But it\u2019s a job that critics say she deliberately shirked after voters passed a legalization measure just two years ago.<\/p>\n<p>Gov. Kristi Noem (R) made the latest comments at an event last week, attempting to explain why she was taking a different approach to citizen-led reform this round by saying that the 2022 initiative \u201cis written more appropriately towards the Constitution.\u201d<\/p>\n<p>Advocates aren\u2019t quite buying it, though. The lawsuit that led the state Supreme Court to <a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-supreme-court-invalidates-2020-marijuana-legalization-initiative-as-activists-pursue-2022-ballot\/\" target=\"_blank\" rel=\"noopener\">invalidate a 2020 legalization measure that voters approved<\/a> at the ballot originated in her office. Now that she\u2019s up for reelection, some suspect that the pivot is an attempt to align herself with a popular issue and divert attention from her former obstruction.<\/p>\n<p>To avoid another legal challenge, South Dakotans for Better Marijuana Laws (SDBML) did take a more narrowly tailored approach to legalization with the new 2022 initiative, omitting provisions that deal with taxes and regulations like the earlier version and leaving those decisions up to the legislature.<\/p>\n<p>But the idea that Noem\u2014who vetoed a hemp reform bill in 2019 and actively <a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-governor-urges-no-vote-on-marijuana-legalization-initiative-in-new-ad\/\" target=\"_blank\" rel=\"noopener\">urged voters to oppose the adult-use measure<\/a> in TV ads the following year\u2014is now content to implement legalization if voters approve it has raised some eyebrows.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Reminder: Kristi Noem used taxpayer dollars to overturn voter-approved recreational marijuana, and defied the will of the people. <\/p>\n<p>It\u2019s high time for our elected officials to respect South Dakotans\u2019 decisions.<\/p>\n<p>\u2014 SD Democratic Party (@SoDakDems) <a href=\"https:\/\/twitter.com\/SoDakDems\/status\/1562102151391887360?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">August 23, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>The governor has taken steps to align herself with the enactment of medical cannabis reform that she previously opposed, including by airing taxpayer-funded ads highlighting her role in the implementation. But advocates and pro-reform lawmakers in the state have consistently questioned her motives.<\/p>\n<p>\u201cThis is phase two of Gov. Noem\u2019s PR rebranding on cannabis,\u201d Matthew Schweich, campaign director of SDBML, told Marijuana Moment. \u201cLast year she spent a significant amount of taxpayer money running ads to present herself as the responsible steward of medical cannabis even though, just months before, she advocated for legislation to severely delay implementation of the medical law.\u201d<\/p>\n<p>\u201cThankfully, we defeated her,\u201d he said. \u201cSince then, she\u2019s been very quiet on cannabis and now finally she has expressed her desire to respect the will of the people when it comes to cannabis policy in South Dakota.\u201d<\/p>\n<p>Noem was also asked during last week\u2019s event about what would happen to people who have faced marijuana convictions if voters pass the legalization initiative. She said that it\u2019s \u201chard to have that discussion when you don\u2019t know necessarily if it\u2019ll pass or not,\u201d the Argus Leader <a href=\"https:\/\/www.argusleader.com\/story\/news\/local\/2022\/08\/23\/kristi-noem-talks-possibility-legalize-recreational-marijuana-south-dakota\/7851351001\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>House Minority Leader Jamie Smith (D), who is the Democratic nominee challenging the governor this year, has also taken Noem to task over her prior efforts to interfere in voter-approved legalization, releasing ads this month <a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-governors-push-to-block-voter-approved-marijuana-legalization-slammed-in-campaign-ad\/\" target=\"_blank\" rel=\"noopener\">that remind voters of the interference<\/a>.<\/p>\n<p>\u201cKristi Noem sued the voters the first time we approved recreational marijuana,\u201d Smith said on Tuesday in response to reports about the governor\u2019s latest remarks. \u201cIt\u2019s suspicious that this sudden change of heart conveniently happens during an election year.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Kristi Noem sued the voters the first time we approved recreational marijuana. <\/p>\n<p>It\u2019s suspicious that this sudden change of heart conveniently happens during an election year. <a href=\"https:\/\/t.co\/rT7ZTp8K22\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/rT7ZTp8K22<\/a><\/p>\n<p>\u2014 Jamie Smith for SD Governor (@RepJamieSmith) <a href=\"https:\/\/twitter.com\/RepJamieSmith\/status\/1562099637221265410?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">August 23, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>A poll released in December 2021 found that most South Dakota voters approved of Noem\u2019s job performance overall, but\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-voters-disapprove-of-governors-handling-of-marijuana-legalization-poll-finds\/\" target=\"_blank\" rel=\"noopener\">just 39 percent supported her handling of marijuana legalization<\/a>, with 51 percent disapproving.