{"id":56423,"date":"2022-08-09T08:21:27","date_gmt":"2022-08-09T16:21:27","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/08\/09\/missouri-marijuana-legalization-initiative-will-appear-on-november-ballot-state-announces\/"},"modified":"2022-08-09T08:45:28","modified_gmt":"2022-08-09T16:45:28","slug":"missouri-marijuana-legalization-initiative-will-appear-on-november-ballot-state-announces","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/08\/09\/missouri-marijuana-legalization-initiative-will-appear-on-november-ballot-state-announces\/","title":{"rendered":"Missouri Marijuana Legalization Initiative Will Appear On November Ballot, State Announces"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/08\/MM_Bill_Tracker_V5_blank-46.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Missouri officials on Tuesday announced that an initiative to legalize marijuana will appear on the state\u2019s November ballot.<\/p>\n<p>While early reporting from county officials had signaled that the campaign was <a href=\"https:\/\/www.marijuanamoment.net\/missouri-marijuana-legalization-initiative-short-of-signatures-needed-for-ballot-in-county-reviews\/\" target=\"_blank\" rel=\"noopener\">coming up short on signatures in key congressional districts<\/a>, Secretary of State Jay Ashcroft (R) has now certified that activists indeed turned in enough valid petitions to place the cannabis reform measure before voters.<\/p>\n<p>\u201cI encourage Missourians to study and educate themselves on any ballot initiative,\u201d Ashcroft <a href=\"https:\/\/www.sos.mo.gov\/default.aspx?PageId=10227\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cInitiative 2022-059 that voters will see on the November ballot is particularly lengthy and should be given careful consideration.\u201d<\/p>\n<p>Legal Missouri 2022 submitted about <a href=\"https:\/\/www.marijuanamoment.net\/missouri-activists-submit-double-the-signatures-needed-for-marijuana-legalization-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\">400,000 signatures for a legalization initiative<\/a> in May. They needed to reach a signature threshold in at least six of the state\u2019s eight congressional districts to make the ballot, and it initially appeared that <a href=\"https:\/\/www.marijuanamoment.net\/missouri-marijuana-legalization-initiative-short-of-signatures-needed-for-ballot-in-county-reviews\/\" target=\"_blank\" rel=\"noopener\">they were falling behind in two of those districts<\/a>.<\/p>\n<p>John Payne of Legal Missouri had commented on the concerns about signature gathering and said the campaign had been actively reviewing the results from local officials to check for errors.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,500 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/08\/MM_Bill_Tracker_V5_blank-45.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p><strong>Here\u2019s what Legal Missouri 2022\u2019s reform\u00a0<a href=\"https:\/\/www.legalmo22.com\/initiative\" target=\"_blank\" rel=\"noopener\">initiative<\/a>\u00a0would accomplish:\u00a0<\/strong><\/p>\n<p style=\"padding-left: 40px\">Adults 21 and older could purchase and possess up to three ounces of cannabis.<\/p>\n<p style=\"padding-left: 40px\">They could also grow up to six flowering marijuana plants, six immature plants and six clones if they obtain a registration card.<\/p>\n<p style=\"padding-left: 40px\">The initiative would impose a six percent tax on recreational cannabis sales and use revenue to facilitate automatic expungements for people with certain non-violent marijuana offenses on their records.<\/p>\n<p style=\"padding-left: 40px\">Remaining revenue would go toward veterans\u2019 healthcare, substance misuse treatment and the state\u2019s public defender system.<\/p>\n<p style=\"padding-left: 40px\">The Department of Health and Senior Services would be responsible for regulating the program and issuing licenses for cannabis businesses.<\/p>\n<p style=\"padding-left: 40px\">Regulators would be required to issue at least 144 microbusiness licenses through a lottery system, with priority given to low-income applicants and people who have been disproportionately impacted by drug criminalization.<\/p>\n<p style=\"padding-left: 40px\">Existing medical marijuana dispensaries would also be first in line to start serving adult consumers with dual licenses.<\/p>\n<p style=\"padding-left: 40px\">Regulators could create rules around advertising, but they could not be any more stringent than existing restrictions on alcohol marketing.<\/p>\n<p style=\"padding-left: 40px\">Public consumption, driving under the influence of cannabis and underage marijuana use would be explicitly prohibited.<\/p>\n<p style=\"padding-left: 40px\">A seed-to-sale tracking system would be established for the marijuana market.<\/p>\n<p style=\"padding-left: 40px\">Local jurisdictions would be able to opt out of permitting cannabis microbusinesses or retailers from operating in their area if voters approve the ban at the ballot.<\/p>\n<p style=\"padding-left: 40px\">The measure would further codify employment protections for medical cannabis patients.