It shouldn\u2019t be \u201cjust a few people making the rules for everybody.\u201d<\/p>\n<p>At this point, it\u2019s all but certain that Colorado voters will only have one psychedelics reform measure to decide on this November. That \u201cNatural Medicine Health Act\u201d would legalize certain psychedelics and also create licensed psilocybin \u201chealing centers\u201d where people could use the substance for therapeutic purposes.<\/p>\n<p>The Natural Medicine Colorado campaign, which did have sizable financial backing and a professional petitioning resources, had submitted about 100,000 more signatures than required for ballot access, a sizable buffer that was the result of <a href=\"https:\/\/www.marijuanamoment.net\/colorado-activists-collect-tens-of-thousands-of-signatures-to-put-psychedelics-reform-on-ballot\/\" target=\"_blank\" rel=\"noopener\">just about three months of petitioning<\/a>.<\/p>\n<p>One of the co-proponents of Initiative 58, Kevin Matthews, also served as campaign manager for the earlier Denver psilocybin measure. It was a policy development that helped ignite a national movement that has reached cities across the U.S., as well as a growing number of state legislatures and Congress.<\/p>\n<p>The new statewide measure Matthews is working on would legalize possession of certain psychedelics, establish a therapeutic model for supervised psilocybin treatment and provide a pathway for record sealing for prior convictions.<\/p>\n<p>Matthews told Marijuana Moment on Monday that his campaign is \u201cfocused on our goal of delivering medicine to Coloradans suffering from PTSD, depression, addiction and challenging mental health conditions in a way that successfully balances their access and safety in a regulated, therapeutic setting.\u201d<\/p>\n<p>\u201cWe will continue to reach out and welcome into our coalition all Coloradans committed to providing access to this research-based and transformative treatment,\u201d he said.<\/p>\n<p>Meanwhile, Colorado Gov. Jared Polis (D) was recently asked about the prospects of enacting psychedelics reform in the state, and he acknowledged that advocates are working to accomplish that policy change at the ballot and also said\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-backs-psychedelics-reform-and-says-prohibition-inhibits-research-into-medical-benefits\/\" target=\"_blank\" rel=\"noopener\">he supports the idea of decriminalizing the substances<\/a>.<\/p>\n<p>In June, Polis signed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-bill-to-legalize-mdma-prescriptions-heads-to-governor-following-senate-passage\/\" target=\"_blank\" rel=\"noopener\">align state statute to legalize MDMA prescriptions<\/a>\u00a0if and when the federal government ultimately permits such use.<\/p>\n<p>He also issued an executive order last month to <a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-issues-executive-order-on-marijuana-protections-for-workers-with-professional-licenses\/\" target=\"_blank\" rel=\"noopener\">provide broad professional licensing protections<\/a>\u00a0for workers who use marijuana in compliance with state law. The move further prevents state agencies from assisting in any out-of-state investigations related to lawful cannabis conduct that could result in employment penalties.<\/p>\n<p><strong>With respect of psychedelics, Colorado is far from the only state where reform is advancing.<\/strong><\/p>\n<p>A California bill to legalize psychedelics possession that already passed the Senate and two Assembly committees <a href=\"https:\/\/www.marijuanamoment.net\/california-bills-to-legalize-psychedelics-possession-allow-interstate-marijuana-commerce-and-more-teed-up-for-key-hurdle-next-week\/\" target=\"_blank\" rel=\"noopener\">is teed up for a final committee vote<\/a> before potentially heading to the floor. Because it\u2019s been amended, it would still need to return to the Senate for concurrence before potentially moving to the governor\u2019s desk.<\/p>\n<p>The leader of the New Jersey Senate filed a bill in June that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-senate-president-files-psilocybin-legalization-bill-that-includes-home-grow-option-unlike-current-marijuana-law\/\" target=\"_blank\" rel=\"noopener\">legalize the possession, home cultivation and gifting of psilocybin mushrooms<\/a>\u00a0for adults 21 and older\u2014with provisions that give adults even more freedoms for the psychedelic than are afforded under the state\u2019s current marijuana laws.