{"id":56833,"date":"2022-08-25T04:09:45","date_gmt":"2022-08-25T12:09:45","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/08\/25\/new-york-marijuana-officials-are-now-accepting-applications-for-the-first-recreational-dispensary-licenses\/"},"modified":"2022-08-25T08:46:02","modified_gmt":"2022-08-25T16:46:02","slug":"new-york-marijuana-officials-are-now-accepting-applications-for-the-first-recreational-dispensary-licenses","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/08\/25\/new-york-marijuana-officials-are-now-accepting-applications-for-the-first-recreational-dispensary-licenses\/","title":{"rendered":"New York Marijuana Officials Are Now Accepting Applications For The First Recreational Dispensary Licenses"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/08\/MM_Bill_Tracker_V5_blank-126.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>People who\u2019ve been directly impacted by the drug war in New York are now able to submit applications for the first round of retailer licenses in the state.<\/p>\n<p>New York regulators have been promoting the launch of the application portal for weeks, emphasizing that this represents a key step toward ensuring industry equity as the state prepares to open its adult-use market by the year\u2019s end.<\/p>\n<p>Earlier this week, the Office of Cannabis Management (OCM) unveiled a regional breakdown of the <a href=\"https:\/\/www.marijuanamoment.net\/heres-how-many-marijuana-shops-new-york-plans-to-approve-in-each-region-of-the-state-in-the-first-licensing-round\/\" target=\"_blank\" rel=\"noopener\">maximum 150 conditional adult use retail dispensary<\/a> (CAURD) licenses that it plans to accept as an initial step to setting New York up to serve adult use consumers.<\/p>\n<p>That announcement came weeks after the state Cannabis Control Board (CCB) said <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-approve-first-processor-licenses-and-cannabis-testing-rules-ahead-of-retail-sales-launch\/\" target=\"_blank\" rel=\"noopener\">it would start accepting retailer applications<\/a> from justice-involved individuals who have been historically impacted by marijuana criminalization.<\/p>\n<p>The <a href=\"https:\/\/www.businessexpress.ny.gov\/app\/answers\/cms\/a_id\/3823\/kw\/caurd\" target=\"_blank\" rel=\"noopener\">application portal<\/a> launched on Thursday and will be open until September 26.<\/p>\n<p>Applications for the conditional retailer licenses must still be reviewed on a regional basis, so the numbers from OCM don\u2019t necessarily reflect the number of storefronts that will be opened under the program. It just shows that maximum that will be accepted per region.<\/p>\n<p>In order to qualify for the special retail license, applicants must have faced a conviction for a cannabis-related offense prior to the enactment of legalization in the state, or have a direct relative with such a conviction, and they must also have experience operating a qualifying business.<\/p>\n<p>Regulators have also expanded the definition of a qualifying \u201cjustice-involved\u201d individual to include people who were arrested for marijuana but convicted for a lesser offense, which advocates view as a positive step that will broader the applicant pool.<\/p>\n<p>People who receive Conditional Adult-Use Retail Dispensaries (CAURD) licenses will be able to access a $200 million Social Equity Cannabis Fund and also be eligible for turnkey storefronts that are now being secured and built out by the Dormitory Authority of the State of New York.<\/p>\n<p>Additionally, regulators say that up to 25 of the CAURD licenses will go to eligible non-profits\u2014\u201dspecifically organizations with a history of serving justice-involved individuals and creating vocational opportunities for them.\u201d<\/p>\n<p>Those non-profit organizations will not be entitled to the Social Equity Cannabis Fund and they couldn\u2019t access the state-approved turnkey facilities so they\u2019d have to operate their own compliant storefronts.<\/p>\n<p>There are additional conditions that non-profit organization applicants must meet to qualify for the first round of retail licenses. Join us live tomorrow at 2pm EST to learn about our higher equity standards and how you can apply for our first conditional dispensary licenses. <a href=\"https:\/\/t.co\/qXn8EOJb9r\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/qXn8EOJb9r<\/a><\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1562511655996903424?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">August 24, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>In anticipation of the CAURD license applications opening, the mayor of New York City on Monday\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-mayor-launches-marijuana-resource-hub-to-support-industry-equity-as-state-prepares-to-accept-first-retailer-applications\/\" target=\"_blank\" rel=\"noopener\">announced the launch of a new program<\/a>\u00a0to promote cannabis industry equity by supporting entrepreneurs most impacted by the drug war.