{"id":56215,"date":"2022-07-29T07:18:31","date_gmt":"2022-07-29T15:18:31","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/07\/29\/biden-continues-to-evaluate-marijuana-clemency-options-white-house-says\/"},"modified":"2022-07-29T08:45:30","modified_gmt":"2022-07-29T16:45:30","slug":"biden-continues-to-evaluate-marijuana-clemency-options-white-house-says","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/07\/29\/biden-continues-to-evaluate-marijuana-clemency-options-white-house-says\/","title":{"rendered":"Biden \u2018Continues To Evaluate\u2019 Marijuana Clemency Options, White House Says"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/07\/MM_Bill_Tracker_V5_blank-141.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>President Joe Biden is continuing to \u201cevaluate further uses of clemency powers,\u201d the White House said on Thursday after being asked for clarification about the administration\u2019s plans for relief for federal marijuana prisoners.<\/p>\n<p>Biden made his <a href=\"https:\/\/www.marijuanamoment.net\/biden-says-hes-working-on-fulfilling-marijuana-campaign-pledge-to-free-prisoners\/\" target=\"_blank\" rel=\"noopener\">first public comments on cannabis<\/a> since taking office earlier this month after being pressed on whether he plans to follow through on his campaign pledge to release people who are incarcerated over non-violent federal marijuana offenses.<\/p>\n<p>The president reiterated at the time that he doesn\u2019t believe people should be locked up over cannabis use, said that his administration is \u201cworking on\u201d fulfilling that clemency promise and vaguely alluded to a crime bill that he suggested would address the issue.<\/p>\n<p>At Thursday\u2019s briefing, New York Post reporter Steven Nelson followed up on those remarks, asking White House Press Secretary Karine Jean-Pierre whether the president also believes the people with federal convictions for selling marijuana should qualify for relief and whether the crime bill that Biden referenced \u201crules out potential mass clemency.\u201d<\/p>\n<p \/>\n<p>Jean-Pierre started by noting that <a href=\"https:\/\/www.marijuanamoment.net\/biden-finally-grants-relief-to-people-with-federal-marijuana-and-drug-convictions-after-more-than-a-year-in-office\/\" target=\"_blank\" rel=\"noopener\">the president granted relief to 78 people<\/a>, including those with non-violent federal drug convictions, in April, which she said is \u201cmore grants of clemency at this point in the presidency than any of his five recent predecessor.\u201d<\/p>\n<p>\u201cHe continues to evaluate further uses of clemency powers. We just don\u2019t have any additional announcement to make at this time\u2014but I can tell you that\u2019s what he\u2019s been doing during his administration,\u201d she said, without addressing what role any future legislation might play to that end and ignoring the query about whether people who sell cannabis should remain in prison.<\/p>\n<p>Advocates have heard similar refrains from the White House on marijuana clemency under the Biden administration before. And they\u2019ve grown frustrated over the lack of specificity and limited action, especially considering Biden\u2019s stated commitment to release people incarcerated over marijuana on the campaign trail.<\/p>\n<p>The president was applauded for granting an initial round of commutations and pardons, but he\u2019s faced intense pressure to issue a mass pardon, similar to how Presidents Gerald Ford and Jimmy Carter did for people who avoided the draft during the Vietnam War.<\/p>\n<p>Prior to his April clemency action, the president had reserved his pardon power to <a href=\"https:\/\/www.marijuanamoment.net\/biden-pardons-turkeys-but-white-house-has-nothing-new-on-relief-for-marijuana-prisoners\/\" target=\"_blank\" rel=\"noopener\">turkeys who were ceremonially spared<\/a>\u00a0around Thanksgiving.<\/p>\n<p>Following that ceremony, The Post\u2019s Nelson pressed the president on cannabis clemency, asking him if there were plans to pardon \u201cany people in addition to turkeys.\u201d Biden jokingly replied, \u201cyou need a pardon?\u201d and didn\u2019t respond to a follow-up question about marijuana prisoners.