The controversy isn\u2019t so much not about Cohen reportedly patronizing the shop; rather, it\u2019s about the apparent use of a federally funded Secret Service detail to protect the transaction at a time when Biden has failed to fulfill his campaign pledges to decriminalize cannabis and free people who are serving time behind bars for past convictions.<\/p>\n<p>Biden has said that he <a href=\"https:\/\/www.marijuanamoment.net\/biden-says-hes-working-on-fulfilling-marijuana-campaign-pledge-to-free-prisoners\/\" target=\"_blank\" rel=\"noopener\">doesn\u2019t believe people should be incarcerated over cannabis<\/a>, and he\u2019s expressed support for letting states set their own policies without federal intervention, but he hasn\u2019t taken meaningful steps to end federal criminalization as he promised on the campaign trail.<\/p>\n<p>The president <a href=\"https:\/\/www.marijuanamoment.net\/biden-finally-grants-relief-to-people-with-federal-marijuana-and-drug-convictions-after-more-than-a-year-in-office\/\" target=\"_blank\" rel=\"noopener\">did grant clemency to 78 people<\/a>, including those with non-violent federal drug convictions on their records, in April. But advocates have made clear that they want to see bolder executive action, like a mass pardon for all people who remain behind bars over marijuana.<\/p>\n<p>To that end, the optics of a presidential relative <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-11016081\/Hunter-Bidens-wife-Melissa-Cohen-leaves-cannabis-store-Malibu-running-errands.html\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> getting Secret Service protection while appearing to engage in an activity that remains federally prohibited and for which the president is allowing people to remain in prisons despite campaign promises to the contrary raises questions.<\/p>\n<p>However, it\u2019s important to note that while the Daily Mail reported that the person in plainclothes who appears in the outlet\u2019s photos next to Cohen is a Secret Service agent, Marijuana Moment has not been able to independently confirm that. It\u2019s also possible that Cohen could have purchased non-cannabis items at the dispensary, or federally legal hemp items.<\/p>\n<p>The White House did not respond to a request to fact-check The Daily Mail\u2019s reporting and offer comment.<\/p>\n<p>BOWL PAC Founder Justin Strekal told Marijuana Moment that if the reporting is accurate, he hopes that \u201cMelissa had a positive experience and will convey the normalcy of buying cannabis to the president and encourage his vocal support for legalization.\u201d<\/p>\n<p>(Disclosure: Strekal supports Marijuana Moment\u2019s work through a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">monthly pledge on Patreon<\/a>.)<\/p>\n<p>While Biden has backed modest cannabis reform proposals, the White House has made clear that his overall position in <a href=\"https:\/\/www.marijuanamoment.net\/bidens-opposition-to-marijuana-legalization-has-not-changed-press-secretary-says\/\" target=\"_blank\" rel=\"noopener\">opposition of adult-use legalization has not changed<\/a>, despite supermajority support for the policy change among voters in his party.<\/p>\n<p>Instead, the president\u2019s only public comment on marijuana policy since taking office happened last month, when said in response to a reporter\u2019s question about cannabis clemency that his administration is \u201cworking on\u201d it.<\/p>\n<p>Biden\u2019s broader opposition to recreational legalization hasn\u2019t stopped congressional lawmakers, including Senate Majority Leader Chuck Schumer (D-NY), from working to end federal prohibition legislatively, however.<\/p>\n<p>The leader <a href=\"https:\/\/www.marijuanamoment.net\/senate-bill-to-federally-legalize-marijuana-and-promote-social-equity-finally-filed-by-schumer-booker-and-wyden\/\" target=\"_blank\" rel=\"noopener\">filed a much-anticipated legalization bill<\/a> that would also impose a federal tax on cannabis sales and promote social equity last month.