<\/p>\n<p>Noem tried to get the legislature to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-medical-marijuana-activists-propose-alternative-legalization-timeline-after-governor-pushes-delay\/\" target=\"_blank\" rel=\"noopener\">approve a bill to delay implementation<\/a>\u00a0of the medical cannabis program for an additional year, but while it cleared the House, negotiators were unable to reach an agreement with the Senate in conference, delivering a defeat to the governor.<\/p>\n<p>In response,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-governor-floats-marijuana-decriminalization-as-part-of-medical-cannabis-compromise\/\" target=\"_blank\" rel=\"noopener\">her office started exploring a compromise last year<\/a>, with one proposal that came out of her administration to decriminalize possession of up to one ounce of cannabis, limit the number of plants that patients could cultivate to three and prohibit people under 21 from qualifying for medical marijuana.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,500 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/08\/MM_Bill_Tracker_V5_blank-117.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Following the court ruling that invalidated the earlier ballot box win, activists decided to take a two-track approach to the policy change in 2022, both working with legislators for a legislative reform while separately collecting signatures for the ballot initiative if lawmakers failed to act.<\/p>\n<p>While they would have preferred lawmakers to enact the policy change, that did not materialize this session. The House\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-house-rejects-marijuana-legalization-bill-that-was-temporarily-revived-in-smoke-out-vote\/\" target=\"_blank\" rel=\"noopener\">rejected a Senate-passed legalization bill<\/a>\u00a0in March, effectively leaving it up to activists to get on the ballot again.<\/p>\n<p>SDBML then successfully turned in enough signatures to qualify again for 2022. The organization said it intends to work with lawmakers on that measure while continuing to push for the ballot measure.<\/p>\n<p><strong>Here\u2019s what the campaign\u2019s marijuana legalization ballot\u00a0<a href=\"https:\/\/www.southdakotamarijuana.org\/2022-initiative\" target=\"_blank\" rel=\"noopener\">initiative<\/a>\u00a0would accomplish if approved by voters:\u00a0<\/strong><\/p>\n<p style=\"padding-left: 40px\">The measure would allow adults 21 and older to purchase and possess up to an ounce of cannabis. They could also grow up to three plants for personal use.<\/p>\n<p style=\"padding-left: 40px\">It also lays out civil penalties for violating provisions related to issues such as public consumption or growing more plants than permitted.<\/p>\n<p style=\"padding-left: 40px\">Employers would specifically be allowed to continue enforcing workplace drug policy prohibiting cannabis use by workers.<\/p>\n<p style=\"padding-left: 40px\">State and local governments could continue to ban marijuana activities made legal under the initiative in buildings \u201cowned, leased, or occupied\u201d by a governmental body.<\/p>\n<p style=\"padding-left: 40px\">The measure does not touch on regulatory policies concerning taxing cannabis sales, licensing or equity.<\/p>\n<p>A Marijuana Interim Study Committee, headed by legislative leaders, was established last year to explore cannabis policy reform, and the panel ultimately recommended that the legislature\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-south-dakota-lawmakers-officially-recommend-marijuana-legalization-bill-for-2022-session\/\" target=\"_blank\" rel=\"noopener\">take up legalization this session<\/a>. The House-defeated legislation was one of the direct products of that recommendation.<\/p>\n<p><strong>With respect to the 2022 ballot, South Dakota is just one of several states where voters may decide on drug policy reform this November.\u00a0<\/strong><\/p>\n<p>In neighboring North Dakota, voters will have the chance to <a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-voters-will-decide-on-marijuana-legalization-at-the-ballot-this-november-state-certifies\/\" target=\"_blank\" rel=\"noopener\">decide on marijuana legalization at the ballot<\/a>\u00a0this November, the secretary of state\u2019s office confirmed.<\/p>\n<p>Oklahoma officials certified on Monday that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-officials-say-marijuana-initiative-has-enough-signatures-but-it-might-miss-this-novembers-ballot\/\" target=\"_blank\" rel=\"noopener\">activists have collected enough valid signatures<\/a>\u00a0to place a marijuana legalization initiative before voters. But the measure may not end up on this November\u2019s ballot as planned, because there are still additional formalities the proposal needs to go through as state deadlines to print voting materials approach.<\/p>\n<p>Nebraska lawmakers and advocates are considering <a href=\"https:\/\/www.marijuanamoment.net\/nebraska-activists-weigh-recreational-marijuana-legalization-for-2024-ballot-after-medical-cannabis-campaign-setback\/\" target=\"_blank\" rel=\"noopener\">new paths forward for marijuana reform<\/a>\u2014including pursuing recreational legalization on the 2024 ballot or convening a special legislative session to pass medical cannabis in the interim\u2014after state\u00a0 officials announced that a medically focused reform campaign\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nebraska-medical-marijuana-initiatives-will-not-appear-on-november-ballot-state-announces\/\" target=\"_blank\" rel=\"noopener\">had come up short on signatures to put their measures before voters<\/a>\u00a0this year.