<\/p>\n<p>The governor of Connecticut\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-governor-signs-bill-creating-psychedelic-treatment-program\/\" target=\"_blank\" rel=\"noopener\">signed a large-scale budget bill<\/a>\u00a0in May that includes provisions to set the state up to provide certain patients with access to psychedelic-assisted treatment using substances like MDMA and psilocybin.<\/p>\n<p>Maryland\u2019s governor recently allowed a bill to go into law without his signature to create a state fund to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maryland-bill-to-fund-psychedelics-research-and-access-for-veterans-takes-effect-without-governors-signature\/\" target=\"_blank\" rel=\"noopener\">provide \u201ccost-free\u201d access to psychedelics<\/a>\u00a0like psilocybin, MDMA and ketamine for military veterans suffering from post-traumatic stress disorder (PTSD) and traumatic brain injury.<\/p>\n<p>A Massachusetts-based campaign, Bay Staters for National Medicine (BSNM), is also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/massachusetts-psychedelics-activists-plan-to-put-decriminalization-on-local-ballot-and-force-lawmakers-to-file-state-bills\/\" target=\"_blank\" rel=\"noopener\">supporting a statewide reform push<\/a>\u00a0to force state lawmakers to file legislation to both legalize entheogenic substances for therapeutic use and otherwise decriminalize certain psychedelics.<\/p>\n<p>The Maine Senate approved\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maine-senate-approves-medical-psilocybin-bill-but-house-refusal-kills-measure-for-the-year\/\" target=\"_blank\" rel=\"noopener\">a bill in April to to create a medical psilocybin program<\/a>\u00a0in the state, but the House of Representatives refused to go along.<\/p>\n<p>Also that month, Georgia lawmakers advanced a bipartisan resolution that calls for the formation of a House study committee to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/georgia-bill-would-create-psychedelic-study-committee-to-recommend-reform-policies\/\" target=\"_blank\" rel=\"noopener\">investigate the therapeutic potential of psychedelics<\/a>\u00a0like psilocybin and make recommendations for reforms.<\/p>\n<p>The governor of Utah signed a bill in March to create a task force to study and make recommendations\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/utah-governor-signs-bill-to-study-use-of-psychedelics-for-mental-health-therapy\/\" target=\"_blank\" rel=\"noopener\">on the therapeutic potential of psychedelic drugs<\/a>\u00a0and possible regulations for their lawful use.<\/p>\n<p>A Missouri House committee also held a hearing that month on a GOP-led bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-lawmakers-discuss-gop-led-psychedelics-therapy-and-decriminalization-bill-in-committee\/\" target=\"_blank\" rel=\"noopener\">legalize a wide range of psychedelics for therapeutic use<\/a>\u00a0at designated care facilities while further decriminalizing low-level possession in general.<\/p>\n<p>The Washington State legislature recently sent a budget bill to the governor\u2019s desk that includes a proposal to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-state-legislature-approves-200000-in-psilocybin-research-funding-in-budget\/\" target=\"_blank\" rel=\"noopener\">direct $200,000 in funding to support a new workgroup<\/a>\u00a0to study the possibility of legalizing psilocybin services in the state, including the idea of using current marijuana regulatory systems to track psychedelic mushrooms.<\/p>\n<p>In March, the Hawaii Senate approved a bill to set up a state working group to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-unanimously-approves-psilocybin-task-force-bill-with-decriminalization-measures-still-pending\/\" target=\"_blank\" rel=\"noopener\">study the therapeutic benefits of psilocybin mushrooms<\/a>\u00a0and develop a \u201clong-term\u201d plan to ensure that the psychedelic is accessible for medical use for adults 21 and older.<\/p>\n<p>Also that month, the Oklahoma House of Representatives passed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-house-passes-psilocybin-decriminalization-and-research-bill-sending-it-to-senate\/\" target=\"_blank\" rel=\"noopener\">decriminalize low-level possession of psilocybin<\/a>\u00a0and promote research into the therapeutic potential of the psychedelic.<\/p>\n<p>Rhode Island lawmakers introduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rhode-island-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-while-legal-marijuana-momentum-increases\/\" target=\"_blank\" rel=\"noopener\">a pair of drug decriminalization bills in March<\/a>\u2014including one focused on psilocybin and buprenorphine that would authorize doctors to prescribe the psychedelic mushroom.