{"id":56795,"date":"2022-08-24T04:51:40","date_gmt":"2022-08-24T12:51:40","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/08\/24\/u-s-forest-service-reminds-workers-of-federal-marijuana-ban-and-warns-against-cbd-use\/"},"modified":"2022-08-24T08:45:54","modified_gmt":"2022-08-24T16:45:54","slug":"u-s-forest-service-reminds-workers-of-federal-marijuana-ban-and-warns-against-cbd-use","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/08\/24\/u-s-forest-service-reminds-workers-of-federal-marijuana-ban-and-warns-against-cbd-use\/","title":{"rendered":"U.S. Forest Service Reminds Workers Of Federal Marijuana Ban And Warns Against CBD Use"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/08\/MM_Bill_Tracker_V5_blank-122.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Another federal agency is reminding employees that they\u2019re prohibited from using marijuana and warning them about the risks of consuming federally unregulated CBD products.<\/p>\n<p>The U.S. Forest Service (USFS) human resources division posted a notice on Monday that says while cannabis is legal in some form in a majority of states, federal workers \u201cmust remain drug-free and refrain from illegal drug use whether on or off duty regardless of state laws.\u201d<\/p>\n<p>\u201cThere have been no changes to the panel of drugs contained in the list of Schedule I drugs under the Controlled Substance Act,\u201d USFS said.<\/p>\n<p>As such, the agency will continue to randomly test employees who are reasonably suspected of having used marijuana, and those in \u201cTest Designated Positions\u201d will be regularly tested for THC.<\/p>\n<p>\u201cAny employee having a positive drug test result for marijuana (or any other illegal drug), will be subject to mandatory administrative actions\u2026which includes discipline up to removal for the first finding of illegal drug use,\u201d the <a href=\"https:\/\/www.fs.usda.gov\/inside-fs\/mail-call\/hrm-federal-law-prohibits-marijuana-use\" target=\"_blank\" rel=\"noopener\">notice<\/a> says.<\/p>\n<p>USFS didn\u2019t say that workers are prohibited from using hemp-derived CBD that was legalized under the 2018 Farm Bill, but it cautioned that the products available in commercial markets across the U.S. are not currently evaluated by the Food and Drug Administration (FDA) and could result in positive drug tests for THC.<\/p>\n<p>\u201cCannabidiol is an active ingredient in cannabis and is not regulated,\u201d it said. \u201cIt can be inaccurately labeled as having no to low levels of Tetrahydrocannabinol, and yet actually contain high levels. Ron Wyden (D-OR) that would prohibit the federal government from denying people the security clearances they need to work at intelligence agencies simply because they\u2019ve used marijuana.<\/p>\n<p>But in general, federal agencies have been reluctant to loosen cannabis-related employment rules despite state efforts to legalize cannabis for medical and recreational use.<\/p>\n<p>For example, the Substance Abuse and Mental Health Services Administration (SAMHSA) recently proposed a changes to drug testing policies for federal workers that would clarify that having a doctor\u2019s recommendation for medical marijuana or any other Schedule I drug is not a valid excuse for a positive drug test.<\/p>\n<p>Meanwhile, the director of national intelligence (DNI) said late last year that federal employers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-federal-intelligence-official-loosens-marijuana-restrictions-for-workers-and-addresses-cannabis-stocks\/\" target=\"_blank\" rel=\"noopener\">shouldn\u2019t outright reject security clearance applicants<\/a>\u00a0over past use and should use discretion when it comes to those with cannabis investments in their stock portfolios.<\/p>\n<p>FBI updated its hiring policies last year to make it so candidates are only automatically disqualified from joining the agency if they\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fbi-loosens-marijuana-employment-policy-for-would-be-agents\/\" target=\"_blank\" rel=\"noopener\">admit to having used marijuana within one year<\/a>\u00a0of applying. Previously, prospective employees of the agency could not have used cannabis within the past three years.<\/p>\n<p>The Environment Protection Agency (EPA)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/epa-warns-workers-theyre-banned-from-using-marijuana-or-investing-in-the-industry-in-new-memo\/\" target=\"_blank\" rel=\"noopener\">also emphasized to its workers<\/a>\u00a0that they are prohibited from using marijuana\u2014or directly investing in the industry\u2014no matter the state law or changes in \u201csocial norms\u201d around cannabis.