<\/p>\n<p>Biden has received about a dozen\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/senators-urge-biden-to-grant-mass-pardon-for-thousands-of-marijuana-cases\/\" target=\"_blank\" rel=\"noopener\">letters<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/republican-lawmakers-tell-biden-to-keep-marijuana-campaign-promise-by-reclassifying-it-under-federal-law\/\" target=\"_blank\" rel=\"noopener\">from<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-blast-biden-and-harris-over-continued-silence-on-marijuana-and-urge-rescheduling\/\" target=\"_blank\" rel=\"noopener\">lawmakers<\/a>,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/drake-killer-mike-and-other-celebs-push-biden-to-issue-mass-marijuana-pardons\/\" target=\"_blank\" rel=\"noopener\">advocates<\/a>, celebrities and people impacted by criminalization to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/aoc-calls-on-biden-to-use-executive-authority-on-marijuana-policy-as-presidents-agenda-stalls-in-congress\/\" target=\"_blank\" rel=\"noopener\">do something<\/a> about the people who remain behind federal bars over cannabis. But <a href=\"https:\/\/www.marijuanamoment.net\/after-one-year-as-president-bidens-marijuana-promises-remain-unfulfilled\/\" target=\"_blank\" rel=\"noopener\">he\u2019s yet to take meaningful action<\/a> after more than a year in office.<\/p>\n<p>Six senators\u2014including Sens. It also said that the administration can move to federally legalize cannabis without waiting for lawmakers to act.<\/p>\n<p>The White House has been asked about the issue several times. Former Press Secretary Jen Psaki had said that the president has \u201cevery intention of using his clemency power\u201d and is \u201clooking at\u201d relief for non-violent drug offenders.<\/p>\n<p>Rahul Gupta, director of the Office of National Drug Control Policy (ONDCP), said last month that the Biden administration is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-drug-czar-says-biden-admin-is-reviewing-marijuana-policies-and-safe-consumption-sites\/\" target=\"_blank\" rel=\"noopener\">\u201cmonitoring\u201d states that have legalized marijuana<\/a>\u00a0to inform federal policy, recognizing the failures of the current prohibitionist approach.<\/p>\n<p>In the background of these administrative developments, congressional lawmakers have continued to work legislatively to put an end to cannabis criminalization.<\/p>\n<p>Senate Majority Leader Chuck Schumer (D-NY), Senate Finance Committee Chairman Ron Wyden (D-OR) and Booker filed a much-anticipated bill to federally legalize cannabis and promote social equity last week, and a Senate Judiciary subcommittee chaired by Booker held a hearing on Tuesday <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-senators-discuss-marijuana-reform-at-historic-hearing-following-legalization-bill-introduction\/\" target=\"_blank\" rel=\"noopener\">where members discussed the proposal<\/a>.<\/p>\n<p>Weldon Angelos, who received a presidential pardon for a federal marijuana conviction under the Trump administration, was among the <a href=\"https:\/\/www.marijuanamoment.net\/im-a-former-marijuana-prisoner-heres-what-ill-tell-senators-at-their-legalization-hearing-op-ed\/\" target=\"_blank\" rel=\"noopener\">witnesses who testified at that meeting<\/a>.<\/p>\n<p>Schumer, for his part, said last week that he is committed to working with bipartisan offices to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/schumer-commits-to-bipartisan-work-to-pass-marijuana-reform-this-year-after-legalization-bill-unveiled\/\" target=\"_blank\" rel=\"noopener\">get \u201csomething\u201d done on cannabis reform \u201cthis year.\u201d<\/a> He\u2019s seemed to leave the door open to using provisions of his legalization bill as the basis <a href=\"https:\/\/www.marijuanamoment.net\/new-details-on-congressional-marijuana-omnibus-bill-emerge-as-lawmakers-work-for-60-senate-votes\/\" target=\"_blank\" rel=\"noopener\">for an incremental marijuana reform package<\/a>\u00a0that he\u2019s been discussing with bipartisan and bicameral offices.<\/p>\n<p>The House\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-begins-final-debate-on-federal-marijuana-legalization-bill-with-floor-vote-imminent\/\" target=\"_blank\" rel=\"noopener\">passed a comprehensive piece of legalization legislation<\/a>\u00a0for the second time in April.<\/p>\n<p>Biden has maintained a steadfast opposition to adult-use marijuana legalization, so there\u2019s still an open question about what he would do if wide-ranging reform legislation made it to his desk.
