Cory Booker (D-NJ) <a href=\"https:\/\/www.marijuanamoment.net\/here-are-the-full-details-of-the-new-federal-marijuana-legalization-bill-from-chuck-schumer-and-senate-colleagues\/\" target=\"_blank\" rel=\"noopener\">first released a draft version<\/a> of comprehensive legislation to end federal cannabis prohibition and promote social equity in the industry. And on Thursday, Bloomberg reported that the bill\u2019s introduction would be coming next week.<\/p>\n<p>But sources on Capitol Hill who are familiar with the planning tell Marijuana Moment that the exact timing is still in flux. It\u2019s possible that the Cannabis Administration &amp; Opportunity Act (CAOA) could drop next week, they say, but there are no scheduled plans to do so at this point, despite what Bloomberg <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-07-14\/marijuana-decriminalization-bill-teed-up-for-senate-introduction\" target=\"_blank\" rel=\"noopener\">reported<\/a>. However, they maintain that the bill will be introduced ahead of the August recess just weeks away, as Schumer has promised.<\/p>\n<p>The timeline for the introduction of CAOA has been repeatedly pushed back as leadership has worked to gather input on various provisions and build bipartisan buy-in. The majority leader had said earlier this year that <a href=\"https:\/\/www.marijuanamoment.net\/schumer-plans-to-file-marijuana-legalization-bill-in-april-as-top-house-lawmaker-details-his-own-reform-plan\/\" target=\"_blank\" rel=\"noopener\">CAOA would be filed in April<\/a>, but that did not pan out. He then amended the timeline and made\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/schumer-makes-promise-on-marijuana-legalization-bill-timeline-after-repeated-delays\/\" target=\"_blank\" rel=\"noopener\">a \u201cpromise\u201d to bring the bill forward<\/a> ahead of the recess.<\/p>\n<p>Details about any changes to the bill since it was released last year are still being heavily guarded. But it\u2019s expected to contain the key components: removing cannabis from the Controlled Substances Act, imposing a federal tax on marijuana sales, promoting equity in the industry and providing an avenue for relief for those who have faced federal cannabis convictions.<\/p>\n<p>Once the measure is introduced, its path to passage is still murky. There\u2019s a fair level of skepticism about the prospects of reaching the 60-vote threshold needed to pass CAOA through the Senate.<\/p>\n<p>Republican senators are generally expected to oppose a measure that would deschedule cannabis, especially if it involves imposing a federal tax and using revenue to meet equity objectives. At the same time, it\u2019s far from certain that all Democratic members of the Senate will back the legislation, as several members have been either non-committal or indicated that they\u2019d oppose it based on the original draft language. Democrats hold a slim majority in the chamber, so any dissent within the caucus could jeopardize the bill\u2019s chances of passage.<\/p>\n<p>But Schumer says he isn\u2019t deterred by those political obstacles, or at least is unwilling to break his promise to bring the bill to the floor for a vote. It stands to reason that CAOA would also enjoy majority support if it manages to clear the Senate.<\/p>\n<p>Last year, Schumer also emphasized that CAOA will <a href=\"https:\/\/www.marijuanamoment.net\/schumer-marijuana-bill-will-stop-big-alcohol-and-tobacco-from-dominating-market-he-says\/\" target=\"_blank\" rel=\"noopener\">specifically seek to restrict the ability<\/a>\u00a0of large alcohol and tobacco companies to overtake the industry.<\/p>\n<p>The year-long push by Senate leadership to get the comprehensive legalization bill to the floor hasn\u2019t just frustrated stakeholders who\u2019ve wanted to see the reform move more expediently; it\u2019s also created tension with advocates and pro-reform lawmakers who\u2019ve argued in favor of passing bipartisan, incremental policy changes like the Secure and Fair Enforcement (SAFE) Banking Act.<\/p>\n<p>That bill has passed the House in some form seven times at this point, but Schumer and colleagues have faced criticism over their insistence that <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-reform-will-not-be-enacted-as-part-of-manufacturing-bill-congressional-leaders-agree\/\" target=\"_blank\" rel=\"noopener\">broad reform must be enacted first<\/a>, both as a matter of social justice and because they\u2019ve feared that passing the banking bill first could compromise GOP support for CAOA.<\/p>\n<p>Additionally, there are reportedly plans in the works to <a href=\"https:\/\/www.marijuanamoment.net\/new-details-on-congressional-marijuana-omnibus-bill-emerge-as-lawmakers-work-for-60-senate-votes\/\" target=\"_blank\" rel=\"noopener\">advance an alternative omnibus cannabis reform package<\/a> if CAOA doesn\u2019t garner enough support to be enacted. Offices in both chambers are said to be discussing a plan to advance what would effectively be a marijuana minibus of incremental reforms, addressing issues like cannabis banking protections, Small Business Administration (SBA) access and marijuana research, for example, but stopping short of descheduling cannabis.<\/p>\n<p>In June, Rep. Dave Joyce (R-OH) had a meeting with Schumer to go over possible paths forward for interim reform like the SAFE Banking Act or the HOPE Act, which he\u2019s sponsoring alongside Rep. Alexandria Ocasio-Cortez (D-NY). That measure would incentivize states and local governments to <a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-and-aoc-team-up-on-marijuana-bill-to-incentivize-state-level-expungements\/\" target=\"_blank\" rel=\"noopener\">expunge cannabis records in their jurisdictions<\/a>.<\/p>\n<p>Meanwhile, a GOP congresswoman, Rep. Nancy Mace (R-SC), filed her own legalization bill last year titled the States Reform Act (SRA) that shares similar provisions to the Democratic-led proposals. It has not received committee consideration, but if the House flips following the midterms, some feel\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-congresswoman-takes-marijuana-victory-lap-after-primary-win-and-talks-next-steps-for-her-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">it could be a vehicle for reform<\/a>\u00a0should Republican assume control of the chamber.<\/p>\n<p>There are serious questions about the prospects of passing any broad legalization bill in the current congressional climate, especially given the steep Senate vote threshold. But another looming question is what President Joe Biden would do if a legalization measure does ultimately arrive at his desk.<\/p>\n<p>Despite supermajority support for the reform within his party, the president has maintained a firm opposition to adult-use legalization. Instead, he\u2019s voiced support for modest changes such as decriminalization, rescheduling and continuing to allow states to set their own policies.<\/p>\n<p>After more than a year in office, however, he\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/after-one-year-as-president-bidens-marijuana-promises-remain-unfulfilled\/\" target=\"_blank\" rel=\"noopener\">yet to take any meaningful steps<\/a>\u00a0to make good on those campaign pledges.