<\/p>\n<p>The Cannabis NYC initiative aims to initially help would-be dispensary operators complete the licensing application process, but is also promising to provide \u201csupport beyond the license\u201d by connecting \u201caspiring cannabis entrepreneurs to no-cost services, along with technical assistance, to support successful businesses.\u201d<\/p>\n<p>Meanwhile, CCB, which also approved the state\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-approve-first-processor-licenses-and-cannabis-testing-rules-ahead-of-retail-sales-launch\/\" target=\"_blank\" rel=\"noopener\">first round of recreational cannabis processor licenses<\/a>\u00a0last week, has encouraged eligible retailer applicants to start collecting the documentation they need to take advantage of the equity application opportunity.<\/p>\n<p>CCB has also been approving numerous conditional cultivator applications, which are being granted to existing hemp businesses in the state. Gov. Kathy Hochul (D) signed a bill\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-signs-bill-to-let-hemp-farmers-start-growing-adult-use-marijuana-while-promoting-equity\/\" target=\"_blank\" rel=\"noopener\">to create the conditional cultivation licenses<\/a>\u00a0in February.<\/p>\n<p>Last week, regulators\u00a0approved 19 more cultivator cultivator licenses, for a total of 242.<\/p>\n<p>With respect to retailers, OCM Executive Director Chris Alexander said last month that the office diligently reviewed and responded to public comments on the proposed rules for conditional retailers, but there\u2019s still been some frustration among stakeholders who feel that the input was not thoughtfully incorporated.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">From Brooklyn to Buffalo, we are growing something special in the Empire State, but we can\u2019t do it without you!<\/p>\n<p>Watch Executive Director, Chris Alexander discuss  our new dispensary license program, CAURD, and get helpful resources to apply at <a href=\"https:\/\/t.co\/865xuy7Uuz\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/865xuy7Uuz<\/a>. <a href=\"https:\/\/t.co\/VHHBuTP2dP\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/VHHBuTP2dP<\/a><\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1561814842075381762?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">August 22, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>For what it\u2019s worth, a poll found that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/most-new-york-voters-oppose-prioritizing-marijuana-licenses-for-people-with-previous-convictions-poll-finds\/\" target=\"_blank\" rel=\"noopener\">most New Yorkers voters are against that proposal<\/a>\u00a0to prioritize retail licenses for justice-involved people.<\/p>\n<p>Separately, OCM also recently publicized dozens of cease and desist letters that they have sent to businesses accused of illegally selling marijuana as the state prepares to launch its adult-use market.<\/p>\n<p>But there\u2019s been skepticism about the accuracy of the office\u2019s enforcement targets. Some businesses that were named as operating illicit marijuana shops say they never received the notice; others, including\u00a0<a href=\"https:\/\/www.syracuse.com\/marijuana\/2022\/07\/ny-cannabis-agency-publicly-and-wrongly-accused-a-local-business-of-illegal-marijuana-sales.html\" target=\"_blank\" rel=\"noopener\">one<\/a>\u00a0event and catering business, say that were wrongfully targeted, denying that they\u2019ve been involved in cannabis sales.<\/p>\n<p>As it stands, adults 21 and older can\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cops-cant-arrest-you-for-smoking-marijuana-on-sidewalks-nypd-says-in-post-legalization-memo\/\" target=\"_blank\" rel=\"noopener\">possess and publicly consume cannabis<\/a>, as well as gift marijuana to other adults as long as they aren\u2019t being compensated.<\/p>\n<p>In June, CCB also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-approve-rules-on-packaging-advertising-and-testing-as-state-readies-for-adult-use-sales\/\" target=\"_blank\" rel=\"noopener\">approved a series of proposed rules<\/a>\u00a0for marijuana packaging, labeling, advertising and testing requirements.<\/p>\n<p>During April\u2019s CCB meeting, regulators also approved revised regulations to allow medical marijuana patients to grow their own plants for personal use following a public comment period on initial rules that were proposed last year.<\/p>\n<p>In general, the rule would allow registered patients and caregivers to grow up to six plants, only three of which could be mature. They could possess up to five pounds of cannabis derived from those plants, which is consistent with the state\u2019s adult-use legalization law.