John Hickenlooper (D-CO) announced on Thursday that he will soon be filing a congressional bill to set the country up for federal cannabis reform.<\/p>\n<p>Specifically, the Preparing Regulators Effectively for a Post-Prohibition Adult-Use Regulated Environment Act (PREPARE) Act would direct the attorney general to create a commission charged with making recommendations on a regulatory system for marijuana that models what\u2019s currently in place for alcohol.<\/p>\n<p>The measure is identical <a href=\"https:\/\/www.marijuanamoment.net\/u-s-attorney-general-would-be-required-to-create-marijuana-commission-to-advise-on-legalization-under-new-bipartisan-bill\/\" target=\"_blank\" rel=\"noopener\">to a House companion bill<\/a> that Reps. Dave Joyce (R-OH), Hakeem Jeffries (D-NY) and Brian Mast (R-FL) filed in April. Hickenlooper\u2019s staff told Marijuana Moment that the Senate version will be formally introduced when the chamber returns from recess in mid-November.<\/p>\n<p>The senator sees the commission that would be created by the legislation as similar to a task force he empaneled when he was Colorado\u2019s governor to steer implementation of legalization at the state level.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Federal marijuana legalization doesn\u2019t need to start from scratch and we should prepare for it now.<\/p>\n<p>Today we introduced the PREPARE Act, a bipartisan bill to pave the way for the federal regulation of marijuana once legalization arrives.<\/p>\n<p>\u2014 Senator John Hickenlooper (@SenatorHick) <a href=\"https:\/\/twitter.com\/SenatorHick\/status\/1588277460084609025?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">November 3, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cColorado successfully pioneered marijuana legalization a decade ago, thanks in part to the Amendment 64 Task Force,\u201d he said in a <a href=\"https:\/\/www.hickenlooper.senate.gov\/press_releases\/ten-years-after-legalization-in-colorado-hickenlooper-bill-to-pave-way-for-federal-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">press release<\/a>. \u201cFederal legalization doesn\u2019t need to start from scratch, and we should prepare for when it arrives.\u201d<\/p>\n<p>Hickenlooper recently participated in an event with current Colorado Gov. Jared Polis (D) to celebrate the <a href=\"https:\/\/www.marijuanamoment.net\/colorado-officials-celebrate-10-year-marijuana-legalization-anniversary-including-politicians-who-initially-campaigned-against-it\/\" target=\"_blank\" rel=\"noopener\">10-year anniversary of the state\u2019s legalization vote<\/a>, which he opposed at the time. He has since acknowledged, however, that many of his fears about ending prohibition haven\u2019t materialized, particularly when it comes to youth cannabis use.<\/p>\n<p>The new congressional measure would \u201cprovide lawmakers across the ideological spectrum the opportunity to engage on cannabis reform by creating a fair, honest and publicly transparent process for the federal government to establish effective regulation to be enacted upon the termination of its 85-year prohibition of cannabis,\u201d according to a summary.<\/p>\n<p>It would lead to the \u201cdevelopment of a federal regulatory framework that will help ensure safety, accountability and economic growth among the 45+ states that have enacted cannabis legalization to some degree\u201d while accounting for the \u201cunique needs, rights and laws of each state.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Legalizing marijuana at the federal level will increase tax revenues, create jobs, and spur innovation. I look forward to continuing to work together to pave the way for more comprehensive <a href=\"https:\/\/twitter.com\/hashtag\/cannabis?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#cannabis<\/a> reform. <a href=\"https:\/\/t.co\/HpW8fgMbre\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/HpW8fgMbre<\/a><\/p>\n<p>\u2014 Dave Joyce (@RepDaveJoyce) <a href=\"https:\/\/twitter.com\/RepDaveJoyce\/status\/1588274529947852805?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">November 3, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cThis legislation gives lawmakers on both sides of the aisle the answers they need to effectively engage on cannabis reform, safely and effectively regulate it, and remedy the harms caused by the failed war on cannabis,\u201d he said. \u201cWith those answers, Congress can develop a much-needed federal regulatory framework that not only respects the unique needs, rights, and laws of each state, but also ensures a responsible end to prohibition and a safer future for our communities.\u201d<\/p>\n<p>\u201cI was proud to lead the introduction of this commonsense bill in the House and thank Senator Hickenlooper for advancing it in the Senate,\u201d he added. \u201cI look forward to continuing to work together to pave the way for more comprehensive reform.\u201d<\/p>\n<p><strong>Here\u2019s what the bill would accomplish:<\/strong><\/p>\n<p style=\"padding-left: 40px\">Require the attorney general to establish a \u201cCommission on the Federal Regulation of Cannabis\u201d within 30 days of the bill\u2019s enactment.