<\/p>\n<p>The Arkansas Supreme Court recently ordered the secretary of state\u2019s office to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/arkansas-supreme-court-orders-state-to-put-marijuana-legalization-initiative-on-ballot-but-votes-may-not-be-counted\/\" target=\"_blank\" rel=\"noopener\">certify a marijuana legalization initiative<\/a>\u00a0for the November ballot\u2014but there\u2019s a chance that the votes will not end up being counted, depending on the final outcome of a pending legal challenge.<\/p>\n<p>Maryland elections officials have finalized the language\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maryland-officials-certify-final-text-of-marijuana-legalization-ballot-question-and-provide-summary-ahead-of-november-vote\/\" target=\"_blank\" rel=\"noopener\">for a marijuana legalization referendum<\/a>\u00a0that lawmakers placed on the November ballot, and have issued a formal summary of the reform proposal.<\/p>\n<p>Missouri\u2019s secretary of state announced earlier this month that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-marijuana-legalization-initiative-will-appear-on-november-ballot-state-announces\/\" target=\"_blank\" rel=\"noopener\">activists had turned in enough signatures<\/a>\u00a0to put marijuana legalization on the state\u2019s November ballot.<\/p>\n<p>Colorado voters will have the chance to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-psychedelics-legalization-and-psilocybin-therapy-measure-qualifies-for-november-ballot\/\" target=\"_blank\" rel=\"noopener\">decide on a historic ballot initiative<\/a>\u00a0this November to legalize psychedelics and create licensed psilocybin \u201chealing centers\u201d where people can use the substance for therapeutic purposes.<\/p>\n<p>Michigan activists announced in June that they will no longer be pursuing\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/michigan-activists-give-up-2022-push-for-psychedelics-legalization-ballot-initiative-shifting-focus-to-2024\/\" target=\"_blank\" rel=\"noopener\">a statewide psychedelics legalization ballot initiative<\/a>\u00a0for this year\u2019s election and will instead focus on qualifying the measure to go before voters in 2024.<\/p>\n<p>The campaign behind an effort to decriminalize drugs and expand treatment and recovery services in Washington State said in June that it has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-state-activists-call-off-drug-decriminalization-ballot-effort-even-as-new-poll-shows-voter-support\/\" target=\"_blank\" rel=\"noopener\">halted its push to qualify an initiative<\/a>\u00a0for November\u2019s ballot.<\/p>\n<p>While Wyoming activists said earlier this year that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-activists-jumpstart-signature-gathering-for-2022-marijuana-ballot-initiatives\/\" target=\"_blank\" rel=\"noopener\">they made solid progress in collecting signatures<\/a>\u00a0for a pair of ballot initiatives to decriminalize marijuana possession and legalize medical cannabis,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-marijuana-activists-turn-focus-to-2024-ballot-for-decriminalization-and-medical-cannabis-initiatives\/\" target=\"_blank\" rel=\"noopener\">they didn\u2019t get enough to make the 2022 ballot deadline<\/a>\u00a0and will be aiming for 2024 while simultaneously pushing the legislature to advance reform even sooner.<\/p>\n<p>In March, California activists announced that they\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-activists-drop-2022-psilocybin-legalization-ballot-initiative-after-falling-short-of-signature-requirement\/\" target=\"_blank\" rel=\"noopener\">came up short on collecting enough signatures<\/a>\u00a0to qualify a measure to legalize psilocybin mushrooms for the state\u2019s November ballot, though they aren\u2019t giving up on a future election cycle bid.<\/p>\n<p>An effort to put adult-use legalization on the statewide ballot in Ohio\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ohio-will-not-vote-on-marijuana-this-november-but-lawsuit-settlement-puts-legalization-activists-on-path-for-2023\/\" target=\"_blank\" rel=\"noopener\">fizzled out this year<\/a>, but the campaign did secure a procedural legal win that will allow them to hit the ground running for a planned 2023 reform initiative.<\/p>\n<p>Locally, Ohio voters in at least seven cities will get a chance to join many of their neighboring jurisdictions in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ohio-voters-in-seven-more-cities-will-decide-on-marijuana-decriminalization-at-the-ballot-this-november\/\" target=\"_blank\" rel=\"noopener\">enacting local marijuana decriminalization<\/a>\u00a0at the ballot this November.<\/p>\n<p>Voters in five Texas cities will also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/voters-in-five-texas-cities-will-decide-on-marijuana-decriminalization-in-november-activists-say\/\" target=\"_blank\" rel=\"noopener\">vote on local cannabis decriminalization measures<\/a>\u00a0this year.<\/p>\n<p>Advocates have also worked to place local decriminalization ordinances on the ballot in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/west-virginia-activists-are-collecting-signatures-to-put-marijuana-decriminalization-measures-on-local-ballots\/\" target=\"_blank\" rel=\"noopener\">West Virginia<\/a>.<\/p>\n<p>Wisconsin voters in at least half a dozen cities and counties\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/voters-across-wisconsin-will-see-marijuana-questions-on-their-ballots-in-november\/\" target=\"_blank\" rel=\"noopener\">will also be asked on November\u2019s ballot<\/a>\u00a0whether they support legalizing, taxing and regulating cannabis in a manner similar to alcohol.