<\/p>\n<p>Meanwhile, New York lawmakers recently sent a budget proposal to the governor\u2019s desk that includes provisions to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-send-budget-with-marijuana-business-tax-breaks-to-governor-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\">let marijuana businesses take state tax deductions<\/a>\u00a0that are available to other industries despite an ongoing federal ban on cannabis. That was signed into law.<\/p>\n<p>Sen. Jeremy Cooney (D)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-allow-marijuana-industry-to-deduct-business-expenses-on-state-taxes\/\" target=\"_blank\" rel=\"noopener\">filed a standalone bill in December<\/a>\u00a0seeking a similar carve-out for the state\u2019s burgeoning cannabis market. Assemblymember Donna Lupardo (D) followed suit in her chamber. Cooney also filed a bill in May to allow regulators to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-promote-marijuana-banking-by-giving-financial-institutions-access-to-business-information\/\" target=\"_blank\" rel=\"noopener\">disclose certain information about cannabis licensees<\/a>\u00a0to financial institutions to promote marijuana banking.<\/p>\n<p>Hochul has repeatedly emphasized her interest in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/getting-new-york-marijuana-legalization-rolling-is-a-priority-new-governors-office-says\/\" target=\"_blank\" rel=\"noopener\">efficiently implementing the legalization law<\/a>.<\/p>\n<p>The governor released a State of the State book in January that called for\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-announces-200-million-marijuana-fund-to-promote-industry-equity\/\" target=\"_blank\" rel=\"noopener\">the creation of a $200 million public-private fund<\/a>\u00a0to specifically help promote social equity in the state\u2019s burgeoning marijuana market.<\/p>\n<p>That proposal was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-will-generate-more-than-1-25-billion-in-marijuana-revenue-over-next-six-years-governors-budget-estimates\/\" target=\"_blank\" rel=\"noopener\">also cited in the governor\u2019s executive budget<\/a>, which was released in January. The budget also estimated that New York stands to generate more than $1.25 billion in marijuana tax revenue over the next six years.<\/p>\n<p>Hochul said that while cannabis business licenses have yet to be approved since legalization was signed into law last year, the market stands to generate billions of dollars, and it\u2019s important to \u201ccreate opportunities for all New Yorkers, particularly those from historically marginalized communities.\u201d<\/p>\n<p>OCM has also been putting out PSAs to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-taxpayer-funded-ad-slamming-racist-marijuana-criminalization-laws-airs-during-nba-finals\/\" target=\"_blank\" rel=\"noopener\">promote public education about the marijuana policy change<\/a>, including a first-of-its-kind taxpayer-funded marijuana ad that aired in most of New York during an NBA Finals game last month. The PSA boldly addressed the racially discriminatory harms of cannabis criminalization and highlighted steps that state regulators are taking to right the wrongs of prohibition.<\/p>\n<p>CCB also wants the opportunity to showcase its marijuana PSA campaign on the social media app TikTok, but it was told by the company previously that it could not use the platform because of its existing ban on the use of the word \u201ccannabis.\u201d The department\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulators-ask-tiktok-to-stop-banning-cannabis-education-advertising\/\" target=\"_blank\" rel=\"noopener\">recently sent a letter to TikTok<\/a>, requesting a policy change for government marijuana-related ads that concern public education.<\/p>\n<p><strong>Here are some other ways that New York lawmakers and regulators are working to promote drug policy reform as the state prepares to implement retail marijuana sales:\u00a0<\/strong><\/p>\n<p>Last month, Hochul announced that the state had awarded $5 million in funding to community colleges to support the development and improvement of courses and programs specifically meant to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-community-colleges-awarded-5-million-to-create-marijuana-job-training-programs-governor-announces\/\" target=\"_blank\" rel=\"noopener\">help people secure jobs in the marijuana industry<\/a>.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,500 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/08\/MM_Bill_Tracker_V5_blank-125.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>The New York Senate approved a bill in June that would require public health insurance programs\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senate-approves-bill-to-mandate-medical-marijuana-health-insurance-coverage\/\" target=\"_blank\" rel=\"noopener\">to cover medical marijuana expenses<\/a>\u00a0and clarify that private insurers are allowed to do the same.<\/p>\n<p>Both chambers of the state legislature have passed a measure to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-encouraging-businesses-to-use-hemp-for-construction-and-other-purposes-heads-to-governor\/\" target=\"_blank\" rel=\"noopener\">encourage businesses to use hemp materials<\/a>\u00a0for packaging, construction and other industrial purposes.