<\/p>\n<p>The Department of Transportation (DOT) also took a different approach to its cannabis policy in 2020, stating in a notice that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/department-of-transportation-says-safety-sensitive-workers-wont-be-tested-for-cbd\/\" target=\"_blank\" rel=\"noopener noreferrer\">it would not be testing drivers for CBD<\/a>. However, DOT recently reiterated that the workforce it regulates is prohibited from using marijuana and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/transportation-department-reminds-workers-they-cant-use-marijuana-and-cautions-against-cbd\/\" target=\"_blank\" rel=\"noopener\">will continue to be tested for THC<\/a>, regardless of state cannabis policy.<\/p>\n<p>In a letter sent to Transportation Secretary Pete Buttigieg in May, Rep. Earl Blumenauer (D-OR) argued that DOT\u2019s overall cannabis testing policies are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressman-urges-transportation-department-to-reform-marijuana-testing-policies-for-drivers\/\" target=\"_blank\" rel=\"noopener\">unnecessarily costing people their jobs<\/a>\u00a0and contributing to supply chain issues. He urged a review and administrative reform of the guidelines.<\/p>\n<p>Buttigieg, who\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/where-presidential-candidate-pete-buttigieg-stands-on-marijuana\/\" target=\"_blank\" rel=\"noopener\">campaigned on a pro-legalization platform<\/a>\u00a0during his 2020 presidential bid and repeatedly condemned the harms of prohibition\u2014going so far as to call for decriminalizing possession of all drugs\u2014has yet to take any administrative steps to modernize DOT marijuana policy since taking the helm of the department.<\/p>\n<p>While DOT will continue to test workers for THC, however, the department did also recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-transportation-agency-proposes-new-marijuana-testing-policies-to-reduce-false-positives\/\" target=\"_blank\" rel=\"noopener\">propose a revised drug testing policy<\/a>.<\/p>\n<p>Commercial drivers who use CBD products are doing so \u201cat their own risk,\u201d a federal agency <a href=\"https:\/\/www.marijuanamoment.net\/transportation-department-proposes-new-cbd-guidance-for-medical-examiners-certifying-commercial-drivers\/\" target=\"_blank\" rel=\"noopener\">said in a recently released draft handbook<\/a> for medical examiners who are responsible for issuing DOT certifications.<\/p>\n<p>While the Biden administration has instituted a policy of <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">granting waivers to certain workers<\/a>\u00a0who admit to prior cannabis use, it\u2019s come under fire from advocates following reports that it fired or otherwise punished dozens of staffers who were honest about their history with marijuana.<\/p>\n<p>Then-White House Press Secretary Jen Psaki\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">attempted to minimize the fallout<\/a>, without much success, and her office released a statement last year stipulating that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-says-biden-hasnt-fired-staff-for-marijuana-use-that-was-casual-or-years-ago\/\" target=\"_blank\" rel=\"noopener\">nobody was fired for \u201cmarijuana usage from years ago,\u201d<\/a>\u00a0nor has anyone been terminated \u201cdue to casual or infrequent use during the prior 12 months.\u201d<\/p>\n<p>Meanwhile, a union representing firefighters has claimed credit for a New York City legal directive ordering government agencies, including the New York City Fire Department (NYFD) and New York Police Department (NYPD), to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-firefighters-wont-be-tested-for-marijuana-department-says-following-nypd-leak\/\" target=\"_blank\" rel=\"noopener\">cease drug testing workers for marijuana<\/a>\u00a0since the state enacted legalization.<\/p>\n<p>Last year, the state Department of Labor separately announced in guidance that New York employers are no longer allowed to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">drug test most workers for marijuana<\/a>, with limited exceptions. Even prior to the enactment of legalization, New York City officials had established a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-adds-more-exceptions-to-pre-employment-marijuana-testing-ban\/\" target=\"_blank\" rel=\"noopener\">local ban on pre-employment drug testing<\/a>\u00a0for cannabis.<\/p>\n<p>Washington, D.C.