<\/p>\n<p style=\"padding-left: 40px\">Medical marijuana cards would be valid for three years at a time, instead of one. And caregivers would be able to serve double the number of patients.<\/p>\n<p>A strong majority of Missouri voters, including a plurality of Republicans, <a href=\"https:\/\/www.marijuanamoment.net\/majority-of-missouri-voters-back-marijuana-legalization-new-poll-finds-as-state-reviews-signatures-for-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\">support legalizing marijuana for adult use<\/a>, a recent poll found.<\/p>\n<p>Payne previously led a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-voters-approve-medical-marijuana-measure\/\" target=\"_blank\" rel=\"noopener\">successful ballot effort to legalize medical cannabis<\/a>\u00a0in the Show-Me State in 2018.<\/p>\n<p>Legal Missouri 2022\u2019s initiative is backed by the Missouri Medical Cannabis Trade Association as well as ACLU of Missouri; St. Louis City, St. Louis County and St. Charles County chapters of the NAACP; all six active chapters of Missouri NORML and Missouri Association of Criminal Defense Lawyers.<\/p>\n<p>Meanwhile, some advocates and stakeholders have raised concerns about the ballot proposal and pushed for legislative reform instead,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-led-bill-to-legalize-marijuana-in-missouri-heads-to-house-floor-as-key-deadline-approaches\/\" target=\"_blank\" rel=\"noopener\">like a legalization bill from Rep. Ron Hicks (R)<\/a>.<\/p>\n<p>That measure moved through the committee process this year, and there were expectations that it would reach the House floor in May, but\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-house-leadership-delays-marijuana-legalization-vote-amid-licensing-dispute\/\" target=\"_blank\" rel=\"noopener\">leadership was unwilling to advance it<\/a>\u00a0before the session adjourned.<\/p>\n<p>Supporters of the Hicks bill have argued that the lack of specific language in the initiative prohibiting a licensing cap means the market that emerges will not be competitive. Some have also raised concerns about the measure\u2019s provisions to give medical cannabis dispensaries a head start in serving the adult-use market.<\/p>\n<p>Another Republican lawmaker in the state, Rep. Jason Chipman (R),\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-bill-would-let-voters-mandate-more-oversight-on-medical-marijuana-revenue-distribution-to-veterans\/\" target=\"_blank\" rel=\"noopener\">filed a joint resolution<\/a>\u00a0this session\u00a0that would let voters require additional oversight over how medical cannabis tax revenue is distributed to veterans.<\/p>\n<p>A different campaign, Fair Access Missouri,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-marijuana-activists-file-legalization-initiatives-for-2022-as-other-groups-prepare-separate-measures\/\" target=\"_blank\" rel=\"noopener\">separately explored multiple citizen initiatives<\/a>\u00a0this year with the hopes of getting at least one on the ballot, but did not end up submitting signatures for any of the measures.<\/p>\n<p><strong>Here\u2019s the state of play for other drug policy reform ballot measures in 2022:\u00a0<\/strong><\/p>\n<p>Arkansas activists have filed a lawsuit with the state Supreme Court, seeking to secure ballot access for their proposed marijuana legalization initiative. The legal action came after the state Board of Election Commissioners <a href=\"https:\/\/www.marijuanamoment.net\/arkansas-marijuana-activists-plan-to-defend-legalization-ballot-initiative-in-state-supreme-court-after-officials-decline-to-certify\/\" target=\"_blank\" rel=\"noopener\">ruled that the measure\u2019s ballot title and popular name are misleading<\/a> even though the secretary of state verified that collected enough signatures to qualify.<\/p>\n<p>Colorado voters will have the chance to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-psychedelics-legalization-and-psilocybin-therapy-measure-qualifies-for-november-ballot\/\" target=\"_blank\" rel=\"noopener\">decide on a historic ballot initiative<\/a>\u00a0this November to legalize psychedelics and create licensed psilocybin \u201chealing centers\u201d where people can use the substance for therapeutic purposes.<\/p>\n<p>In May, South Dakota officials certified that activists\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-voters-will-decide-on-marijuana-legalization-ballot-measure-in-november\/\" target=\"_blank\" rel=\"noopener\">turned in a sufficient number of signatures<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-dakota-activists-turn-in-signatures-to-put-marijuana-legalization-on-the-ballot\/\" target=\"_blank\" rel=\"noopener\">qualify a marijuana legalization measure for the November ballot<\/a>.<\/p>\n<p>Maryland lawmakers passed legislation this year, which the governor allowed to go into effect without his signature, that will\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maryland-governor-lets-bill-to-implement-marijuana-legalization-take-effect-without-his-signature\/\" target=\"_blank\" rel=\"noopener\">put the issue of cannabis legalization before voters<\/a>\u00a0this November.