<\/p>\n<p style=\"padding-left: 40px\">The commission would be responsible for studying federal and state regulatory models for alcohol and make recommendations about how they could inform marijuana regulations.<\/p>\n<p style=\"padding-left: 40px\">Among other things, the commission\u2019s report must look at the impact of marijuana criminalization, particularly as it concerns minority, low-income and veteran communities.<\/p>\n<p style=\"padding-left: 40px\">The panel would also examine the \u201clack of consistent regulations for cannabis product safety, use and labeling requirements\u201d as well as the \u201clack of guidance for cannabis crop production, sale, intrastate, interstate, and international trade.\u201c<\/p>\n<p style=\"padding-left: 40px\">It would also need to make recommendations on how to remedy cannabis-related banking and research barriers as well as address measures to ensure the \u201csuccessful coexistence of individual hemp and cannabis industries, including prevention of cross pollination of cannabis and hemp products.\u201d<\/p>\n<p style=\"padding-left: 40px\">Members would further be mandated to study and make recommendations on \u201cefficient cannabis revenue reporting and collecting, including efficient and tenable federal revenue frameworks.\u201d<\/p>\n<p style=\"padding-left: 40px\">The panel would be required to issue a report to Congress within 12 months.<\/p>\n<p><strong>The panel would include representatives of:<\/strong><\/p>\n<ul>\n<li>Department of Health and Human Services<\/li>\n<li>Department of Justice<\/li>\n<li>Department of Agriculture<\/li>\n<li>Department of Veterans Affairs<\/li>\n<li>Department of Interior<\/li>\n<li>Department of Education<\/li>\n<li>Department of Labor<\/li>\n<li>Department of Commerce<\/li>\n<li>National Institutes of Health<\/li>\n<li>Alcohol and Tobacco Tax and Trade Bureau<\/li>\n<li>Food and Drug Administration<\/li>\n<li>Internal Revenue Service<\/li>\n<li>Bureau of Alcohol, Tobacco, Firearms and Explosives<\/li>\n<li>National Highway Traffic Safety Administration<\/li>\n<li>Occupational Safety and Health Administration<\/li>\n<li>National Institute of Standards and Technology<\/li>\n<li>Small Business Administration<\/li>\n<li>U.S. Trade Representative<\/li>\n<\/ul>\n<p>It would also include a person formerly incarcerated for a non-violent cannabis use or possession crime, a substance use disorder prevention expert, a medical cannabis patient or advocate, a historical expert on cannabis criminalization, a medically licensed individual with knowledge of cannabis use and treatments, a representative from a trade organization or nonprofit representing highly regulated adult goods and consumer package goods and two people who have worked to develop state-level regulatory systems.<\/p>\n<p>Some of the appointments would be made by the attorney general, and others would come from congressional leaders. The bill also contains a stipulation that, \u201cif after the commission is appointed there is a partisan imbalance of commission members, the congressional leaders of the political party with fewer members on the commission shall jointly name additional members to create partisan parity on the commission.\u201d<\/p>\n<p>Attorney General Merrick Garland, for his part, said during his Senate confirmation proceedings that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-ag-stresses-that-marijuana-use-in-legal-states-is-not-a-justice-department-priority\/\" target=\"_blank\" rel=\"noopener\">it\u2019s a waste of federal resources<\/a> to go after people acting in compliance with state cannabis laws and recognized racial disparities in marijuana enforcement.<\/p>\n<p>After President Joe Biden directed an administrative review into marijuana\u2019s federal scheduling last month, the Justice Department was quick to say that it would <a href=\"https:\/\/www.marijuanamoment.net\/doj-to-expeditiously-act-on-bidens-marijuana-pardon-directive-while-hhs-looking-forward-to-scheduling-review\/\" target=\"_blank\" rel=\"noopener\">carry out that obligation \u201cexpeditiously.\u201d<\/a><\/p>\n<p>Biden said this week that his separate mass pardon proclamation for federal marijuana possession offenses is one of the top things he\u2019s done to improve the lives of Black Americans since taking office. However, he seemed to <a href=\"https:\/\/www.marijuanamoment.net\/biden-says-his-marijuana-pardons-have-improved-black-americans-lives-but-he-overstates-real-life-impact\/\" target=\"_blank\" rel=\"noopener\">overstate the practical impact of his action<\/a> by conflating the relief with expungements.<\/p>\n<p>Meanwhile, the House sponsor of a marijuana banking bill said that he <a href=\"https:\/\/www.marijuanamoment.net\/schumer-reaffirms-commitment-to-marijuana-banking-reform-in-white-house-discussion-bill-sponsor-says\/\" target=\"_blank\" rel=\"noopener\">recently spoke with the Senate majority leader at an event<\/a>\u00a0at the White House and discussed the need to enact the bipartisan reform this session.<\/p>\n<p>Rep.