<\/p>\n<p>Washington State lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/psilocybin-services-would-be-legalized-in-washington-state-under-new-bill\/\" target=\"_blank\" rel=\"noopener\">also introduced legislation in January<\/a>\u00a0that would legalize what the bill calls \u201csupported psilocybin experiences\u201d by adults 21 and older.<\/p>\n<p>New Hampshire lawmakers filed measures to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022\/\" target=\"_blank\" rel=\"noopener\">decriminalize psilocybin and all drugs<\/a>.<\/p>\n<p>Legislation was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-will-study-benefits-of-psychedelics-for-military-veterans-under-bill-enacted-without-governors-signature\/\" target=\"_blank\" rel=\"noopener\">also enacted by the Texas legislature<\/a>\u00a0last year requiring the state to study the medical risks and benefits of psilocybin, MDMA and ketamine for military veterans in partnership with Baylor College of Medicine and a military-focused medical center.<\/p>\n<p>Congressional lawmakers and federal agencies have also started to take serious interest in psychedelics policy.<\/p>\n<p>For example, top federal health agency says it is actively \u201cexploring\u201d the possibility of creating a task force to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-administration-exploring-psychedelics-task-force-ahead-of-expected-federal-approval-of-psilocybin-and-mdma\/\" target=\"_blank\" rel=\"noopener\">investigate the therapeutic of certain psychedelics<\/a>\u00a0like psilocybin and MDMA in anticipation of federal approval of the substances for prescription use.<\/p>\n<p>In January, bipartisan House lawmakers sent a letter to the Drug Enforcement Administration (DEA) that implored the agency to allow terminally ill patients to access psilocybin as an investigational drug, pursuant to federal \u201cRight to Try\u201d statute\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bill-on-trumps-desk-would-allow-marijuana-and-maybe-mdma-for-some-patients\/\" target=\"_blank\" rel=\"noopener\">enacted under the Trump administration<\/a>.<\/p>\n<p>DEA is now facing another lawsuit for refusing to allow a Seattle-based doctor to obtain psilocybin for his oncology patients. Plaintiffs say that the agency is unlawfully failing to abide by federal law by denying such access under the circumstances.<\/p>\n<p>Bipartisan House and Senate lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cory-booker-and-rand-paul-bill-would-force-dea-to-let-patients-use-psychedelics-and-marijuana\/\" target=\"_blank\" rel=\"noopener\">filed companion bills last month<\/a>\u00a0that seeks to clarify the intent and application of the \u201cRight to Try\u201d law at the center of the case. Sens. Cory Booker (D-NJ) and Rand Paul (R-KY), along with Reps. Earl Blumenauer (D-OR) and Nancy Mace (R-SC), are the lead sponsors of the legislation.<\/p>\n<p>In May, Booker and Sen. Brian Schatz (D-HI)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/senators-want-psychedelics-research-review-from-federal-agencies\/\" target=\"_blank\" rel=\"noopener\">separately pushed top federal officials<\/a>\u00a0to provide an update on research into the therapeutic potential of psychedelics, arguing that ongoing federal prohibition has stymied studies.<\/p>\n<p>Federal health officials recently recognized that\u00a0federal prohibition\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-health-officials-say-psychedelics-illegal-status-makes-it-harder-for-researchers-to-study-them\/\" target=\"_blank\" rel=\"noopener\">makes it harder to study the benefits of psychedelics<\/a>, requiring researchers to jump through additional regulatory hoops.<\/p>\n<p>Activists including one of the plaintiffs in the Right to Try case, Erinn Baldeschwiler,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/watch-live-psychedelics-activists-protest-at-dea-headquarters-to-demand-psilocybin-access-for-terminal-patients\/\" target=\"_blank\" rel=\"noopener\">staged a demonstration outside of DEA headquarters<\/a>\u00a0in Virginia in May, demanding that the agency allow terminally ill patients to access psilocybin therapy.<\/p>\n<p>DEA is separately being sued over\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dea-sued-over-unlawful-delays-on-psychedelic-and-marijuana-public-records-requests-through-foia\/\" target=\"_blank\" rel=\"noopener\">repeated delays in processing requests for public records<\/a>\u00a0related to psychedelics and marijuana.<\/p>\n<p>Following significant pushback from the research and advocacy communities, the agency recently rescinded its proposal to ban five psychedelic compounds that scientists say could hold significant therapeutic potential.
