{"id":56097,"date":"2022-07-25T05:35:29","date_gmt":"2022-07-25T13:35:29","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/07\/25\/senate-confirms-key-va-official-who-expanded-new-jerseys-medical-marijuana-program-and-backs-federal-legalization\/"},"modified":"2022-07-25T08:45:36","modified_gmt":"2022-07-25T16:45:36","slug":"senate-confirms-key-va-official-who-expanded-new-jerseys-medical-marijuana-program-and-backs-federal-legalization","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/07\/25\/senate-confirms-key-va-official-who-expanded-new-jerseys-medical-marijuana-program-and-backs-federal-legalization\/","title":{"rendered":"Senate Confirms Key VA Official Who Expanded New Jersey\u2019s Medical Marijuana Program And Backs Federal Legalization"},"content":{"rendered":"<\/p>\n<p>A key position at the U.S. Department of Veterans Affairs (VA) has been filled, with the Senate voting to confirm a nominee who previously helped oversee and expand New Jersey\u2019s medical marijuana program and who has advocated for federal legalization.<\/p>\n<p>Shereef Elnahal, President Joe Biden\u2019s nominee for VA undersecretary of health, will be responsible for leading a key division of the department that until now has administratively prevented VA doctors from issuing medical cannabis recommendations to military veterans.<\/p>\n<p>Not only did Elnahal enthusiastically work to regulate and improve New Jersey\u2019s medical cannabis program as the state health commissioner from 2018-2019, but he\u2019s also made clear that he personally believes federal prohibition must come to an end. And now, he has been confirmed for a top VA slot by a Senate <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1172\/vote_117_2_00267.htm\" target=\"_blank\" rel=\"noopener\">vote<\/a> of 66-23 on Thursday. He\u2019s expected to be sworn in this week.<\/p>\n<p>During a confirmation hearing before the Senate Veterans\u2019 Affairs Committee in April, Sen. Dan Sullivan (R-AK) brought up Elnahal\u2019s cannabis regulatory background and expressed frustration over <a href=\"https:\/\/www.marijuanamoment.net\/va-continues-to-oppose-marijuana-research-bill-for-military-veterans-under-biden\/\" target=\"_blank\" rel=\"noopener\">VA\u2019s consistent opposition to legislation, including his own,<\/a> that would promote clinical research into the therapeutic potential of marijuana for conditions that commonly afflict the veteran population.<\/p>\n<p>The now-confirmed official spoke about how, when he was serving as New Jersey\u2019s health commissioner, he ran the medical marijuana program and \u201cexpanded access to the program across the state, and made it easier for veterans to enroll, as well.\u201d<\/p>\n<p>\u201cAs you know, senator, this issue is very complex from the national standpoint and the federal government standpoint because it remains a Schedule I drug,\u201d he said, adding that he would commit to \u201chave these discussions with leadership across the administration, but also with this committee, and try to set up next steps.\u201d<\/p>\n<p><strong>Watch the conversation about medical cannabis and veterans, starting around 02:03:15 into the video below:<\/strong><\/p>\n<p><span data-mce-type=\"bookmark\" style=\"width: 0px;overflow: hidden;line-height: 0\" class=\"mce_SELRES_start\">\ufeff<\/span>\n<\/p>\n<p>While it remains to be seen how vocal he will be about the issue as a federal official, Elnahal has made clear in the past that he feels marijuana\u2019s restrictive status should change.<\/p>\n<p>He tweeted in 2018 that cannabis \u201cneeds to be descheduled at the federal level.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Marijuana needs to be descheduled at the federal level. Patients on #MedicalMarijuana deserve better,\u201d he wrote, listing complications of the federal-state policy conflict such as high cannabis costs and a lack of authorized access at health care facilities.<\/p>\n<p>At the confirmation hearing, Sullivan followed up by asking if the nominee had seen any \u201cbenefits or takeaways\u201d from his marijuana regulatory work, specifically as it concerns veterans who received cannabis treatment.<\/p>\n<p>\u201cI did. I did serve as an advocate for the program across the board for all patients who are eligible for specific conditions. It\u2019s a condition-based system,\u201d he <a href=\"https:\/\/www.veterans.senate.gov\/2022\/4\/nomination-hearing\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cBut the intersection with federal law was not something I had to contend with at the time, and so that would be a layer of issues that I would have to address if confirmed.