenses\/\" target=\"_blank\" rel=\"noopener\">for the state\u2019s first cannabis retailer licenses<\/a>\u00a0in September\u2014and 903 businesses run by people who have been harmed by the drug war\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-gets-900-marijuana-dispensary-applications-from-people-harmed-by-drug-war\/\" target=\"_blank\" rel=\"noopener\">completed and submitted their forms<\/a>.<\/p>\n<p>It\u2019s not clear how many conditional licenses will up for the first approvals, but officials say <a href=\"https:\/\/www.marijuanamoment.net\/heres-how-many-marijuana-shops-new-york-plans-to-approve-in-each-region-of-the-state-in-the-first-licensing-round\/\" target=\"_blank\" rel=\"noopener\">that they will be selecting 150 applicants<\/a>\u00a0in total before expanding the application pool.<\/p>\n<p>In order to qualify for the special retail license, applicants must have faced a conviction for a cannabis-related offense prior to the enactment of legalization in the state, or have a direct relative with such a conviction, and they must also have experience operating a qualifying business.<\/p>\n<p>Regulators have also expanded the definition of a qualifying \u201cjustice-involved\u201d individual to include people who were arrested for marijuana but convicted for a lesser offense, which advocates view as a positive step that will broader the applicant pool.<\/p>\n<p>Additionally, regulators say that up to 25 of the CAURD licenses will go to eligible non-profits\u2014\u201dspecifically organizations with a history of serving justice-involved individuals and creating vocational opportunities for them.\u201d<\/p>\n<p>Those non-profit organizations will not be entitled to the Social Equity Cannabis Fund and they couldn\u2019t access the state-approved turnkey facilities so they\u2019d have to operate their own compliant storefronts.<\/p>\n<p>In anticipation of the CAURD license applications opening, the mayor of New York City recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-mayor-launches-marijuana-resource-hub-to-support-industry-equity-as-state-prepares-to-accept-first-retailer-applications\/\" target=\"_blank\" rel=\"noopener\">announced the launch of a new program<\/a>\u00a0to promote cannabis industry equity by supporting entrepreneurs most impacted by the drug war.<\/p>\n<p>The Cannabis NYC initiative aims to initially help would-be dispensary operators complete the licensing application process, but is also promising to provide \u201csupport beyond the license\u201d by connecting \u201caspiring cannabis entrepreneurs to no-cost services, along with technical assistance, to support successful businesses.\u201d<\/p>\n<p>CCB also approved the state\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-approve-first-processor-licenses-and-cannabis-testing-rules-ahead-of-retail-sales-launch\/\" target=\"_blank\" rel=\"noopener\">first round of recreational cannabis processor licenses<\/a>\u00a0in August. The board has further approved\u00a0numerous conditional cultivator applications, which are being granted to existing hemp businesses in the state.<\/p>\n<p>In September, regulators\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-regulators-vote-to-let-medical-marijuana-patients-grow-their-own-starting-next-month\/\" target=\"_blank\" rel=\"noopener\">additionally voted to adopt home grow rules<\/a>\u00a0for medical cannabis patients, as well as another round of conditional marijuana processor and cultivator business applications.<\/p>\n<p>The adoption of the medical cannabis home grow resolution came about a year after draft regulations were first proposed and several months after the board accepted revised rules following a public comment period.<\/p>\n<p>With respect to retailers, OCM Executive Director Chris Alexander said in July that the office diligently reviewed and responded to public comments on the proposed rules for conditional retailers, but there\u2019s still been some frustration among stakeholders who feel that the input was not thoughtfully incorporated.<\/p>\n<p>For what it\u2019s worth, a poll found that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/most-new-york-voters-oppose-prioritizing-marijuana-licenses-for-people-with-previous-convictions-poll-finds\/\" target=\"_blank\" rel=\"noopener\">most New Yorkers voters are against that proposal<\/a>\u00a0to prioritize retail licenses for justice-involved people.