<\/p>\n<p>The state Department of Labor separately announced in recent guidance that New York employers are no longer allowed to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">drug test most workers for marijuana<\/a>. Even prior to the enactment of legalization, New York City officials had established a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-adds-more-exceptions-to-pre-employment-marijuana-testing-ban\/\" target=\"_blank\" rel=\"noopener\">local ban on pre-employment drug testing<\/a>\u00a0for cannabis.<\/p>\n<p>A recent legal directive from the New York City Law Department (NYCLD) has put police and firefighter drug testing policy in the spotlight\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nypd-will-no-longer-drug-test-officers-for-marijuana-effectively-immediately-department-says\/\" target=\"_blank\" rel=\"noopener\">after a document that was leaked<\/a>\u00a0from the New York Police Department (NYPD) signaled that officers would no longer be subject to pre-employment, random or scheduled screening for cannabis because of the legal analysis.<\/p>\n<p>A firefighters union\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-firefighters-wont-be-tested-for-marijuana-department-says-following-nypd-leak\/\" target=\"_blank\" rel=\"noopener\">claimed credit for the new directive<\/a>, saying that it was responsive to inquires that it made to the city.<\/p>\n<p>Separately, Adams says he\u2019s looking into the idea of authorizing marijuana to be grown in greenhouses\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nyc-mayor-wants-to-explore-putting-marijuana-greenhouses-on-rooftops-of-public-housing-buildings\/\" target=\"_blank\" rel=\"noopener\">on the rooftops of public housing buildings<\/a>\u2014an ambitious proposal that\u2019s unlikely to sit well with the federal government, which provides funding to support the NYC Housing Authority (NYCHA).<\/p>\n<p>A New York senator filed a bill in May that would legalize what\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-allow-community-marijuana-gardens-for-adults-who-cant-grow-at-home\/\" target=\"_blank\" rel=\"noopener\">would essentially be licensed community marijuana gardens<\/a>\u00a0for people who aren\u2019t able to cultivate cannabis at their own homes.<\/p>\n<p>Also that month, a New York Assembly committee advanced a bill to establish a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-approve-bill-to-authorize-safe-drug-consumption-sites-in-committee\/\" target=\"_blank\" rel=\"noopener\">statewide safe consumption site program<\/a>, allowing regulators to authorize facilities where people could use currently illicit drugs in a medically supervised environment.<\/p>\n<p>Meanwhile, a New York lawmaker introduced a bill last year that would require the state to establish an institute to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-create-state-sponsored-psychedelics-research-institute\/\" target=\"_blank\" rel=\"noopener\">research the therapeutic potential of psychedelics<\/a>.<\/p>\n<p>Another state legislator filed a bill in December to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmaker-files-bill-to-legalize-medical-psilocybin-treatments-with-focus-on-first-responders-and-veterans\/\" target=\"_blank\" rel=\"noopener\">legalize psilocybin mushrooms for medical purposes<\/a>\u00a0and establish facilities where the psychedelic could be grown and administered to patients.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"BZfn0Solqi\">\n<p><a href=\"https:\/\/www.marijuanamoment.net\/feds-issue-first-refunds-for-cannabis-products-that-were-deceptively-marketed-to-consumers\/\" target=\"_blank\" rel=\"nofollow noopener\">Feds Issue First Refunds For Cannabis Products That Were \u2018Deceptively Marketed\u2019 To Consumers<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The post <a rel=\"nofollow noopener\" href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-officials-are-now-accepting-applications-for-the-first-recreational-dispensary-licenses\/\" target=\"_blank\">New York Marijuana Officials Are Now Accepting Applications For The First Recreational Dispensary Licenses<\/a> appeared first on <a rel=\"nofollow noopener\" href=\"https:\/\/www.marijuanamoment.net\" target=\"_blank\">Marijuana Moment<\/a>.<\/p>\n<p>&#013;<br \/>\n&#013;<br \/>\nRead More: <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-officials-are-now-accepting-applications-for-the-first-recreational-dispensary-licenses\/\" target=\"_blank\" rel=\"nofollow noopener\">New York Marijuana Officials Are Now Accepting Applications For The First Recreational Dispensary Licenses<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>People who\u2019ve been directly impacted by the drug war in New York are now able to submit applications for the first round of retailer licenses in the state.