\u201d<\/p>\n<p>Sen. Jon Tester (D-MT), chair of the committee who <a href=\"https:\/\/www.marijuanamoment.net\/va-would-have-to-study-medical-marijuanas-benefits-for-veterans-under-new-bipartisan-bill-in-congress\/\" target=\"_blank\" rel=\"noopener\">also sponsored the VA cannabis research bill<\/a> alongside Sullivan, said that he\u2019s aware of the numerous health conditions that people use marijuana to treat, and he\u2019d be \u201call-in\u201d if there was evidence supporting that cannabis can supplant the use of dangerous pharmaceuticals. But if the science doesn\u2019t support those medical uses, he said he thinks \u201cwe\u2019ll make a huge mistake.\u201d<\/p>\n<p>\u201cWe should be doing this research. And if it takes an act of Congress, we\u2019ll do it,\u201d Tester said. \u201cBut I hope you are aggressive in pushing the VA to do the research within the law.\u201d<\/p>\n<p>Meanwhile, other bipartisan lawmakers have devoted significant attention to marijuana- and veterans-related issues, including this month as the House has taken up appropriations and defense legislation for the 2023 Fiscal Year.<\/p>\n<p>While VA under several administrations has repeatedly testified against modest cannabis measures, that hasn\u2019t stopped members on both sides from filing and advancing bills and amendments to force policy changes and revise VA directives.<\/p>\n<p>For example, a bipartisan coalition of House lawmakers <a href=\"https:\/\/www.marijuanamoment.net\/house-will-not-vote-on-marijuana-amendments-for-veterans-and-public-housing-residents-after-committee-snag\/\" target=\"_blank\" rel=\"noopener\">recently attempted to attach language<\/a> to a package of spending measures that would have prevented VA from using its funds to enforce provisions of a 2017 Veterans Health Administration (VHA) directive that ban department doctors from issuing medical cannabis recommendations to veterans and blocks VA from covering medical marijuana costs. (As VA undersecretary, Elnahal will lead VHA.)<\/p>\n<p>The amendment as introduced was meant to merge prior standalone bills led by Congressional Cannabis Caucus co-chairs Reps. Dave Joyce (R-OH), Barbara Lee (D-CA), Earl Blumenauer (D-OR) and Brian Mast (R-FL). But <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-blast-congressional-inaction-on-marijuana-reform-for-veterans-and-public-housing-residents-after-committee-setback\/\" target=\"_blank\" rel=\"noopener\">it was not made in order in the Rules Committee<\/a>, with committee leadership keeping it from floor consideration on procedural grounds.<\/p>\n<p>Separately, <a href=\"https:\/\/www.marijuanamoment.net\/house-approves-more-marijuana-amendments-to-defense-bill-including-banking-and-veterans-medical-access\/\" target=\"_blank\" rel=\"noopener\">an amendment did recently pass the House<\/a> as part of a defense bill would tackle the issue of allowing VA doctors to issue medical cannabis recommendations to veterans, but it\u2019s unclear if the Senate will follow suit.<\/p>\n<p>In any case, VA itself has also created bureaucratic headaches for lawmakers who feel a duty to enact reform that enjoys widespread public support, including from much of the veterans community. To that end, Joyce said in a statement to Marijuana Moment on Friday that he\u2019s \u201cpleased to see the bipartisan confirmation of Dr. Shereef Elnahal.\u201d<\/p>\n<p>\u201cThe undersecretary of health is a critically important position at the VA, and it has been vacant for far too long,\u201d Joyce, whose father was a World War II veteran, said. \u201cI look forward to working with Dr. Elnahal to ensure that veterans get the health care they deserve and have earned, including increased medical cannabis access in states that have chosen to make it legal.\u201d<\/p>\n<p>It\u2019s not clear just how much authority Elnahal will have to unilaterally reform administrative marijuana policies or spur additional VA-led research into cannabis, but his confirmation will likely be well-received by advocates and veterans organizations that have pushed for departmental policy changes on the issue for years.<\/p>\n<p>In 2018, then-New Jersey Health Commissioner Elnahal talked about the recalcitrance of the medical community to embrace cannabis as a legitimate therapeutic, arguing that prevailing \u201cstigma that\u2019s built up over time\u201d because of its recreational use has produced false narratives.<\/p>\n<p>\u201cOf course it\u2019s been used illegally for those [recreational] reasons, but it has a lot of therapeutic benefits,\u201d he said.