<\/p>\n<p>Separately, OCM also recently publicized dozens of cease and desist letters that they have sent to businesses accused of illegally selling marijuana as the state prepares to launch its adult-use market.<\/p>\n<p>But there\u2019s been skepticism about the accuracy of the office\u2019s enforcement targets. Some businesses that were named as operating illicit marijuana shops say they never received the notice; others, including\u00a0<a href=\"https:\/\/www.syracuse.com\/marijuana\/2022\/07\/ny-cannabis-agency-publicly-and-wrongly-accused-a-local-business-of-illegal-marijuana-sales.html\" target=\"_blank\" rel=\"noopener\">one<\/a>\u00a0event and catering business, say that were wrongfully targeted, denying that they\u2019ve been involved in cannabis sales.<\/p>\n<p>As it stands, adults 21 and older can\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cops-cant-arrest-you-for-smoking-marijuana-on-sidewalks-nypd-says-in-post-legalization-memo\/\" target=\"_blank\" rel=\"noopener\">possess and publicly consume cannabis<\/a>, as well as gift marijuana to other adults as long as they aren\u2019t being compensated.<\/p>\n<p>In June, CCB also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-approve-rules-on-packaging-advertising-and-testing-as-state-readies-for-adult-use-sales\/\" target=\"_blank\" rel=\"noopener\">approved a series of proposed rules<\/a>\u00a0for marijuana packaging, labeling, advertising and testing requirements.<\/p>\n<p>Meanwhile, Hochul recently signed budget legislation that includes provisions to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-send-budget-with-marijuana-business-tax-breaks-to-governor-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\">let marijuana businesses take state tax deductions<\/a> that are available to other industries despite an ongoing federal ban on cannabis.<\/p>\n<p>Sen. Jeremy Cooney (D)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-allow-marijuana-industry-to-deduct-business-expenses-on-state-taxes\/\" target=\"_blank\" rel=\"noopener\">filed a standalone bill in December<\/a>\u00a0seeking a similar carve-out for the state\u2019s burgeoning cannabis market. Assemblymember Donna Lupardo (D) followed suit in her chamber. Cooney also filed a bill in May to allow regulators to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-promote-marijuana-banking-by-giving-financial-institutions-access-to-business-information\/\" target=\"_blank\" rel=\"noopener\">disclose certain information about cannabis licensees<\/a>\u00a0to financial institutions to promote marijuana banking.<\/p>\n<p>Hochul has repeatedly emphasized her interest in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/getting-new-york-marijuana-legalization-rolling-is-a-priority-new-governors-office-says\/\" target=\"_blank\" rel=\"noopener\">efficiently implementing the legalization law<\/a>.<\/p>\n<p>The governor released a State of the State book in January that called for\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-announces-200-million-marijuana-fund-to-promote-industry-equity\/\" target=\"_blank\" rel=\"noopener\">the creation of a $200 million public-private fund<\/a>\u00a0to specifically help promote social equity in the state\u2019s burgeoning marijuana market.<\/p>\n<p>That proposal was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-will-generate-more-than-1-25-billion-in-marijuana-revenue-over-next-six-years-governors-budget-estimates\/\" target=\"_blank\" rel=\"noopener\">also cited in the governor\u2019s executive budget<\/a>, which was released in January. The budget also estimated that New York stands to generate more than $1.25 billion in marijuana tax revenue over the next six years.<\/p>\n<p>Hochul said that while cannabis business licenses have yet to be approved since legalization was signed into law last year, the market stands to generate billions of dollars, and it\u2019s important to \u201ccreate opportunities for all New Yorkers, particularly those from historically marginalized communities.\u201d<\/p>\n<p>OCM has also been putting out PSAs to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-taxpayer-funded-ad-slamming-racist-marijuana-criminalization-laws-airs-during-nba-finals\/\" target=\"_blank\" rel=\"noopener\">promote public education about the marijuana policy change<\/a>, including a first-of-its-kind taxpayer-funded marijuana ad that aired in most of New York during an NBA Finals game in July.