<\/p>\n<p>North Dakota activists turned in what they believe to be enough signatures to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-activists-officially-turn-in-signatures-for-marijuana-legalization-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\">place a marijuana legalization initiative before voters<\/a>.<\/p>\n<p>Oklahoma activists also said they\u2019ve submitted what they believe to be more than enough signatures to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-marijuana-activists-submit-signatures-to-put-legalization-on-november-ballot\/\" target=\"_blank\" rel=\"noopener\">qualify a marijuana legalization initiative<\/a>\u00a0for the November ballot.<\/p>\n<p>Nebraska advocates recently submitted signatures for a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nebraska-medical-marijuana-activists-turn-in-ballot-signatures-after-campaign-suffers-legal-setback\/\" target=\"_blank\" rel=\"noopener\">pair of medical cannabis legalization initiatives<\/a>. The campaign has faced several challenges along the way, including the loss of critical funding after a key donor passed away and a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/15-state-attorneys-general-file-brief-opposing-lawsuit-to-help-put-medical-marijuana-on-nebraska-ballot\/\" target=\"_blank\" rel=\"noopener\">court battle of the state\u2019s geographic requirements<\/a>\u00a0for ballot petitions.<\/p>\n<p>An initiative to legalize marijuana\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ohio-will-not-vote-on-marijuana-this-november-but-lawsuit-settlement-puts-legalization-activists-on-path-for-2023\/\" target=\"_blank\" rel=\"noopener\">will not appear on Ohio\u2019s November ballot<\/a>, the campaign behind the measure announced in May. But activists did reach a settlement with state officials in a legal challenge that will give them a chance to hit the ground running in 2023.<\/p>\n<p>Michigan activists announced in June that they will no longer be pursuing\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/michigan-activists-give-up-2022-push-for-psychedelics-legalization-ballot-initiative-shifting-focus-to-2024\/\" target=\"_blank\" rel=\"noopener\">a statewide psychedelics legalization ballot initiative<\/a>\u00a0for this year\u2019s election and will instead focus on qualifying the measure to go before voters in 2024.<\/p>\n<p>The campaign behind an effort to decriminalize drugs and expand treatment and recovery services in Washington State said in June that it has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-state-activists-call-off-drug-decriminalization-ballot-effort-even-as-new-poll-shows-voter-support\/\" target=\"_blank\" rel=\"noopener\">halted its push to qualify an initiative<\/a>\u00a0for November\u2019s ballot.<\/p>\n<p>While Wyoming activists said earlier this year that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-activists-jumpstart-signature-gathering-for-2022-marijuana-ballot-initiatives\/\" target=\"_blank\" rel=\"noopener\">they made solid progress in collecting signatures<\/a>\u00a0for a pair of ballot initiatives to decriminalize marijuana possession and legalize medical cannabis,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-marijuana-activists-turn-focus-to-2024-ballot-for-decriminalization-and-medical-cannabis-initiatives\/\" target=\"_blank\" rel=\"noopener\">they didn\u2019t get enough to make the 2022 ballot deadline<\/a>\u00a0and will be aiming for 2024 while simultaneously pushing the legislature to advance reform even sooner.<\/p>\n<p>In March, California activists announced that they\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-activists-drop-2022-psilocybin-legalization-ballot-initiative-after-falling-short-of-signature-requirement\/\" target=\"_blank\" rel=\"noopener\">came up short on collecting enough signatures<\/a>\u00a0to qualify a measure to legalize psilocybin mushrooms for the state\u2019s November ballot, though they aren\u2019t giving up on a future election cycle bid.<\/p>\n<p>Meanwhile, there are various local reforms that activists want to see voters decide on this November\u2014including local marijuana decriminalization ordinances in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/more-ohio-cities-set-to-vote-on-marijuana-decriminalization-as-activists-pursue-statewide-reform-initiative\/\" target=\"_blank\" rel=\"noopener\">Ohio<\/a>,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/west-virginia-activists-are-collecting-signatures-to-put-marijuana-decriminalization-measures-on-local-ballots\/\" target=\"_blank\" rel=\"noopener\">West Virginia<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/voters-in-five-texas-cities-will-decide-on-marijuana-decriminalization-in-november-activists-say\/\" target=\"_blank\" rel=\"noopener\">Texas<\/a>.<\/p>\n<p>Meanwhile, Wisconsin voters in at least half a dozen cities and counties <a href=\"https:\/\/www.marijuanamoment.net\/voters-across-wisconsin-will-see-marijuana-questions-on-their-ballots-in-november\/\" target=\"_blank\" rel=\"noopener\">will be asked on November\u2019s ballot<\/a> whether they support legalizing, taxing and regulating cannabis in a manner similar to alcohol.