<\/p>\n<p>\u201cThe side effect profile, in particular the risk for dependence, addiction, overdose, death\u2014all of those are much lower and nonexistent for marijuana versus opioids,\u201d he <a href=\"https:\/\/www.njspotlightnews.org\/video\/health-commissioner-marijuana-program-needs-more-doctors-to-participate\/\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cThe other thing is we\u2019re not necessarily recommending it as a first-line therapy, we\u2019re just allowing you now to recommend it as a first-line therapy. It\u2019s still a clinical judgement.\u201d<\/p>\n<p>While advocates were encouraged by the work of New Jersey regulators like Elnahal to expand the states medical cannabis program, with the number of registered patients increasing significantly under his tenure, he also recognized the need to do more to make it easier for patients to easily access affordable products, especially in a state that didn\u2019t allow home cultivation.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">We are finally giving the NJ <a href=\"https:\/\/twitter.com\/hashtag\/MedicalMarijuana?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#MedicalMarijuana<\/a> program the attention it deserves- thousands more patients will have access, doctors will find it easier to recommend marijuana as a first-line tx, and dispensaries will find it easier to service many more <a href=\"https:\/\/twitter.com\/GovMurphy?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@GovMurphy<\/a> <a href=\"https:\/\/twitter.com\/NJDeptofHealth?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@NJDeptofHealth<\/a> <a href=\"https:\/\/t.co\/Lq8iKbeKBX\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/Lq8iKbeKBX<\/a><\/p>\n<p>\u2014 Shereef Elnahal, MD (@ShereefElnahal) <a href=\"https:\/\/twitter.com\/ShereefElnahal\/status\/978648349803937792?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">March 27, 2018<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cIt\u2019s justified impatience,\u201d he <a href=\"https:\/\/www.insidernj.com\/insider-nj-interview-nj-health-commissioner-shereef-elnahal-njs-medical-marijuana-program\/\" target=\"_blank\" rel=\"noopener\">told<\/a> Insider NJ in 2018, adding that the public pressure his office faced over access barriers \u201cholds us accountable, makes sure we\u2019re not losing perspective on how patients are feeling.\u201d While he said he might not prefer receiving critical Twitter posts from people demanding faster reform, even that kind of informal feedback sometimes \u201cleads to action.\u201d<\/p>\n<p>The then-commissioner oversaw numerous medical cannabis <a href=\"https:\/\/www.nj.gov\/health\/news\/2018\/approved\/20180618b.shtml\" target=\"_blank\" rel=\"noopener\">policy<\/a> <a href=\"https:\/\/www.nj.gov\/governor\/news\/news\/562019\/20190513g.shtml\" target=\"_blank\" rel=\"noopener\">changes<\/a> that were enacted in New Jersey, including adding new qualifying conditions, lowering registration fees, allowing patients to have more primary caregivers, repealing a strain limit and approving additional forms of medicine.<\/p>\n<p>News on the growing number of patients who were enrolling in New Jersey\u2019s medical cannabis system was met with applause from Elnahal, who <a href=\"https:\/\/nj.gov\/governor\/news\/news\/562018\/approved\/20180702a_marijuana.shtml\" target=\"_blank\" rel=\"noopener\">said<\/a> in 2018 that \u201cwe are building a compassionate, consumer-friendly program,\u201d even though \u201cour work is far from done.\u201d<\/p>\n<p>\u201cMore physicians should look to medicinal marijuana as a safe, effective treatment\u2014and one that can help not only improve patients\u2019 wellbeing but also combat the opioid crisis,\u201d he said.<\/p>\n<p>Elnahal also participated in a lecture <a href=\"https:\/\/www.nj.gov\/health\/news\/2019\/approved\/20190225a.shtml\" target=\"_blank\" rel=\"noopener\">tour<\/a> where he visited hospitals and healthcare facilities around New Jersey to encourage doctors to participate in the medical cannabis program.<\/p>\n<p>In another notable development to come out of the Biden administration recently, the president\u2019s judicial nominee for a key federal appeals court has helped to <a href=\"https:\/\/www.marijuanamoment.net\/bidens-nominee-for-key-federal-court-worked-to-legalize-marijuana-in-arizona-prompting-ted-cruz-criticism\/\" target=\"_blank\" rel=\"noopener\">craft Arizona\u2019s marijuana legalization ballot initiative<\/a> and also served in a leadership role for a national cannabis advocacy organization.<\/p>\n<p>Also, last year, <a href=\"https:\/\/www.marijuanamoment.net\/biden-selects-white-house-drug-czar-who-helped-implement-state-marijuana-program-and-touted-medical-benefits\/\" target=\"_blank\" rel=\"noopener\">Biden nominated a White House drug czar<\/a> who previously played a key role in overseeing the implementation and expansion of West Virginia\u2019s medical marijuana program.
